MCA ournal November 2015 Volume XXIV/ Number 6 DCs Agree: CE and Weather…Awesome! The MCA returned to Ocean City, Md. and the Clarion Resort Fontainebleau Hotel for its 2015 Fall Convention and CE. Chiropractors agree that both the continuing education offerings and the weather were awesome. Offering up to 16 hours of CE and taking place October 9-11, this year’s convention offered an impressive list of speakers and sponsors who provided attendees with insight into some of the latest developments on contemporary topics. The convention kicked-off on Friday with Dr. Brian Morrison presenting "Movement in Relation to Pain Pathways." Dr. Morrison noted while some movement disorders are due to serious illnesses like Parkinson’s disease or significant injuries, most limitations occur after minor injury, too much sitting or as our tissues age. Dr. Morrison presented information on how we can use movement in the chiropractic office to reduce pain and make meaningful functional improvements. Friday ended with a cocktail reception and light fare with the convention exhibitors. As is always the case, the convention attendees took the opportunity to network with colleagues, and to visit with the vendors exhibiting and letting them know how much we appreciate their support. On Saturday morning we saw the return of Dr. William Morgan, who presented "Treatment of the Warrior Athlete." Dr. Morgan classified who is a warrior athlete and defined the realistic expectations in treating warrior athletes and what makes them different. During the seminar, he discussed anatomical trains of motion and principles of healthy movement patterns. During the Annual Business Meeting, we met the new MCA president Ronda Sharman, DC and the 2016 board of directors. Louis Crivelli, DC chaired his last Annual Business Meeting and received a standing ovation for his outstanding leadership as president over the past two years. We’ll hear more from Louis as he stays on the board as the ACA Chair with his ICA counterpart Anthony Hardnett, DC We also said thanks to Paul Henry, DC, Rick Schmitt, DC and Norm Spector, DC who are rolling off the board to give other members the opportunity to take a leadership role in the association. One Final HowlI knew I’d have to write this one too. After I was elected President two years ago I thought a lot about my first "letter" to you, the membership. As the first two months turned into the final two months I started thinking about writing this one as well. What could I possibly have to say that hasn’t been said already? Something about past, present, and future? Something about all

the things I wanted to do when I took office? Something about the accomplishments we’ve made so far? Another thought provoking (hopefully) comparison of something ordinary to our beloved profession of chiropractic?

Since autumn is now upon us, perhaps I should say something about Halloween and all the figurative "masks" we wear on a daily basis. Do you wear a different mask with your patients than you do with your families? Or the general public? Or your fellow chiropractors? Does our profession in general wear a mask when dealing with the public? Or other healthcare professionals? Or again, each other? Should we unmask ourselves and reveal who we truly are? Who are we again? Certainly some deep thoughts (and seasonal).

November brings Thanksgiving. Perhaps I should take a moment to thank all the various people that helped me over the last two years. It would honestly take up too much of the page to list them all individually so I’ll just say a HUGE THANK YOU to my fellow members of the MCA Board (past and present) who guided me through my term. I would be remiss if I also didn’t thank YOU, the MCA membership who entrusted me with the awesome responsibility of being your president. I sincerely hope I met your expectations. I continue to hope that the MCA EXCEEDS your expectations.

I am very optimistic for the future of the MCA. Our new president Dr. Ronda Sharman has some exciting ideas and will no doubt do a fantastic job of leading us to the next step in our ongoing collective journey. I wish her the best and pledge to still be as active in our organization as ever. Lately I have been quoted as saying "You ain’t getting rid of me that easy." Take that as a threat, promise, or anyway you please but it’s true. I still have a lot of energy in my body, a lot of thoughts in my head, and the motivation to help this wonderful profession of ours not just survive but thrive.

Speaking of thriving, I recently checked in with Grey Wolf populations and guess what? The once endangered species is THRIVING in many locations. This heartens me tremendously. After all, are we not a pack of wolves? Are we not all in this together? Are our futures not tied to one another’s? Of course we are and of course they are...so one last time...OOOWWWWWOOOOOOOOOOOOOOOOOOOOOOO!

If you’re reading this, you made it past ICD-10’s October 1 transition date, and you’re still here to tell about it. The transition from one code set to a brand new one was a big deal. There are bound to be some bumps in the road to getting claims paid for a while, but eventually, ICD-10 should actually improve your reimbursement.

