Full complaints may be viewed by clicking on the “View” link in the far left column of the electronic version of this letter. Consumers continue to file complaints with CAS that confirm a range of safety-related defects involving the TIPM. The most often cited TIPM failure is a loss of vehicle power that can create a dangerous stall condition at any speed. Additionally, there are numerous complaints alleging bizarre and unexplained headlight and taillight failure, windshield wiper activity, instrument panel failure, and door lock problems. Airbag Complaints Your letter of September 29, 2014 asked about airbag complaints including non-deployment. As NHTSA knows from the GM ignition switch mass defect, it is virtually impossible to be sure that an airbag will deploy until there is a crash. However, NHTSA itself has viewed airbag warning or readiness light failure as a safety concern to be investigated. See PE05-043 where NHTSA initiated a defect investigation where “Repeated and uncorrected illumination of the SRS or readiness indicator light can hinder the detection of potential vital airbag system operation of components such as airbag module, crash sensor and wiring integrity.” Complaints directly citing airbag system warnings can be found in the following complaints received by CAS: 35. “Defective TIPM: causes multiple electrical issues including failure to start, malfunctioning fuel pump, inoperative air bags and random horn” 36. “TIPM is bad. Car doesn't start and now the fuel pump keeps running. The TIPM can cause the airbags to not deploy and car to stall at anytime.” 61. “Started with the airbag light. Then a battery. Now the TIPm module. This has been a safety issue for a while.” 62. “From time of purchase constant oil burning smell, after 4 dealership trips problem determined to be faulty oil breather leaking onto 02 sensor. Early 2014 Master cylinder frozen causing severely hard brake pedal. July 2014 vehicle computer failure requiring replacement and subsequently exhausting the vehicles battery requiring repair. October 2014 faulty wiring in passenger front seat causing airbag failure warning to illuminate and the TIPM sensor failed making the vehicle unable to start. Overall this vehicle continually displays the makings of a complete LEMON as per the text book definition!”

82. “At mile 142, on day 3 of ownership, the airbag light began turning on intermittently. I brought it in for service, the next day. The dealership reset the computer and sent me on my way. That night, the same problem recurred. I contacted the dealership, who set up a new appointment for me on day 8 of ownership. They kept the car and gave me a loaner. They called that night, to let me know that the TIPM was faulty, and that the part was on backorder. They have since put me in a rental car. I have now learned that there is a class action lawsuit against Chrysler for this very part. I don't know how long I'll be in a rental, or when the part will be in. I am extremely concerned for my family's safety, once I get my new car back. I am unconvinced that, once the new part arrives, I will not have problems with it. 105. “The TPIM is going out. Lose power to all sorts of things. Happens at will, mostly below 32 degrees or freezing 4x4 can't be turned on, no power to rear windows, airbag lights come on, ABS comes on, ESP comes on and off, Tow/haul comes and goes, sliding rear window comes and goes, heater fan DON'T work at all SERIOUSLY DANGEROUS being the problem occurs at freezing temp. wind shield wipers come and go, digital thermometer stopped working also fuel economy is terrible now too 12-13.5 MPG average 146. “Failed TIPM. Open circuit in drivers seat airbag.” NHTSA also inquired about complaints submitted to the agency on airbag system failures. The agency’s complaint database contains over 10,000 complaints on the subject vehicles as of November 5, 2014. A cursory search of NHTSA’s complain database turns up the following VOQ’s related to airbag system problems in the subject vehicles: 10628311, 10559190, 10546506, 10542104, 10621901, 10368810, 10619130, 10619133, 10514933, 10562678, 10547415, 10604486, 10406375, 10410579, 10429082, and 10406375. There are quite a few more consumer complaints that cite instrument panel lights without specifically referring to airbag warning lights. NHTSA’s ability to evaluate these complaints far outstrips ours, as the public VOQ database contains limited information, and NHTSA has the ability to contact complainants whose personal information is redacted from the public file. In addition, the Center has provided the agency with a list of EWR death and injury claims on relevant defect codes on vehicles covered by the defect petition. With the addition of the EWR data through June 30, 2014, there are 329 claims reported on vehicles with the TIPM. Only NHTSA can obtain the underlying records. The Center urges NHTSA to do so. Acceleration Complaints Your letter of September 29, 2014 also asked about unintended acceleration. The Center used this term to indicate reports where the vehicle continued to move or accelerate when the operator did not want this to happen. Below is an analysis and listing of CAS complaints as requested. TIPM issues related to acceleration appear to arise from lack of fuel pump shut-off as well as problems with gear shift, throttle, and cruise control. There are quite a few consumer complaints in both CAS and NHTSA databases citing lack of fuel pump shutoff that result in stalling and/or non-start condition but do not produce uncontrolled acceleration. In the interest of space we have not included these below. Consumer problems related to acceleration, gear and/or throttle control may be found in the following CAS complaints: 69. “On January 27, 2014, after remotely opening the sliding door but before starting the car (I was still in the house), the minivan’s horn began a constant blaring, and the front and back windshield wipers came on. After a few minutes when it became apparent it would not stop on its own this time, I disconnected the battery terminals, but nothing changed. After 30 minutes, I drove

