  • NPDES Pesticide General Permit In October 2012, the DOH issued a NPDES General Permit to authorize point source discharges from the application of pesticides (including insecticides, herbicides, fungicides, rodenticides, and various other substances to control pests) to State waters. This NPDES Pesticide General Permit (PGP) is in Hawaii Administrative Rules (HAR), Chapter 11-55, Appendix M. You may download HAR 11-55 from the DOH-CWB website at: http://health.hawaii.gov/cwb/

  • NPDES Pesticide General Permit As with all NPDES General Permits, the PGP has already been issued. You can obtain coverage under the PGP: By qualifying for automatic coverage, or By submitting an NOI if you do not meet automatic coverage eligibility.

  • NPDES Pesticide General Permit For your convenience, the DOH has created a flow chart to summarize PGP applicability and requirements. The flow chart does not include all the terms, conditions, and requirements of the PGP. You must read HAR Ch. 11-55, Appendix M, for further detail.

  • Will you be applying a pesticide to a State water or will the pesticide get into a State water during its application? * NPDES Permit coverage not required.Is the State water a Class A Marine Water or Class 2 Inland Water? Is the application of pesticide required for weed, algae, or animal pest control to maintain flow in agricultural irrigation ditches or in flooded agricultural fields? Individual NPDES permit coverage may be required. Are you a state or federal government entity? Is the reason you are applying the pesticide to control: 1.Mosquito or other flying insect pest. 2.Weed or algae pest. 3.Animal pest. 4.Forest canopy pest. Will you be exceeding any of the following during a calendar year: 1.For mosquito or other flying insect pest adulticide treatment area greater than 6400 acres. 2.For weed, algae, and animal pest treatment of more than 20 linear miles or treatment area greater than 80 acres of water. 3.For forest canopy pest treatment area greater than 6400 acres. Are you a large entity as defined in HAR 11-55-01? You are automatically covered under the Pesticide General Permit and do not need to submit a NOI, PDMP, or annual report. You are required to comply with requirements as applicable (e.g. HAR 11-55, Appendix M, Sections 2, 3, 4, 6, and 7). * This flow chart is intended to summarize permit applicability and requirements. It is not all inclusive of the terms, conditions, and requirements of the Pesticide General Permit. You must read HAR Ch. 11-55, Appendix M, for further detail. You are required to: 1.Submit an NOI. 2.Keep records. 3. Comply with other requirements per HAR 11-55, Appendix M. PDMP and Annual report not required.   • NPDES Pesticide General Permit Four main PGP scenarios: 1. The PGP does not apply to you at all. 2. You are automatically covered under the PGP and do not have to submit a NOI. 3. You are not automatically covered under the PGP and you must submit a NOI. 4. You are not qualified for PGP coverage and must either look into obtaining Individual NPDES Permit coverage or not apply pesticides to State waters.