Now that the implementation date is behind us, this is a good time to regain perspective and remember that even something as big as ICD-10 is only a part of your practice. Certainly it has nothing directly to do with your commitment to your patients or your relationship with them.

In other words, ICD-10 is an insider issue - one your patients should ideally never even hear about. So, no matter how top-of-mind this transition may continue to be for you and your team for the next couple of months, make sure the frustration and distraction don’t make their way to your front desk or your exam table. Yes, it’s kind of a one-way street. Your patients may well tell you about the minutiae of their daily lives - things that have nothing to do with their treatment. You and your team, however, enjoy no such equivalent luxury. Trust me, none of your patients want to hear about your coding and financial department issues.

So what do patients want to hear about? Themselves and their care, first and foremost. It’s not that chiropractic patients are inherently self-absorbed. It’s that their health is why they’re

National Campaign Launched for Medicare Equality: ACA Seeks Full Physician Status in ProgramArlington, Va. - The American Chiropractic Association (ACA) has launched a national grassroots effort to eliminate a blatantly anti-competitive provision of Medicare law that arbitrarily limits reimbursement for medically necessary services delivered by doctors of chiropractic (DCs). The statutory change ACA seeks would define DCs as "physicians" under Section 1861 of the Social Security Act for the provisioning of any existing Medicare covered service that falls within the scope of practice of an individual DC as defined by their applicable state law. The centerpiece of ACA’s campaign will focus on generating a robust level of patient grassroots support aimed at Congress that seeks to ensure that Medicare beneficiaries have full access to a broader range of covered services provided by chiropractic physicians than current law permits. The level of support needed will be largely generated via the distribution of a National Medicare Equality Petition that will raise awareness of how the current Medicare system shortchanges seniors who want and need the essential services provided by DCs to stay healthy, pain free and mobile.

"Studies have shown that essential services provided by chiropractic physicians can help aging Americans live healthier lives, yet every day our nation’s seniors are being unjustly denied reimbursement for Medicare-covered services by chiropractic physicians that could improve their quality of life," said ACA President Anthony Hamm, DC

According to Dr. Hamm, the federal government continues to rely on an antiquated statute that discriminates against Medicare’s chiropractic patients by not covering medically necessary and mandated services delivered by DCs. The federal Medicare program, which in many cases serves as a model for private insurance plans, currently serves more than 55 million Medicare beneficiaries. Various projections forecast the number of people age 65 or older increasing by about one-third over the next decade. Chiropractic inclusion in the Medicare program was established in 1972 and has seen little change since then, other than elimination of the X-ray requirement in 1997.

ACA strongly encourages DCs across the country to recruit the active support of patients and other chiropractic supporters to sign the petition and add their name to a growing list of Americans who demand coverage for all services provided by chiropractic physicians for the Medicare population. The plan is to let signers of the petition have their voice heard in Washington through a series of targeted grassroots campaigns whereby they contact their members of Congress and seek a solution to the problem.

Welcome to a new article series. In this and future articles, I’ll be highlighting several apps/gadgets/pieces of technology that I or other Chiropractors have found useful. But first, a few "official" disclaimers - the views expressed are not meant to be recommendations and are not officially endorsed by any Chiropractic group or agency, they are just personal opinions and reviews - take it or leave it, it’s up to you.

Second, I welcome any and all contributions to future articles - if you use a device, and piece of technology, and app, etc., that you find particularly useful in your practice or in your business, whether it be of clinical use or just useful in running/managing a business related to Chiropractic/health care, please feel free to e-mail the information to me and I can include it in future articles. If you want me to mention your name in that article related to that item, that’s fine, and if you don’t want your name mentioned, that’s fine too.

Third, any apps/gadgets I talk about will probably be Apple-related apps or pieces of technology, as I’m not an Android user (don’t hate me). So related to what I said above, if anyone has any experience with Android-related apps/gadgets, please contribute, and if any of the apps I mention have an android counterpart, please let us know.

So, on with the show. Today I want to highlight a few apps I find very useful and have on my iPad & iPhone, and some I use at least three or four times a day:

1.) 3D Consultation – a great app for helping with your Report of Findings, or just explaining common conditions to patients in general. It has great graphics and animated slides of different conditions such as disc herniations, subluxations, extremity injuries, etc. It also allows you to draw on the animated slides and you can e-mail the slides, with animations, with or without your drawings, to your patient. It’s a bit pricey at $79.99 for the app, but then it’s yours for life.

