NOTICE OF STUDY COMMENCEMENT MUNICIPAL CLASS ENVIRONMENTAL ASSESSMENT Pedestrian Bridges over the Speed River linking St. Patrick’s Ward to Downtown

The Study The City of Guelph (City) has initiated a Class Environmental Assessment (Class EA) study for proposed improvements to address the future pedestrian and cyclist traffic demands with two new bridge crossings over the Speed River. The study area is bound by Wellington Street East, Macdonell Street, Guelph Junction Railway (GJR) tracks, Arthur Street South, and includes an area approximately 90 metres south of the existing GJR tracks. The City is proposing to construct one of the bridges immediately south of the GJR tracks to link a future active transportation trail along the GJR tracks from Macdonell to Huron Streets through St. Patrick’s Ward. A second pedestrian bridge is proposed within the Study Area located further south along the Speed River to address anticipated increased pedestrian and cycling traffic generated from the Metalworks condominium development on Arthur Street South and other anticipated developments to the east. The site location and approximate extents of the Study Area are shown on the map provided below. The Process The Class EA will be conducted as a Schedule ‘B’ Project in accordance with the "Municipal Class Environmental Assessment” document (Municipal Engineers Association, October 2000, as amended in 2007, 2011 and 2015), which is an approved process under the Ontario Environmental Assessment Act. The Class EA process includes public and review agency consultation, an evaluation of alternatives, an assessment of potential environmental impacts of the proposed improvements, and identification of reasonable measures to mitigate any potential adverse impacts. How to Participate Later this summer/fall, neighbourhood businesses, residents, community members and interested parties will be invited to attend an open house to review and discuss opportunities and constraints related to the Class EA study. The meeting date and details will be advertised in the Guelph Mercury Tribune and on guelph.ca. Meeting notices will also be circulated to neighbourhood residents and businesses. Municipal Class Environmental Assessment Pedestrian bridges over the Speed River linking St. Patrick’s Ward to Downtown

The StudyThe City of Guelph (City) has undertaken a Class Environmental Assessment (Class EA) study for proposed improvements to address future pedestrian and cyclist traffic demands with two new bridge crossings over the Speed River in the St. Patrick’s Ward area. This study is being carried out in accordance with the Schedule ‘B’ requirements of the Municipal Class Environmental Assessment (October 2000, amended 2007, 2011, 2015), which is approved under the Ontario Environmental Assessment Act.

In order to best address community needs, a number of bridge locations were considered in an area bound by Wellington Street East, Macdonell Street, Guelph Junction Railway (GJR) tracks, Arthur Street South, and Neeve Street. Additionally, a do nothing alternative was also explored. The City has proposed to construct two bridges in this area on a staged basis, as need arises.

An integral component of this study was consultation with directly affected stakeholders, agencies and the general public. Two Public Information Centres were held on September 21, 2016 and March 21, 2017 to present the project details and to collect community feedback. Comments received have been carefully considered in the evaluation process.

Based on the assessment and evaluation of alternatives considered, the preferred locations are immediately south of the GJR Bridge and just south of 43 Arthur Street South (heritage buildings). The second bridge would be constructed at such time that the need for a second crossing is realized and Council approves funding.

The Final Project File Report, documenting the study process and the rationale for the Preferred Solution to replace the bridge, is available for public review, starting Thursday, July 6, 2017, on the City of Guelph’s website: http://guelph.ca/living/construction-projects/ward-downtown-bridges/ and at City Hall:

Public and agency consultation is a key element of the environmental assessment process. We encourage members of the public to review the Project File and share their comments or concerns by Friday, August 14, 2017. If you have serious concerns that cannot be resolved through discussions with the City, you may request the Minister of the Environment and Climate Change (in writing) to issue a “Part II Order” under the Environmental Assessment Act and request an elevated level of study. Requests must be received at the following addresses by August 14, 2017: Ministry/Minister of the Environment and Climate Change, 77 Wellesley St. West, 11th Floor

Toronto, Ontario M7A 2T5 and Director, Environmental Approvals Branch, Ministry of Environment and Climate Change, Floor 12A, 2 St. Clair Avenue W., Toronto, ON M4V 1L5. A copy of the request must also be sent to the City. If no request is received by August 14, 2017, the project is considered to have met the requirements of the Class EA and will proceed to construction as outlined in the Project File, subject to obtaining any other approvals or permits.

Dear Ms Brûlé and Mr. Willis: Re: Pedestrian Bridges over the Speed River linking St. Patrick’s Ward to Downtown Guelph Response to Notice of Commencement This letter is our response to the Notice of Commencement for the above noted project. This response acknowledges that the City of Guelph has indicated that its study is following the Schedule “B” process under the MEA Class EA in order to assess the future pedestrian and cyclists’ needs for a linkage to the downtown Guelph area. Thank you for the opportunity to comment on this project. It is understood that tentative locations for the two bridges have been identified. Consultation with First Nation and Métis Communities Your proposed project may have the potential to affect Aboriginal communities who hold or claim Aboriginal or treaty rights protected under Section 35 of Canada’s Constitution Act 1982. The Crown has a duty to consult First Nation and Métis communities when it knows about established or credibly asserted Aboriginal or treaty rights, and contemplates decisions or actions that may adversely affect them. Although the Crown remains responsible for ensuring the adequacy of consultation with potentially affected Aboriginal communities, it may delegate procedural aspects of the consultation process to project proponents. The environmental assessment process requires proponents to consult with interested persons and government agencies, including those potentially affected by the proposed project. This includes a responsibility to conduct adequate consultation with First Nation and Métis communities. The Ministry relies on consultation conducted by proponents when it assesses the Crown’s obligations and directs proponents during the regulatory process.

