The information brochure "National law relating to the EPC" has been revised in agreement with the EPC contracting states and the validation and extension states. The 18th edition of this brochure (October 2017) is available only online as a printable PDF file on the EPO website.

La brochure d'information "Droit national relatif à la CBE" a été révisée en accord avec les États contractants de la CBE ainsi que les États autorisant l'extension ou la validation. The HTML version has likewise been expanded to include the new information on the validation states. Information can now be displayed in parallel for up to three states from either the group of 38 contracting states or the group of 12 other states (i.e. the two validation states, the two extension states and the eight former extension states).

November 2015 hat das Europäische Patentamt (EPA) ein Pilotprogramm gestartet, um zu testen, ob und in welchem Maße ein neues Informationsblatt ("Informationen zur Recherchenstrategie") mit zusätzlichen Informationen zu der vom Prüfer durch-geführten Recherche für die Anmelder und für Dritte von Nutzen ist.1

On 1 November 2015, the European Patent Office (EPO) launched a pilot programme aimed at testing whether and to what extent a new information sheet ("Information on Search Strategy") containing additional information regarding the search performed by the examiner could be useful to applicants and third parties.1

3. In view of the high levels of satisfaction expressed by users during the pilot phase, the EPO has decided to fully implement the programme as a permanent service as from 1 January 2018. This service is considered to increase transparency by providing details of the key aspects of the search strategy employed, and thus to enable users and third parties to make more in-depth assessments of the search.

The European Patent Office (EPO) and the Canadian Intellectual Property Office (CIPO) have decided to extend the comprehensive Patent Prosecution Highway pilot programme.

L'Office européen des brevets (OEB) et l'Office de la propriété intellectuelle du Canada (OPIC) ont décidé de prolonger le programme pilote "Patent Prosecution Highway" (PPH) complet.

Mit dem "Patent Prosecution Highway" (PPH) werden die in den Ämtern bereits praktizierten beschleunigten Patent-prüfungsverfahren so gebündelt, dass die Anmelder schneller und effizienter korrespondierende Patente erlangen können. Die Ämter können ihrerseits die Arbeitsergebnisse des jeweils anderen Amts nutzen.

The Patent Prosecution Highway (PPH) leverages fast-track patent examination procedures already available at the offices to allow applicants to obtain corresponding patents faster and more efficiently. It also permits each office to exploit the work previously done by the other office.

Le PPH s'appuie sur les procédures d'examen accéléré de brevets déjà mises en œuvre dans ces offices afin de permettre aux demandeurs d'obtenir les brevets correspondants de manière plus rapide et plus efficace. Mit Wirkung vom 6. Januar 2018 wird das PPH-Pilotprogramm zwischen EPA und CIPO verlängert für einen Zeitraum von drei Jahren bis 5. Januar 2021. Die nachstehend genannten Teilnahmevor-aussetzungen gelten für PPH-Anträge, die ab 6. Januar 2018 beim EPA einge-reicht werden.

With effect from 6 January 2018 the PPH pilot programme between the EPO and CIPO is extended for a period of three years ending on 5 January 2021. The requirements laid forth below will apply to PPH requests filed with the EPO on or after 6 January 2018.

EPA und CIPO werten die Ergebnisse aus und entscheiden dann, ob und wie das Programm nach dem Versuchszeit-raum implementiert werden soll. Dieser kann bei Bedarf verlängert werden, um die Umsetzbarkeit des PPH-Programms angemessen beurteilen zu können. Bei zu hohem Aufkommen, aber auch aus anderen Gründen kann das EPA das Pilotprogramm auch vorzeitig beenden. Für den Fall, dass es vor dem 5. Januar 2021 beendet werden sollte, ergeht eine entsprechende Bekanntmachung.

The EPO and CIPO will evaluate the results of the pilot programme to determine whether and how the programme should be fully implemented after the trial period. The trial period may be extended if necessary to adequately assess the feasibility of the PPH programme. The EPO may also terminate the PPH pilot programme early if the volume of participation exceeds a manageable level, or for any other reason. Notice will be published if the PPH pilot programme between the EPO and CIPO is terminated before 5 January 2021.

