Action taken on Item No.27 dated 21.02.2017 TO IMPOSE CHARGES/SECURITY FOR USE OF LOUD SPEAKERS/D.J./SOUND SYSTEM DURING COMMERCIAL/NON-COMMERCIAL AND RELIGIOUS FUNCTIONS IN THE CIVIL AREA OF THE JALANDHAR CANTT.

Sh. Suresh Kumar, V.P. and Smt. Sneh Gupta, Elected Member raised the point that rates of loud speakers be exempted for religious functions held inside the Dharamshala.

Sh. Sanjeev Trehan, Elected Member informed the Board that the Cantt Board charged taxes on lighting also in the religious functions.

Col. JPS Cheema, Nominated Member commented, if religious function is held on the Govt. land by any person, then taxes must be charged by the Cantt Board/DEO.

CEO informed the Board if the religious function held inside the Dharamshalas then no charges will be charged from the Dharamshalas but if govt. property is used in any way then the Cantt Board would charge the necessary fee.

Shri Suresh Kumar, Vice President again raised the point regarding use of lights in religious functions, he also asked that no digging is done on Govt. land only two-three poles are placed for lights.

Col. JPS Cheema, Nominated Member asked that this is totally violation of Cantonments Act. Digging on Govt. land is a violation of Act. He further stated that if person violates the rules and regulations then Board must take necessary action and forfeit their security amount.

Col. JPS Cheema, Nominated Member informed the Board that the volume of loud speakers used inside cantonment is very high even after 10.30 P.M. He suggested that those who violates the rules, immediate action should be taken against them.

Sh. Sanjeev Trehan, Elected Member requested the Cantt Board to procure volume measuring instrument so that Cantt Board staff can check the volume post 10:30 P.M.

Sh. Suresh Kumar, Vice President raised the point that there is an urgent requirement of Community Centre for public functions to resolve this issue.

The Board resolved that a Community Hall in Jalandhar Cantonment area near Bus Stand Open Space be constructed and all religious functions be organised in the said Community Hall as per rules and regulations /orders issued by the Court.

02. RESOLUTION:- The Board scrutinized the individual receipts and payments vouchers, considered and approved the monthly accounts. ITEM NO.03 ANNUAL ADMINISTRATION REPORT To consider and approve the Annual Administration Report in respect of Jalandhar Cantonment for the year 2016-2017 which is required to be sent to Central Govt. through the GOC-In-Chief, Western Command as per Section 50 of Cantonments Act, 2006. In this regard Annual Administration Report placed on the table. 03. RESOLUTION:- Considered and approved.

ITEM NO.04 ANNUAL CONSOLIDATED ACCOUNTS FOR THE FINANCIAL YEAR 2016-2017 To consider and approve the Annual Consolidated Accounts of Cantonment Board, Jalandhar Cantt for the year 2016-2017 under Rule 40 of Cantonment Account Code 1924, the Annual Consolidated Accounts are placed on the table for consideration and approval. 04. RESOLUTION:- Considered and approved.

ITEM NO.05 FILLING OF VACANT POSTS FALLEN WITHIN ONE YEAR OF E&M SUPERVISOR IN JALAHDHAR CANTT BOARD.

Reference DG DE letter No. 25/Misc/C/DE/2004 dated 13.01.2011.

To consider the issue of filling of vacant posts fallen vacant within one year of E&M Supervisor in Jalandhar Cantt Board.

The Board is informed that the Post of E&M Supervisor has fallen vacant due to voluntary retirement of Sh. Inder Kumar Vij on 30.09.2016 and charge of the E&M branch has been handed over to Office Supdtt on temporary basis. Since the post is of technical nature and carrying high responsibility dealing with Electrical, Mechanical maintenance and Water Supply and in the absence of E&M Supervisor, work of such technical of sensitive nature are suffering a lot. Hence post of E&M Supervision needs to be filled on priority.

As per MOS the said post is equated with Section Officer of PWD (B&R) present nomenclature of that post in the State Govt. is Junior Engineer and requisite educational qualification for the said post is three year Diploma of JE in Electrical Engineering from a State Technical Education Board or from a recognized university or institution and in addition, should have passed Punjabi upto Matric or its equivalent level.

Hence, it is recommended that the filling of posts/ vacancies be dealt in compliance of the

direction of DG DE issued in referred letter.

05. RESOLUTION –The Board considered the issue in detail and unanimously resolved to fill the post of E&M Supervisor in view of the utmost requirement of that post. The Board further resolved that being an important post of higher responsibility and of technical nature, Degree in Electrical Engineering be added in addition to the qualification of Diploma in Electrical Engineering in requisite qualification under Advertisement so that the well qualified candidate be selected for the Group ‘B’ non-gazetted post.

ITEM NO.06 ANNUAL MAINTENANCE CONTRACT OF ACCRUAL BASED ACCOUNTING SYSTEM (ABAS) IN CANTONMENT BOARDS. Reference DG DE Delhi Cantt letter No.56/15/DG DE/Coord/Double Entry dated 13, April,2017. and ibid letter dated 15, April,2017. DG DE Delhi has intimated vide letter under reference that the Accrual Based Accounting System (ABAS) being implemented through the Consultant M/S ABM Knowledgeware, Mumbai. ABAS application has been successfully tested and implemented in the two Cantt Boards of Agra and STM. Due to difficulties faced by NIC in carrying out performance testing of ABAS software/database in cloud server, it has taken time for DGDE and the Consultant to go through the `Performance Testing’ phase by engaging M/s HP experts. The Performance Testing phase is nearing completion of providing access to 62 Cantt Boards in the Production Server to enable them to log on to the system, create their Master Tables/accounts and start data entry in Accrual accounting system. In the meanwhile, the original contract period for developing and propagating Accrual Based Accounting System for 62 Cantonment Boards has been completed. Therefore, as per approval taken from the CMC and CFA, the implementation of ABAS in 62 Boards will be done during the first year of “Three Years Maintenance Contract” (from 2017-2018 to 2019-2020) being signed with the Consultant. The total AMC amount payable to M/s ABM Knowledgeware during the first year of the three years period will be Rs.97.20 lakhs plus service tax as applicable on date of submission of bill. The amount of annual maintenance will be increased by 20% every year to be shared equally amongst 62 Cantonment Boards including such increased amount. Further, the additional training may be provided to the staff of the Board and expenditure therefore shall have to be incurred by the Boards themselves. In case of onsite visit of support team to particular Cantt Board, the charges will have to be paid by the Cantt Board alongwith the cost of travel, lodging and boarding. The Cantt Boards will make arrangements for staying of technical team preferably in their Guest Houses, if any such visits are required. The entitlements for the team members will be similar to that of JTS level officer. For on-site visit, if requested by the CEO, charges will be payable as prescribed vide DG DE Delhi Cantt letter

