NOTICE INVITING TENDER

No. 3 (2)/BESD/SHS/2014/60 DATED:-12.08.2014 The Sub-Divisional Engineer (E), BSNL, Electrical Sub-Division, SAHARSA invites on behalf of B.S.N.L. sealed percentage rate tenders for the work of :- Repairing of submersible motor pump set for M/W bldg & staff quarters at M/W Colony Saharsa under Saharsa SSA. from eligible contractors satisfying the following conditions.

Eligibility:

BSNL enlisted contractors in Electrical category of respective class as per their tendering limits

The contractor shall submit following document along with application on their printed letterhead for purchase of tender as applicable.

i) Chartered Accountant Certificate towards Submission of Income Tax. ii) Enlistment certificate. iii) Sales Tax, Service Tax & E.P.F. Registration or certificate from notary for not

requirement of EPF. iv) Electrical license issued by state government v) The tender shall be in two bids i) Eligibility bid ii) Financial bid.

The tenderer shall submit the tenders simultaneously in 2 sealed envelopes marked as 1st and 2nd envelope respectively.The first envelope should contain the earnest money deposited in the shape of Demand Draft/Pay Order/Bank Guarantee of a Scheduled Bank or Nationalised Bank/ State Bank guaranteed by Reserve Bank of India drawn in favour of Sr. Account Officer, O/o the Executive Engineer (E), BSNL Electrical Division Patna ,along with all eligibility document. In case the tender document is downloaded from the website, separate DD for the tender cost shall be enclosed along with all eligibility documents in the Eligibility bid in the 1st envelope. The second envelope should contain the financial bid having complete tender documents duly signed in token of acceptance by the firm, complete in all respect along with rates quoted in figures and words in schedule of work therein. The financial bid of only those tenderer shall be opened who qualify the eligibility Bid.

The tender will be received up to 3 PM on 27.08.14 and opened on 3.30 PM on the same day. In case holiday is declared on the opening day the tenders will be opened on the next working day. Conditions and tender forms can be had from his office up to 25.08.14 on payment of Rs.150.00+ 13.5 % Sales Tax (non refundable) or directly from web site.

IMPORTANT NOTE FOR THE CONTRACTOR/FIRMS WHO DOWNLOAD THE TENDER FROM WEB SITE

(These instructions shall supersede all other instructions contained in this NIT)

The contractors/firms who are down loading the tender forms are instructed to go through the following points:- 1. The contractor/firm has to submit an undertaking (duly signed, in the format enclosed with the NIT) that he shall abide by the original standard forms PWD-6 and 8/BSNL forms. 2. The contractor/firm shall submit the following in FIRST ENVELOPE:- (A) Application on the firm’s printed letter-head. (B) Necessary documents for credentials for meeting the eligibility Conditions. (C) Non-refundable cost of tender documents (in the shape of Demand Draft). (D) Earnest money (in the prescribed form and of prescribed amount). [In case of Demand Draft, separate Demand Drafts for “Cost of Tender Documents i/c 10% S.T.” and “EMD” are to be submitted]. 3. After verification of the documents in FIRST ENVELOPE [i.e. credentials, cost of

tender documents and Earnest Money, etc] and on finding them in order, the SECOND ENVELOPE containing the bid documents shall be opened.

4. It shall be the responsibility of the firm to clearly list the documents attached to establish their eligibility credentials in the application (on their printed letter head). 5. The credentials submitted shall be self attested and certified by any BSNL Executive

(not below the rank of SDE). If not certified by BSNL Executive then original documents shall be produced at the time of Tender opening.

6. EMD of non-eligible firms shall be returned in original at the time of opening of tender. 7. The tenderer has to submit the downloaded original computer print out of the

documents from the web site. The photocopy shall be not accepted. 8. If during the opening of tender or during the process of tender finalization, it is

detected that the tenderer has submitted tender documents after making any charges/additions/deletions in the tender documents from the web site. The offer shall be summarily rejected and the EMD deposited by the tenderer shall be forfeited in addition to any other action as per the prevalent rules.

CONDITION OF BANK GURANTEE FOR EMD IS MORE THAN Rs20,000/-

1. The BG shall be from a scheduled bank or a nationalized bank/State Bank guaranteed by Reserve Bank of India, in enclosed Performa for the prescribed value mentioned in NIT.