L'OEB et l'OPIC analyseront les résultats du programme pilote pour déterminer s'il doit être mis en œuvre au terme de la période d'essai et, dans l'affirmative, selon quelles modalités. The EPO understanding of the PPH is that an application is processed in an accelerated manner on the basis of a patentability assessment made by another office. Where the EPO has been ISA and/or IPEA, the PCT WO/ISA or IPER have effectively the same status as a first communication in substantive examination before the EPO as DO/EO. Thus, in this case there is no work product that can be considered as work done by "another" office. Mit Wirkung vom 6. Januar 2018 wird das PPH-Pilotprogramm zwischen EPA und ILPO verlängert für einen Zeitraum von drei Jahren bis 5. Januar 2021. Die nachstehend genannten Teilnahmevor-aussetzungen gelten für PPH-Anträge, die ab 6. Januar 2018 beim EPA einge-reicht werden.

With effect from 6 January 2018 the PPH pilot programme between the EPO and ILPO is extended for a period of three years ending on 5 January 2021. The requirements laid forth below will apply to PPH requests filed with the EPO on or after 6 January 2018.

The EPO and ILPO will evaluate the results of the pilot programme to determine whether and how the programme should be fully implemented after the trial period. The trial period may be extended if necessary to adequately assess the feasibility of the PPH programme. The EPO may also terminate the PPH pilot programme early if the volume of participation exceeds a manageable level, or for any other reason. Notice will be published if the PPH pilot programme between the EPO and ILPO is terminated before 5 January 2021.

Sind alle oben genannten Voraus-setzungen erfüllt, wird dem Antrag auf Teilnahme am PPH-Pilotprogramm stattgegeben, und die EP-Anmeldung wird beschleunigt bearbeitet. Sind nicht alle oben genannten Voraussetzungen erfüllt, wird der Anmelder auf die in seinem Antrag festgestellten Mängel hingewiesen. Der Anmelder erhält einmal die Gelegenheit, formale Mängel im Antrag zu berichtigen. Wird der Antrag nicht berichtigt, wird die Anmeldung aus dem PPH-Pilot-programm genommen, und der Anmelder wird entsprechend informiert.

When the requirements set forth above are met, the request for participation in the PPH pilot programme will be granted and the EP application will be processed in an accelerated manner. In those instances where the request for participation in the PPH pilot programme does not meet all the requirements set forth above, the applicant will be notified and the defects in the request will be identified. The applicant will be given one opportunity to correct formal deficiencies identified in the request. If the request is not corrected, the application will be taken out of the PPH programme and the applicant will be notified.

Mit Wirkung vom 6. Januar 2018 wird das PPH-Pilotprogramm zwischen EPA und IMPI verlängert für einen Zeitraum von zwei Jahren bis 5. Januar 2020. Die nachstehend genannten Teilnahmevor-aussetzungen gelten für PPH-Anträge, die ab 6. Januar 2018 beim EPA einge-reicht werden.

With effect from 6 January 2018 the PPH pilot programme between the EPO and IMPI is extended for a period of two years ending on 5 January 2020. The requirements laid forth below will apply to PPH requests filed with the EPO on or after 6 January 2018.

The EPO and IMPI will evaluate the results of the pilot programme to determine whether and how the programme should be fully implemented after the trial period. The trial period may be extended if necessary to adequately assess the feasibility of the PPH programme. The EPO may also terminate the PPH pilot programme early if the volume of participation exceeds a manageable level, or for any other reason. Notice will be published if the PPH pilot programme between the EPO and IMPI is terminated before 5 January 2020.

For example, where the OEE claims only contain claims to a process of manufacturing a product, then the claims in the EP application are not considered to sufficiently correspond if the EP claims introduce product claims that are dependent on the corresponding process claims. The applicant is required to declare that the claims between the EP and the OEE applications sufficiently correspond.

Die jährliche EPA-Veranstaltung "Search Matters" findet das nächste Mal vom 23. bis 25. April 2018 in Den Haag statt. Sie bietet Fachleuten auf dem Gebiet der Patentrecherche die einzigartige Gelegenheit, Einblicke in die Recherchenstrategien und -methoden des EPA zu gewinnen und mehr über fachspezifische Recherchen zu erfahren.

