MEETING HELD 15 AUGUST 2013 The following recommendations were made by the Committee: • That the reviewed draft Footpath policy is endorsed and recommended to

Elected Members for public consultation. • That the updated draft Road Network Extension and Upgrade policy is

endorsed and recommended to Elected Members for public consultation. • That Council give consideration to ceasing the Frances bin bank service as well

as giving the public at least one months’ notice prior to doing so. • That the Open Space Hierarchy is recommended to Elected Members for

endorsement, and Council officers continue to work with DECD to determine shared use agreements for open space and recreational assets in accordance with Council’s Open Space Strategic Plan.

• That the Strategic Asset Management Committee supports the removal of the tree in front of the Police Station on Smith St subject to budget availability and other priorities.

• That the Strategic Asset Management Committee recommends the Elected Members consider undertaking public consultation on the proposed removal of Itchy Pod Trees on Smith St Naracoorte.

• That the SAM Committee request that Council cease all works on the Kingston Railway Corridor.

• That SAM Committee requests that Council write to DEWNR to advise them of cessation of works on the Kingston Railway Corridor.

• That the Strategic Asset Management Committee recommends the Elected Members consider supporting the preparation of a tender for rubble raising and crushing to determine the most economical strategy for delivering these services over the longer term.

The Committee moved a number of resolutions recommending action for Council. These resolutions are included below for Council’s receipt, notation and endorsement as appropriate. Audit Committee recommendation 2/14: “That the Audit Committee Chairman, Mr Jim Ker, is authorised to sign Council’s Certification of Auditor Independence acknowledging the following statement:-

“To the best of our knowledge and belief, we confirm that, for the purpose of the audit of the Naracoorte Lucindale Council for the year ended 30 June 2013, the Council’s Auditor, Dean Newbery & Partners, has maintained its independence in accordance with the requirements of the Local Government Act 1999 and the Local Government (Financial Management) Regulations 2011 made under that Act. This statement is prepared in accordance with the requirements of Regulation 22(3) Local Government (Financial Management) Regulations 2011”.”

Council’s Chief Executive Officer is also required to sign this declaration in relation to Auditor Independence. Audit Committee recommendation 3/14: “That the Interim Audit Management Letter and Management Response is received and noted.” Audit Committee recommendation 4/14: “That Policy No. 64 – Internal Control Policy & Procedure is endorsed, and recommended to Council for adoption.” Audit Committee recommendation 5/14: “That the 2012 Better Practice Model – Internal Financial Controls is recommended to Council for adoption.” Audit Committee recommendation 6/14: “That the reports relating to the performance of the Naracoorte Regional Livestock Exchange are received and noted.” Audit Committee recommendation 8/14: “That following review of the Naracoorte Lucindale Council Draft Financial Statements for the year ending 30 June 2013 that the Audit Committee believes that they present fairly the state of affairs of the Council.” Council’s Auditors, Dean Newberry & Partners have completed their substantive testing audit and are currently completing their review of the prepared Financial Statements in accordance with Section 129 of the Local Government Act 1999. Council’s Audit Committee has reviewed the Statements at its meeting held on 21 August 2013. As Members will recall from previous years Council’s Auditors are not obliged to sign off on Council’s Financial Statements until they have received the following signed documentation from Council’s Audit Committee, Council and Management: • Management Representations • Certification of Auditor Independence • Certification of Financial Statements

The “Certification of Auditor Independence” is a declaration that states that to the best of Council’s knowledge Council’s Auditor is independent of Council’s operations, that is, Council has not used our Auditor to provide advice in relation to other Council matters. The “Certification of Financial Statements” is a declaration that the financial statements comply with the relevant legislation, present a true and fair picture of Council’s financial position and that the internal control measures implemented by Council provide reasonable reassurance that Council’s financial records are complete, accurate and reliable. Council’s Chief Executive Officer and Director Corporate Services are further required to provide a management letter providing further information in relation to the financial statements to Council’s Auditor prior to sign off on the final account. Members of the Committee may wish to provide further information in relation to items discussed at the meeting. The next meeting of the Committee is scheduled for Tuesday, 19 November 2013 at 4pm in the Council Chamber. At its meeting held 6 August 2013, the NRLE Board resolved;

• That the Board endorse the annual report for presentation to the Audit Committee and Council

• That the NRLE contribute $500 to the Livestock Saleyards Association of Victoria to update the saleyards OHS manual

At its meeting held 25 June 2013, Council resolved; • That Council staff are authorised to call for expressions of interest for the lease

in relation to the Naracoorte Regional Livestock Exchange Canteen/Cafeteria located at Carters Road, Naracoorte for a period of three (3) years.

