As San Diego continues to review and craft policies to produce more housing and to make housing more affordable, the use of public land for affordable housing can be one tool in the arsenal of options. On January 19, 2017, I recommended that the City explore new opportunities for affordable housing production on City- and other publicly-owned land. Using publicly controlled lands for housing development would be an important step in City policy and would move us one step further toward meeting affordable housing goals for all residents of San Diego. On November 8, 2017, I received from the Real Estate Assets Department, a list of City- owned parcels (except for parks/open space) that are vacant or undeveloped, varying in size, zoning and surplus designation. Additionally, a listing of month-to-month and held-over agreements was provided. These properties present an opportunity to tangibly address San Diego’s shelter crisis by providing opportunity sites for additional housing production and the potential to reduce development costs.

Page 2 Review of City-owned land for Housing January 8, 2018 Steps have already been taken at the state level to pressure cities to reserve public lands for affordable housing. In 2014, Assembly Bill 2135 was passed that compels land-owning public agencies to give a first right of refusal for affordable-housing development, and even encourages public agencies to sell their lands below market value to make affordable-housing development as viable as possible. San Diego must do more to take either the intent or the letter of AB 2135 seriously. The purpose of this memorandum is to request that the Mayor and appropriate City departments, in partnership with the San Diego Housing Commission and Civic San Diego, perform the following:

• Conduct a formal review of underutilized properties to establish a portfolio of housing opportunity sites. The review should include all city-owned or city-controlled parcels (attached) for their potential for housing. Additionally, all city properties that have been deemed surplus and identified for sale should undergo a formal review by the San Diego Housing Commission and Civic San Diego for housing development potential, including initial site analysis. The site analysis should include:

o optimizing land utilization; consideration of rezoning to increase density, particularly around transit opportunity areas

o redeveloping underutilized parcels of land o incentivizing adaptive reuse (i.e. adapting disused commercial and industrial

zones and City sites for residential use) o infilling vacant lots.

• Evaluate the effectiveness of the City’s existing real estate disposition processes and

policies (i.e. Council Policy 700-10: Disposition of City-Owned Real Property) in producing affordable housing. The City must be more aggressive in securing a portfolio of public sites for this purpose. The policies should be updated to prioritize affordable housing production and maximize capacity and housing potential by soliciting development proposals. It is even more critical that we do not give away land we already have nor should sites simply be sold off to a highest bidder. Publicly owned sites create a unique opportunity for the City to get closer to meeting its housing obligations.

• Identify all city-owned parcels with zoning that allows for multifamily uses. These parcels could be sold or ground-leased to developers for the construction of affordable housing including housing for homeless individuals.

• Identify long-standing nuisance properties, often run-down motels and/or dilapidated or abandoned residential buildings. Cities across the nation have compelled the owners of nuisance properties to correct those conditions. If the owner fails to do so, the municipality can step in and correct, or abate, the conditions itself. This process is known as nuisance abatement. Nuisance abatements have presented unique opportunities to provide affordable housing and have helped to restore the quality of life in neighborhoods.

• Explore partnerships with Civic San Diego, the San Diego Housing Commission, the County, SANDAG, MTS, SDUSD, and other public agencies to advocate for ground leases of public property to private affordable and moderate income housing developers or the establishment of Community Land Trusts.

Page 3 Review of City-owned land for Housing January 8, 2018 Lastly, as new discussions get under way about the potential development of the City's San Diego County Credit Union Stadium (“Qualcomm Site”), Valley View Casino Center (“Sports Arena Site”), the Chargers Training Facility, and as more and more City properties move through the process of being classified as surplus and advertised broadly on the open market, it is more important than ever to establish a firm policy that underutilized publicly owned lands, a scarce and precious public resource, go toward achieving the City's critical affordable-housing needs. The City needs to be very clear that there is a priority for a housing on every suitable public site.