2. The Bank guarantee shall remain valid for the period at least 15 days beyond the validity

period of the tenders. 3. For works in Bihar the BG shall be furnished duly stamped at the rate of Rs. 15.75 (as per

Indian Stamp Act). 4. For other states the Bank Guarantee shall be furnished duly stamped for Rs.15.75. or

prescribed stamp duty of the state of issuing Bank whichever is more. 5. Firm shall have to extend the validity of Bank Guarantee furnished by them if so required

by BSNL. 6. The provision of Indian Stamp Act 1899 for stamp duty rate shall be applicable.

MEMORANDUM.

Subject: - Exemption from payment of earnest money with each tender.

The rules regarding enlistment of contractors in CPWD allow the categories of the contractors depending upon the cases in which they are registered, to deposit lump sum money in order to enable them to secure exemption from payment of earnest money with each tender vide Para 21.3 and appendix 31 of CPWD manual (volume: II edition 1980).

This facility of exemption from payment of earnest money with each tender is withdrawn with effect from 18.6.93. All tenders invited on or after 15.6.93 will be accompanied by earnest money at the new rates being notified simultaneously.

In a press notification, the contractors have been requested to apply for refund of earnest money deposits, which will be released after obtaining clean” no demand” certificates from sub ordinate formation. Such cases should be got expedited and earnest money deposits released without undue delay.

In view of the above, no fresh case for security exemption from earnest money will be accepted.

The extent provision in the CPWD manual will be amended in due course.

STANDING ORDER NO. 258.

SUBJECT:- Special conditions for reimbursement of levies/taxes arising of the l6th constitution Amendment 1982.

Tendered rates are inclusive of all taxes and levies payable under the respective statutes. However, pursuant to the constitution (46th amendment) act, 1982 if any further tax or levy is imposed by stature, after the date of receipt of tenders, and the contractors the reupon necessarily and properly pays such taxes /levies the contractors shall be reimbursed the amount so paid, provides such, payment of any, is not in the opinion of the Superintending Engineer (whose decision shall be final and binding) attributable to delay in execution of work within the control of the contractor.

The contractor shall keep necessary books of account and other documents for the purpose of this condition and may be necessary and shall allow inspection of the same by a duly authorized representatives of the government and further shall furnish such other information/documents as the Engineer-in-Charge may require.

The contractor shall, within a period of 31 days of imposition of any further tax or levy pursuant to the constitution (46th amendment act 1982), give a written notice thereof to the engineer-in-charge what the same is given pursuant to this condition, together with all necessary information relating thereto.

NOTICE INVITING TENDER.

1. Percentage rate tenders are invited on behalf of BSNL from eligible BSNL contractors for the work of: S/F main switch, changeover switch, MCB DB etc at T.E Jeetapur under Saharsa SSA 1.1 The work is estimated to cost Rs 21272.00 This estimate, however, is given mere as a rough guide. 1.2 Tenders will be issued to eligible BSNL contractors provided they produce definite proof

from the appropriate authority which shall be to the satisfaction of the competent authority of having completed similar works of magnitude specified below:

1.3 CRITERIA OF ELIGIBILITY FOR ISSUE OF TENDER DOCUMENTS: A Eligibility: AS PER NIT B. Tender Bids:

The tender shall be in two bids (i) Eligibility bid (ii) financial bid. The agencies who qualify the eligibility bid, financial bid of only those shall be opened. The department reserves the right to accept or reject any bid without assigning any reasons.

(i) Eligibility bid:

a. The firm should submit following documents to meet eligibility conditions:

i) Chartered Accountant Certificate towards Submission of Income Tax. ii) Electrical License. iii) Sales Tax ,Service Tax & E.P.F. Registration.

b. The earnest money deposit in prescribed form. c. Separate DD for the Cost of tender paper i/c sales tax ( for web down load)

(ii) Financial bid:

The complete tender documents issued to the firms shall be submitted duly signed in token of acceptance by the firm, complete in all respect along with rates quoted in figures and words in schedule of work therein.

2. Agreement shall be drawn with the successful tenderer on prescribed form No. 7/8 which is available as a Govt. of India Publication. Tenderer shall quote his rates as per various terms and conditions on the said form which will form part of the agreement.

3. The time allowed for carrying out the work will be 15 days from the ten day after the date of written order to commence the work or from the first date of handing over the site ,whichever is later, in accordance with the phasing ,if any, indicated in the tender documents.

4. The site for the work is available 5. Receipt of applications for issue of forms will be stopped by 16.00 hrs. four days before the date fixed for

opening of tenders. Issue of tender forms will be stopped three days before the date fixed for opening of tenders.