Expressions of Interest (EOI) were sought through advertisements in the Naracoorte Herald and by advising stakeholders at the NRLE. These closed on 9 August and two EOI were received to operate the canteen. The current lessee provided an EOI confirming their desire to negotiate a reduced fee for the lease.

Richard James NRLE Manager and Steve Bourne Director Planning, Environment & Community Development conducted interviews on 14 August and selected a suitable lessee to operate the canteen at the approved lease fee. A lease has been entered into between Council and Virginia Harvie and Joanne Moore for three years commencing 20 August 2013.

At its May meeting, Grantley Simons made a presentation to Elected Members suggesting a focus on making the centre of town more accessible for people in a wheelchair. Mr Simons reported that people in gophers and wheelchairs are struggling to access the main street, and asked Council to help people with disabilities get around town, especially as Naracoorte is a centre for visiting medical specialists there are many people with disabilities visiting the town. Cr Bell suggested forming a Working Group to focus on improving access for people with disabilities. The Accessibility Working Group met on 22 July 2013. The working group is made up of representatives from Community Health, Longridge Retirement Home, the General public and Council. Members raised a number of issues which will require ongoing consideration. The highest priority was parking and issues relating to access to footpaths in the town centre. This has previously been raised by Cr Banning and an example of his suggestion is provided below.

Council has an allocation in its budget for 2013/14 for improving access. It is recommended that this be used to implement disabled access car parks and improving pedestrian access as demonstrated below.

The group also recommended that a survey be circulated seeking comments from the community on matters such as, accessible vehicle parking, footpaths / ramps, and access to Council and privately owned buildings etc. The results of this survey will be prioritised by the working group and will be presented to Council’s Strategic Asset Management Committee. Although discussed, privately owned buildings are beyond Council’s control until such time that upgrade work is proposed which will require a development application / approval for proposed work to be carried out on the premises. Council staff are able to provide advice to business owners prior to any upgrade work being carried out. The working group will meet every three months initially and then on an as required basis into the future.

REPORT The Volunteer Resource Centre was established in 2005, utilising a small stone building on the Ormerod Street side of the council office car park. It was established as the front of house delivery point for the volunteer program, delivered through Naracoorte Lucindale Council across the Limestone Coast region. The level of funding has remained constant with no CPI increases, leading to an effective decline in available funds. The most recent three year agreement (signed July 2012) with the Australian Government funding partner has clear targets to meet and the annual report confirms these targets have been achieved. The Centre does not play a significant role in achieving these targets. The role of the Centre has changed over the years with the establishment of a Multicultural Resource Centre catering for the migrant section of our community. Initially, the Centre offered a front of house for Council but this has greatly reduced with several changes. The Volunteer Coordinator, Jan Bittner, is employed for 38 hours per fortnight on the funding to deliver the regional volunteer service. Jan moved into the Council offices in September 2012 and the Centre’s opening hours are restricted to 10-4 on Tuesdays and Thursdays, manned by two volunteers. These volunteers assist with a number of Council activities such as the Masters Games and Seniors Month. Areas for these volunteers to continue to support Council activities could be provided at the Visitor Information Centre, Library or Council offices.

The Centre receives a small number of enquiries when open and a small number of face to face enquiries. These could easily be dealt with at Council’s front office. The role of the Centre in delivering Council’s strategic goals is now limited. The continued use of the Centre for its current purpose restricts its use for more critical Council needs. Council has received correspondence from the Naracoorte Art Gallery requesting Council vacate the two rooms currently used for storage of Council records at the Gallery. The Gallery has plans to renovate and reinvigorate this part of the building. The Volunteer Resource and Community Centre is ideally located to be used for records storage and repurposing for this is a more appropriate use of Council infrastructure.