under reference and the ibid rates shall be revised by 20% each year during the second and third year of AMC. DG DE has further requested PDs to instruct the CEOs under their jurisdiction to contribute an initial amount of Rs.2,00,000/ (Rupees two lakh only) towards first year AMC cost plus taxes plus training charges etc. to the “Common Pool Fund of Cantt Boards for ABAS” to be maintained by Cantonment Board Delhi. The details of account for ABAS shall be shared by the CEO Delhi to all Boards shortly. The CEOs are required to transfer the amount to the Account as intimated by CEO Delhi by Bank Transfer within 10 days after receiving the details from CEO Delhi. In this regard DG DE Delhi Cantt has vide their letter No.56/15/DG DE/Coord/Double Entry dated 15, April, 2017 conveyed to CEO Delhi for necessary action. The DG DE letters dated 13 April, 2017 and 15 April, 2017 refers above are placed on the table for information of the Board. 06. RESOLUTION:- The matter discussed in detail and resolved that the amount of contribution of Rs.2,00,000/- for “Common Pool Fund of Cantt Boards for ABAS” with 20% escalation in Annual Maintenance Contract of Accrual based Accounting System (ABAS) in Cantonment Boards is too excessive. The CEO would take up the matter with the PD DE and DG DE in this regard to reduce the contribution amount of ABAS.

ITEM NO.07 PAYMENT OF MINIMUM RATES OF WAGES TO CERTAIN CATEGORIES OF EMPLOYEES – GAZETTE NOTIFICATIONS W.R.T. COURT ORDER: ENGAGEMENT OF PERSONS ON CASUAL, TEMPORARY, ADHOC, DAILY-RATE AND CONTRACTUAL BASIS.

Reference Dte.General DE New Delhi letter No.105/17/Misc/ Adm/DE, dated 07.04.2017 AND PD DE WC Letter No.15/933/Adm/ WC/DE/RMS 27010/136 dated 15.11.2016 w.r.t. DGDE New Delhi Letter no. 105/17/Misc/Adm/DE dt.04.11.2016. The Board is informed that the Principal Director DE WC Chandigarh vide its letter dated 15.11.2016 w.r.t. DG DE letter dated 04.11.2016 has directed to draw attention of the CEOs /Boards towards (i) The Judgement of the Hon’ble Supreme Court of India in Civil appeal no 213 of 2013 State of Punjab & others versus Jagjit Singh & others ensuing down principles of granting equal pay to equal work to temporary employees. Para 42-45 of this judgement are relevant. (ii) Further, attention is also drawn towards the Hon’ble Supreme Court of India order dated 10 th April,2006in Civil appeal 3595-3612 of 1999 in the case of Secretary, State of Karnataka & others versus Umadevi & others laying down the Principles regarding regularization of temporary employees. Further, directed to peruse both these judgements carefully so as to understand and be aware of implications of these orders on engagement of persons on Casual, temporary, Adhoc, Daily-Rate

and Contractual basis and ensure that no occasion arises for any person to approach Court of Law citing violation of these judgment / orders. Now , the Director General, DE New Delhi vide letters under reference has also referred /circulated Notifications of Ministry of Labour and Employment dated 19th January,2017 specially vide No. S.O.190(E) & S.O. 191( E) revising the minimum rates of Wages payable to the employees engaged in different employment including those engaged in the employment of “Sweeping & Cleaning excluding activities prohibited under the Employment of Manual Scavengers and Construction of Dry Latrines( Prohibition) Act,1993” and those engaged in the employment of “Watch and Ward”. Specific mention have been made in these notifications to the Cantonment Boards also.

It is therefore, recommended that the Board should comply both the judgements referred above in true spirit pertaining to engagement of persons on Casual, Temporary, Adhoc, Daily-rate and Contractual basis and also implementing the Notification issued by the Min.of Labour and Employment revising the minimum rates of Wages payable with regards to the categories mentioned under schedule (Part-I) of contractual staff including sweeping staff, watchmen, Group D, Data Entry Operator and other skilled or non-skilled engaged by the Cantt Board Jalandhar.

The relevant file containing referred documents is placed on the table for perusal of the Board for consideration. 07. RESOLUTION:- The Board considered the issue in detail and further resolved to implement the Notification issued by the Ministry of Labour and Employment dated 19.01.2017 revising the minimum rates of Wages payable w.e.f. 19.01.2017 to the employees engaged in different categories mentioned under scheduled (Part-1) of contractual staff including such as Data entry operator, “Sweeping & Cleaning excluding activities prohibited under the Employment of Manual Scavengers and Construction of Dry Latrines(Prohibition) Act,1993 , Watch and Ward and etc. Staff engaged by the Cantt Board Jalandhar. Further the Board also resolved to comply both the judgements as mentioned ibid in the agenda side and principles laid down therein referred by the DG DE New Delhi. ITEM NO.08 REIMBURSEMENT OF MEDICAL EXPENSES TO SHRI SADHU RAM S/O SH. SWARNA RAM SAFAIWALA, CANTT BOARD, JALANDHAR CANTT. To consider the question of reimbursement of Medical expenses incurred by Shri Sadhu Ram S/O Sh. Swarna Ram, Safaiwala, Cantt Board, Jalandhar Cantt in respect of treatment of himself. The medical claim has been processed under the provisions of CCS(MA) Rules 1944 by the Medical Officer In Charge, Cantt General Hospital who has recommended that a sum of Rs.1,31,766/- may be reimbursed to the applicant under the rules. In this connection Medical claim enclosed with Medical Bills/documents duly recommended by Dr. Madhvi Oberoi, M.O. Incharge, Cantt General Hospital, Jalandhar Cantt and office report are placed on the table.

