    Indira Gandhi had in 1973nationalized coal. This had ended theblack marketeering of coal and coal hadbecome available at government notifiedrates all over the country. But ManmohanSingh has opened the coal coffers toprivate players thus harming the causeespoused above.

    It was a minister who did the 2Gscam. The PM was not even aware of it.Adarsh and Commonwealth loot too were

    21 April 2011: Indeed it is an exciting,explosive, website. It lists the scams ofIndia since Independence - Bofors, 2G,CWG included - with colour photographsof alleged scamsters. It exposes thehidden truth about the Congress partyand the dynasty.

    Most important forIndian discourse, it isunquest ionab lysecular! Next, it is noteven remotely BJ Pswork, nor Lohiites, orS u b r a m a n i a nSwamys, or the workof anyone who themedia can dismiss asreckless, or of someone inimical to SoniaGandhi or the UPA. On the contrary itbelongs to those who Sonia Gandhiherself seems to respect a lot. Whose siteis this then? Wait till the climax. Here is atelling catalogue of its explosive contents.

    Its star content is a video slidepresentation titled India: a republic ofscams. It starts off with a BrahmaChallaney quote that the scams are notjust corruption, but plunder of India. Thefourth slide titled 2G-spectrum allocationfraud Rs 1.76 lakh crores shows a photo

    2007 when Shibu Soren was in jail andthe Prime Minister Manmohan Singh washolding the coal ministry. In this periodDasi Narayan and Santosh Bagdodiyawere ministers of state for coal. It was

    under the Prime minister that the coalministry gave out the maximum numberof captive coal blocks free of cost. Themost glaring and blatant fact is that thecoal mines were given out free at the lowerthan nominal cost of Rs.100 royalty perton of coal that would be extracted. It wasdone at a time when the market price ofcoal was over Rs. 2000 per ton.

    When this issue was brought to thenotice of the Parliament, the governmentignominiously declared that it would notallocate coal blocks further withoutamending the Mines and Minerals Act,1957, which would bring in the clausespertaining to open bidding process. Alsoagain when the Bill was moved in theRajya Sabha it was agreed that no furtherallocation of coal blocks would beundertaken unless both the houses

    passed the Bill into an Act. Though it waspassed in the Rajya Sabha, it wasdeliberately stalled in the Lok Sabha forfour years, and it could become an Actonly in 2010.

    In the meanwhile the government inthe most sinister manner, breached itspromise to the P arliament and theallocation of free coal blocks continuedsurreptitiously. Actually, there was a deepconspiracy behind this ploy to keep theBill pending in the Lok Sabha. Theamendment to the Bill unambiguouslyenvisaged that from the date of itspassage, allocation of mines or mineralswould be brought under the umbrellaambit of a fair open bidding process. Thus,had the Bill not been kept hanging in alurch, the government would not havebeen able to propitiate its favourite private

    companies. Thus, in this period coalblocks to the tune of proven reserves of21.69 billion tons was given away free toprivate companies and also middlemen.

    The Prime minister ManmohanSingh was the coal minister during thisperiod and all this bungling andembezzlement happened under his verynose, maximum number of blocks weresquandered under him only. ManmohanSingh gave away 63 blocks for free. Butwhy did he do so? During these four years(2006-2010) almost 175 blocks weregifted to brokers and capitalists of differentshades.

    Actually apparently, the magnitudeand the seriousness of the matter andscam do not catch the eye so ChauthiDuniya decided to estimate the monetaryloss inflicted upon the exchequer because

    of this government largesse. What cameout was numbing. Actually the act of givingcaptive coal blocks to private companiesstarted in 1993. The pretext of this wasthat the private players, in search of profit,could be lured into investing in suchblocks which for the government wouldprove both difficult and cost ineffective tomine. This would invariably take coalproduction to newer heights while fuellingthe economy.

    From 1993 to 2010, 208 blocks ofcoal were alloctaed for free. Thistantamounts to coal reserves of 49.07billion tons. Out of the 208 blocks, 113blocks were given to 184 privatecompanies for free. This amounted to coalreserves equal to 21.69 billion tons. If thevalue of this coal is calculated at themarket price of Rs. 2500 per ton, it comesout to 5,382,830.50 Crores. If out of thisRs. 2500, Rs. 1250 is deduced givingspace for Rs. 850 as cost of production,transportation etc and Rs. 400 is deduced

    as profit, then also the country was inflicteda revenue loss of about 26 Lakh Crores.So this is the Father and Mother of allScams. This is surely Indias biggest andscariest scam ever as also perhaps, the

    biggest ever in any country in the world.During investigations Chauthi

    Duniya laid its hands upon a fewdocuments that are astonishing. Thesedocuments reveal that even the CAG isaware of this scam. Question is why isthe CAG silent till now?

    The UPA government squanderedthe mineral resources of the nation towhich all 120 Crore citizens have an equalright. The breath-bating sum of 26 LakhCrores could have been used for themultitude of deprived and marginalized ofthis country.

    The UPA government, since the dayit has assumed power, has put out an allout specious policy faux pas. Apparently,it has been emphasizing that to propelIndias growth, it must be made selfsufficient in energy resources. But the

    picture that has emerged is that the samegovernment has gifted scarce naturalreserves of the country to privatecompanies and industrialists for free. Thiscommon national capital should haveaccrued to all the citizens but thegovernment circumvented proceduresand resorted to subterfuge in order to robthe Indian exchequer of 26 Lakh Crores.