REPORT Council’s Open Strategy was adopted in September 2011. The Recreation and Sporting Facilities Committee has been implementing recommended actions and monitoring progress against the strategy. The strategy highlighted the opportunities for Council to establish a hierarchy of open space to ensure open space is provided and established in an appropriate and sustainable manner. A high priority in the plan is to: • Develop a Master Plan for Memorial Parklands / Oval that will consider the

diversity of use and set out a planned approach to sporting, community and environmental agendas.

The Recreation and Sporting Facilities Committee formed two subcommittees to develop concept plans for the Memorial Parklands and Market Square. Extensive community consultation was undertaken using direct mail out to neighbouring landholders, presentations to user groups and white boards placed within the respective parks. This information has been used to inform consultants engaged to prepare the attached plans. These concepts plans have been developed by Alice Leake (Memorial Parklands) and Bill Chandler (Market Square) reflecting community feedback and direction provided by the subcommittees and council officers. In accordance with Council’s policy on Community Land, community consultation needs to be undertaken prior to the finalisation and adoption of the plans for implementation. The plans do not commit Council to undertake all works immediately, but provide the basis for future budget allocations enabling work to be completed in a strategic and planned manner. Risk assessment The following risks from Council’s organisational risk assessment are relevant to the development of these draft concept plans. • Major assets lack long term plans to sustain them creating unplanned financial

The thorough planning based on consultation, and an assessment of constraints and opportunities, ensures the final plans will enable Council to implement with minimal risk. In addition to this, Council has engaged Bill Chandler to prepare concept designs for the section of creek walk along the duck pond near Park Tce. The upgrade of the creek walk through this area is in Council’s rolling three year works program and has a budget of $25,000 in 2013-14. The concept plans are attached and endorsement is sought for community consultation on these plans prior to commencing construction.

REPORT In April 2010 Council resolved (421/10) to change the name of Johnsons Road to Munns Road. This change was recently implemented. Council has received a letter from Mr Lawrence Munn, Senior thanking Council and requesting consideration for the possible changing of the remaining length of this road which is known as Walla-Walla Road to Munns Road. Currently if entering the road via the eastern end it is known as Walla-Walla Rd and if entering from the western end Munns Road. A name change would impact rural addressing recently completed with 14 properties and 12 owners affected if the name was changed.

REPORT In April 2013, Council submitted a project application under the Community Recreation and Sport Facilities Program. The project scope was to install new adult exercise equipment and construct pathways, lighting and signage to support the movement of people safely through Memorial Parklands in Naracoorte. The scope directly addressed the community feedback received in preparation of the parklands master plan. The project budget is a combination of $20,000 allocated for adult exercise equipment over two years plus a $10,000 allocation in 2012-13 for extending the paths in the parklands. All capital budgets would need to be carried forward to 2013-14 to fund this project.

Existing Exercise Equipment in Memorial Parklands

Council has been advised in writing that it has been successful with its application. (see letter from DPTI attached). Council is required to submit one half of the total project cost under this program. The funding is subject to Council entering into a Grant Agreement with the South Australian Government which will be provided to Council shortly. This agreement will need to be signed under common seal.

Undergrounding Power Lines in Robertson St

REPORT Further to the report tabled at Council’s meeting in June 2013, Council has received a letter from the Power Line Environment Committee (PLEC) dated 15 July 2013 advising that they are seeking submissions for the next round of projects to be approved in December 2013 for construction between July 2014 and December 2014. Recent advice from PLEC representatives has suggested that Council is a likely candidate to receive funding in this program. To proceed with registration of interest, Council must prepare a formal submission including estimates of Council’s portion of works by October 2013. These works would include footpath and kerbing renewal, tree planting, stormwater drainage upgrades and service relocations in accordance with approved concept plans. Council must provide commitment to funding these works in order for PLEC to consider the submission for undergrounding power lines in Robertson St. This would require the funding of survey and design works in 2013-14 and construction in 2014-15. If successful, an application to PLEC for funding the undergrounding of power lines will enable Council to extend its planned capital expenditure to achieve the maximum community benefit through co-contributions. It is anticipated that this would be the first stage of the undergrounding and that future stages will be funded in a similar way with Council’s contribution being tied predominantly to the upgrading of the stormwater drainage network.

