A RESOLUTION FORWARDING THE COMMilTEE REPORT OF THE COMMilTEE ON FINANCE AND APPROPRIATION TO THE OFFICE OF THE COMMISSION ON AUDIT (COA), SANTA ROSA OFFICE THRU SUPERVISING AUDITOR MS. ELENA L. LUARCA REQUESTING OPINION ON WHETHER RE-ALIGNMENT FOR THE 20% DEVELOPMENT FUND IS ALLOWED.

WHEREAS, the City Development Council submitted a Resolution to the Sangguniang Panlungsod recommending the re-alignment of appropriation of various projects from previous years under the 20% Development Fund for the purchase of Medical Equipment for the Santa Rosa Community Hospital;

WHEREAS, the Committee on Finance and Appropriation submitted its report in the session of the Sangguniang Panlungsod and made an integral part of this Resolution and marked as "ANNEX";

NOW, THEREFORE, on a motion duly seconded by: ·

HEREBY RESOLVED, as it is hereby RESOLVED to forward the Committee report of the Committee on Finance and Appropriation to the Office of the Commission on Audit (COA), Santa Rosa Office thru Supervising Auditor Ms. Elena L. Luarca requesting opinion on whether re-alignment for the 20% development fund is allowed.

That, the Committee on Finance and Appropriation received the Resolution of the City Development Council last November 05, 2015.

That, a CommittP.e Hearing was held last November 23, 2015 at the SP Session Hall Gallery. Present during the hearing were Hon. Edward Tiongco- SP Chairman Committee on Finance & Appropriation, Hon, Petronio Factoriza- Committee Vice Chairman, Committee Members; Hon. Antonia Laserna,; Hon. Raymond Ryan Carvajal; Hon. Mythor Cendana; and Hon. Laudemer Carta. City Councilors: Hon. Ma. Theresa Aala and Hon. LuisitoAlgabre. M_r. Celso Catindig- GSO Head; Mr. Ermin Lucino- CPDO Head; Ms. Gina Madin- CPDO; Mr. Angel Amarante- Engineering Office. Stakeholders: Mr. Cris Entena; Ms. Teresita Lijauco and Former Board Member Emil Tiongco.

That, the Sangguniang Panlungsod received a letter from Dr. Parnell Patacsil, Chief of the Santa Rosa Community Hospital expressing his regret for he and Dr, Mavez cannot attend the hearing since they have a scheduled meeting with the Department of Health.

That, the following forms part of the discussion of the body:

1. The 20% development fund from the previous years were not fully utilized since there were projects charged to the development fund that were disallowed by the Commission on Audit.

2. DILG Memorandum Circular 2010-138 dated December 02, 2010, states that purchase of medical equipment can be charged to Development Fund.

3. The list of medical equipment purchased by the SRCH is not yet available because GSO is still working on the AOM received from COA for the four ( 4) Billion worth of physical assets of the City Government There are items on hand but is not recorded and there are items recorded but cannot be found. GSO is doing its physical inventory by department and they haven't inspected the SRCH. So far they already traced some items with an estimate value of 2.7 billion.

4. The copy of the breakdown of 20% development fund for hospital equipment shows the items to be purchased, name of the supplier, quantity and the amount. GSO said that the equipment is still undelivered and the form submitted were just canvass done by the end-user. That is still not final.

5. The Committee finds the form not acceptable as a canvass paper.

That, as per Committee's findings, DILG Memorqndum does not states that re-alignment is allowed for the use of the 20% Development Fund.

That, the Committee is considering Section 287 of the Local Government Code which states that :

Every LGU Shall appropriate in its annual budget no less than twenty percent (20%) of its annual internal revenue allotment for development projects.

That, the re-alignment proves that the City Government was not able to utilize the 20% Development Fund for the last few years as required by the law.

After careful review and evaluation, the Committee recommends to make a query to the Commission on Audit if re-alignment for the 20% Development Fund is allowed

WHEREAS, the Annual Investment Program·(AIP) which was approved by the City Development Council and was submitted to the Saagguniang Panlungsod and was authorized pursuant to the provision of Republic Act (RA) no. 7160 otherwise known as the Local Government Code of 1991;

WHEREAS, the body approved and prioritized the proposed project based on the social condition of the City of Santa Rosa marked as annex "A";

WHEREAS, there is an urgent need for the purchase of medical equipment but the Santa Rosa Community Hospital has insufficient appropriat~cal equipment this year;

WHEREAS, as per DILG Memorandum ircular 2010-13 dated December 2, 2010 the purchase of medical equipment, can be charged to D und;

NOW, THEREFORE, for and · in consideration of the above premises, the City Development Council hereby approves, the re-alignment of appropriation for various projects from previous years for the purchase of Medical Equipment amounting to sixteen million eight hundred seventeen thousa~d two hundred fifty pesos (Php 16,817,250.00) under social services for this year. ·