Where the Crown’s duty to consult is triggered in relation to your proposed project, the Ontario Ministry of the Environment is delegating the procedural aspects of rights-based consultation to you through this letter.

To assist you in ensuring that these obligations are met, follow-up correspondence identifying the appropriate First Nations and Metis communities for this area will be provided to by the end of this month.

Source Water Protection Per the recent amendments to the Municipal Engineers Association (MEA) Class EA parent document approved October 2015, proponents undertaking a Municipal Class EA project must identify early in the process whether a project is occurring within a source water protection vulnerable area. This must be clearly documented in a Project

File report or ESR. If the project is occurring in a vulnerable area, then there may be policies in the local Source Protection Plan (SPP) that need to be adhered to (requirements under the Clean Water Act). The proponent should contact and consult with the appropriate Conservation Authority/Source Protection Authority (CA/SPA) to discuss potential considerations and policies in the SPP that apply to the project. Please include a section in the report on Source Water Protection. Specifically, it should discuss whether or not the project is located in a vulnerable area and provide applicable details about the area. If located in a vulnerable area, proponents should document whether any project activities are a prescribed drinking water threat and thus pose a risk to drinking water (this should be consulted on with the appropriate CA/SPA). Where an activity poses a risk to drinking water, the proponent must document and discuss in the Project File Report/ESR how the project adheres to or has regard to applicable policies in the local SPP. This section should then be used to inform and should be reflected in other sections of the report, such as the identification of net positive/ negative effects of alternatives, mitigation measures, evaluation of alternatives etc. (As a note, even if the project activities in a vulnerable area are deemed to not to be a drinking water risk, there may be other policies that apply and so consultation with the local CA/SPA is important). You must contact the Director, Environmental Approvals Branch if you have reason to believe that your proposed project may adversely affect an Aboriginal or treaty right, consultation has reached an impasse, or if a Part II Order is anticipated. The Ministry will then assess the extent of any Crown duty to consult in the circumstances, and will consider whether additional steps should be taken and what role you will be asked to play in them. We are the Mississaugas of the New Credit First Nation (MNCFN), the descendants of the

Mississaugas of the River Credit. Our traditional territory extends from the Rouge River Valley

in the east, across to the headwaters of the Thames River, down to Long Point on Lake Erie, and

back along the shores of Lake Erie, the Niagara River, and Lake Ontario to the Rouge River

Valley. It encompasses present-day London, Hamilton, and Toronto, as well as our communal

lands. Our traditional territory has defined and sustained us as a First Nation for countless

generations, and must continue to do so for all our generations to come.

Thank you for your notification on the Pedestrian Bridge Over the Speed River linking Patrick’s

Ward to Downtown dated October 3, 2016. The Mississaugas of the New Credit First Nation

(MNCFN) has various treaty rights across its traditional territory, including the area

contemplated by your project. For further information, please see our website,

http://www.newcreditfirstnation.com/. MNCFN continues to exercise treaty rights which

include, but are not limited to, rights to harvest, fish, trap and gather species of plants, animals

and insects for any purpose including food, social, ceremonial, trade and exchange purposes. The

MNCFN also has the right to use the water and resources from the rivers, creeks and lands across

the MCNFN traditional territory.

At this time, MNCFN does not have a high level of concern regarding the proposed project and

therefore, by way of this letter, approves the continuation of this project. However, MNCFN

requests that you continue to notify us about the status of the project. In addition, we

respectfully ask you to immediately notify us if there are any changes to the project as they

may impact MNCFN’s interests and that you please provide us with a copy of all associated

the scope of work and expected archaeological and environmental impacts.

Additionally, MNCFN employs Field Liaison Representatives (“FLRs”) to act as official

representatives of the community and who are answerable to MNCFN Chief and Council

through the Department of Consultation and Accommodation. The FLRs’ mandate is to ensure

that MNCFN’s perspectives and priorities are considered in the field and to enable MNCFN to

provide timely, relevant, and meaningful comment on the Project. Therefore, it is MNCFN

policy that FLRs are on location whenever any fieldwork for environmental and/or

archaeological assessments are undertaken. It is expected that the proponent will cover the

costs of this FLR participation in the fieldwork. Please also provide the contact information of

the person, or consultant, in charge of organizing this work so they may facilitate the

participation of the MNCFN FLRs.

Nothing in this letter shall be construed as to affect the Aboriginal or Treaty rights and hence

shall not limit any consultation and accommodation owed to MNCFN by the Crown or any

proponent, as recognized by section 35 of the Constitution Act, 1982, of any other First Nation.

MNCFN reserves the right in relation to any development project or decision, to decide whether

it supports a project and to: comment to regulators, participate in regulatory processes and

hearings, seek intervener funding or status, or to challenge and seek remedies through the courts.

MNCFN expects all proponents to act according to the following best practices:

Engage early in the planning process, before decisions are made

Provide information in meaningful and understandable formats.

Convey willingness to transparently describe the project and consider any MNCFN concerns.

Recognize the significance of cultural activities and traditional practices of the MNCFN

Demonstrate a respect for MNCFN knowledge and uses of land and resources.

Understand the importance of youth and elders in First Nation communities.

Act with honour, openness, transparency and respect.

Be prepared to listen and allow time for meaningful discussion.
