2016 LEGISLATIVE SESSION

In many ways, the 2016 session was more about what did NOT happen than what did. Multiple bills fell victim to deadlines and committee

assignments, as the budget took over everyone’s time and effort for the more intense work. Some of the most divisive environmental legislation

avoided contentious floor debates and political maneuvering by not making it out of committees or not making final agendas.

However overall, we came out VERY well this session regarding the “big environmental picture.” Almost every single “anti-wind energy” bill was

defeated, and one of the worst bills overall (SB1413 which would have required 75% of all of Oklahoma’s electricity to be produced using natural gas)

failed to get traction and died in the Senate. Despite the launch of an anti-wind organization called Windfall (backed by Continental’s founder Harold

Hamm), we saw the defeat of all of the most troubling anti-wind bills. Windfall spent a tremendous amount of time and energy spreading

misinformation about Oklahoma’s wind energy industry and hosting legislative dinners—they were even given a spot in the State Treasurer’s monthly

newsletter in March—we raised concerns about the legality of this relationship, and the State Treasurer ended up issuing a “modification to the initial

newsletter.” It did not go far enough, but it was made know that citizens are watching!

A FEW BILL HIGHLIGHTS (The Good and the Bad)

-We saw an attempt to improve Oklahoma’s solar energy market with the introduction of SB1222, the Oklahoma Solar Energy Development Act

sponsored by Senator Ron Sharp. This bill died in committee, but we expect it to be back for 2017 with input from many more interests to give it a

better shot to succeed.

-Unfortunately, the Oklahoma Scenic Rivers Commission was defunded and its duties have been rolled in to the Grand River Dam Authority via the

passage of SB1388. We have been assured the GRDA Director has expressed a sincere interest in following through on the requirements of the Scenic

Rivers Act—but only time will tell if this turns out to be a good or bad bill.

-Once again, attempts to address the earthquake issue in any meaningful way failed to get traction. As an example, HB2455 (Rep. Mike Shelton, D-

Oklahoma City) would have required schools to make earthquake planning part of its annual agenda—this bill dies in committee.

- Pipeline safety was formally addressed, and HB2444 was passed which will bring Oklahoma up to federal standards regarding violations and actions

impacting our thousands of miles of pipeline. Oklahoma ranks third nationally in total installed pipeline, so it is vital we do all we can to assure this

infrastructure is protected to avoid catastrophe.

-A Pollinator Taskforce Bill (SB1223) was left dangling in committee at the end of session, and so sadly this bill failed. We hope to push for this

legislation next year.

SUMMARY OF MAJOR LOBBY AREAS

The Oklahoma Chapter of Sierra Club, by way of a Legislative Committee, a full-time lobbyist, and the efforts of volunteers, consistently voiced our

opinions on a number of bills and issues this session. Via Legislative Alerts, emails, phone calls, and face to face meetings at the Capitol, Sierra Club

made sure that Oklahoma’s Senators and Representatives were well aware of what we were concerned about and what we believe was best for

protecting Oklahoma’s air, land, and water.

Anti-Wind Energy Efforts Pushed Back

Time and time again, we emailed, phoned, met with, and distributed our messages and materials that wind power makes a huge positive impact in

Oklahoma, and we were not going to sit by and watch misinformation lead to bad legislation. Bills like HB1549, SB1308, HB2817, HB2818, SB883,

SB1443 were all defeated, and wind energy will for the moment move forward on a firm footing. Oklahoma looks to move from 4th in the nation in

wind energy production to third in the nation over the coming year, and the oil and gas industry sees wind as a threat to its previous monopoly. 2017

WILL BE A TOUGH YEAR FOR WIND—we ask you all to be ready to help us in our efforts to share the facts and spread the truth about wind

energy’s benefits next legislative session

Slow and Steady Weakening of Environmental Conservation

Several bills were passed that while taken individually do not mean anything major, but when taken as a group make it clear the legislature is

consistently seeking to weaken Oklahoma’s environmental progress. Bills like HB2407 (removes annual reporting of overall recycling done by agencies),

HB2502 (takes away requirement that Ag Department licenses are signed under oath), and HB3116 (grants automatic assumption that agencies are

meeting energy conservation goals) all make it clear that our legislature has no interest in helping Oklahoma standing up for energy efficiency and

energy savings.