The project scope was to upgrade the Cadgee Rd, Mahoneys Rd and Higgs Rd intersection approximately 3kms North from Naracoorte to address concerns identified in a previous road safety audit. Proposed works include: • Realignment of Mahoneys Rd to provide a "T" type intersection, • Seal the aprons of Mahoneys Rd and Higgs Rd, • introduce line marking, • removal and pruning of vegetation, • construct slip lanes, • widen and seal shoulders, • install advanced warning signage and raised retro-reflective pavement

markers, and • other related works including relocation of Telstra and realignment of fencing.

Location of Proposed Intersection Upgrade

Whilst unsuccessful under the Nation Building Black Spot Program, Council has been advised that it has been successful under the State Black Spot Program (see letter from DPTI attached). Council is required to submit one third of the total project cost under this program. A funding deed is required to be signed under common seal to accept the grant from the State Government. All funds must be expended by June 2014.

REPORT As part of Council’s 2011-12 capital works program, a 4.2 km section of Boddingtons Rd West was reconstructed. Through the survey and design process it was identified that portions of privately owned land were needed to be acquired to improve the road alignment. Council received correspondence from Westley Di Giorgio Solicitors & Conveyancers on 15 July 2013 (refer attached) requesting Council execute the consent to the vesting of allotments to create the alterations on Boddingtons West Road so that it can be lodged at the Land Titles Office.

REPORT As part of the annual business planning process, Council endorsed a budget which included a number of civil works projects as defined in the rolling three year works program (see Major Projects Status Report in separate agenda item). A large majority of these projects are planned, designed and constructed over a number of years. In the early stages, concept design plans are prepared and often community feedback is sought from relevant stakeholders before proceeding to full design. The purpose of consultation can be defined as: “The process of community consultation has been identified as a way of achieving better outcomes by attempting to address community views at the initial planning stage.” In the recent past, many of the concept plans have been brought to Council for endorsing prior to being released to the public. Whilst this provides a rigorous process for review it can add significant time delays to the delivery of major projects depending on the timing of Council meetings. Council typically allows three to four weeks for community consultation. This consultation period could be extended or the results brought back to Council earlier if Council endorsement of concept plans was not always required. As an alternative, concept designs could be endorsed by the project sponsor which is typically the CEO or one of the executive management team. Does Council wish for all concept plans for civil works projects to be presented to them for endorsement prior to being released for public consultation?

Since March 2012 Council has provided free disposal of waste to the value of $3,900 to the Society. Total waste disposal charges incurred by the Society from 1 July 2012 - 30 June 2013 are $4,444.30. At the time of writing this report the Society owes Council $1,221.15 in disposal fees. As Members would be aware, the Society installed CCTV in 2012. This installation was supported by Council’s Community Chest Program ($1,600). Unfortunately, based on an assessment of the waste disposal charges there is no evidence that this installation has had any impact on the disposal of unwanted or unusable goods at the Society. The Community is able to drop items at the Society at any time due to the drop off zone being an open access area. In some communities the Society’s premises are fully fenced with items only accepted when the centre is open. Council Decision Required This request is outside Council’s Policy Guidelines, therefore a Council decision is required. REPORT The Local Government Association has reviewed and updated the Model Guidelines for the Control of Election Signs, in preparation for the coming Federal, State and Local Government Elections. REPORT Volunteer Resource Centre

The volunteer training program for 2013/14 has commenced with “Good Governance” workshops held in two centres in August. Volunteer referrals remain steady. The Naracoorte Volunteer and Community Centre has been selected as a finalist in the Regional South Australian awards to be held in the Naracoorte Town Hall 30 October. Seniors Month The calendar of events has been finalised and widely distributed. The program is attracting good levels of interest with registrations and enquiries being handled through the Visitor Information Centre. YAC The Youth Week projects and Council’s partnership with the community was a finalist in “Community Partnerships” section of the Education Industry Awards, held recently in Mount Gambier.

REPORT The circulation of items remains higher than last year at the Naracoorte Public Library as shown in the graph below.

