    ORDINANCE 2015-377 5 AN ORDINANCE AMENDING CHAPTER 518, ORDINANCE 6 CODE (JACKSONVILLE PROPERTY SAFETY AND 7 MAINTENANCE CODE); PART 2. (IMPROVED OR 8 UNIMPROVED LOTS AND EXTERIOR CONDITIONS OF 9 RESIDENTIAL AND COMMERCIAL PROPERTIES); 10 SECTION 518.203 (JUNK AND ABANDONED VEHICLE 11 PARKING OR STORAGE PROHIBITED) TO RE-NAME THE 12 SECTION AS PROHIBITED OUTDOOR STORAGE; TO 13 STRIKE THE EXISTING LANGUAGE AND TO INSERT NEW 14 LANGUAGE TO PROHIBIT THE OUTDOOR STORAGE OF 15 CERTAIN ITEMS INCLUDING BUT NOT LIMITED TO 16 ABANDONED, INOPERATIVE, MOTOR VEHICLES, 17 FREEZERS, REFRIGERATORS, JUNK, RUBBISH AND 18 GARBAGE; REQUIRING THAT THE LICENSE TAG BE 19 CLEARLY VISIBLE ON COVERED VEHICLES; PROVIDING 20 FOR AN EDUCATIONAL COMPONENT; PROVIDING FOR A 21 PROSPECTIVE EFFECTIVE DATE; PROVIDING AN 22 EFFECTIVE DATE. 23 24

    WHEREAS, the Council finds that certain persons are storing 25 vehicles in side yards or parking vehicles in such a manner which 26 prevents the observation of the license tag from the right-of-way; 27 and 28 WHEREAS, such improper storage of vehicles contributes to 29 blight conditions; and 30

    WHEREAS, the City of Jacksonville has a compelling interest in 31

    promoting the health and safety of citizens and visitors by 1 regulating potentially hazardous conditions and blighting 2 influences on private property; now therefore 3

    BE IT ORDAINED by the Council of the City of Jacksonville: 4 Section 1. Chapter 518 (Jacksonville Property Safety and 5 Maintenance Code), Ordinance Code, amended. Chapter 518 6 (Jacksonville Property Safety and Maintenance Code), Ordinance 7 Code, is hereby amended to read as follows: 8

    CHAPTER 518 JACKSONVILLE PROPERTY SAFETY AND MAINTENANCE CODE 9 * * * 10

    PART 2 (IMPROVED OR UNIMPROVED LOTS AND EXTERIOR CONDITIONS OF 11 RESIDENTIAL AND COMMERCIAL PROPERTIES) 12

    * * * 13 Sec. 518.203. Prohibited Outdoor Storage. Junk and abandoned 14 vehicle parking or storage prohibited. 15

    It shall be unlawful for any person to store on any private or 16 public property, or the owner or occupant of any property to store 17 or allow to be stored on private or public property owned or 18 occupied by such owner or occupant, outside of a legally 19 constructed fully enclosed structure, unless approved pursuant to a 20 Planned Unit Development zoning district, the following items: 21

    1) any abandoned, disabled or inoperative motor vehicle or 22 parts thereof, or unless it is stored on a bona fide automobile 23 sales lot or an automobile storage yard or automobile wrecking 24 yard, as those terms are defined in Section 656.1301, Ordinance 25 Code; 26

    2) any abandoned, inoperative, disabled or unattended freezer, 27 refrigerator or parts thereof; 28

    3) any junk, rubbish or garbage; 29

    4) any materials, equipment, furnishings, furniture, 1 appliances, construction materials or any items which are not 2 designed to be used outdoors; 3

    5) any item of personal property including clothing or 4 bedding; or 5

    6) any vehicle that is parked on private property, and is 6 visible from the right-of-way or any vehicle that is covered to 7 protect the motor vehicle which does not comply with this 8 subsection: 9

    a. Any parked vehicle that is visible from the right-of-way 10 shall contain the required license tag, and such license tag shall 11 be clearly visible from the right-of-way or the license tag shall 12 be printed legibly and visible from the right-of-way, with 13 characters not less than two inches in height so that it is clearly 14 visible from the right-of-way. 15

    b. Any cover shall allow at least the bottom of at least six 16 inches of each tire to be visible from the right-of way. The 17 required license tag shall be clearly visible from the right-of-way 18 or the license tag number shall be printed legibly on the cover 19 with characters not less than two inches in height so that it is 20 clearly visible from the right-of-way. 21

    c. Covers shall be in good condition without tears, rips or 22 holes. The entire cover shall be one color, except factory-made 23 fitted covers may have more than one color, and shall be kept clean 24 and free from mold and mildew. Covers may include tarpaulin which 25 shall be in good condition, free of holes, tears and rips. 26

    No person in charge or control of any property within the city 27 whether as owner, tenant, occupant, lessee or otherwise, shall 28 allow any junk or abandoned vehicle to remain on any private or 29 public property within the city longer than 15 days; and no person 30 shall leave any such vehicle on any property within the city for a 31

    longer time than 15 days; except that this article shall not apply 1 to a vehicle on the premises of a business enterprise licensed and 2 operated in a lawful place and manner, to repair vehicles with 3 current license or those places where active restoration is taking 4 place and both activities are taking place within a closed 5 building. 6

    Section 2. Educational Component. The Municipal Code and 7 Compliance Division shall provide an educational program to the 8 public to inform them of the changes made herein prior to the 9 prospective effective date of this Ordinance. 10

    Section 3. Prospective Effective Date. This Ordinance 11 shall become effective October 1, 2015, in order to allow time for 12 the public to be educated on the changes made herein. 13

    Section 4. Effective Date.
