Opposition Grows to Visa, MasterCard SettlementAs reported in the September/October issue of Business Credit magazine, the proposed settlement in an antitrust case against Visa and MasterCard may have some dangerous side effects for merchants accepting credit cards. While the settlement would allow merchants to pass down their interchange fees to their customers via surcharge, other provisions have engendered a great deal of opposition from some increasingly higher-profile market advocates. Most recently, opponents to the settlement found powerful allies in both the National Retail Foundation (NRF) and the National Restaurant Association (NRA).

NRF’s complaints mirror those of existing opponents to the settlement like the National Association of Convenience Stores (NACS), the National Grocers Association (NGA) as well as mega-retailers Walmart, Target and Lowe’s. “The National Retail Federation categorically opposes the proposed settlement,” said NRF President and CEO Matthew Shay. “It does nothing to curb the anticompetitive behavior of Visa and MasterCard, and instead ensures that swipe fees paid by retailers and their customers will continue to rise while barring any future legal challenges. The proposal is a lose-lose-lose for merchants, consumers and competition.”

The NRA lent a bit more weight to their recent rejection of the settlement by way of a unanimous vote from their board of directors. “There is strong concern that the proposed settlement agreement will not achieve the litigation’s most critical goal—to fundamentally change a broken marketplace in which swipe fees are set,” said NRA President and CEO Dawn Sweeney. “The current payment system is so convoluted, the average restaurateur has no idea exactly what they are paying and why they are paying large amounts to accept credit and debit cards, which are necessary in today’s marketplace. The proposed settlement does not address those issues.”

Other provisions of the settlement include a $7.25 billion payment from Visa and MasterCard, given to merchants via temporary rate decreases as well as lump payments, and a stipulation that no suits on interchange fees can be brought against the two companies in the future if the agreement enters into force.

NACM of Louisiana has officially become a part of the NACM of South Texas family, and we couldn’t be happier to have you aboard!

All staff members are working hard on the transition, and soon you will begin to notice enhancements to the Association’s suite of offerings.

Many things will remain the same, including the continuation of existing credit groups and your existing NACM National Trade Credit Reports. Your Board of Directors will remain on as the Advisory Board, and Kathy Wall (your former Chairman of the Board) has stepped into the seat designated on the NACM of South Texas Board of Directors for a Louisiana member to ensure you are well represented.

You may have noticed enhancements in your NACM credit reports already, as we align the South Texas and the Louisiana data-bases to become one. Within the next few months, Louisiana members will have a new, more navigable website with additional features such as a Members Only section with downloadable forms and documents, The Knowledge Vault (where expert mem-bers offer one-on-one assistance) and an education calendar. The South Texas Scholarship Fund is now available to Louisiana members; over $18,200 was proudly distributed last year to members attending the NACM Credit Congress, All South Credit Conference, certification courses, and seminars and workshops.

A section dedicated to NACM Louisiana member news and activities has been added to the NACM of South Texas newsletter, Business Credit Pro, highlighting activities, meeting schedules, new members and events in Louisiana. Also, significantly more credit, collections and finance seminars and workshops will be held in the Louisiana area, including the Collections Workshops coming up on October 26th. Please support these offerings—we are so looking forward to expanding our new relationship and hearing, first-hand, how we are doing!

Collections will be provided by extremely capable NACM of South Texas staff, who are ready and eager to service Louisiana members with the same high performance and professionalism enjoyed by South Texas members.

Credit Managers’ Index for September The CMI for September was nearly the same as in August, falling only half a percentage point to 55.3. The gain made in the CMI in August showed an economy with an overall better performance than earlier in the year. The August 55.8 was the highest this year, except for the February number, which matched it. The sense was that some key areas were showing improvement. In short, the bounce first registered in August appears to be more secure than originally assumed. Slight shifts in some factors have implications for the next few months, but it can be asserted that the momentum from late summer is carrying forward into the fall.

There was a slight decline in the favorable factor index due mostly to a reversal of the sales number. It slipped from 62 to 59.5, marking the second lowest point reached in over a year after July’s 58.5. The rebound in August was expected to continue into September, but that was not the case for sales, and may be the most worrisome of the figures. Without some expansion in sales, the other categories may start to slump as well.

Unfavorable factors varied more than those of the favorable factor index. The unfavorable factor index sank from 53.1 to 52.6, making it largely responsible for the decline in the combined index. The shift was not all that drastic and far cry from the sub-50 readings from just a month ago, but expectations were that the numbers would improve. All factors remain above 50, but some of them took a dip and are a lot closer to contraction territory.