Tender documents consisting of plans, specifications, the schedule of quantities of the various classes of work to be done and the set of terms and conditions of contract to be complied with by the contractor whose tender may be accepted and other necessary documents can be seen in the office of the Sub-Divisional

Engineer (E), BSNL Elect. sub-Division , SAHARSA between hours of 11.00 AM and 4.00 PM every day except on Sundays and Public Holidays. Tender documents, excluding standard form, will be issued from the office, during the hours specified above, on payment of Rs. 150.00 + sales tax in cash.

6. The tenders must produce a Chartered Accountant certificate in the revised form as modified under Ministry of Finance CBDT circular No. 153/191/2002-TPL dated 13-02-2003 as Amended from time to time before papers can be sold to him. 7. Tenders, which should always be placed in sealed envelope, with the name of work and

due date written on the envelopes will be received by the __________________ on and will be opened by him or his authorised representative in his office on the same day at 03.30 PM.

8. Tenderers are advised to inspect and examine the site and its surroundings and satisfy

themselves before submitting their tenders as to the nature of the ground and sub soil (so far as is practicable), the form and nature of the site, the means of access to the site, the accommodation they may requisite and in general shall themselves obtain all necessary information as to risks, contingencies and other circumstances which may influence or affect their tender. A tenderer shall be deemed to have full knowledge of the site whether he inspects it or not and no extra charges consequent on any misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for arranging and maintaining at his own cost all materials, tools and plants, water, electricity access, facilities for workers and all other services required for executing the work unless otherwise specifically provided for in the contract documents. Submission of a tender by a tenderer implies that he has read this notice and all other contract documents and has made himself aware of the scope and specifications of the work to be done and of conditions and rates at which stores, tools and plant, etc. will be issued to him by the Government and local conditions and other factors having a bearing on the execution of the work.

10. The competent authority on behalf of BSNL does not bind itself to accept the lowest or any other tender, and reserves its right to reject any or all of the tenders received without the assignment of a reason. All tenders, in which any of the prescribed conditions are not fulfilled or are incomplete in any respect are liable to be rejected.

11. Canvassing whether directly or indirectly, in connection with tenders is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable to rejection.

12. The competent authority on behalf of BSNL reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rate quoted.

13. The contractor shall not be permitted to tender for works in the BSNL Electrical zone (responsible for award and execution of contracts) in which his near relative is posted in any capacity in that zone. He shall also intimate the names of persons who are working with him in any capacity or are subsequently employed by him and who are near relatives to any person employed in BSNL in that zone . Any breach of this condition by the contractor would render him liable to be removed from the approved list of contractors of BSNL.

14. No Engineer of gazetted rank or other Gazetted officer employed in Engineering or

Administrative duties in an Engineering Department of the Government of India is allowed to work as a contractor for a period of two years after his retirement from Government service, without the previous permission of the Government of India in writing. This contract is liable to be cancelled if either the contractor or any of his employees is found any time to be such a person who had not obtained the permission of the Government of India as aforesaid before submission of the tender or engagement in the contractors service.

15. The tender for the works shall remain open for acceptance for a period of ninety days

from the date of opening of tenders. If any tenderer withdraws his tender before the said period or makes any modifications in the terms and conditions of the tender which are not acceptable to the department, then the Government shall, without prejudice to any other right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid.

16 The Notice Inviting Tender shall form a part of the contract document. The successful

tenderer/contractor, on acceptance of his tender by the Accepting Authority, shall within 10 days from the stipulated date of start of the work sign the contract consisting of:- a. The notice inviting tender, all the documents including additional conditions,

specifications and drawings, if any, forming the tender as issued at the time of invitation of tender and acceptance thereof together with any correspondence leading thereto.

Participation of near relatives of the BSNL employees All near relatives of BSNL Employees either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the different units of BSNL., The detailed guidelines in this regard are given in the following paragraphs :- I) The near relatives for this purpose are defined as: a) Members of a Hindu Undivided family. b) They are Husband and wife. c) The one is related to the other in the manner as father, mother, son(s) & son’s wife (daughter in-law). Daughter (s) & daughter’s husband (son-in-law). Brother (s) & brother’s wife sister (s) & sister’s husband (brother-in-law). II) As per Government of India’s CCS Conduct rule 4, no Government servant shall in the

