The Additional Commissioner of Commercial Taxes (Enforcement) South Zone, is inviting Tenderfor supply of Wireless set and TV screen under sealed cover system from reputed dealers registeredin the Karnataka State. The bidder, having sufficient experience and wherewithal to supply all theitems listed in the following table only required to apply.

• GENERAL INFORMATION

1. The bidder should be a registered tax payer under the provisions of the Karnataka Goodsand Services Act, 2017 and should furnish satisfactory evidences for having registered underthe provisions of the said Act. He should be an up-to date filer of the returns under the saidAct.

2. The price of the products to be quoted should include all taxes and statutory levies. No extraamount of tax or s atutory levies will be paid in the event of upward revision of the rate oftaxes. On the other hand, if there is down ward revision of the tax rate during theintervening period, the tax amount will be restricted to the extent of revised rate.

3. The bidder should also be registered under any other statutes required of him.4. The successful bidder should provide after sales service for at least one year.5. The warranty/ Guarantee for the product supplied shall be as specified by the original

equipment man~acturer and in the event of any defects in functioning of the productssupplied, the successful bidder should ensure repair or replacement of the product duringwarranty period.

6. The products should be brand new and strictly conform to the technical specifications setout in this document.

7. Alternative tender will not be considered.8. Tender awarded is non-transferable. The successful bidder should not sub-contract the

supply. In such as case the bidder is deemed to be disqualified from the anterior date.9. Conditional tenders are liable for rejection.10. Tenders without or insufficient amount of EMD will be rejected outright.11. Intending tenderers can have detailed information from the office during office hours. The

Additional Commissioner of Commercial Taxes (Enforcement), South Zone, Bengalurureserves the right to reject any or all tenders without assigrilng' any reason.

12. Security deposit as prescribed in the contract' docurhe-nf would be t returned to theunsuccessful bidder after finalization of the tender process within three months,

13. The bidder/agency shall submit their quotations in the format given in Part-I of the tenderdocument.

14. In case more than one agency stands L1, firstly, agency which is registered under theprovisions of Indian Companies Act will get preference. The Limited Liability Partnershipconcern, the Private Limited Company, the Partnership Concern and the Proprietary concernwill be next in order of preference. Secondly, the agencies having higher turnover will getpreference over others. '

15. For all the disputes arising out of the agreement the jurisdiction of the court shall be atBangalore for both the parties.

16. The successful bidder will be fully and solely responsible for any violations under therelevant statutes and any such violation will be a breach of contract and the Department atits discretion, may cancel the contract. The successful bidder shall also be liable for anypecuniary liability arising on account of any violation of anyof the provisions of the relevantlaws.

17. In case of any ambiguity or doubts with regard to the terms, clauses used in the tenderdocuments, clarifications should be sought in writing before submitting the tenders, failingwhich, the decision of the Department in all such matters shall be final and binding on theservice provider.

18. The scope of service is liable for alteration by way of deletions or additions at the discretionof the Department.

19. In case any dispute or difference arises between the Department or its representative andthe successful bidder on any matter within the scope of this contract, then either party shallforthwith give written notice of such dispute or difference to the other party and suchdispute or difference shall be referred to the Commissioner of Commercial Taxes(Karnataka), whose decision will be final

20. If any loss or damage is caused to the Department by non-compliance of the obligationsunder this agre ment by the successful bidder, he is liable to make good such losses and theDepartment shall be entitled to recover the same from the bidder.

21. Tender documents shall be submitted manually in sealed cover to the office of theAdditional Commissioner of Commercial Taxes (Enforcement), South lone, VTK-2,Koramangala, Bengaluru-47 during office hours.

22. Final acceptance of the tender rests with the Additional Commissioner of Commercial Taxes(Enforcement\ S.l, Bengaluru who reserves the right to accept or reject any or all tenderswithout assigning any reason therefor.

23. Submission of the tender by the bidder implies that the conditions of contract have beenread and is aware of the scope of the supply.

24. Tenders will be opened in the presence of bidder or their authorized representatives on thedate and time specified here in.

25. Tenders not submitted in the prescribed form will be rejected. Tenders which propose anyalterations in the supply specified or containing other conditions of any sort will be rejected.

26. Unsuccessful/rejected Bidder's EMD shall be refunded within three months.27. The successful bidder shall attend the office on a date to be fixed and intimated to him for

executing agreement etc. failure on the part of the successful bidder to execute the contractagreement within 1 week from the receipt of written communication of letter of acceptanceto this effect, would entail rejection ofthe bid and forfeiture of EMD