08. RESOLUTION:- Considered and approved as per provisions of CCS(MA) Rules 1944.

ITEM NO.09 GRANT OF INTERIM RELIEF @ 5% WEF 01.01.2017 to CANTT BOARD PENSIONER’S. The State Govt. of Punjab had granted Interim relief @ 5% of basic Pay/Pension to the Punjab Government employees and Pensioners w.e.f. 01.01.2017 vide their notification No. 6/1/1995-IFPI/86 dated 16.02.2017. The interim relief will be treated as pay for all intents and purposes. Amount of interim relief will be absorbed in the pay revision to be allowed by the State Government on the recommendation of the 6th Punjab Pay Commission (copy enclosed). The same is also admissible to the Cantt Board pensioners on the said terms and conditions as specified in the State Govt. of Punjab letter ibid. The pensioners of the Cantt Board, Jalandhar are now requesting vide letters dated 05.04.2017 that Cantt Board pensioners are governed under CCS Pension Rules 1972 and terms and conditions for grant of Interim relief to Cantt Board pensioners applies mutatis-mutandis and hence, they should be released Interim relief @ 5% w.e.f. 01.01.2017and paid accordingly. In this connection all relevant papers along with case file No. 1/51 is placed on the table for consideration. 09. RESOLUTION:- Considered and approved. The Interim relief @ 5% w.e.f. 01.01.2017 be paid to the pensioners/Family pensioners of the Cantonment Board, Jalandhar Cantt on the terms and conditions as mentioned in the notifications of agenda with prior sanction of the Dte DE, Western Command. Chief Executive Officer is authorized to incur necessary expenditure and take all required action accordingly. ITEM NO.10 CIRCULAR AGENDA To note and ratify the agenda and resolution by circulation letter No.JCB/Adm/Bd-Agnda/2015/2/1616 dated 23.02.2017, No.JCB/Adm/Bd-Agnda/2017/2/1750 dated 03.03.2017, No.JCB/Adm/Bd-Agnda/2017/2/1809 dated 24.03.2017, No.JCB/Acctts/Budget/2016-17/833 dated 29.03.2017 and No.JCB/Adm/Bd-Agnda/2017/2/651 dated 05.04.2017.

To consider the question of disposal of municipal solid waste as per Solid Waste Handling Rules, 2016. E-Tender was published vide E-Tender ID No. 2016_DGDE_158342_1 and tender publication in the Tribune (English) and Times of India newspaper vide this office letter No. JCB/SS/E-PROCURE/MGT OF MSW/1276/C dated 26 Dec 2016. 10.(A) RESOLUTION:- Noted. Amplification:- Sh. Sanjeev Trehan, Elected Member raised the issue that garbage is not collected from some areas inside cantt. He stated that the residents of Nalwa Road throw their garbage outside the dustbins.

Col. JPS Cheema, Nominated Member stated that the MES quarters have not been covered under military conservancy agreement.

Sh. Suresh Kumar, Vice President, Cantt Board stated that the residents of cantonment even throw their Malwa in the dustbins. He suggested that the CMP also take action against the defaulters.

The President Cantonment Board informed the Board that the Cantonment Board will start door to door garbage collection through Rikshaws inside military areas from this year and assured the Board that the same will be implemented in the MES Colony as well. PCB further informed the Board that locks are necessary for garbage bins to control dog and cattle nuisance. The PCB directed the CEO that locks be provided to the staff and they maintain cleanliness in the area. Shri Sanjeev Trehan, Elected Member raised the issue regarding covering the Open drains in the cantonment area. CEO informed the Board that the Cantonment Board will study and follow the NGT Orders regarding covering of open drains. After studying NGT guidelines the matter will be discussed in the next Board meeting. PCB requested the Board Members to make the public aware regarding segregation of garbage under Solid Waste Management plan. Smt. Sneh Gupta, Elected Member requested the Board that a copy of the Circular Agenda be given to all the Board Members along with the main copy meant for signatures of all board members. It is brought to the notice of the Board that the Board is organizing Annual Flower Show 2017 in collaboration with the local military authorities for which approximate expenditure will be about Rs.2,00,000/-, out of which the LMA have been requested to contribute Rs.1,00,000/-. Budget provision for the contribution of the Board exists in budget estimates under head H(5).

The Board to consider and approve the expenditure by Jalandhar Cantt Board towards Annual Flower Show: 2017 for various items.

The instance case is related with service matter and required Engagement of a senior legal

Counsel/ Lawyer for drafting of pleadings, Counter affidavits / reply to Writ Petition to defend the Respondents in the in effective way. Mostly the senior Lawyers at practicing at Pb. & HR High Court Chandigarh is demanding huge fee of more than Rs.50,000/-.

In this regard please refer Office Memorandum vide No. 26(1) /2004Jidl. Dated 01.10.2015,

Part (D)(2) issued by the Govt. of India, Min of Law & Justice, Deptt. of Legal Affairs Judicial Section, regarding Revision of fee payable to various categories of Central Govt. Counsel, wherein the Ad. Valoram / regulation fee (Subject to Max of Rs.45000/- in a case) against Original Suits, Civil Appeal from Decrees in Suits and proceedings including second appeal and land acquisition appeal except LPA from Petitioner under Article 226 & 227 of the Constitution (including drafting fee) is approved.