    The Parliament was first kept in darkand when it did come to light theauspicious body was defrauded intobelieving that the government wanted toamend the relevant laws to include theprocess of open bidding. Actually theParliament was taken for a ride for fouryears and in the intervening period thegovernment, in sinister collusion with itscrony industrialists settled all the darkdeals. Looking at the amount robbed (26

    Lakh Crores) it is pretty obvious how muchmoney would have changed hands.

    But the irregularities do not endhere. Yet another startling fact has cometo light. There are certain guidelinesregulating the allocation of coal blockswhich were again either circumvented orturned a blind eye to. There are certainconditions which cannot be violated in anycase while allocating the coal blocks. Acondition is that in case of undergroundmines production should mandatorily startwithin 36 months (a grace period of 6months is allowed if the mine falls underforested area). If the mine is of the opencast type, this mandatory period of startingproduction is 48 months (and another 6months is allowed if the mine falls underforested area). If production does notcommence within this stipulated period,

    the license stands null and void. Thisclause has been added in order to keepout middlemen and brokers whothemselves do not need coal but wait forthe right industrialist to come and then sellthe mine to the latter at exorbitant prices.

    But interestingly, the governmenthas not cancelled any license under thisclause even when the statistics ofproduction are dismal. This is because thegovernment had given away many a minefor this very purpose, that middlemen maymake profit. If the government was and isnot in collusion with the black marketersand middlemen, why at all, in the firstplace middlemen were allotted blocks andsecondly, why at all no cancellation oflicenses have occurred even whenproduction period has been overshot?Latter is the job of Sri Prakash J aiswalwho made no amends whatsoever. Till2003, 40 blocks had been allocated. Outof this only 24 have started production.So why have the licenses of the rest of

    the 16 companies not cancelled? In 2004,4 blocks were allotted and none hasstarted production. Similarly, in 2005, 22blcoks were allotted and only 2 havestarted production. In 2006 52, 2007 51,

    2008 22, 2009 16 and in 2010 0ne blockwere allotted. But the report till 18thJ anuary says that none have startedproduction. So first the government allotscoal blocks to private interests. Then keepthe Mines and Minerals Act pending in theParliament, while the embezzlementkeeps going on. Then when minesallocated to middlemen does not startproduction (they were not meant to startproduction at all) then nobody cancelstheir licenses. Now none needs to be arocket scientist to see behind the officialmaze and fathom what went on betweenthe government and middlemen. Hadthere been no covert collusion and nexus,only 26 out of 208 mines would not beproducing.

    This UPA government has beenultimately specious in its dealings with the

    nation. First it gives the slogan ofdevelopment and energy security and onthe other hand squanders away one of themost important inputs of growth-coal. Itgives it away for free, as gift, to its favouritecapitalists and brokers. It is not so thatthe government did this under someunavoidable circumstances. It isindefensible. Mining DevelopmentCorporation of Maharashtra also got somefree coal blocks from Coal India. Thesewere Agarjhari, Varora, Marki, J amni,Adakuli, and Gare palma etc. later thecorporation sold these blocks to privatecompanies thus earning a profit of 750Crores for the state coffers. This too wasa way in which the government could havegone about in the case of coal blocks butas it stands they were gifted free. It is notso that the presence of middlemen in this

    process is a matter of conjecture; actuallya company in Maharashtra which hasnothing to do with coal was allotted a freecoal block which it sold for Rs. 500 Crores.Pure and simple profit without investing apenny. So the coal blocks were turned intoDalal Street wherein coal was bought andsold like shares with no accruing benefitsto the people of India.

    Pranab Mukjherjee declared that hewas going to present a budget for thecommon man. But what came out of hisred briefcase was a mockery of commonman. Having a look at that demeaningbudget it comes to light that social sectorwas given 1.6 lakh crores. Infrastructuregot 2.14 lakh crores. Defence was given1.64 lakh crores. The fiscal deficit of Indiastands at 4.12 lakh crores. Tax revenueof India is 9.32 lakh crores. The total

    expenditure for the year 2011-12 is 12 lakh57 thousand and 729 crores. And thissingle scam is worth 26 lakh crores.

    It means that middlemen,blackmarketeers, industrialists andcapitalists were given almost twice theamount that was allocated for whole ofIndia for the year 2011-12. It means thatthree years tax on Indian peoplesearnings was gulped up by this singlescam. This means that Indian defenceforces would have been supplied for bythis amount for the next 25 years. Thismeans that Indias infrastructure bluescould have been fixed for ever in just asingle year with the amount involved inthis single scam. And India, in this periodof slow recovery from global recession,could have paid off all its debts, domesticand international in just one go. Blackmoney stashed in foreign banks has beena headache for the people of this country,but what about this money, who will bringthis back in mainstream economy if India.

While scepticsscoff at such stories, devotees regardthem as a proof of divine manifestation.Some rationalists have challenged theBaba on this account, but his own takeon miracles is different. I shall tell youwhy I give these rings, talismans androsaries. It is to signal the bond betweenme and those to whom they are given.When calamity befalls them, the objectcomes to me in a flash and returns in aflash taking from me the remedial graceof protection. That grace is available to

    all who call on me in any name or form,not merely to those who wear these gifts.Love is the bond that wins grace.