In July, 7,140 items were borrowed which is an increase from 4,958 last year. In July 4,857 customers, an average of 200 per day, visited the library as well as 672 requests via phone, the web and email.

Many customers are reserving items themselves via the internet. To satisfy requests of our customers 412 items were received from around the state compared to 202 last year. In addition, 690 of our items were placed in transit to other libraries compared to 162 last year. In summary, twice as many boxes are being received and sent satisfying customer requests. Number of items borrowed from the Library

Library Manager, Paula Coventry, co-ordinated another Australian Broadcasting Commission Open Writing Workshop held in the Library. Members of our local writers group and recent work experience students were invited to attend. Sessions were conducted over two weeks with around nine interested participants at each event.

Numerous children enjoyed the school holiday activities conducted in the library over the two weeks. The story time sessions included enthusiastic audience participation. Various artistic creatures and designs were made from felt and old compact disks.

The latest Australian Public Libraries Statistical Report for 2011-12 is now available. Highlights from the report include: • Almost 181 million items were lent to 10 million members of Australia’s public

libraries. • Libraries received over 110 million customer visits annually, or more than 9

million per month. • Total expenditure on public libraries increased from $815 million in 2007-2008

to over $1.01 billion in 2011-2012, representing a 24% increase.

June at the Naracoorte Town Hall saw a variety of events held. The start of the month began with the installation of the new Boiler for the air conditioner unit. This was installed by Below Zero which bought back some much needed heating at the hall. Normans Carpets also installed edging on the steps leading up to the meeting room during July which has made a huge difference in safety when walking up or down from the meeting room.

Normans also installed a new entrance mat at the front door. The old entrance had a metal recess with a changeable mat for wiping your feet which people often caught their shoes on. A larger entrance mat has been installed which has been set into the existing carpet eliminating this tripping hazard.

MacKillop Farm Management Group held a dinner at the hall during July and were so impressed that it will now become an annual event. The installation process for the Cinema began at the end of July with complete installation on track to be finished by the end of August. REPORT The Visitor Information centre recorded 855 visitors for July, 71 email / phone enquiries taking the total to 926. There were 150 museum entries. With winter coming to end a steady increase of visitor numbers is expected. Comparing visitors to the VIC to numbers at the Naracoorte Caves, the rises and declines in visitor numbers are similar.

We are starting to get some accommodation enquiries for next year’s South East Field Days and Naracoorte’s Masters Games. Brenten Kahl attended a presentation regarding the 2014 Tasting Australia event and an Events & Festivals Workshop hosted by the South Australian Tourism Commissions (SATC) Events Division. Below are Brenten’s reports on what information was delivered at both the sessions. Tasting Australia

Tasting Australia will be held in autumn 2014, from 27 April - 4 May 2014. The Creative Team behind Tasting Australia for 2014 is made up of; Maggie Beer, Simon Bryant and Paul Henry.

The theme for the 2014 event is “Origins” and the team is aiming to encourage people to think about where their food and wine is produced. The team has decided to split the concept of “origins” into three key themes and they are:-

• Land - produce, place and people (livestock; crops; flora; fauna; history) • Sea – produce, place people, and influence (fish; seafood; maritime climate;

culture)

The South Australian Tourism Commission (SATC) and the creative team have yet to finalise all the elements that will make up the various events but plan to have it finalised by September 2013. REPORT DOGS Impounded: As at 31 July Council staff had impounded 16 dogs with all being returned to their owners. Attack: There has been a spate of dog attacks on a property on Martins Road, Naracoorte where a number of lambs were killed. The stock owner was informed that under Section 48 the Dog and Cat Management Act that: 48 – Power to protect persons or property from dogs (1) A person may lawfully injure or destroy a dog if the action is reasonable and

necessary for the protection of life or property (2) If a dog, unaccompanied by a person, is found in an enclosed paddock or other

enclosed place in which an animal is being farmed is confined, the owner or occupier of the place, or a person acting under the authority of the owner or occupier, may lawfully injure or destroy the dog.