The latest in the EPO's "Search Matters" series of annual training events will be held in The Hague from 23 to 25 April 2018. This event provides patent search professionals with a unique opportunity to gain an insight into the EPO's search strategies and techniques and to learn more about industry-specific searches.

La prochaine édition de "Search Matters", un séminaire de formation annuel organisé par l'OEB, se tiendra à La Haye du 23 au 25 avril 2018. Cet événement offre aux professionnels de la recherche de brevets une occasion unique de se familiariser avec les stratégies et techniques de l'OEB en matière de recherche et d'en savoir plus sur les recherches adaptées à des domaines précis.

At a total of 25 workshops run by patent examiners, participants will be able not only to take a closer look at a wide range of topics including using search strategies on Espacenet, CPC, Asian prior art, searching cross-technology inventions and dealing with lack of unity, but also to find out more about free search tools such as Google Patents and explore the complexities of searching in chemical or biotechnological fields.

Les 25 ateliers, dirigés par des examinateurs de brevets, permettront aux participants non seulement d'approfondir de nombreux sujets tels que l'utilisation des stratégies de recherche sur Espacenet, la CPC, l'état de la technique asiatique, la recherche pour des inventions à technologies multiples et le traitement des questions relatives à l'absence d'unité, mais aussi d'en apprendre davantage sur les outils de recherche gratuits, tels que Google Patents, et de passer en revue les difficultés liées à la recherche dans les domaines de la chimie ou des biotechnologies.

Der derzeit aktuelle Gebührenhinweis ergibt sich aus ABl. EPA 2016, A26. Bitte beachten Sie auch die neuen Vorschriften über das laufende Konto (VLK) und ihre Anhänge (in der geltenden Fassung vom 1. Dezember 2017, Zusatzpublikation 5, ABl. EPA 2017), und die Einführung der Zahlung mittels Kreditkarte (s. ABl. EPA 2017, A72 und A73).

The fees guidance currently applicable is set out in OJ EPO 2016, A26. In addition, please note the new arrangements for deposit accounts (ADA) and their annexes (valid as from 1 December 2017 - supplementary publication 5, OJ EPO 2017) and the new method of fee payment by credit card (see OJ EPO 2017, A72 and A73).

The Romanian State Office for Inventions and Trademarks has informed us that the amounts in Romanian currency of the following patent fees have been changed.1

Considering that the PCT Assembly, having heard the advice of the PCT Committee for Technical Cooperation, has appointed the European Patent Office as an International Searching and Preliminary Examining Authority under the Patent Cooperation Treaty and approved this Agreement in accordance with Articles 16(3) and 32(3),

d) "Artikel" einen Artikel des Vertrags (sofern nicht spezifisch auf einen Artikel dieser Vereinbarung Bezug genommen wird),

(d) "Article" (except where a specific reference is made to an Article of this Agreement) means an Article of the Treaty;

(e) "Rule" means a Rule of the Regulations;

h) "Internationales Büro" das Internatio-nale Büro der Weltorganisation für geis-tiges Eigentum.

(2) Alle anderen in dieser Vereinbarung verwendeten Begriffe und Bezeich-nungen, die auch im Vertrag, in der Ausführungsordnung oder den Verwal-tungsvorschriften vorkommen, haben im Rahmen dieser Vereinbarung die-selbe Bedeutung wie im Vertrag, in der Ausführungsordnung und den Verwal-tungsvorschriften.

(2) All other terms and expressions used in this Agreement which are also used in the Treaty, the Regulations or the Administrative Instructions have, for the purposes of this Agreement, the same meaning as in the Treaty, the Regulations and the Administrative Instructions.

(1) Die Behörde führt nach Maßgabe des Vertrags, der Ausführungsordnung, der Verwaltungsvorschriften und dieser Vereinbarung die internationale Recher-che und die internationale vorläufige Prüfung durch und nimmt alle anderen Aufgaben einer Internationalen Recher-chenbehörde und einer mit der inter-nationalen vorläufigen Prüfung beauf-tragten Behörde wahr, die in den genannten Texten vorgesehen sind.

(1) The Authority shall carry out international search and international preliminary examination in accordance with, and perform such other functions of an International Searching Authority and International Preliminary Examining Authority as are provided under, the Treaty, the Regulations, the Administrative Instructions and this Agreement.