    He said: People may be very near(physically) to the avatar, but they live outtheir lives unaware of their fortune; theyexaggerate the role of miracles, which areas trivial, when compared to my glory andmajesty, as a mosquito is in size andstrength to the elephant upon which itsquats. Therefore, when you speak aboutthese miracles, I laugh out of pity thatyou allow yourself so easily to lose theprecious awareness of my reality.

If you lift your handto serve, to help, to console, to encourageanother, you are lifting it for God, because inevery one of you is God.Even avatars haveto one day leave their mortal coils behind but who is to convince loyalists who regardthe Baba as God, who expect his physicalbody to remain mortal? Following a hipoperation, Baba had declared, My body isnot immortal; my message is.God-like, theBaba has given succour to millions fromSouth America to Australia and all theregions in between. Its faith and hope thatmove his followers, with the strongmotivation of putting service before self.And thats not a point of dissension. Thebody might wither away, but the messagethat brings hope remains forever.

It also says, RahulGandhi was arrested by FBI in US formoney laundering. Another slide showsthe billion-dollar home of Mukesh Ambani,contrasting it with the slum in Dharavi inMumbai and says Ambani gave a jetplane as a birthday gift to his wife, which,Swamy says, is used by Sonia Gandhi asprivate jet for secret Italy trips.

    The site also contains the videospeeches of Swamy on Sonia familyssmuggling; and on the truth about SoniaGandhi declining the position of PrimeMinister. It also carries Swamys famous

    article Know the truth about SoniaGandhi where he talks on what he callsas her lies, including about her education,about the KGB payments to her family,the Schweizer Illustrierte expose of the$2.5 billion secret bank funds inherited byher, and more.

This is thewebsite of India Against Corruption (IAC).The site authors say in the column AboutUs: India Against Corruption movementis an expression of collective anger ofpeople of India against corruption. Wehave all come together to force/request/persuade/pressurise the government toenact the J an Lokpal Bill. We feel that ifthis Bill were enacted it would create aneffective deterrence against corruption.Whos who of IAC is in the About us. Who

    heads the IAC? Hold your breath. It isAnna Hazare who, like most in the country,Sonia Gandhi too respects! Who are theothers?     QED: Those who are campaigningagainst corruption call Sonia Gandhicorrupt; but Anna Hazare invites her tofight corruption! Two critical questionsarise. One, what will be the response ofSonia Gandhi and the Congress to theIAC headed by Anna Hazare namingSonia Gandhi and her family asscamsters? Two, what will be theresponse of Team Hazare to Annas

    repeated invite to Sonia Gandhi, whomtheir site lists among the scamsters, tofight corruption together?

    Gujarat IPS officer Sanjiv Bhatt maybe positioning himself as a crusaderagainst injustice, but his own track record

    on that count is a blot on the uniform. Theofficer was involved in planting narcoticsubstance in a hotel room to arrest anadvocate of Rajasthan in 1996. TheNational Human Rights Commission hadasked the Gujarat Government to pay upRs 1 lakh compensation to the victimand Gujarat HRC twice asked the StateGovernment to place the controversialIPS officer under suspension.

    The charges against Bhattsurfaced when he was Superintendentof Police at Palanpur in 1996. Anadvocate, Sumersinh Rajpurohit of Paliin Rajasthan, filed a complaint againstBhatt at Pali Kotwali police station. Theadvocate alleged that Bhatt plantednarcotic in a hotel room in Palanpur,showed the room booked in his(advocates name) and then travelled all

    the way to Pali with a police party to arresthim at midnight. The advocate allegedthat Bhatt acted on behalf of an additionaljudge RR J ain, whose sister was ownerof a shop occupied by Sumersinh. Thelady and the advocate were atloggerheads and Bhatt did the dirty workfor the judge, who was later suspended.

    According his complaint, Sumersinhsuccumbed to police torture after sevendays behind bars and asked his brotherto vacate the shop. Thereafter, the policereleased him on the ground that he couldnot be identified in the test identificationparade.

    The Pali Bar Association, theRajasthan Bar Association and the BarCouncil of Rajasthan raised strongprotests and wrote to the Chief J ustice ofIndia, NHRC and Chief Justice of GujaratHigh Court against Bhatt and J ustice RRJ ain.

    After the Rajasthan High Courtrejected their quashing plea, J ustice Jainapproached the Supreme Court withcontention that any criminal proceedingsagainst him would require green signalfrom the CJ I. J ain got a stay onproceedings on the technical ground, butwas not confirmed as judge of the highcourt, and later repatriated to his originalpost of City Civil and Sessions judge atAhmedabad.     Meanwhile, Gujarat VigilanceCommission, vide its letter dated 15-7-2002 stated that charges levelled againstSanjiv Bhatt were very serious and heshould be placed under suspension. Butthe Modi Government again did not actagainst the officer.

    New Delhi, April 25, 2011: SackedCWG Organising Committee chief SureshKalmadi was on Monday arrested by CBIon charges of cheating, conspiracy andcorruption in connection with awardingsome Games contracts and the rulingCongress wasted no time in suspendingthe Lok Sabha MP.

