GUIDELINES IN TIlE IMPLEMENTATIOOF TIlE COURT'S RESOLUTION INADMINISTRATIVE MAlTER NO. 05-3-35-SC

Pursuant to the Resolutions dated January 31, :'>'006 and March 11,2008, the Court En Bane NOTED (lnd GRAN'I'F<:Dthe Audit ObservationMemorandum of the Supreme Court Resident Auditor and DIRECTED theremittance of interests earned from the hduciary Fund andforfeited/confiscated bonds to the Bureau of Treasury in accordance withthe General Provisions of the General Appropriations AcL

In order to implement th(~abovementioned Resolutions of the Court,the following guidelines shall be observed beginning January 2009:

1. Interests from the fiduciary Fund aecount of all <:ourts, as well asforfeited/confiscated bonds, shall be deposited to the aeeount ofthe Bureau of Treasury;

2. At the end of each quarter, Clerks of Court shall: (a) withdraw theinteresLs and forfeited amounts; (b) issue an Oifici(ll Receipttherefore; and (c) remit the S(lme to the account of the Bureau ofTreasurv'- ,

3. The collections shall be deposited to the Land Bank of thePhilippines under the ae<.:Ountof the Bureau of Treasury. Heretoatt(lched (Annex "A") is the list of Clearing Account umlJei's tobe used in depositing the colleeLions in the Laud Bank of thePhilippines tOj!,cLherwith the preseribed form hercLo atta<;hed asAnnex "B". Also (ltLached as "Annex C" is the list of Area Codesprovided for by the Bureau of Treasury to be indic::ltcd in theprescribed form;

4. All existing time deposit and high-yielding savings accounts of thecourt for the fiduciary fund sh(ll1 immediately be closed and onlyone savinj!,s aewullt shall be maintained;

5. Clerks of Court arc requireu to maint(lill a separate ofiieial cashbook for the General Fund to record trans(leLions with the Bureauof Treasury, (lS well asa separate set of Official Rrceipts for thepurpose;

6. Clerks of Court are required to submit a quarterly financial reporton the collections of and deposits to the General Fund (seeattached form, Annex "1)") cluly Sl bserihec1 and sworn to 1y thePresic!ing/hxeeutive .Judge, <lltaching therewith a duplir.ate copyof the Official Receipts and a copy of the machine validateddeposit slip to the Aecoullting Division, Financial ManagementOffice, OCA, on or before the 10th day of the month following theclose of the quarter. Same reporl is required to be submitted tothe National Office, Bureau of Treasury, lnlramuros, Manila,attach ing therewi Ih the Certified True Copies of the OfficialReceipts and deposit slips;

7. In ease of eoufiscatcLi/forfeited bonds deposited in the localtreasurer's office, a court order shall be i, sued for the withdrawalof the amount. The Clerk of Courl shall subsequently withdrawthe amount, issue all Official Receipt for t~w Ceneral Fund anddeposit the sa me to the aceount of the Bu reau of TreaslI ry; and

8. In loealities where there are no !.Hi->Hranch, remittances to theBureau of Treasury shall he through Postal Money Order (PMO)[Jayable to the Chief Accountant, Accounting Division, FinancialManagement Oniee, OCA, SUlJreme Court of the Philippines.Costs of PMOs and other incidental cXjJenses are reimhursableafter submission of the documenta ry req uircrnents to the FinanceDivision, Finaneial Managell1ent Office, OCA ..

All Clerks of Court are enjoined to observe the foregoillg guidelines.F<lilllre to eomply with any of these rules and regulations shall meanwithholding of their s<llaries and allowances without prejudice to suchfurther disciplinary action the Court may take against thcll1.

This circular shall apply to all interests earned and bond'confiscated/forfeited beginning January 2009.

All Circulars and Issuances inconsistent with the foregoing rules arehereby amended.