2.) Ortho App - good (not complete, but semi-comprehensive) list of commonly used orthopedic tests, with descriptions of how to perform the test, positive indications, etc. Cost is $14.99. Again, a little pricey for something we all have in our old textbooks and flashcards (not to mention in our memory) but a good refresher for those unique cases.

3.) ICD-10 Search – I’ve used this one the most over the last two weeks, for obvious reasons. It has a complete (at least so far) list of all ICD-10 Dx’s, broken down by category, etc. You can search

for ICD-10, scroll through the tabular list and it will even do an ICD-9 to ICD-10 conversion for you, which is pretty accurate compared to the Chirocode book. Best of all, it’s free.

Finally, two for general business use:

4.) Docusign - this app lets you use your iPad/iPhone touchscreen to create your signature and initials. With that, other people can send you documents that you would need to sign/initial/date, and you can simply insert your already created signature/initials, etc. on

the electronic copy of the document and have the app send your signed document back to the sender. The app walks you through the whole document, telling you exactly where to sign, in order, so you don’t miss anything and don’t have to scroll through pages and pages of documents to find the three or four places to sign. You can also take one of your own documents (for example, a

contract you want to send to a potential associate) and create a Docusign version for them to sign and send back to you. Other than the places for signatures, the document acts like a PDF file so the recipient can’t change the document. The app is free and with the download you get a certain number of free signings (I think it’s three). After that you have to pay a fee. The fees range from $10/month for a single user for up to five documents a month, up to $30/month for business, which includes

unlimited documents with multiple users.

5.) Zite – not directly business-related or Chiropractic related, but a great news feed app that allows you to create news feeds on as many and/or as specific topics as you like. This feed doesn’t subscribe to any one news source, so the article you get comes from all sources around the world, most of them internet-based. And each article in a particular news feed includes the original Zite news feed that it came from in case you want to add that feed to your favorites list. Also a free app, no hidden fees.

On September 16, CNN Wire posted a report about potential antibiotic levels in the meat and chicken in twenty-five fast food restaurants. The article has been picked up by many online news services, so the full text can be easily read. The restaurants were graded A to F, just as we were graded in school. Restaurants receiving F’s failed the antibiotic criteria. Chipotle and Panera Bread received scores of A, while Chick-fil-A received a B. This suggests we might want to only eat at Chipotle and Panera Bread. However, if you want to eat fast food, go with Chick-fil-A.

Here are the restaurants that likely should be avoided. Duncan’ Donuts and McDonald’ received a grade of C. The following restaurants all received an F: Subway, Wendy’s, Burger King, Denny’s, Domino’s, Starbucks, Olive Garden, Papa John’s, Taco Bell, Pizza Hut, KFC, Applebee’s, Sonic, Chili’s, Jack-in-the-Box, Arby’s, Dairy Queen, IHOP, Outback and Little Caesar’s.

I realize that chicken and red meat were both considered, however, chicken has never been demonized in the fashion suffered by red meat. Consider that red meat has been demonized for decades, being indicted for causing both heart disease and cancer. If this was true, why did the Native Americans, who lived on buffalo for generations, not die off due to heart disease and cancer? Cancer and heart disease are fundamentally modern conditions, which means indicting red meat is shortsighted at best.

For decades, the U.S. public has been conditioned to fear red meat and bacon, in the context that all red meat and bacon are the same. What about grass fed meat? What about cattle and pigs that are ethically raised and free of antibiotics? Applegate Farms is an example of a company that appears to produce animal products in a fashion that renders them similar to those that would be found in the wild. I mention Applegate Farms because products are

readily available in health food stores and regular supermarkets. To find animal products that are grass-fed and free of antibiotics, interested readers can search two websites: eatwild.com and americangrassfed.org.

Wild game and grass-fed meat are very different from feedlot animals that are fed grains, animal products, hormones and antibiotics. My recommendation is to watch the movie Food, Inc., which vividly depicts the problem with animals raised by the

food industrial complex.

If you choose not to eat red meat, do it for reasons that are not based on fear. Wild game and grass-fed meat do not cause heart disease, cancer or any other disease, so the avoidance of animal products should not be based on the false notion that they do.

Consider the absurdity of focusing on red meat as a primary health risk in the American diet. The average

American consumes approximately 60% of their calories from sugar, flour, and refined oils. Compared to these calories, Americans consume virtually no vegetables, fruit, roots/tubers, and nuts; but somehow, red meat is blamed for our ailing health as a nation. This is absurd.