    Six months after the end of the NewDelhi Commonwealth Games that wasmired in controversies and scams, the CBIfinally closed in on 66-year-old Kalmadi,the CWG's public face, arresting him forallegedly awarding illegal contracts to aSwiss firm for Timing-Scoring-Result(TSR) system for the Games causing aloss of Rs 95 crore to the exchequer.

    A beleaguered Kalmadi's arrest was

    announced after his more than four hoursquestioning at the CBI headquarters, hisfourth since December last, over thealleged irregularities related to the awardof contract to Swiss Timekeeping and theQueens Baton Relay (QBR).

    The agency also arrested two otherOC officials Surjeet Lal, deputy directorgeneral (procurement) and A SV Prasad,joint director general (sports) in the samecase.

    Kalmadi, who came to theheadquarters of the agency here onMonday morning, was arrested at 1530hours, a senior CBI official said.

    Kalmadi, an MP from Pune, and thetwo other officials will be in CBI custodytonight and they will be produced in a courton Tuesday.

    The CBI registered a case undersection 120B (conspiracy) read withSection 420 (cheating) IPC and otherrelevant sections of Prevention ofCorruption Act in the case, an official said.

    "The CBI has today arrested the thenChairman of OC of CommonwealthGames-2010 for conspiracy to causefavour to a private firm based inSwitzerlandin awarding the contract for Timing, Scoringand Result system at an inflated cost of Rs141 crore," CBI spokesperson DharniMishra told reporters.

    Kalmadi's arrest came weeks afterhis close aide and OC's secretary generalLalit Bhanot and director general VKVerma were arrested in the same case.CBI officials said more arrests would followin the case.

    Shortly after Kalmadi's arrest was

    announced, AICC general secretaryJ anardhan Dwivedi said the Congress hassuspended Kalmadi.

    "The disciplinary committee (of theCongress has suspended Suresh Kalmadifrom the membership of the party,"Dwievedi said.

    Problems also mounted for Kalmadiin the sphere of sports administration afterhis arrest with the Union sports ministrywriting a letter to the Indian OlympicAssociation (IOA) asking it to considerappointing a new president to replace him.

    opposition on Monday went ballistic againstthe government, saying it needs to actagainst others as well.

    While the BJ P said Kalmadi is only asmall fry in this matter, the Left believes thearrest has come a little too late in the day.

    "Kalmadi is just the tip of the iceberg.There are more names mentioned in theShunglu Committee. Whoever those peopleare - ministers or CMs - actions should betaken, otherwise, the arrest will just be aneyewash," said BJ P chief Nitin Gadkari.

    The Officer stated, that all this officials are helpless and are forced todoing something which they do not like, they become scapegoats in the eyesof people and media by the act of this beasts. He further quoted that a few

    opposition leaders are also bought by congress leaders to suppress themfrom speaking anything against Rahul and Soniaji. One name which ispopularly doing rounds is that of Ranjan Bhatacharya who plays a mediatorrole between Congress and BJ P leaders. It is at his disposal, he fixes meetings

    between them at some undisclosed places.

    I am sure many would agree with me that the above outcome of the

    meeting clearly signifies a Dictator rule for the blank future of India. Are Gandhifamily above the Law in India. It definitely seems so.

    If we do not protest or challenge the same, our Country will turn into

    another Afghanistan, Libya, with atrocity on streets of India by the so calledleaders. Only the J udiciary and the Defence Personnel can save the countryfrom the clutches of this Greedy politicians of our country.

    The disdain with which leading lightsof the anti-corruption movement - Mallika

    Sarabhai, Medha P atkar, KavitaSrivastava et al - are publicly threateningto dislodge Anna Hazare from theleadership role because he praisedNarendra Modi's rural development workin Gujarat indicates that the poor man wasonly being used as a convenient symbolthat can be discarded as arbitrarily as hewas chosen to lead the 'movement'.

    Human rights activists can retaintheir credibility only as long as they remainsteadfastly non-partisan. To the personkilled, it matters little whether themurderous mob was shouting 'LalSalaam', 'Har Har Mahadev' or 'NationalUnity' as did the mobs that massacredover 10,000 Sikhs in northIndia following Indira Gandhi'sassassination. However, thesecular brigade shows a

    consistent soft corner forthose who kill under theMaoist or communist banneras well as those who verballyprofess secularism.

    Narendra Modi's acts ofcommission and omissionduring the 2002 riots deservethe strongest ofcondemnations. Thosecrimes need to be impartiallyinvestigated and the guilty punished. J ustas we are proud that our democraticsystem ensured a fair trial even for apublicly identified ISI-associated terroristlike Kasab, so also we should let thecourts take the Gujarat trials to their logicalconclusions.

    Those who ask for Modi's headwould do well to remember that hordes ofCongressmen in Gujarat gleefully joinedthe BJP and RSS goons who went aroundmassacring innocent people.