It is therefore, recommended that fee structure in terms of ibid OM be consider and approved

to engage a senior lawyer to defend the Cantt Board Jalandhar and others official respondents in the instance case effectively pleading, Counter Affidavits / reply to Writ Petition as mentioned in the agenda side.

In this connection all relevant papers are placed on the table for consideration.

Resolution:- The Board considered the issue in detail and after deliberation resolved to approve the revised fee structure for the instance case as proposed in the agenda side and authorised the Chief Executive Officer, Cantonment Board, Jalandhar to defend the subject Writ Petition on behalf of the Board and other official respondents by filing required reply/affidavit and also authorised to incur the expenditure thereof. The Board further also recommended that in view of the revised fee structure a panel of 3-4 lawyers/counsels for District Court and Punjab & Haryana High Court, Chandigarh be reviewed or formed as fresh and the matter be put up before the Board within 02 months for approval”. 10.(H) RESOLUTION:- Noted. Amplification – Sh. Suresh Kumar,V.P. stated that the Board un-necessarily has been dragged into litigation by approving the qualification and written test to be conducted at their own level irrespective of the TET and further contented that he stands by his views expressed earlier.

Sh. S.C. Somani, CWE stated that he never used any unparliament language. Shri Sanjeev Trehan, Elected Member raised the point regarding over flow of MES sewerage pipe line. He stated that the drains of Sofi Pind are blocked and the level of their pipes are not appropriate. Sh. S.C. Somani, CWE stated that the main cause of blockage in cantonment drains is the polythene bags. Sh. Suresh Kumar, Vice President stated that drains are not over flowing in the morning time and cantonment board pipes size is about 8” and last point pipe size is about 18”, so there is no cause of blockage in our lines. Smt. Sneh Gupta, Elected Member asked that spray should be done regularly in the civil area. PCB directed CWE, Cantt Board staff and Cantt Board members to proceed for a joint inspection of Sadar Bazar sewerage line in presence of SHO after Cantt Board meeting and submit a feedback for consideration of PCB. ITEM NO.18 REPORT OF CATTLE NUISANCE/SALE OF ANIMALS FOR THE MONTHS OF FEBRUARY 2017 AND MARCH, 2017.

Sneh Gupta, Elected Member raised the point regarding Cattle nuisance in the Cantonment area. Col. JPS Cheema, Nominated Member also raised the point that the Cantt Board Cattle Catchers only caught two cattle in a month whereas 11 cattle are caught by the military personnel. PCB directed the CEO to take necessary action for improvement in cattle catching matter. CEO informed the Board that Cantt Board staff has to act within the perview of cattle trespass act. CEO further informed the Board that action would be taken against the cattle nuisance. Sh. Sanjeev Trehan, Elected Member suggested to shift the dairies from the Cantt area to Village Subhana. PCB asked that shifting is the best policy but it is a long term process. Smt. Sneh Gupta, Elected Member stated that many accidents have been caused by stray cattle. Col. JPS Cheema, Nominated Member stated that the Cantt Board staff shift only non- mulching cows outside the Cantonment limits. He further suggested that staff have to shift mulching cows also outside the Cantonment limits. Sh. Suresh Kumar, Vice President agreed with Col. JPS Cheema’s views. Sh. Sanjeev Trehan, Elected Member suggested to construct boundary wall at village Subhana for dairy purpose and thereafter all the dairy owners can be directed to shift their cattle there. CEO informed the Board that the residents of village Subhana may object to construction of the boundary wall. CEO informed the Board that a Committee of the Elected Members has already been constituted for this purpose. CEO asked Shri Suresh Kumar, Vice President to finalize the Committee Report.

Sh. Suresh Kumar, V.P. asked that charges should be reduced then the dairy owners will be willing to shift their dairies to the earmarked place. PCB informed the Board that the matter would be discussed in the next board meeting. ITEM NO.19 SWACHH BHARAT ABHIYAN AND IMPLEMENTATION OF SOLID WASTE MANAGEMENT RULES, 2016 : PROCUREMENT OF NEW GARBAGE COLLECTION RICKSHAWS AND ENGAGEMENT OF MANPOWER Reference C.B.R. No.16 dated 03.06.2015. To consider the question of procurement of new garbage collection rickshaws and engagement of manpower for door to door collection of garbage from civil area of Cantonment. The Cantt Board Jalandhar has to provide the door to door collection of garbage services in the civil area, which is being carried out presently. At present these services are provided through 15 garbage collection cycle rickshaws alongwith 15 staff (on contract basis). The existing strength is insufficient and is not appropriate to provide the services in a true manner. There are almost 4500 houses/locations located in the civil pocket of Jalandhar Cantonment and the Cantt Board has resolved to provide two types of separate dustbins to all houses for segregation of garbage at source. Keeping in view the enhanced work load and to provide the services more effective and improvised to the residents of the Cantonment there will be requirement of the following:- 1. Requirement of 30 Nos. new garbage collection cycle rickshaws duly partitioned for collection

of biodegradable and non biodegradable waste. 2. Additional requirement of 30 persons (on contract basis) other than permanent strength for

door to door collection of biodegradable & non biodegradable waste. (Presently available 15, additional required 15).

The tender of the subject Cantt fund property were invited on 14.09.2016 fixing Minimum Reserved License fee (MRLF) Rs.3,000/- per month vide CBR No. 25 (B) dated 19.08.2016. The shop was licensed out to Sh. Murari Lal Aggarwal S/O Sh. Om Parkash Aggarwal, House No. 110, R.A.Bazar, Jalandhar Cantt for a period of three years i.e. 20.10.2016 to 19.10.2019 @ Rs.3,200/- per month, but he informed vide letter dated 02.02.2017 that he was unable to run the shop due to a huge loss in business and requested for taken over the vacant possession of the subject shop on or before 10.02.2017. He handed over the vacant possession of the above said property on 18.02.2017 and his security money was forfeited as per the clause No. 14 of the license agreement. The fresh tender of the subject property was called on 17.03.2017 for a period of three years extendable by two year fixing M.R.L. fee Rs. 3,000/- per month. To consider the matter of traffic problem and parking of vehicles in the civil area of the Jalandhar Cantt.

