    lawsuit, an officer of the V illage of A tw ood P olice D epartm ent.     FACTS7. At approximate ly 5:35 P .M, . O T! June 7,2009, th e Plaintiff was driving west on Rt 36,8. T I H l t at said time and place, the Defendant stopped the Plaintiff's vehicle in the 100 block

    o f S outh M a in S treet an d a pproac hed th e d riv er's s id e window.9 , The indiv idual Defendant then checked w ith dispa tch ttl confirm tha t there w as no

    outstanding order of protection pertaining to the Plaintiff. Upon his confirmation. the Plaintiffpassen ger exited th e v eh icle an d w alked tow ard s the p atro l ca r. T he in div id ual Defendant orderedth e P la in tiff b ac k in with the t hr ea t o f a rr es t if he did not return.

    10. The Defendant then informed the Plaintiff that he would be under arrest. The Plaintiff

    sat in h is v ehicle, buckled his seatbelt and attem pted to shut the door.1 1 . That w hile the P lain tiff w as in the v ehicle, the indiv idual Defendant m aced him in the

    face, intending to punish the Plaintiff and cause him to s u ff er phys ic a l pain, f or h is o bs tin an ce .J 2 . T ha t th ro ug ho ut th e in cid en t, th e P la in tiffw a s unarmed, had no w eapon of any kind , and

    did not offer any physical resistance.13. That as a result of the physical contact atoresald, the Plaintiff was injured. suffered

    severe emotional and mental stress, suffered great pain and anguish and continues to suffer mentalend emotional distress as the result of this conduct.

    14. That in addition to the aforesaid . the D efendant, in an attem pt to justify his conduct ofa rr es tin g P la in tif f p re se nte d to the State's A ttorney charges of rensting/obstructmg a p ea ce o ff ic er.T he p lain tiff w as nev er charged with u c rim e .