    The overall track record of theCongress in this matter is no better, if notmuch worse, than that of the BJ P. Inaddition to the 1984 massacre of Sikhs innorth India, it masterminded numerousother riots through the 1970s, 1980s and1990s. None of the killers of politicallyengineered riots in Meerut, Malliana,Bhiwandi, Bhagalpur, Hyderabad,Mumbai, Ahmedabad, Surat and scoresof others were ever punished. TheCongress also injected terrorism intoPunjab by its covert support ofBhindranwale's Khalistani brigades inorder to wrest control of the SGPC thatpresides over well-endowed gurdwaras.It did incalculable harm to the Sri LankanTamils by creating a Frankenstein's

    monster like the LTTE. The secessionistmovement in Kashmir owes its origins anddraws sustenance from the Congressparty's penchant for rigging elections toinstall puppet chief ministers.

    And yet, even those of us whogenuinely want to see the guilty amongCongress leaders pay for their crimes dorecognise that there is a lot more to thispremier national party than a legacy ofmayhem and massacres. There are timeswhen the Congress party has actuallylived up to the highest values of Indiandemocracy and some of our bestcontemporary politicians have emergedfrom the Congress fold.

    Due to their ideological predilectionsand cosy relationship with the Congresshigh command, most of those attackingHazare have a history of acting as the

    fighting arm of the Congress against Modiand the BJ P. But to declare Hazare apolitical untouchable because he is not

    as ideologically committed to their brandof secularism is to display deadly

    arrogance. One earns the moral right tocriticise only when one has the moralcourage to acknowledge the positiveaspects or good deeds of those wecondemn for specific evil actions. Oneshould be able to condemn Modi for hisrole in the 2002 massacre and point tohis many other blind spots and lapses,without feeling the need to deny hispositive role in Gujarat leading the countryin many vital areas such as assured powersupply to all villages, measures forbringing down the maternal mortality rateby providing financial and other supportfor safe deliveries to poor women, and a9.8% growth rate in agriculture while the

    rest of the country remainsstuck at 2-3% growth. It is oneof the few states wherefarmers at large are not at war

    with industry, where deliverymechanisms for governmentservices have improveddramatically.

    The manner in whichMaulana Ghulam MohammadVastanvi, the vice-chancellorof Darul Uloom of Deoband,was humiliated and asked toresign for stating that thedevelopment agenda of Modi

    is benefiting Muslims in equal measureshows that the 'secular' gang has acquireda vested interest in promoting a siegementality among Muslims. The man theycondemn as the 'maut ka saudagar'seems to have recognised the folly ofpromoting communal polarisation. He hasnot let another riot take place in Gujarat,a state which witnessed numerous casteand communal riots under Congress rule.In recent years, hundreds of Muslims havewon municipal elections on BJ P tickets.Democracy with its one-person, one-voteprinciple has tamed Narendra Modi. Butthose who don't need to get endorsementfor their political posturing from citizenson whose behalf they speak, are notamenable to such self-correctingmechanisms.

    The task of cleansing our polity ofcrime and corruption is not a battlebetween demons and angels. It requirestaking the entire spectrum of politicalopinion on board including those whosupport Maoists or vote for Modi. Such atask cannot be done by those who harbourblind prejudice, and partisan agendas. Itis best done by people of compassion,and humility; people who remain fair andnon-partisan even when dealing with

    those they hate.

    The prime witness in the Best Bakerycase was manipulated and coerced to givefalse evidence before the trial court inMumbai. This startling disclosure hasemerged from an affidavit sent to the ChiefJ ustice of Bombay High Court on June 17,2010 by Sheikh Yasmeen Banu, whosefather-in-law Habibulla owned the ill-fatedBest Bakery. Yasmeens husband Nafitullawas injured when rioters set Best Bakeryablaze. Nafitulla later died due to illness. Inall, 14 persons were killed in the blaze.

    In her affidavit dated J une 17, 2010,Yasmeen, whose eyewitness account of thecarnage played a crucial role in the convictionof the alleged accused persons stated thather deposition before the trial court was madeunder duress and she regretted that theinnocent persons have been convicted on thebasis of her testimony. She has implicatedsocial activist Teesta Setalvad for her

    fabricated deposition.Yasmeen stated that after the carnageshe went to her parents home atChhotaudepur along with her maternal uncle.After sometime, she went to Baroda along withher daughter and mother and started living inBest Bakery house after getting it repaired.

    That is when Yasmeen wasapproached by Setalvads trusted right-handman Rais Khan. Incidentally, Khan hasseparately accused Setalvad of fabricatingthe affidavits of the riot witnesses.

    Yasmeen stated that one day, RaisKhan, who is associated with TeestaSetalvad, visited her along with local Muslimleaders and said that there was a danger toher (Yasmeen) life here and she must cometo Mumbai where Best Bakery case wascontested. Rais Khan connected me toTeesta Setalvad from his cell phone. TeestaSetalvad also persuaded me to come toMumbai along with him and promised me to

    help from every point of view, Yasmeen said.Yasmeen said she and her mother were

    forced and threatened, even assured by RaisKhan that he and Teesta Setalvad will fulfillall her needs throughout her life.

    After getting assurances from Muslimleaders, Rais Khan and Teesta Setalvad, Ialong with mother and my daughter left forMumbai with Rais Khan by locking my houseand leaving all the household articles there,which I brought from my widow mothershouse from Chhotaudepur.