It is seen that residents of the Jalandhar Cantonment are parking their vehicles on the roads

sides in day and night time which cause hindrance for smooth traffic of vehicles in day time. This office licensed out the three sites of parking in the Cantonment area i.e. Near Sabji Mandi, Opposite S.B.I. Bank and Near Local Bus Stand for parking of the vehicles and fixed the nominal charges of Rs. 10/- per day for four wheeler vehicles. It is suggested to not allow the four wheeler vehicles to park on the road from 9 AM to 8 PM in the market area like Hardyal Road, Patel Road, Mool Raj Road, Phagwara Road and its linked crossing road etc.

It is further suggested that S.H.O and traffic police may please also be approached to take

action on the vehicles which are parked on the roads in day time i.e. 9 AM to 8 PM by issuing the sticker challan against the defaulter and also approach the S.H.O Cantt Police station to arrange the tow-away vehicle for this purpose. 22. RESOLUTION:- Considered and approved. Col. JPS Cheema, Nominated Member has informed the Board that some shopkeepers have encroached the front area of their shops. Sh. Suresh Kumar, Vice President also pointed out that the shopkeepers have also covered the yellow line area. CEO informed the Board that Cantt Board staff will take necessary action with the help of Cantt Police personnel to resolve the traffic problem. “That the Cantonment Board Laboratory is operational and is the liability of Cantonment Board,

Jalandhar Cantt. That the Laboratory is maintained by Cantonment Board and the maintenance and other liabilities of Cantonment Board, Jalandhar Cantt are as following:- 1. That the accessories which are used for tests at the laboratory are provided by the cantonment board amount to expenditure on purchase and maintenance of machinery for conducting tests at laboratory. 2. That the lab attendants are provided by the cantonment board and their salaries are paid by the cantonment board adding to the expenses of the cantonment board. 3. That the fluids and other chemicals which are used in the laboratory for tests are also provided by the Cantonment Board, Jalandhar Cantt. 4. That the electricity bills of the laboratory which included the use of full time Air conditioner in the laboratory are also paid by the cantonment board adding to heavy expense to the cantonment board. 5. That all the tests are not conducted at cantonment board laboratory and are done at high rates without any discounts from outside laboratories adding to high tests costs to the general civil public. I propose that this laboratory to be given at contract to any company and the incidental benefits to cantonment board and to general public are as following: 1. Cantonment board’s cost of salary to lab attendants will be reduced to zero affecting to increase in the revenue of the cantonment board. 2. That the company so contracted will be providing the fluids and other chemicals which are used in the laboratory for tests and will reduce the expenses of the cantonment board, Jalandhar Cantt. 3. That the electricity bills of the laboratory will be paid by the company so contracted to run the laboratory, cutting the heavy expense of the cantonment board, Jalandhar Cantt. 4. That a facility of 24 hours running laboratory will be provided with this proposition if taken by any company on contract basis providing additional facility to the civil population. 5. That the tests which were done from outside earlier by this means will now be conducted in the laboratory itself and then there will be no need to get the tests conducted from outside laboratories. 6. That in addition to these facilities the company will pay contract fees to the Cantonment board, Jalandhar Cantt adding to another source of income to the board.”

25. RESOLUTION:- The matter discuss in detail. Shri Sanjeev Trehan raised the point that the Cantt General Hospital Laboratory should be privatised because all material is currently given by the Cantonment Board. Only men power is taken from the contractor. The facility of all lab tests are not available in the Cantt General Hospital Lab and mostly tests are done outside where patients are charged high rates. Sh. Sanjeev Trehan further stated that the private agency will give 24 hours services in the Cantt General Hospital and will also charge at par with govt. rates. Sh.Rajinder Sharma stated that mostly pregnant ladies are coming in the Cantt General Hospital and doctors prescribed tests to the patients. The contractual Lab Technician has been doing this job for about 13 years and not a single complaint has been received till date against the Lab Technician. He further stated that Lab Technician is doing good job and about 6000 tests are done monthly in our lab which also generate revenue for Cantonment Board. Brig. Ramesh Kaushik, SEMO informed the Board that he personally checked the Lab Test documents and enough tests are done by the Cantt General Hospital on rates at par with the State Govt. These lab tests are generating enough income for the Cantonment Board and there is no need to outsource the Laboratory of Cantt General Hospital. The private lab agencies are totally commercialised and charge high rates from the patients. Brig. Ramesh Kaushik, SEMO further informed the Board that the Lab Technician should maintain one register to enter the tests done outside. The lab technician would inform the Board how many tests are done through the private laboratory and how much amount is charged by the private laboratory which would be checked by him after two months. PCB agreed with the views of the SEMO and stated that there is no need to outsource the Cantt General Hospital Lab. PCB further directed the CEO to check the performance of the lab technician. ITEM NO.26 RATIONALIZATION / REVISION OF ESTABLISHMENT OF TEACHING STAFF TO PROVIDE QUALITY OF SCHOOL EDUCATION & TO IMPROVING THE PERFORMANCE OF CANTONMENT BOARD SCHOOLS.

Ref- Minutes of Committee held on 12.05.2017 on the subject cited above.

The Board is informed that the Dte. DE WC letter No.15/428/Rulling /Cantt/DE/2016 dated19.10.2016 & Letter No.15/933/ADM/ WC/DE/RMS 27010/136 dated 15.11.2016 w.r.t. Dte. Gen.DE letter dated 4.11.2016 - observed and expressed its views regarding filling of vacancies “that due to financial constraints recourse was taken to contractual engagements for disposing various works of Cantonment Boards, however wholesale engagement of contractual labour for doing works of any section is not advisable for various reasons. Moreover this system may also lead to different kinds of exploitation of contractual labour. Another area that requires urgent attention is engagement of teachers in the schools run by the Cantonment Boards. In some Cantt, teachers have been taken on contract basis and regular basis posts are lying vacant.”