the van to the local Chrysler service center. During the 15 minute drive, the car would not downshift at all. When I arrived at the service center, the mechanic disconnected the fuse (or possibly the TIPM) to stop the car’s horn and wipers. After a mechanic inspected the minivan, the service manager informed me that the TIPM was bad and would have to be replaced. I paid the entire cost of $818.00 ($610.00 for the TIPM and $208.00 for labor).” 89. “I was driving my 2009 Dodge Journey today, 9/10/11 and all of a sudden it started to lose power. It began to shake as if it were trembling underneath the vehicle. The Journey was in drive and started to go backwards. I pressed the accelerator with my foot and it went straight to the floor. The gear shift was in drive and the car continued to go backwards with the gear shift in drive. I was very frantic and then began to press the brake pedal with my foot. The Journey would not stop. The brake pedal went straight to the floor as the car continued to go backwards. I quickly pressed the emergency brake with my left foot and the car stopped suddenly and shut off while the gear was still in drive. I put the gear back in the park position and tried to start the car but it would not crank. I waited a few minutes and then tried to crank the car again. The car started and I drove it slowly back to my home. I was only a few feet from my home. The car is parked and I am frantic to drive it. I am very fearful after what happened today. My children were in the car with me and were very afraid that we were going to get hurt. There is something wrong with my 2009 Dodge Journey. I can’t drive it to work. In fact, I can’t drive it at all. I refuse to get back in it!” 106. “Ram 2500: My truck has only 47K miles on it and is perfect condition. It is a 2009 Dodge Ram 2500 Diesel with a 6 speed manual transmission. Last Thursday evening, while driving home from work, the vehicle began spraying wiper fluid by itself and then wiper blades came on with no input from myself. After driving less than a block all power was lost and the vehicle stalled. After attempting to restart the vehicle and realizing there was no power at all. I put the emergency brake on, put keys in my pocket and truck in first gear. I then popped the hood on the vehicle only to notice smoke coming from the TIPM module. I opened the cover to this exposing the fuse panel. Instantly I could see there had been a major electrical short. I called a tow truck and no more than 10 minutes had passed the TIPM module began to catch fire. At that point the vehicle tried to start itself and began to lurch down the road without a driver. Again, this is a manual transmission truck and will not start without depressing the clutch in BUT somehow as the vehicle shorted out it was able to override this? Luckily, I was able to stop the truck safely. A passerby stopped with a fire extinguisher to help me stop the fire. The vehicles horn was stuck on as the vehicle began to electrically melt down. I then pulled both battery cables to stop all this non-sense. I had the vehicle towed to the dealership and they confirmed the TIPM module caught fire and will need to be replaced along with engine wiring harness.” 117. "The car has been into the dealership 5 times because the engine races out of control 18 plus times for no reason. I have to pull over and shut the car off to stop the engine from racing out of control. The dealership doesn't want to do anything about it and I can not get anyone from Jeep to return or respond to my letters." 183. "I purchased a 2014 Jeep Grand Cherokee Limited for $46,000 from Dothan Chrysler Dodge Jeep Ram on Saturday, August 17th, 2013. We drove off the at 8:30 p.m. that evening. On Monday, August 19th, at approximately 4:00 p.m. as I was driving down the highway after having just left my job at the Washington County Sheriff' Office, where I am the public information officer, my vehicle's screen flashed a warning that read: vehicle gear shift malfunction. The screen went completely black for approximately 1 minute. When it came back on the screen read: Please Service Transmission followed by turn off ignition to engage park. I tried to turn off ignition, in the middle of the highway, and the warning then read: vehicle must be in park to turn off ignition. This endless circle continued as I was able to stop the car at a gas station parking lot. I sat in the parking lot of the gas station for approximately 5-7 minutes where I documented (via cellphone camera) the repeated messages and attempted to turn my engine off and simultaneously attempted to put the vehicle in park. The gears would not display. There was no way to see if the