    In Mumbai, Yasmeen was kept at AshokGuest House in Bhindi Bazaar for one month.Yasmeen said Rais Khan daily took her toSetalvads house at Nirant Bungalow, JuhuTara Road, Santacruz (West), Mumbai, whichis her office also. Teesta Setalvad used toexplain to me about the case there. Fromthere she used to take me to the office ofPublic Prosecutor Manjula Rao and thereaftershe used to drop me at the guest house, shepoints out.

    She further added that during thisperiod, she was paid by Teesta through herstaff Dhyansingh and Pradip. Yasmeen waskept for 11 months in Room No. 102, atMariam Apartment, Ismile Katre Road, BhindiBazaar.

    Indicating that all the witnesses werekept under Setalvads supervision, Yasmeensaid when she was shifted there, the sameday other witnesses of the Best Bakery case,namely Taufel, Rais, Shezad, Selon, Ashraf,Shahjahan, Zahira Sheikh and hergrandmother also came to stay there.

    Rais Khan and Teesta Setalvad keptstrict observation on the flat in which we wereresiding, we were not able to go out and noone was allowed to meet us. Neither werewe having mobile nor were we allowed to talkto anybody, even if we requested. We werenot permitted to open the window of the room.

    Dhyansingh or sometimes Pradip, working inthe office of Teesta Setalvad, used to stay for24 hours there. They used to fulfill ourrequirements as well as keeping watch on us,

    Yasmeen states and adds whosoever wascalled for deposition in the court used to leavethe house and did not return.

    Yasmeen said the witnesses were keptin a Government guest house during the periodof deposition. They used to get mobile phonefrom Teestas men in which outgoing calls werebarred. Teesta used to explain on mobile onwhat they have to depose, she said.

    She revealed that Public ProsecutorManjula Rao where Teesta Setalvad used tobe present everybody was tutored what tospeak against whom in the court.

    Claiming that the depositions, whichshe gave against the persons, on the adviceof these people, were unknown to her,Yasmeen said Teesta, Manjula Rao and RaisKhan used to take the witnesses to show their(accused) photographs to her on computersto identify them.

    She took my signatures on a few papers

    about which she (Yasmeen) had no knowledge,Yasmeen said, adding that Rais Khan and TeestaSetalvad visited them till the trial continued andassured them that they will fulfill all commitmentsmade to them after the completion of thedeposition. Yasmeen was sent to Ahmedabadafter the trial and was kept in a house for fourmonths in Shaper Mill Compound.

    I was removed from the house the verynext day of the pronouncement of judgement.I came to know that in the name of Best BakeryCase and for arranging deposition of personslike us, Teesta has collected lakhs of rupeesand nothing was given to us, she said.

    With nowhere to go, Yasmeen returnedto her uncles house. The Best Bakery wasnow out of her reach because her husbandssecond wife lived there. After her maternaluncle refused to support her, some peopletook pity and contributed money to buy her ahut. Her misery did not end. She re-married,

    got pregnant and was then dumped by herhusband. Yasmeen now lives with her motherand two children.

    Accusing Rais Khan and TeestaSetalvad of cheating her, Yasmeen said, Bygiving false deposition in this case, I have notonly lost my ancestral property Best Bakery,which was in my possession and where Istarted living and earning my livelihood, butalso on the basis of false assurances, so manyinnocent persons got convicted. Because ofthis, I am feeling guilty and probably due tothis reason I am leading poor and sorrowfullife. I always repent why I did the wrong thingon the advice of a person like Teesta.

    She added that since the judgement ofthe Best Bakery Case has been delivered onthe basis of false testimonies, due to thisreason her affidavit be treated as a petition,and the case be re-heard so that now no poorperson can be bribed and misled by suchpeople and no innocent person is wronglypunished and the persons like TeestaSetalvad and Rais Khan be tried as per law,who by misleading and bribing poor, weak andunsupported persons like us, are managingfalse testimonies.

    New Delhi, April 26, 2011: Thesupplementary charge sheet, secondsince April 2 in the 2G spectrum allocationcase, filed by the Central Bureau of

    Investigation on Monday in a court here,dwells at length on the role Kanimozhi,Rajya Sabha MP and daughter of TamilNadu Chief Minister and DMK chief M.Karunanidhi, played in incorporatingKalaignar TV Private Ltd. along with otherpromoters.

    The 48-page charge sheet says Ms.Kanimozhi actively pursued with theintermediaries and the DMKheadquarters reappointment ofaccused A. Raja as the Minister forCommunications and InformationTechnology in 2009. This clearlyestablishes the strong association ofaccused Kanimozhi and A. Raja inthe official/political matters.

    The charge sheet saysinvestigations revealed that therewere a number of circumstances that

    together conclusively establish thatthe amount of Rs. 200 crore paid byDynamix Realty to Kalaignar TVthrough Kusegaon Fruits andVegetables P vt. Ltd. and CineyugFilms P vt. Ltd. was not a genuine businesstransaction but was in the nature of illegalgratification paid in lieu of the UnifiedAccess Service [UAS] Licences, valuablespectrum and other undue benefit givenby accused public servants to SwanTelecom Pvt. Ltd.