Further directed that a thorough review of these posts is necessary and considering the trend of enrolment required teacher-student ratio, a view may be taken as to the requirement of teachers.

Further also directed that Cantt Boards review their staff strength and take decisions about recruitment appropriately.

In order to comply with the directions of DG DE / PD DE WC & Super review report dated 31.03.2017 issued by the PCDA, WC Chandigarh, a committee comprising elected members of the Board, Principals and officials was constituted to review the staff strength of Schools, etc.

Consequently, meeting of said committee was held on 12.05.2017 in the office of Cantonment Board office and the said review Committee with their considered views have made certain recommendations on the subject cited above, which is appended as Annex-A .

The Board is to consider the recommendations made under minutes of the review committee dated 12.05.2017.

It is pertinent to mention here that the Pb. Govt. vide its letter dated 08.05.2017 has also initiated process for merger of Govt. schools having low student strength & violating the area or limit for establishment neighbourhood school as laid down under Pb. Govt. RTE Rules, 2011.

In this regard all relevant papers in all respect are placed on the table for perusal of the Board.

26. RESOLUTION:- At the start, CEO informed the Board that the DG DE & PD DE WC Chandigarh has directed to draw attention of the CEOs /Boards towards judgements of The Hon’ble Supreme Court of India, laying down principles of granting equal pay to equal work to temporary employees and Principles regarding regularization of temporary employees, further directed that actual requirement of establishment be made against the sanctioned vacant posts and same may be filled up by Direct Recruitment.

CEO, also quoted the directions made under para 07 of Dte.DE WC letter No. 15/428/Ruling /Cantt/DE/016 dated 19.10.2016, that engagement of teachers in the schools run by the Cantonment Board have been taken on contract basis and regular basis posts are lying vacant. English Medium schools are being run with contract teachers. Further directed that a thorough review of these posts is necessary as teaching cannot be left to such arrangements in order to impart quality education to the students. Further also directed that English Medium Schools be got recognized and affiliated appropriately.

Moreover excess teachers on regular / contractual basis against existing low students strength have been kept in violation of the laid down norms of RTE, 2009 and Pb. RTE Rules, 2011.Further the DY CDA also made objection for excess staff.

Hence policy of rationalization and merger of schools is required to be proposed. CEO further suggested the Elected Members to discuss the merger of each Schools one by

one. Consequently, at the outset, Board resolved to merger of middle classes from CB Elementary

School, R.A.Bazar to Boys / Girls Sr. Sec Schools.

With regards to Merger of Mata Parvati CB Primary School with CB Primary School Moh.No.20 JRC, Sh. Sanjeev Trehan, MCB stated that the Mata Parvati, CB Primary School which is lease hold property stands in the name of Mata Parvati Trust who had given the land to CB for maintaining School and is having more student strength in comparative to Moh. No. 20, hence resisted that CB primary School, Moh.No.20 JRC be merged into Mata Parvati School and building of Moh. No. 20 JRC be utilized for Vocational Centre. Smt.Puneet Kaur, MCB seconded him. Whereas Sh. Suresh Kumar, Vice President, stated that Cantt Board Primary School, Moh.No.20 JRC be converted as Silver Oak Public School.

With regards to CB primary School, Rama Mandi, JRC – Sh. Suresh Kumar, Vice President

stated that CB Primary School should remain at Rama Mandi irrespective of the low students strength and further suggested that 4-5 rooms in the parking area land adjacent to existing school which is also under the management be constructed and existing building be utilized as commercial site to generate the revenue of Board.

The Chief Executive Officer, stated that in considering the directions of DG DE / PD DE WC and objections raised by DY CDA regarding engagement of Excess holding of Staff on contract basis; teaching staff only against the sanctioned strength will be provided and extra contractual teaching staff which is engaged beyond sanctioned strength will be discontinued. CEO also took the stand that it is an administrative matter and orders in this regard will be issued shortly.

In concluding the issue, the President stated that although he is not in favour of merger of school, but due to over and above engagement of teachers on contractual basis as have been pointed out by the Dy CDA, there is need to take action in this regard and further also directed to constitute a Committee comprising CB officials and elected members to examine the issue of Merger of Schools / Staff afresh and to prepare a detail presentation of each school with existing data in Power Point which may be shown to him to take further action and decision in this regard. Jalandhar under section 304-B IPC and has been sentenced to undergo ten years of imprisonment. As per section 34 sub section 4 of Cantonment Act 2006 a registered show cause notice was served to him on 10.4.2017 at Modern Jail, Kapurthala, where he has been presently lodged and call upon him to show cause within fifteen days as to why he should not be removed being an elected member of Cantonment Board. In response to show cause notice he filed his reply dated 02.05.2017.

Legal Opinions dated 04.4.2017 and 25.4.2017 were solicited from Shri Mandeep Singh Sehdev, Legal counsel of the Board and he opined that “Shri Rajinder Kumar Member Contentment Board can be removed by initiating provision under section 34 section 28 and 29. He further opined that even if Shri Rajinder Kumar Raju is bailed out by the appellant court there is no effect until and unless the conviction is stayed. The chances of stay of convictions are very less. So the proceeding for removal of Rajinder Kumar Raju can be intimated as per law. The reply of the show cause notice was also shown to Sh. Mandeep Sachdev Counsel of the Board. In this response he opined that his previous opinions are final. In this connection all relevant paper alongwith legal opinions dated 04.4.2017 and 25.4.2017 and reply of show cause notice filed by said Sh. Rajinder Kumar Sonker dated 02.05.2017are placed on the table.

