AN ORDINANCE providing for the construction ahd installation of a 36 ineh concrete storm sewe~in Kenyon Alley, and providing for emergency advertisement.

WHEREAS by reason of the recent severe storms, it has become necessary that some-thing be done at once to care for the flow of surface water in Kenyon Alley; and

WHEREAS under the provisions of the Act~of Aasembly of the Commonwe~lth of Penn-sylvania applicable thereto, it is provided that when an emergency is declared by an affirmative vote of five members of Council, the regular advertising period may be reduced to one advertisement; and

WHEREA~ it is the concensus of opinion of Council that an emergency situation exists;

therefore,

BE IT ORDAINED AND ENACTED by the affirmative vote of five members of Council of the

Borough of Donora, in regular meeting assembled, and it is hereby ordained and enacted by

virtue of the authority in them vested, as follows, to wit:

SECTION 1. That a 36 inch concrete storm water sewer be and the same is hereby authorized to

be installed in Kenyon Alley, between such points as shall be determined and fixed by the

Borough Engineer.

SECTION 2~ That, in conformity with the Acts of Asse~bly in such cases made and provided,

an emergency is hereby declared to exist, and any advertising for the letting of the contract ·

for the purchase of materials for the sewer ab ove authorized shall be on an emergency basis.

SECTION 3. That the proper officers of the Borough of Donora shall, after emergency advertising

enter into a contract with the lowest responsibme bidder and whose bid haa been approved by

Council, for the furnishing of materials necessary for the construction of the sewer above

recited and as advertised in such emergency advertisi ng.

SECTION 4. That, under supervision of the Borough Ehgineer, the employees of the Borough of

Donora be and they are hereby authorized to construct such sewer in conf ormity with the plans

and specifications as prepared by the Borough Engineer and a pproved by Council. ·

SECTION 5. That as and when the person, firm or corporation·furnishing such materials has

delivered them in conformity with the contract and the same have been approved by the Borough

Engineer, the proper officers of the Borough of Donora be and t hey are hereby authorized . to '

execute and deliver to such contractor, a warrant, drawn upon the funds of the Borough of

Donora appropriated for that purpose, in the amount of the price agreed to be paid there-for.