    The charge sheet keeps its focus onestablishing the money trail - the paymentof the illegal gratification of over Rs. 200crore to Kalaignar TV through a circuitousroute. It says investigations revealed thatfor all the transactions of more than Rs.200 crore among Dynamix Realty,Kusegaon Fruits & Vegetables Pvt. Ltd.,

    Cineyug and Kalaignar TV, claimed to be

    in the nature of loan, no valid agreementswere signed between any of the partiesand no collaterals/securities ensured tosecure the alleged loan amounts.

    The charge sheet states thataccused Asif Balwa and Rajiv B. Agarwal,directors of Kusegaon Fruits andVegetables Pvt. Ltd. (now KusegaonRealty Pvt. Ltd.), and Karim Morani,director of Cineyug Films Pvt. Ltd. (nowCineyug Media and Entertainment Pvt.Ltd.) in Mumbai, intentionally aided and

    facilitated the payment of an illegalgratification of Rs. 200 crore as a rewardfor undue favours shown to their groupcompany Swan Telecom to Kalaignar TVon behalf of Mr. Raja, Kalaignar TVdirector and 20 per cent equity holderSharad Kumar and Ms. Kanimozhi andgave it a colour of a regular businesstransaction.

    These facts and circumstancesconstitute commission of offence during2007-2011, punishable under Section120-B of the Indian Penal Code read withSection 7 of the Prevention of CorruptionAct, 1988 against A. Raja, Sharad Kumar

    and Kanimozhi, and Section 12 of the PC

    Act, 1988 against Shahid Balwa, VinodGoenka, Asif Balwa, Rajiv B. Agarwal andKarim Morani.

    The charge sheet sought to

    demolish the defence of the accused thatthe transactions of Rs. 200 crore amongDynamix Realty, Kusegaon Fruits &Vegetables Pvt. Ltd., Cineyug andKalaignar TV were genuine businesstransactions in the nature of loans/advances. It lists 14 circumstances insupport of the charge that the transaction

    amounted to illegal gratification.Refund of amountIt says the refund of the entire

    amount began after the CBIregistered the case. The refundstarted on December 23, 2010 andMr. Raja was asked to join the CBIprobe on December 24 and 25. OnJ anuary 24, 2011, Rs. 65 crore wasrefunded. An amount of Rs. 25 crorewas refunded on J anuary 29 and Rs.50 crore on February 2, 2011.

    During this time around, mediareports about the likely arrest of Mr.Raja started appearing and, onFebruary 2, 2011, he was arrested.

    The charge sheet says theentire paid-up equity of Kalaignar TV wasRs. 10.01 crore and its entire income(turnover) for the year ending March 31,2009, was only Rs. 47.54 crore. The paid-up equity of Cineyug during the sameperiod was only Rs. 1 lakh and that ofKusegaon Fruits & Vegetable Pvt. Ltd. ason March 31, 2009 was only Rs. 1 lakh.

    The charge sheet alleges that Rs.200 crore was paid by Dynamix Realty toKalaignar TV through intermediaries fromDecember 23, 2008 to August 7, 2009,after the offshore investments in SwanTelecom from Etisalat Mauritius Ltd., andGenex Exim Ventures Pvt. Ltd. came in

    on December 17, 2008. The funds fromwhich Kalaignar TV refunded Rs. 200crore to Cineyug partly came fromAnjugam Films Pvt. Ltd, said to be asubsidiary of Kalaignar TV.

    On the role of Ms. Kanimozhi, thecharge sheet says she was initially adirector and resigned only for the reasonthat her clearance from the Home Ministrywas pending and could take time anddelay the matter of launching KalaignarTV channel. Accused A. Raja was furtherpursuing the cause of Kalaignar TV notonly for getting registration of the companyfrom the Ministry of Information andBroadcasting but also for getting it in theTata Sky bouquet. Kanimozhi was astakeholder of Kalaignar TV to the tuneof 20 per cent equity and was an activebrain behind its operations. Ms.Kanimozhi was also widely covered by theKalaignar Seithigal (news) channel, itpoints out.

    On Mr. Karunanidhi's wife DayaluKarunanidhi, who is the 60 per centstakeholder in Kalaignar TV, the chargesheet says she was requested by theboard to act as director of the company.However, as per the minutes of the boardmeeting of J uly 27, 2007, she categoricallyinformed [it] that in view of her old ageand deteriorating health, she cannot beexpected to give any attention to thecompany's affairs and requested SharadKumar to exercise degree of skill whichmay reasonably be expected of a personof his knowledge, experience, calibre andstatus. She also informed the board thatdue to her age and non-understanding ofany language other than Tamil, afterappointment as Director, she will attend

    the meeting only to suffice the legalrequirement to have quorum and not foranything else, says the charge sheet.

    After his arrest in irregularities in thetiming, scoring and results contract for theCommonwealth Games, Kalmadi can bebooked for payments made to the UK firmfor hire of cars, screens and portabletoilets for the October 2009 function

    flagged off by the British Queen in London.No contract was entered into with thefirm on the plea that the OC had torespond to last-minute demands by Britishauthorities - an argument that is undoneby evidence that the organizers were intouch with Patel much earlier. Evidencehas also surfaced of Kalmadi himselfauthorizing payments to the firm quotingpaucity of time.