discharge of his official duties deal with any matter or sanction any contract to any company or for any other person if any member of his family is employed in that company or firm or under that person or if he or any member of his family is interested in such matter or contact to his official superior. This clause is applicable to all BSNL employees and in view to this as soon as any BSNL employee becomes aware of the above aspect, he must intimate this to the prescribed authority. For non executive employees this authority is SSA Head/Circle Head/Chief Engineer Chief Arch. / Corporate office under which he is posted. For executive employees (at present some of them are called as Gazetted officers) the prescribed authority for this purpose is Circle Head/Chief Engineer/Chief Archt. Corporate office under whom he is posted. III) (a) The company or firm or any other person is not permitted to tender for works in BSNL Units in which his near relative(s) is (are) posted. The unit is defined as SSA/Circle/Chief Engineer /Chief Archt. /Corporate office for non executive employees and all SSA in a circle including circle office /Chief Engineer /Chief Architect /Corporate office for executive employees (those called as Gazatted officers at present). Therefore, it has been decided by the competent authority that a clause must be added in the tender and other related documents that the tenderer should give a certificate that none of his /her such near relative is working in the units as defined above where he is going to apply for tender/work. In case of proprietorship firm certificate will be given by all the partners and in case of limited company by all the Directors of the company. Any breach of these conditions by the company or firm or any other person, the tender/work will be cancelled and earnest money/security deposit will be forfeited at any stage whenever it is so noticed. The department will not pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit.

(b) In respect of case where the tender notice /work related orders have been issued and are waiting for submission the concerned unit should issue corrigendum for inclusion of above clause. However, here tender/work related documents have been opened and are waiting for finalization the certificate may be taken from the company or firm or any other concerned person giving details of the relatives employed in the jurisdiction of the tender. The company or firm or the person concerned will not be debarred in this case but his work will be kept under proper watch to avoid any further

complaint. Further, the relative will not be involved in the decision making and execution of the work.

(c) Where the tenders or the work are already in operation (or awarded ) the tenderer may be requested to give details of relatives employed in the jurisdiction of the tender in such cases the tenderer will be allowed to continue the work but special watch may have to be kept about his performance to avoid any complaint. The concerned relative will not be involved in execution and settlement of claims of the contractor.

I/We have read and examined the notice inviting tender, schedule, A,B,C,D,E & F, Specifications applicable, Drawings and Designs, General Rules and Directions, Conditions of contract, clauses of contract, Special conditions, Schedule of Rate and other documents and Rules referred to in the conditions of contract and all other contents in the tender documents for the work. I/We hereby tender for the execution of the work specified for the BSNL within the time specified in Schedule ‘F’, viz., schedule of quantities and in accordance in all respects with the specifications, designs drawings and instructions in writing referred to in Rule-1 of General Rules and Directions and in Clause 11 of the conditions of contract and with such materials as are provided for, by, and in respects in accordance with, such conditions so far as applicable. We agree to keep the tender open for ninety (90) days from the due date of submission thereof and not to make any modifications in its terms and conditions.

A sum of Rs. 425.00 is hereby forwarded in cash/Receipt Treasury Challan/Deposit at call Receipt/ Bank guarantee of a Scheduled Bank as earnest money. If I/we, fail to commence the work specified I/we agree that the said BSNL or his successors in office shall without prejudice to any other right or remedy, be at liberty to forfeit the said earnest money absolutely otherwise the said earnest money shall be retained by him towards security deposit to execute all the works referred to in the tender documents upon the terms and conditions contained or referred to therein and to carry out such deviations as may be ordered, upto maximum of the percentage mentioned in Schedule’F’ and those in excess of that limit at the rates to be determined in accordance with the provision contained in clause 12.2 and 12.3 of the tender form.

I/We agree that should I/we fail to commence the work specified in the above memorandum, an amount equal to the amount of the earnest money mentioned in the form of invitation of tender shall be absolutely forfeited to the BSNL and the same may at the option of the competent authority on behalf of the BSNL be recovered without prejudice to any other right or remedy available in law out of the deposit in so far as the same may extend in terms of the said bond and in the event of deficiency out of any other money due to me/us under this contract or otherwise. SPECIAL TERMS AND CONDITIONS. 1. Earnest Money 1.1 Value The amount of earnest money to be deposited with each tender is 2% of the estimated cost put to the tender subject to a maximum of Rs. 2 cores. Earnest money will be acceptable in the form of CDR/FDR/DD/BG. 1.2 Validity Period

The offer shall be valid for 90 days from the date of opening of financial bid.

