WHEREAS it is enacted by section 25 of thePharmacy and Poisons Act, 1910-1954, that theseveral articles mentioned in either the Fifth orthe Ninth Schedule shall be deemed poisons withinthe meaning of the Act and that the Governormay by Proclamation from time to time declarethat any other article specified in such Proclama-tion shall be deemed a poison within the meaningof the Act: Now, therefore I, the Governor, withthe advice and consent of the Executive Council,do hereby declare to be poisons within the meaningof the Act

WHEREAS it is enacted, inter alia, by section 2of the Railways (Cue-Big Bell and other Railways)Discontinuance Act, 1960, that the Act shall comeinto operation on a day to be fixed by Proclama-tion, and that it shall not be necessary to proclaimthat the whole of the Act shall commence on oneday, but the several sections and paragraphs ofthe Act may be proclaimed to commence on suchdays as are respectively fixed by Proclamation;and whereas it is enacted by section 8 of theAct that on and after the commencement of thatsection the railway constructed from Brookton toCorrigin, as described in that section, save and

except so much of that line of railway as extendsas specified in paragraphs (a) and (b) of thatsection, shall cease to be operated until the Gov-ernor otherwise declares; and whereas it is desiredthat section 8 of the Act shall commence: Now,therefore I, the Governor, acting with the adviceand consent of the Executive Council, do herebyfix the day on which this Proclamation is publishedin the Government Gazette as the day on whichsection 8 of the Railways (Cue-Big Bell and otherRailways) Discontinuance Act, 1960, shall corn-.mence.

No. 5037/48.WHEREAS by section 34 of the Land Act, 1933-1960, it is made lawful for the Governor, by Orderin Council, without issuing any deed or grant, toplace any reserve under the control of any muni-cipality, road board, or other person or persons,as a board of management, and to empower suchboard to make, repeal, and alter by-laws for thecontrol and management of such reserves, andprescribe fees for depasturing thereon or otheruse thereof, and for other purposes, such by-lawsto be approved by the Governor and publishedin the Government Gazette; and whereas it isdeemed expedient that Reserves Nos. 2010 and 7723at Boat Harbour should be placed under the con-trol of the Shire of Denmark as a board ofmanagement: Now, therefore, His Excellency theGovernor, by and with the advice and consentof the Executive Council, doth hereby place thebeforementioned reserves under the control of theShire of Denmark as a board of management, anddoth empower such board to make, repeal, oralter by-laws for the control and managementof the said reserves; for prescribing fees for de-pasturing thereon or other use thereof; for direct-ing the manner in which such fees shall be im-posed, paid, collected and disposed of, and toimpose penalties not exceeding in any case £5for any breach thereof and £2 a day for a con-tinuing breach, but not more than £20 in theaggregate.

WHEREAS is enacted by subsection (1) of sec-tion 28 of the Companies Act, 1943-1960, that nocompany shall be registered by a name which, interalia, is identical with that by which a companyin existence is already registered under the lawrelating to companies, or in the oi inion of theRegistrar of Companies, so nearly r :sembles thatname as to be calculated to deceive; and- whereasit is provided, inter alia, in proviso (a) to sub-section (7) of that section that where in theopinion of the Governor (on being satisfied thatit would be inequitable or unreasonable to requirea company incorporated outside Western Australiato which Part XI of that Act applies to change itsname before complying with the requirements ofthat Part) it is expedient, the Governor may auth-orise the Registrar to accept for filing the docu-ments and particulars specified in subsection (1)of section 329 of that Act; and whereas registra-tion under Part XI of the Act of a company in-corporated in the State of Victoria by the nameof Patersons Pty. Ltd. was refused by the Registraron the ground that in his opinion that name sonearly resembles the name by which a company inexistence (Paterson & Co. Limited) is alreadyregistered under the said Act, as to be calculatedto deceive; and whereas His Excellency the Gov-ernor is satisfied that it would be inequitable orunreasonable to require Patersons Pty. Ltd. tochange its name before complying with the re-quirements of that Part of the Act and is of theopinion that the circumstances of the case renderit expedient: Now, therefore, His Excellency theGovernor, acting with the advice and consent ofthe Executive Council and in exercise of the powersconferred by proviso (a) to subsection (7) ofsection 28 of the Companies Act, 1943-1960, dothhereby authorise the Registrar of Companies toaccept for filing from Patersons Pty. Notice to Owners and Occupiers of Land.PURSUANT to the powers contained in the BushFires Act, 1954-1958, all owners and/or occupiersof land, business premises and residences withinthe Town of York are hereby required to ensurethat all inflammable material is disposed of or fire-breaks, not less than six feet wide, provided withinthe external boundaries of their property.

Protective burning-off of inflammable materialmay be carried out until 15th December, 1961, pro-vided that a permit has been applied for andgranted. No burning-off will be permitted afterthat date and that land on which inflammablematerial still remains must be surrounded with theprescribed firebreak.

Application for permission to burn must be madeto the Town Clerk. Full responsibility must beaccepted by the applicant, and the York Fire Bri-gade and adjoining owners informed of the in-tention to burn-off.

All protective burning-off must be carried outbetween the hours of 6 p.m. and 12 midnight fromMonday to Saturday inclusive. No burning-off ispermitted on Sunday.