A particularly vicious attack left 2 ewes being put down due to extensive injuries on Brown Street, Naracoorte. Council Animal Management Officers (AMO), Mr Ben Thomson and Mr Simon Smith attended the scene to investigate. A thorough search was conducted but yielded no result. Paw prints and bite marks suggested a large, powerful dog had inflicted the mauling. Council assisted with removal of the dead stock and will continue to investigate. Due to the increase in dog attacks on livestock over the last three months Council has purchased a large dog trap. The trap will be set and operated by Council’s AMOs only in areas where there has been previous attacks on livestock. Any dogs that are caught will be impounded until the owner can be located or held until the mandatory 72 hour holding period. At the end of the 72 hours the dog will either be rehomed or destroyed depending on the temperament of the animal. Barking: Ongoing issues with barking and wandering dogs in the Lucindale township were highlighted by local council staff. Complaints of a barking dog on Acacia Street led to Council AMO intervention. The owner being advised of his responsibilities and provided with options to abate the barking. The situation will continue to be monitored. RSPCA: The General Inspector was contacted by the RSPCA to inspect a dog breeding property East of Naracoorte, on inspection it was found that the animals were in very good condition and well cared for with a report back to the RSPCA stating the findings. STOCK Wandering: Three steers were reported out on the Riddoch Highway at the Bool Lagoon turn off South of Naracoorte by two members of the public. On arrival the stock had already been returned to the paddock. Council officers reported to the General Inspector that a steer was out on the Lucindale road and sheep out on Pinkerton Road. On both occasions the stock had been returned to their respective paddocks prior to the General Inspector arriving at the locations.

The Acting General Inspector was called to Krompa Road where a steer had been seen wandering. On attending NRLE staff were moving the beast down a laneway. It had apparently escaped from the NRLE the previous afternoon. The steer was recovered the following afternoon once it had settled down. The Acting General Inspector was asked to assist in returning a steer to its paddock on the Riddoch Highway by SAPOL. On attending found the owner moving the heifer South, against her boundary fence, towards property entrance. With 3 SAPOL units ensuring safe traffic flow the animal was returned to confinement. The incident is not the first in this location. Council will seek to recover costs. Two steers were reported wandering on the Wimmera Highway in the Rochow Wrays Road area East of Hynam. On attending the officer was unable to locate the beasts in the dark and foggy conditions. After numerous passes the search was called off. A steer was reported out on the Riddoch Highway 5 km north of Naracoorte by SAPOL, on arrival two SAPOL units were already at the location. Whilst attempting to place the steer in the paddock it jumped the fence and joined the mob. A mob of sheep were reported out on Pinkerton Road near Clover Crescent, on arrival no stock were located. Rooster: Council received a report from a resident with regard to a rooster doing what roosters do and that’s waking up the neighbourhood. The owner was contacted and the rooster taken care of. Goat: Two goats were reported wandering on Wheeler St; one goat was impounded with the other disappearing into the sunset. The goat was cared for by a Council employee until the owner contacted Council. ABANDONED VEHICLE The General Inspector placed a 24 hour towing notice on a vehicle that was left on Pinkerton Road, the owner was also notified. The vehicle was removed the following day. FIRE PREVENTION The Fire Prevention Officer along with Mr Steve Bourne, Director Planning, Environment and Community Development attended the Limestone Coast Bushfire Management Committee meeting on 22 July. The LCBMC has a statutory responsibility to prepare a regional bushfire management plan under the Fire and Emergency Services Act. An interim plan has been in place for some time and the process has commenced to review this. The Committee will complete a risk assessment using the National Emergency Risk Assessment Guidelines (NERAG) as a first step in developing the regional plan. This work is being duplicated by the Zone Emergency Management Committee and the LCBMC has sought clarification on each group’s roles to ensure efficient use of staff time involved in each process.

REPORT Below is a summary of some of the key activities from the past month in the Operations and Technical Services Department: • The Gordon, Loveday and Foster St project has continued with paving of the

Uniting Church car park area using environmentally sensitive permeable paving to reduce demand on the downstream bore. This is a first for Naracoorte Lucindale Council and the success of it will be monitored closely. The new footpath on Gordon St is being constructed with a concrete plinth down one side to prolong the life of the asphalt.

• National Tree Planting Day was successfully conducted in the North Parklands

Sports Centre. Approximately 300 native seedlings were planted by local schools as part of the event.