1) L'Administration procède à la recherche internationale et à l'examen préliminaire international conformément aux dispositions du traité, du règlement d'exécution, des instructions administratives et du présent accord et assume toutes autres fonctions confiées aux administrations chargées de la recherche internationale et aux administrations chargées de l'examen préliminaire international en vertu de ces dispositions.

(2) Bei der Durchführung der interna-tionalen Recherche und der interna-tionalen vorläufigen Prüfung ist die Behörde zur Anwendung und Beach-tung der gemeinsamen Regeln für die Durchführung der internationalen Recherche und der internationalen vor-läufigen Prüfung verpflichtet und ins-besondere gehalten, nach den Richt-linien für die internationale Recherche und die internationale vorläufige Prü-fung nach dem Vertrag über die inter-nationale Zusammenarbeit auf dem Gebiet des Patentwesens vorzugehen.

(2) In carrying out international search and international preliminary examination, the Authority shall apply and observe all the common rules of international search and of international preliminary examination and, in particular, shall be guided by the PCT International Search and Preliminary Examination Guidelines.

2) Pour procéder à la recherche internationale et à l'examen préliminaire international, l'Administration applique et observe toutes les règles communes à la recherche internationale et à l'examen préliminaire international et se conforme notamment aux Directives concernant la recherche internationale et l'examen préliminaire international selon le PCT.

(3) Die Behörde unterhält ein Qualitäts-managementsystem, das den Anfor-derungen der Richtlinien für die inter-nationale Recherche und die interna-tionale vorläufige Prüfung nach dem Vertrag über die internationale Zusam-menarbeit auf dem Gebiet des Patent-wesens genügt.

(3) The Authority shall maintain a quality management system in compliance with the requirements set out in the PCT International Search and Preliminary Examination Guidelines.

(4) Die Behörde und das Internationale Büro unterstützen sich gegenseitig in dem Ausmaß, das von beiden, der Behörde und dem Internationalen Büro, als angemessen angesehen wird, bei der Durchführung ihrer jeweiligen Auf-gaben aufgrund des Vertrags, der Aus-führungsordnung, der Verwaltungsvor-schriften und dieser Vereinbarung.

(4) The Authority and the International Bureau shall, having regard to their respective functions under the Treaty, the Regulations, the Administrative Instructions and this Agreement, render, to the extent considered to be appropriate by both the Authority and the International Bureau, mutual assistance in the performance of their functions thereunder.

(1) The Authority shall act as International Searching Authority for any international application filed with the receiving Office of, or acting for, any Contracting State specified in Annex A to this Agreement, provided that the receiving Office specifies the Authority for that purpose, that such application, or a translation thereof furnished for the purposes of international search, is in the language or one of the languages specified in Annex A to this Agreement and, where applicable, that the Authority has been chosen by the applicant and that any other requirements regarding such applicationas specified in Annex A to this Agreement have been met.

The Authority shall not be obliged to search, by virtue of Article 17(2)(a)(i), or examine, by virtue of Article 34(4)(a)(i), any international application to the extent that it considers that such application relates to subject matter set forth in Rule 39.1 or 67.1, as the case may be, with the exception of the subject matter specified in Annex C to this Agreement.

(1) In Anhang D dieser Vereinbarung ist ein Verzeichnis aller Gebühren der Behörde und aller sonstigen Kosten enthalten, die sie in ihrer Eigenschaft als Internationale Recherchenbehörde und mit der internationalen vorläufigen Prüfung beauftragte Behörde in Rech-nung stellen kann.

(1) A schedule of all fees of the Authority, and all other charges which the Authority is entitled to make, in relation to its functions as an International Searching Authority and International Preliminary Examining Authority, is set out in Annex D to this Agreement.

(3) The Authority shall, under the conditions and to the extent set out in Annex D to this Agreement, refund the whole or part of the preliminary examination fee paid where the demand is considered as if it had not been submitted (Rule 58.3) or where the demand or the international application is withdrawn by the applicant before the start of the international preliminary examination.