29. RESOLUTION:- Considered and approved proposal be sent to the GOC-in-C for removal of Sh.Rajinder Kumar Sonker (Raju) elected Member of Cantonment Board as he has been convicted by Court of Shri RS Atri , Learned Session Judge, Jalandhar under section 304-B IPC and has been sentenced to undergo ten years of imprisonment.

After the Gazette Notification received from the Ministry of Defence for removal of membership then the re-election of the concerned ward shall be initiated by the board.

ITEM No. 31 FILLING OF ESSENTIALLY REQUIRED POSTS OF VARIOUS CADRES LYING VACANT BEYOND

ONE YEAR IN JALAHDHAR CANTT BOARD.

and DG DE letter No. 25/Misc /C /DE 2004 dated 13.01.2011.

To consider the subject issue, the Board is informed that this office has acute shortage of

permanent staff in Sanitation Branch, Schools, Hospital and Office due to death / regular retirement of

Cantt Board employees and no Direct recruitment in Group -C (except teaching staff) against the

posts lying vacant beyond one year has been made from the last 7-8 year to this effect as the prior

approval of Dte. DE is required to filling of vacant posts, resulting the routine works on essential posts

to deal with the civil area suffering a lot due to deficiency of manpower in various branches.

Whereas, the Principal Director Western Command vide their letter under reference has

directed - that a thorough review of these posts is necessary and considering the trend of enrolment

required teacher-student ratio, a view may be taken as to the requirement of teachers.

Further also directed that Cantt Boards review their staff strength and take decisions about

direct recruitment appropriately.

In order to comply with the directions of DG DE / PD DE WC as referred above, the

requirement of posts in various cadres have been workout and it is observed that the following

sanctioned posts lying vacant from more beyond one year and are essentially required to be filled for

smooth functioning of this office;

2. DPE - 01 No.

3. C&V Teachers - 03 Nos.

4. JBT Teachers - 13 Nos.

It is also informed the Board that presently, the contractual staff has been engaged for

It is therefore recommended that above mentioned vacancies / posts are essentially required to

be filled for not only smooth functioning of this office but also to improve & provide better facilities in the

field of Education / Medical and Sanitation to the general public of this Cantonment Board.

UNAUTHORISED CONSTRUCTION Reference C.B.R. No.01 dated 07/10/2016.

There are following cases of unauthorized constructions in respect of the under mentioned properties which are as under:- 1.) Property No. 94(P) at Mohalla No.21 (Outside). 2.) House No.47/4, 47/5(P), 47/6, 47/7(P) at Mohalla No.28. 3.) House No.8/1 at Mohalla No.05 (Outside).[ 4.) Shop No.85 & Shop No.85/1 at Mohalla No.27. 5.) Property No.3, 3/1, 3/2, 3/4(P) at Mohalla No.01.

Board vide C.B.R. No.01 dated 07/10/2016 had resolved that fresh applications for mutations in the General Land Register records maintained by this office, be called from the occupiers of the above mentioned referred property cases and in case of breaches of terms and conditions of Old Grant/Leases, proposals be forwarded to the Central Govt. for condonation of the same and also for the composition of the unauthorized constructions.

Accordingly, the occupiers/applicants of these properties had already been informed/asked by this office to provide the requisite documents to establish the entire link-up between the recorded Holder of Occupancy Rights as per the General Land Register records maintained by this office and with the occupiers of the above mentioned properties, so that the cases for the composition of the unauthorized constructions be referred to the higher authorities. But till date the complete relevant documents to establish the entire link-up between the recorded Holder of Occupancy Rights as per the G.L.R. records and with the occupiers of the above mentioned properties, has not yet been submitted by any one of the occupiers of the above mentioned properties

Board to take necessary decision in the matter. In this connection all relevant papers are placed on the table.

37. RESOLUTION:- The matter was discussed in detail. CEO informed the Board that as resolved by the board previously regarding composition proposal w.r.t. these 05 cases, necessary and relevant documents have not been received from any one of them. Hence further action as per Cantt Act 2006 is required to be taken against them.

Shri Sanjeev Trehan, Elected Member requested the Board all 05 cases are to be compounded

