NTEU UTS INFORMATION SHEET

PARENTAL LEAVE

What is it?A type of paid and unpaid leave that enables parents to care for their child/ren from expected date of birth or placement. Parental leave incorporates maternity leave, adoption leave, partner leave and foster parent leave. These entitlements are in both the UTS Support Staff and Academic Staff Agreements at clause 33 and 29 respectively.All ongoing staff maybe eligible for parental leave. At UTS the basic entitlement is 104 weeks unpaid parental leave, for the primary carer, from the expected date of birth or placement of a child, once the staff member has completed 40 weeks continuous service.

Paid Leave Maternity Adoption Partner Foster ParentEntitlement • up to 20 weeks on full

pay (can be taken at half pay), and

• 30 days paid leave that can be used as leave, phased return to work, professional/ career development projects, or a combination of all 3

• up to 20 weeks on full pay (can be taken at half pay), and

Follows from the birth or adoption of a child• 20 working days paid

leave, which can be taken at any time in the 3 month period following the birth of a child of their partner, or on taking custody of a child

Maximum in the following 12 month period from the time the foster child enters the staff member’s care:• 3 weeks at full pay or

6 weeks at half pay if the child < 5 years

• 8 days full pay or 3 weeks at half pay if the child is > 5 years

Eligibility Criteria Female staff member has completed 40 weeks continuous service prior to the expected date of birth

Primary carer has completed 40 weeks continuous service prior to the expected date of adoption

What do I do? Inform your supervisor that you intend to take this leave. You will require documentation indicating the expected date of birth, such as a medical certificate. You will also need to indicate you are the primary carer for the period of leave.

Fixed-term contractsYou can be granted paid or unpaid parental leave if the period of leave falls within the time span of your fixed-term appointment. If you are offered another appointment at the University, the leave can be extended into the new appointment.

Casual staff membersYou may be entitled up to 52 weeks unpaid parental leave from the date of birth or taking custody of a child.
