ORDINANCE MERCER COUNTY, WEST VIRGINIA NOISE ORDINANCE BE IT ORDAINED AND ORDERED BY COTY C OF C COT ST , A PLIC BY CPORA COT ST , AS FOLLO: The Mercer County Commission recognizes that, at certain levels, noise can be detrimental to the health, welre, saty, and quality oflife ofthe inhabitants ofthe county, and in the public interest, noise should be restricted. It is, therere, the policy of the Mercer County Commission to reduce noise in the community and to prohibit unnecessary, excessive, and annoying noises om all sources suect to its police power. SECTION 1. KEEPING OF ANIMALS CAUSING A PUBLIC NUISANCE. It shall be unlawl r any person knowingly to keep or harbor any animal which habitually barks, howls, cries or yelps to the great discomrt of the peace and quiet of the neighborhood, or in such manner as to materially disturb or annoy persons in the neighborhood who are ordinary sensibility. Such animals are hereby declared to be a public nmsance. SECTION 2. PETITIONS COMPLAINING OF BAING DOGS A CING CATS. ( a ) Whenever any person shall complain to the Mercer County Sherifs Department that an animal which habitually barks, howls, cries, or yelps, the Sherifs Department shall noti the owner of said animal that the person should take whatever steps necessa to alleviate the barking, howling, yelping, or crying problem. ( b ) If the warning given to the person alleged to be keeping an animal as set rth in subsectioi1 ( a) above is ineffective, then a verified complaint of at least two (2) dHzens, rtot om the same mily m' household, or by a deputy §hcriff, may be presented to the magistrate, alleging that an animal who habitually barks, howls, cries, or yelps is being kept by any person within the coun. The Sherifs Department shall inrm the owner of such animal or the owner of the property at which the animal is being kept or harbored that said petition has been filed and shall cite the owner of the animal r the violation alleged in said petition. MERCER COUNTY, WEST VIRGINIA

NOISE ORDINANCE

BE IT ORDAINED AND ORDERED

BY THE COUNTY COMMISSION OF MERCER COUNTY, WEST VIRGINIA, A

PUBLIC BODY CORPORATE OF MERCER COUNTY, WEST VIRGINIA, AS

FOLLOWS:

The Mercer County Commission recognizes that, at certain levels, noise can be detrimental to the health, welfare, safety, and quality oflife of the inhabitants of the county, and in the public interest, noise should be restricted. It is, therefore, the policy of the Mercer County Commission to reduce noise in the community and to prohibit unnecessary, excessive, and annoying noises from all sources subject to its police power.

SECTION 1. KEEPING OF ANIMALS CAUSING A PUBLIC NUISANCE.

It shall be unlawful for any person knowingly to keep or harbor any animal which habitually barks, howls, cries or yelps to the great discomfort of the peace and quiet of the neighborhood, or in such manner as to materially disturb or annoy persons in the neighborhood who are ordinary sensibility. Such animals are hereby declared to be a public nmsance.

SECTION 2. PETITIONS COMPLAINING OF BARKING DOGS AND_

CRYING CATS.

(a) Whenever any person shall complain to the Mercer County Sheriff's Department thatan animal which habitually barks, howls, cries, or yelps, the Sheriff's Departmentshall notify the owner of said animal that the person should take whatever stepsnecessary to alleviate the barking, howling, yelping, or crying problem.