The validity period of the Earnest Money Deposit is kept 15 days beyond the tender validity e.g. 90 +30 = 115 days. 1.3 Extension of Validity In case, where the letter of award of work cannot be placed within the validity period of the tender, the BSNL shall request all tenderer to extend the validity of their respective tenders and the Earnest Money deposit by a reasonable period. In such cases, extension of validity of Earnest Money deposit by 15 days beyond the extended validity date of tender shall also be asked for. 1.4 Release of Earnest Money deposit Earnest Money deposit of all unsuccessful tenderer shall be released on issue of award letter to the successful tenderer within one week of issue of award letter. In case of successful tenderer, the Earnest Money deposit shall be released on submission of performance bank guarantee.

2) Eligibility: The Manufacturer or their Authorized Service Dealer for capacities mentioned in the

tender. 2.1) (i) Tender Bids:

The tender shall be in two bids (i) Eligibility bid (ii) financial bid. The agencies who qualify the eligibility bid, financial bid of only those shall be opened.

(ii) Eligibility bid:

a. The firm should submit following documents to meet eligibility conditions:

i) Chartered Accountant Certificate towards Submission of Income Tax. ii) Electrical License. iii)_ Sales Tax ,Service Tax & E.P.F. Registration.

iv) The firm should furnish the list of equipment/tools and fixtures for repairing and testing of engine alternator.

b. The earnest money deposit in prescribed form. c. Separate DD for the Cost of tender paper i/c sales tax (for web down load)

iii) Financial bid:

The complete tender documents issued to the firms shall be submitted duly signed in token of acceptance by the firm, complete in all respect along with rates quoted in figures and words in schedule of work therein.

3. (i) Security Deposit: - sum @ 10% of the gross amount of the bill shall be deducted from each running bill of the contractor till the sum along with the sum already deposited as earnest money.

3.2 If the performance of the firm is unsatisfactory, they shall be issued show cause notice and their contract shall be terminated if their explanation is found unsatisfactory. The decision of C.E. in this regard shall be final.

6.3 The Maintenance contract may be terminated for breach of contract or default and security amount may be forfeited by EE on this account.

4. Terms of payment: - The payment after completion of work shall be paid after submission of bills, duly signed by the concerned authority.

5. Damage due to negligence: Any loss/damage suffered by the plant or the allied equipment’s/ controls due to negligence of the firm during servicing shall have to be made good to the entire satisfaction of the E.E (E).

6. Progress of work: The firm shall produce on demand the log sheet etc to the E.E (E). or his authorized representative for status of the maintenance.

7. Safety precaution and other site precautions: - The firm shall adhere to, while executing the contract, the relevant safety rules of the Government EE (E).

8. Removal of workmen: The firm shall on the request of the EE (E), forthwith remove from the works any person employed thereon by him who in the opinion of the B.S.N.L / EE, misconducts himself or misbehaves or has doubtful character. Such person shall not be employed again on the works.

9. Labour laws: - The firms have to be abided by all labour laws of the appropriate local body applicable to that place where work is executed. The firm shall be responsible for all compensation payable under the Workman Compensation Act.

10. Force majeure: Both the Department and firm shall not be considered in default in the performance of their obligation under agreement, if any, so long such performance is prevented or delayed because of natural calamities such as war hostilities, earth quake, civil commotion or a result of force majeure or because of any law and order, because of any act of God or any cause beyond the reach/ control of the party affected.

11. Arbitration: Except where otherwise provided in the contract all disputes relating to the meaning of the specification, design, drawing and instruction or as to the quality or workmanship or materials used in the work or arising out of them or/ and conditions of the contract during the progress of the work or after completion or abandonment thereof shall be referred to the sole arbitrator by the C.E. (Electrical) BSNL as per the clauses of contract.

12. Deduction towards taxes: 2% of the payment due to the firm or as applicable shall be deducted at the time of payment towards the income tax payable by them and shall be remitted to the Income Tax Department and certificate to this effect will be issued to the firm on each occasion of payment.

13. Agreement: The firm has to enter into the agreement on acceptance of his tender within 07 days of issue of letter of approval to them, failing which earnest money will be forfeited.

14. Taxes: The firm shall include all taxes and duties as applicable on date except service tax which shall be reimbursed on submission of proof of payment . If any new tax is levied, by the Government on maintenance contracts after opening of tender the same shall be reimbursed by the B.S.N.L on production of proof of payment .

15. Compensation for delay: If the contractor fails to maintain the required services within the contract period or extended date of the contract period, he has to pay the compensation for delay which is limited to 1% per week of proportionate value of work order and thereafter subject to a maximum of 12% of proportionate value of the work order for the exchange where the work is delayed and the firm is found responsible for the same.

16. The rate quoted by the Agency shall be firm and final including all taxes and duties as applicable on the date of opening of tender.