National Constitutional Convention

Calling for a national Constitutional Convention is an idea that all levels of the Sierra Club have been fighting against. Here in Oklahoma, we lobbied

against SJR4 and HJR1018 this session, but unfortunately HJR1018 was passed, and so the State of Oklahoma will now be added to the group of States

calling for a national Constitutional Convention. The reason we stand strongly opposed to this is because there are no clear rules for how a

Constitutional Convention will play out. It is most likely that the agenda would be set by the political powers at play thanks to Citizens United—in

other words, “big money” will likely lay out the agenda for any national convention, and given the current political state we have strong fears about

what the outcome from such a convention will be. We believe weakening of the environment and renewable energy set-backs would form a large part

of any such platform.

Other Highlights

We started session early this year by holding a lobby training at the State Capitol in December of 2015. We were joined by Representative Jason

Dunnington who spoke to our group of approximately two dozen attendees about his thoughts on what makes for effective lobbying. We carried out

mock lobby sessions, and provided attendees with thumb drives containing several great articles on political engagement, lobbying and government

operations.

In addition to our day in and day out lobbying and outreach, we also joined twelve other organizations for a “SAY NO TO 809” Capitol Rally and

Protest organized by Sierra Club and sponsored by Representative Richard Morrissette. Several dozen citizens gathered and marched on the Capitol

with signs, banners, and their voices to let legislators know that the public feels left out of what takes place at the State Capitol.

Following the march and rally, the Oklahoma Chapter of Sierra Club held our annual lobby action—this year focusing on constituent lobbying. We had

some brand-new members join us, and we even ended up with one member filing her candidacy to run for office that very day!

GRASSROOTS EFFORTS

THE LEGISLATIVE COMMITTEE

Oklahoma Sierra Club has a chapter-level Legislative Committee to help wade through the countless bills, to help focus where the most attention is

needed, and to help with the non-stop outreach efforts needed throughout session as well as to help make specific events the best that they can be.

THE ACTUAL GRASS ROOTS—OUR MEMBERS

The Legislative Committee works to reach all of our members who have indicated an interest and a willingness to help out with specific needs during

legislative session—whether it is a phone call, a letter, an editorial, or directly meeting with legislators, our members are the backbone of our work. This

session, we issued numerous Legislative Alerts, sent emails on high-priority Committee actions, and invitations for our media events and Lobby Day—

our members responded, and we logged hundreds of direct legislative contacts between our members and their legislators.

legislator’s relationship to environmental issues in our state as a whole. The following are summaries of the specific bills selected:

BILLS ON SENATORS’ SCORECARD

SJR4: [Sen. Robert Standridge, R-Norman and Rep. Gary Banz, R-Midwest City] Applies to Congress on behalf of the State of Oklahoma and

under Article 5 of the U.S. Constitution calling for a convention of the states for the limited purpose of proposing constitutional amendments to the

U.S. Constitution that impose fiscal restraints on the federal government, limit the power and jurisdiction of the federal government and limit the terms

of office for its officials and members of Congress.

-Sierra Club opposed this bill.

-The bill was signed by Governor Mary Fallin on April 27, 2016, and referred to the Secretary of State.

SB1223: [Sen. Earl Garrison, D-Muskogee and Rep. Wade Rousselot, D-Wagoner] An Act relating to pesticides; creating a task force to study

and create recommendations based on pesticides and their effect on pollinator populations; providing expiration date; setting duties; providing for

membership; providing for naming of chair; providing for quorum; providing that members receive no compensation; providing for travel

reimbursement if funds are available; providing for staff support; requiring certain report; providing for codification; and providing an effective date.

-Sierra Club supported this bill.

-The bill died in the House Rules Committee on April 7, 2016.