    Now, Patel could be an approver inthe two cases related the QBR contractregistered by CBI in November 2010. Atwo-member CBI team that went toLondon to question Patel, who is also ana c c u s e d ,and to gathero t h e re v id e n c esaid the

    "AshishPatel wasquestioned twice and he has given usimportant details on the whole contract.We showed him documents which wehave collected during investigations. Wetold him where he stands," said a source.Officials added that if Ashish Patel did notcooperate, CBI will soon begin theprocess for his extradition. As he is aBritish citizen, Patel cannot be arrestedby CBI but he was questioned at lengthon exchange of emails between arrestedOC officials Sanjay Mohindroo and T SDarbari, release of payments and the so-called contract. Patel could not explain thedocuments though CBI could not get astatement given his nationality.

    Patel is expected to submit his replyto the Scotland Yard police departmentwhich will pass it on to the CBI. "We havesubstantial evidence against Patel of hiscomplicity with Darbari and Mohindroo.Being an accused, he could turn approverdeclaring that he was also part of theconspiracy," said an official.

    Before questioning Patel, CBI tookpermission of UK's Serious Fraud Office.CBI is also hopeful the SFO will register acase against the car rental firm (AM Cars)for alleged overpricing.

    In its FIR, CBI stated, "It is allegedthat in relation to the QBR held on October29, 2009, the OC awarded the work oftransportation to the AM Car and Van HireLtd at exorbitantly high rates withoutfollowing the standard tender process."CBI has registered nine FIRs in different

    Welcoming the over 10,000

    participants in the Vaisakhi parade, theCanadian prime minister shouted the Sikhreligious slogan of 'Waheguruji Ka Khalsa,Waheguruji Ki Fateh' amid applause.

    British Columbia provincial premierChristy Clark, former Canadian healthminister Ujjal Dosanjh, Vancouver mayorGregor Robertson and many other leadersalso joined the Vaisakhi parade whichcarried the Sikh scripture from the city's100-year-old Ross Street Gurdwarathrough main thoroughfares.

    In fact, the mayor became the centre

    of attraction as he came dressed in ajersey of the city's national ice hockeyteam called the Canucks.

    Along the long procession, peopledressed in colourful clothes danced todrum beats as loudspeakers blared musicin the city's Little India area.

    Diane Watts, mayor of theneighbouring Sikh-dominatedcity of Surrey, walked in theprocession wearing colourfulsalwar-kameez.

    "Vaisakhi is an event thatis all about inclusion, it is allabout pride, it is all aboutfamilies, it is all about thosethings that we want for BritishColumbia (province)," saidWatts who went on an 11-daybusiness mission to India in

    February.Thousands of non-Sikhsalso joined the procession to have fun withthe community and feast on free food anddelicacies. People had set up free foodstalls along the route of the VaisakhiParade.

    Similar weekend Vaisakhiprocessions will also be taken out inSurrey and Toronto last this month.

    Though their exact numbers are notknown, Canada is home to about 400,000Sikhs. They were the first Indiancommunity to land in this country in theVancouver area in the 1890s.

    Speaking to media persons aftervisiting the venue for Tibetan YouthCongress ongoing relay huger strikeoutside Tsuglagkhang (Main TibetanTemple) here, the RSS leader also calledon China to hold dialogue with the Tibetangovernment in exile to resolve the issueof Tibet.

    China must at least immediatelystop environmental destructions takingplace in Tibet. Also it must end all religious

    A Bench of J ustices B. SudershanReddy and S.S. Nijjar, hearing petitionsfiled by the former Union Law Minister,Ram J ethmalani, and others, asked thegovernment to explain why itsinvestigation was focussed only on thePune-based businessman Hasan AliKhan and no other name hadcome out.

    J ustice Reddy toldSolicitor-General GopalSubramaniam: Theinvestigation requirescomplete and full-fledged

    involvement of all departments of thegovernment as the most importantquestion was about disclosure of thesource of money stashed [away] in foreignbanks. This could be terror money ormoney coming from drug peddling or fromsale of arms.

    J ustice Reddy said: Your wholefocus is centred on one individual. Doesit mean that all black money parked inforeign banks belong to only one person?Is it that the black money issue issurrounding around one person? Do youhave information beyond that?

    When the SG said different agencieswere investigating different aspects of thematter, J ustice Nijjar asked: Are alldepartment heads sleeping till now.

    J ustice Reddy asked the SG: Whyis the government not disclosing namesof others who had stashed [away] moneyin foreign banks. Is it that the black moneyissue is surrounding around only oneperson? We put it very simply and bluntly.Do you have any information regardingother persons also? It seems there is onlyone person [Indian] who has bank accountin Switzerland and no other person's

    account has come undersuspicion in Swiss banks.

    The SG denied thatthere was slackness on thepart of the government andsaid the court could ask theReserve Bank of India to file a

    report on black money stashed away inUBS bank, Switzerland, on the basis ofwhich further action could be taken. Thepassport case (against Hasan Ali) shouldbe investigated by the CBI as the offencein this regard was not restricted toMaharashtra but involved other States aswell. Pointing out the need for a specialinvestigation team to probe various aspectsof the matter, J ustice Reddy said: We arevery clear in our mind that more than oneagency is required to conduct investigationand it should be monitored by a person ofeminence which could be a retired ChiefJ ustice of High Court.

    The SG sought time to takeinstructions, even as senior counsel AnilDivan, appearing for the petitioner,reiterated the need for a SIT probe.