vehicle was in park, or what gear it was in at all. After struggling with the vehicle for close to 7 minutes, I was FINALLY able to turn the ignition off. When I restarted the vehicle, the transmission service light was on. I contacted the dealership (as noted above) immediately. I was assured by the salesman that this ‘happens all the time to Jeeps.’” 184. “While parking the vehicle, the ParkSense feature disabled on its own. Immediately thereafter, the red lightning bolt indicator light appeared on the dash, which has been known to be associated with the Electronic Throttle Control, glow plugs, swirl motor failure (low pressure in rail or fuel rail pressure malfunction) and also speed sensors. The vehicle then revved up on its own without acceleration while my foot was positioned firmly on the brake pedal. Immediately following that, the word "transmission" appeared on the dash, then the check engine light, then the collision indicator as if a car crash had occurred, which it had not. Finally, the power steering became very stiff. Drove the vehicle to the dealership it was purchased from and they said the codes were unknown like hieroglyphics. Left vehicle there. The following Monday the dealership informed me there were 3 software upgrades that were needed on the vehicle, however, those upgrades did not correct the problem. Technician also informed me the car was not safe to drive and they didn't feel safe driving it themselves and got off of the highway during a test run. The technician further explained the vehicle had 3 test runs and failed all 3 and it was beyond their expertise so Chrysler Engineers would be consulted this week. Lastly, the technician informed me I "may be ahead of a recall issue." The car is 5 and half months old. I ordered the car, meaning, I had it made/built from the manufacturer. It was not a car purchased from the lot. Therefore, no other drivers of the car and it is brand new. It is a safety concern, especially since the Cherokee has been out of production for many years until the 2014 release. As a side note, I remember an incident that occurred the week prior when the vehicle had difficulty shifting gears (automatic transmission). Instead it stalled and revved on its own.

CAS has also received a paper complaint alleging unintended acceleration, which may be found as an attachment to our September 30 letter to Administrator Friedman. We have also received a complaint via phone from Mr. Justin Davis of Indiana, who experienced a frightening and unexplained throttle surge event while driving his 2010 Dodge Ram. Mr. Davis was travelling at highway speed with his family when he tapped his cruise control off to change lanes and allow a vehicle to merge. When he attempted to resume cruise control speed, the vehicle responded as though someone “dropped it into 1st gear and floored it.” Mr. Davis has also experience numerous stall/non-start problems. We would be happy to provide Mr. Davis’ contact information to the agency should the agency desire to follow up on his complaint. We are currently reviewing another online complaint that alleges unintended acceleration in a 2008 Jeep Grand Cherokee. We have yet to confirm the VIN for this complaint, which states the following: “When driving my 2008 Jeep with only 40,000 miles my car stalled out. The car completely turned off disabling breaking, steering and making my gears unable to move. The car continued to drive leaving me helpless in stoping this moving vehicle. I finally had to with a my strength punch the gear into park where my car then finally stopped moving. I was only going 20 MPH but imagine what could of occurred if I was on a highway, this letter which have a much different tone. I tried calling Jeep to explain what occurred not only because I felt their car failed and they should pay for my expenses on their failed part, but also to note it for a recall. I have researched and see that I am not the only one that has experienced this occurring with this Jeep. This is VERY dangerous and there should be immediate recalls so no one gets hurts as this is a very serious problem and I am lucky my outcome did not end in a worse way!”

Additionally, you will find attached to this letter an accident report from a May 2014 crash involving unintended acceleration in Vancouver, WA. The vehicle involved, a 2013 Dodge Challenger, is not a model included in the CAS petition, but does contain a TIPM that is the alleged source of the acceleration event. As former NHTSA Chief Counsel Frank Berndt pointed out in his seminal defects litigation memo, evidence of the safety consequences of the failure of a component in one model can be applied to the failure of the same component in another model, even if the two models are made by different manufacturers. “Thus, evidence of a wiper failure on a Plymouth would be admissible to show the likely effect of wiper failure on a Capri.” Berndt Memo at p.9. A cursory search of NHTSA VOQ’s reveals a number of similar complaints in the subject vehicles. The following VOQ’s cite unintended acceleration, surge, and/or cruise control issues: 10334720, 10340565, 10425148, 10428218, 10446078, 10466747, 10469534, 10479372, 10524054, 10542142, 10543492, 10552468, 10560621, 10594680, 10596862, 10606722, 10618677, 10621484, and 10633687. Again, NHTSA is in a better position to evaluate these complaints given the additional information available to the agency in its consumer complaint data. CAS also urges the agency to evaluate EWR reports on the subject models for acceleration-related claims. Sincerely,