New Planting

• Council officers and the CEO met with ABP, DPTI and the Wattle Range Council

to discuss the current and future harvest of hardwood plantations from the Southern parts of the district. A number of local roads have been put forward for b-double commodity route with HML. ABP have advised that harvest operations will increase significantly over the coming years with more pressure being placed on the local and state road network.

• Patrol grading continued across the district as weather permitted. • Heavy rains and high winds in the month of August created a few unplanned

maintenance events but overall the stormwater drainage system performed very well.

feedback was received and many questions answered from the public. The presentation and the notes from the session are on Council’s website.

• The Director Operations and Technical Services and the Governance and Communications Officer attended the Zone Emergency Management Committee and Bush Fire Hazard workshop for the South East on 13 August 2013. The workshop explored the potential impact of bushfire on the region and identified controls currently utilised to prevent and respond to this hazard. This is one of many regional workshops organised by SAFECOM to prepare a Zone Emergency Risk Management Plan.

• An independent assessment of Council’s asset management methodology for the revaluation of transport assets was conducted by Mr Richard Gayler on 30 July 2013. His report on findings was presented to the Audit Committee as well as the Strategic Asset Management Committee. Good progress has been made with the implementation of the new asset management system and a further follow up on long term financial planning is planned for late October.

• A number of Operations staff have commenced their Certificate IV in Horticulture. Staff already enrolled in the Certificate IV in Civil Supervision have almost completed their training.

• Council staff assisted DPTI staff from Adelaide on 1 August 2013 to assess the road safety of schools in Naracoorte participating in the Way2Go program. The program identifies what the inhibiting factors are for school children walking and cycling to school and through the aid of signage and education tries to develop safer routes to school.

• Road safety audits have been commissioned for a number of dangerous intersections in accordance with the 2013-14 works program including: Pinkerton/Caves, Church/McRae and Jones/Robertson. This work has been awarded to Tonkin Consulting.

• Landscape design of the creek walk near the duck pond in Naracoorte has been awarded to Bill Chandler and a draft plan has been received for comment.

All decisions made regarding restricted access vehicles will be made public through the Council meeting process.

REPORT From time to time, Council is in receipt of applications from operators of Restricted Access Vehicles (RAVs) to apply for access to new routes on Council’s local road network. Whilst the process for assessment and gazettal of new routes is managed by the Department of Planning Transport and Infrastructure (DPTI), as a road authority, Council is invited to provide comment on the application and either support or not support the application. The guidelines for route assessment of RAVs (see link below) explains that DPTI has a responsibility to minimise damage to the structural, safety and environmental integrity of the Local Government road system and that liaison with Local Government is critical to the process. Council has a role in the process in advising the Authorised Assessor and the Applicant as to the appropriateness of the use of RAVs along the proposed route. The guidelines state that to preserve the environmental integrity of the local government road network the Applicant must liaise with Councils involved prior to granting RAV access. Council may give a clearance to Gazette a road for RAVs and this may be subject to certain conditions. At a minimum, Council should consider the following impacts relating to the application: • Community safety issues; • Social issues; • Amenity impact issues; • Environmental issues; and • Local issues. Importantly, DPTI state that they will not, as a matter of policy, grant approval under section 161 of the Road Traffic Act for a RAV to travel on a Local Government road without Council clearance.

Current Route Assessment Process In recent times, Council clearance has been determined by technical staff with knowledge of the local road network. No delegation or sub-delegation for this part of the Road Traffic Act exists. It is proposed that the future process for obtaining Council clearance include a mandatory report from officers to Council seeking a decision from Council. The process by which clearances are managed for RAVs is going to change into the future as the National Heavy Vehicle Regulator (NHVR) takes effect from 1 October 2013. In summary, in July 2009, the Council of Australian Governments (COAG) agreed to establish a set of heavy vehicle laws that would apply consistently across all participating jurisdictions. That set of laws is known as the Heavy Vehicle National Law. The rules and regulations established under the Heavy Vehicle National Law in each participating jurisdiction will be administered by an independent body known as the National Heavy Vehicle Regulator (http://www.transport.wa.gov.au/mediaFiles/Freight_FS_NationalHeavyVehicleRegulator_.pdf).