Zusätzlich kann die Behörde gemäß den Regeln 43.3 und 70.5 die Klassifikation der Gegenstände auf der Grundlage einer anderen, in Anhang E dieser Vereinbarung angegebenen Patent-klassifikation in dem von ihr festge-legten und in diesem Anhang vorgese-henem Umfang angeben.

For the purposes of Rules 43.3(a) and 70.5(b), the Authority shall indicate the classification of the subject matter according to the International Patent Classification. The Authority may, in addition, in accordance with Rules 43.3 and 70.5, indicate the classification of the subject matter according to any other patent classification specified in Annex E to this Agreement to the extent decided by it as set out in that Annex.

For the purposes of correspondence, including forms, other than with the International Bureau, the Authority shall use the language or one of the languages indicated, having regard to the language or languages indicated in Annex A and to the language or languages whose use is authorized by the Authority under Rule 92.2(b), in Annex F.

Geltungsdauer und Verlängerung Duration and Renewability Durée et renouvellement

Diese Vereinbarung gilt bis zum 31. Dezember 2027. Spätestens im Juli 2026 nehmen die Vertragsparteien dieser Vereinbarung Verhandlungen über eine Verlängerung auf.

This Agreement shall remain in force until December 31, 2027. The parties to this Agreement shall, no later than July 2026, start negotiations for its renewal.

Änderung Amendment Modification

(1) Unbeschadet der Absätze 2 und 3 kann diese Vereinbarung vorbehaltlich der Zustimmung der Versammlung des Verbands für die internationale Zusam-menarbeit auf dem Gebiet des Patent-wesens von den Vertragsparteien im gegenseitigen Einvernehmen geändert werden; die Änderungen werden zu dem einvernehmlich festgelegten Zeit-punkt wirksam.

(1) Without prejudice to paragraphs (2) and (3), amendments may, subject to approval by the Assembly of the International Patent Cooperation Union, be made to this Agreement by agreement between the parties hereto; they shall take effect on the date agreed upon by them.

(ii) for any change in the currency or amount of fees or charges contained in Annex D, for any addition of new fees or charges, and for any change in the conditions for and the extent of refunds or reductions of fees contained in Annex D, that date is at least two months later than the date on which the notification is received by the International Bureau.

(1) Diese Vereinbarung tritt vor dem 31. Dezember 2027 außer Kraft,

ii) wenn der Generaldirektor der Weltor-ganisation für geistiges Eigentum gegenüber der Europäischen Patent-organisation diese Vereinbarung schrift-lich kündigt.

(ii) if the Director General of the World Intellectual Property Organization gives the European Patent Organisation written notice to terminate this Agreement.

(2) The termination of this Agreement under paragraph (1) shall take effect one year after receipt of the notice by the other party, unless a longer period is specified in such notice or unless both parties agree on a shorter period.

(i) the following States for which it will act: so far as Article 3(1) is concerned: any Contracting State; so far as Article 3(2) is concerned: any Contracting State, under the condition that the Authority or another International Searching Authority located in and operating for any State party to the European Patent Convention has prepared the international search report. Where a receiving Office specifies the International Authority under Article 3(1) and (2), the International Authority shall become competent for international applications filed at that receiving Office from a date to be agreed by the receiving Office and International Authority and to be notified to the International Bureau.

(3) Where the Authority benefits from the results of an earlier search already made by the Authority on an application whose priority is claimed for the international application and depending on the extent to which an Authority benefits from that earlier search, the search fee paid shall be refunded to the extent provided for in a communication from the Authority to the International Bureau and published in the Gazette.

(4) Where the applicant or, if there are two or more applicants, each applicant is a natural person who is a national and resident of a State not party to the European Patent Convention, which on the date of filing of the application or the demand is classified as a low-income or lower-middle-income economy by the World Bank, the amount of the search fee, the preliminary examination fee andany additional fee to be paid shall be reduced by 75%. Where the Authority is informed of a change under Rule 92bis before the start of the international search or, if a demand for international preliminary examination is filed, before the start of international preliminary examination, and the change would modify the applicability of the fee reduction, the Authority may request the applicant to pay the full amount of the search fee or preliminary examination fee before the Authority starts the search or preliminary examination, respectively, and the Authority will request the full amount of any additional fees that the applicant may be invited to pay.