I personally love bacon, so I eat it as much as I want AND I do this in the wake of a diet that contains vegetation (pounds per day) and no sugar, flour, or refined oils. If I wanted to, I could eat bacon-wrapped filet mignon, chicken or scallops everyday with pounds of vegetation because there is no evidence that this approach to meat eating is remotely unhealthy.

Dr. Curry, a 1982 graduate of Palmer College in Davenport, Iowa has been active in state and national

chiropractic organizations and in Palmer Alumni activities for many decades, and was recognized by the Palmer community for his many years of dedicated service.

At that same event, the Connecticut Chiropractic Council presented Peter Martin, DC, FICA, with a special Lifetime Achievement Award for his many decades of leadership and service in chiropractic education. Dr. Martin presently serves as president of Palmer College of Chiropractic’s Florida campus, located at Port Orange, Fla., where he has served in that important capacity since 2005.

With permission from our Lobbyist, Julia Pitcher Worcester, the main topic of this fall’s Legislative article comes from her. Yes, this is a repeat of the same article I submitted in the summer newsletter, but it bears repeating, as we get closer and closer to the 2016 Legislative session in Annapolis. Now is the time to get involved with your local State Delegate or Senator. They want to meet you, they want to hear from you, they want your support and yes, they want your money, either from you directly or from the PAC. But it goes both ways - we want their support too. You never know what long-term connections you may make. Political affiliations don’t matter in this context - it’s about meeting the folks who vote on our bills and getting them to understand and respect our profession and our side of things. We (the MCA and the Pitcher Law Firm) can and will keep you informed of events in your area if you want to be involved and possibly attend these events - whether it’s on behalf of the MCA or just for yourself.

With regard to how the PAC contributions were made this summer, our firm generally recommends that the year immediately following an election year is what we call a "getting to know you" time. The newly elected legislators have one session under their belt with a few votes on their record, but have probably not gone out of their way for any issue in particular (unless we previously had a relationship with them and they were specifically asked to work on an issue for X organization). So we typically advise much smaller donations from a PAC in the $100-150 range.

Here, we have a year with half of HGO being newly elected Delegates, half of Senate EHEA being new, and no one that’s "newly elected" to FIN, but two that are new to the committee being brought over from other committees. This also goes along with what our firm typically advises - keep contributions to the committees of your jurisdiction (for MCA = health care committees) and once in a while "leadership" such as Miller/Busch/Governor.

With so many new folks on the committees this time around, we don’t have to hit every single event with a contribution from the PAC, but can float a couple early in the summer and others later in the fall when events pick back up again. Completely up to you all to make those decisions and we’re here for advice and counsel for background on individuals, etc.

As for Antonio Hayes, he’s new from Baltimore City, currently works for the City’s Dept. of Social Services, very community involved, particularly because some of his district was affected by

the riots/businesses lost. He does sit on HGO and his subcommittee assignment is Health Facilities and Occupations, meaning he specifically voted on our Trade Name bill and will likely vote on anything having to do with “scope of practice” or the health occupations boards in the future (i.e. if dry needling comes back - that lands in his subcommittee). He’s not very familiar with much of the health care system or the licensing boards but can learn from us and has not expressed any anti-chiropractic sentiments that I’ve heard.

This year we will continue to explore the possibility of separating the licensing boards and will keep you updated. The Dry Needling issue may arise again, but we will be more than prepared for it. There will be a few other bills and issues we may be working on to get ready for next year’s legislative session, and as we gather more information on those items, we will keep you informed.

Before anyone asks, no, we have not forgotten about the Medicaid issue, as this is a large issue, and not one that is going to be solved in one year. This is something that takes time to gather information and put our resources together. And also keep in mind, we on the Legislative committee are a small group. The more help/volunteers we have even for one or two projects at a time, the more availability we will have to put into other projects, like Medicaid expansion.

That’s a hint, by the way - we need your help. Whether you can donate an hour of you time one day, or want to help out once in a while or on a regular basis, we at the MCA board can only get so much done by ourselves. Feel free to come to any MCA board meeting, listen in and see if something piques your interest. You can always call me or any board member anytime, not just with questions, but also just to say "hey, I want to help with the Medicaid issue" or "I want to go to Annapolis one day and meet my State Delegate" and we will happily help you out.