SB1291: [Sen. John Sparks, D-Norman and Rep. Scott Inman, D-Del City] This bill requires the Department of Environmental Quality to seek

and include any response submitted to them by any of Oklahoma's federally recognized tribal governments in preparing any response on behalf of the

State of Oklahoma to the federal government on any issue pertaining to the federal Clean Air Act, the Oklahoma Clean Air Act, modifications to air

emission standards or any air quality issue.

-Sierra Club supported this bill.

SB1308: [Sen. Jason Smalley, R-Stroud and Rep. Kevin Calvey, R-Oklahoma City] This bill creates the Zero Emission Tax Credit Transparency

Act of 2016. The bill requires each taxpayer claiming a credit for electricity generated after Jan 1, 2017 to report specified information to the Oklahoma

Tax Commission on a monthly basis for each turbine.

-Sierra Club opposed this bill.

- The bill died in the House on April 21, 2016, failing to make Agenda or Committee.

SB1379: [Sen. Dan Newberry, R-Tulsa and Rep. David Ralph Brumbaugh, R-Broken Arrow] This bill prohibits the Department of

Environmental Quality and the Board of Environmental Quality from developing or adopting a State Implementation Plan (SIP) relating to the

regulation of carbon dioxide emissions from power generation sources as required by the Federal Clean Air Act, commonly referred to as the Clean

Power Plan rules, unless such action is determined to be required by the Attorney General of Oklahoma or a court of competent jurisdiction in addition

to written authority by the Governor.

-Sierra Club opposed this bill.

- The bill died in the House Utilities Committee on April 7, 2016.

HB2444: [Rep. Terry O'Donnell, R-Catoosa and Sen. Jason Smalley, R-Stroud] This bill modifies civil penalties for violations of pipeline safety

rules, regulations and orders. It modifies administrative penalties for violations to the Hazardous System Safety Act. It places Oklahoma in compliance

with federal pipeline violation standards and regulations.

-Oklahoma Sierra Club supported this bill.

-This Bill was signed into law by Governor Mary Fallin on April 26, 2016.

HB1549: [Rep. Earl Sears, R-Bartlesville and Sen. Brian Bingman, R-Sapulpa] This bill increases from at least 30 days to at least 180 days the

time period before entering upon a surface estate for the purposes of beginning construction of a wind energy facility, the wind energy developer must

provide written notice, by certified mail, of its intent to construct the wind energy facility to certain parties.

-Sierra Club opposed this bill.

-The bill died in the House Conference Committee on Energy and Natural Resources May 27, 2016.

HB2250: [Rep. Brian Renegar, D-McAlester, Rep. John Enns, R-Enid, and Sen. Larry Boggs, R-Wilburton] This bill prohibits the solicitation

of funds not intended to be used in the state of Oklahoma by any animal rights charitable organization, professional fundraiser for an animal rights

charitable organization or professional solicitor employed by an animal rights charitable organization. The bill exempts any organization that is operated

primarily to benefit or further the welfare of companion animals.

-Sierra Club opposed this bill.

-The bill died in the House on April 21, 2016, failing to make Agenda or Committee.

HB2748: [Rep. Richard Morrissette, D-Oklahoma City and Sen. Patrick Anderson, R-Enid] This bill requires the activities and operations of

the Eastern Red Cedar Registry Board terminate on the effective date of this act. It requires the Board cease to exist after the effective date of this act.

It requires the documents, records, property, fund balances, encumbrances, obligations and other resources of the Board be transferred to the Office of

the Eastern Red Cedar Registry Coordinator. It requires the Office of the Eastern Red Cedar Registry Coordinator succeed to any contractual rights

and responsibilities incurred by the Board.

-Sierra Club supported this bill.

- The bill died in the Senate Appropriations Committee on April 7, 2016.

HB2777: [Rep. Charles McCall, R-Atoka and Sen. Josh Brecheen, R-Coalgate] This bill reauthorizes the income tax checkoff relating to the

Wildlife Diversity Fund.
