The 2009 reforms to New York’s Rockefeller Drug Laws included a requirement to study the impact
of these changes (see New York State Executive Law §837). This report details trends in arrests,
indictments and superior court informations (SCIs), prison commitments, and screening and
admission to felony drug court for felony drug and specified property offenses.1 Other reports on this
topic are posted to the DCJS website: www.criminaljustice.ny.gov.
Felony Drug Arrests, Indictments, and Commitments
The charts below present trends in felony drug arrests, indictments, and commitments across New
York City, large counties outside of NYC, and small counties outside of NYC.2 In New York City,
felony drug arrests, indictments, and commitments decreased dramatically from 2008 to 2016, with
commitments increasing slightly from 2015 to 2016. In large counties outside of NYC, arrests and
indictments declined from 2008 to 2015, then increased in 2016. Commitments declined from 2008
to 2013, then remained relatively stable. In small counties outside of NYC, felony drug arrests,
indictments, and commitments generally increased from 2008 to 2016.

Drug Offenders Under Custody
Over the past two decades, the decline in the total inmate population under custody is mostly
attributable to the decline in drug offenders under custody.

CPL Article 216: Judicial Diversion
The charts on Pages 5, 6, and 7 present screenings and admissions to felony drug court for
A216-eligible drug and specified property offenses. In New York City, felony drug court
screenings declined from 2010 to 2012, due in part to decreases in felony drug arrests, then
fluctuated through 2016. Felony drug court admissions peaked in 2010, declined through 2014,
and remained stable through 2016. In large counties outside of New York City, felony drug
court screenings and admissions declined after the initial spike in 2010, but continue to remain
higher than 2008, the year before the drug law changes took effect. In small counties outside of
New York City, felony drug court screenings peaked in 2012 and have been declining since
then. Admissions increased from 2008 to 2014, then decreased slightly through 2016.
Felony drug court screenings and admissions for A216-eligible arrests, by county, are presented
in Appendix G and Appendix H.

Conditional Sealing
CPL Article 160.58 authorized sealing of cases for drug-involved offenders who successfully
completed court-ordered substance abuse treatment. By December 2016, 491 cases had been
conditionally sealed. Cases sealed by county are presented in Appendix I. A regional summary
is presented below.