The lease was not renewed after the expiry on 30.10.1974 and the site was not vacated by the lessee. After the death of lessee his wife Smt. Budhwanti executed a registered General Power of Attorney vide No.2334/4 dated 13.12.1982 in favour of her son Sh. Gian Chand. Under the authority of said General Power of Attorney, Sh. Gian Chand S/O Dewan Lachhman Das has sold the property vide sale deed No.4289 on dated 19.09.2002 to Smt. Kiran Bala W/o Sh. Surinder Kumar Aggarwal. Further Smt. Kiran Bala W/o Sh. The lease of property bearing Survey No.283/2522 is Scheduled VI Rules 1925 as per the original lease deed (copy of the original lease enclosed as Annexure-I) and the purpose of lease was Dwelling House. The lease has been executed on 06-09-1935 for the first term for 30 years and full time period of the lease was 90 years which is renewable after a period of 30 years. The leased property transferred in the name of Smt. Lakshmi Devi W/O Sh. Kidar Nath for the period of 30 years w.e.f. 06-09-1965 vide GOC-in-C, Western Command, sanction letter No.21/1757/LC/4 dated 15-05-1967 (copy of the sanction letter attached as Annexure-II). The second term had been renewed from 06-09-1965 for further 30 years (copy of the renewed lease deed as Annexure-III) and the same has been expired since 05-09-1995. Smt. Lakshmi Devi W/O Sh. Kidar Nath has made a WILL in the favour of Smt. Banti W/O Sh. Budhu Ram for the leased property. After that Smt. Banti W/O Sh. Budhu Ram had sold the leased property to Smt. Krishna Devi W/O Sh. As per this office records land remaining 5000 sft. (0.11 Acre) leased to L.Gharsi Ram S/o L. Kesho Ram. As per the original lease deed was executed w.e.f. 01.12.1931 and the same has been expired since 30.11.1961. The lease of property bearing survey No. 283/2523 is Schedule VI Rules 1925 and as per the original lease deed the purpose of lease deed is residential house. The time period of the lease was for 90 years which is renewable after a period of 30 years on the request of lessee. After that lease property is transferred in the names of Sh. Bhola Nath S/o of Sh.Gharsi Ram & Devi Chand S/o Sh.Budhu Ram S/o Sh.Gharsi Ram. After that leased property transferred in the name of Sh.Milkhi Ram and Sh. Harnam Dass both sons of Sh. Rodha Ram. Tara Devi w/o Sh. Sohan Singh under the authority of sanction accorded by the GOC-in-C, HQ Western Command vide letter 21/2018/Lands/LC dated 28.01.1971. Smt. Tara Devi w/o Sh. Sohan Singh executed a sale deed bearing No.639 dated 20.04.1995 measuring area of 19 and half marla’s which comes to 5304 sqft. In favour of Smt. Kanwaljit Kaur alias Kamaljit Kaur w/o Sh. Inderjit Singh but transaction by sale / transfer to this effect was not reported to the lessor which constitute a breach / violation of covenant 1 (8) of original lease. It is noticed that the lessee Smt. Tara Devi had sold the portion of property measuring area 5304 sqft. To Smt. Kanwaljit Kaur alias Kamaljit Kaur vide sale deed No.639 dated 20.04.1995 but failed to intimate the lessor as required under clause 1 (8) of the lease deed which required condonation by the competent authority. The said Smt. Tara Devi w/o Sh. Sohan Singh during her life time executed a WILL dated 18.12.1998 in favour of her son Sh. Inderjit Singh in respect of remaining portion measuring 496 sqft. The lessee Smt. Tara Devi w/o Sh. Sohan Singh died on 25.12.1998. The said Inderjit Singh under the authority of the said WILL dated 18.12.1998 executed a Sale Deed dated 18.01.2016 registered with the Sub Registrar, Jalandhar vide Sale Deed No.10482 dated 18.01.2016 in favour of Smt. Kanwaljit Kaur alias Kamaljit Kaur and vide her letter dated 18.01.2016 informed that remaining portion of the said property measuring 496 Sqft. has also been sold / transfer by Sh. Inderjit Singh son and legal heir of Smt. Tara Devi w/o Sh. Sohan Singh (original lessee) to Smt. Kanwaljit Kaur alias Kamaljit Kaur vide sale deed No.10482 dated 18.01.2016. Now, the present occupier Smt. Kanwljit Kaur W/o Sh. Inderjit Singh vide her application dated 15.05.2017 has applied for renewal/extension of the lease for the further remaining time period of lease i.e. 3rd term alongwith copies of sale deeds.

Sham Sunder in respect of property No. 36 at Mohalla No.11, Jalandhar Cantt vide their application dated 05.01.2016 had requested mutation of the above said property in GLR (General Land Register). As per the General Land Register maintained by Cantt. Board, Jalandhar the property bearing Survey No.283/556 is described as House No.36 at Mohalla No.11, Jalandhar Cantt admeasuring an area 1512 Sft., classified as class B-3 land under the management of Cantonment Board, Jalandhar and the nature of the holders rights are Old Grant. Subsequently, the applicants namely Sh. Vidya Sagar and Sh. Rajan Mittal sons of Late Sh. Sham Sunder vide their application dated 05.01.2016 has applied for entry in the GLR with relevant documents in claim of their owner along with registered admission deed admitting therein Govt.’s ownership of the land in question and right to resume the property. The applicants had also got decree dated 09.11.2002 from the District court in their favour and Board had also got legal opinion dated 21.03.2017 in respect of the above mentioned property from the counsel of the Board in this regard. As per the report of the Cantt. Overseer, there is no sub division of site. As per site there are shops and residential accommodation on ground floor and there is a residential accommodation on the first floor. There is no encroachment on Govt. land. Accordingly, a public notice vide this office letter No.JCB/B&L/GLR/Pro. No.36/M.No.11/5496 dated 18 March, 2016 had been invited by this office for inviting any objection in respect of above said property from general public by giving one month time from the date of publication but no objection had been received in this regard till date. It is mentioned here that the above said property is inheritance property. The applicants had also deposited the requisite fee for publication. Board to take necessary action in this matter.

ITEM NO.47 CONVERSION OF SODIUM VAPOUR LAMP STREET LIGHT SETS INTO LED STREET LIGHT SETS As per C.B.R. No.06 dated 02.12.2015 and C.B.R. No.24 dated 10.03.2016 the board considered the mater regarding conversion of SVL street lights to LED lights to improve outdoor lighting and save energy. It was further resolved that the existing sodium vapour street light sets and Tube light sets be replaced with 60 Watts and 25 Watts LED lights respectively except main approaching roads for entering in the Cantonment, which may be replaced with 90 Watts LED lights as per the specification mentioned in C.B.R. No.06 dated 02.12.2015. Subsequently vide C.B.R. No.12 dated 19.08.2016 the board had approved the annual tender for supply of Electrical Goods and LED street lights for the year 2016-2017. Accordingly 375 Nos. of 60 Watts LED street lights and 200 Nos. of 90 Watts LED street lights have been installed by replacing existing SVL street lights. The remaining SVL street lights tube light sets are required to be replaced by LED equivalents as follows:-

47. RESOLUTION:- Considered and approved. Elected Members raised the point that due to non uniform distance between street light poles, more lights are required at some points/areas inside Cantt. PCB directed the CEO that a survey may be done in this regard and fix more lights as per requirement.

BALKAR SINGH, JMIC, JALANDHAR That in the year 2010 after getting information from CPWD (MAP) and GE(East) a under section 116 of Cantts Act, 2006. The Cantonment Board had filed recovery suits under section 324 of Cantonments Act, 2006 against some firms for evading Octroi Tax plus composition being ten time of the Octroi tax so evaded. The above mentioned court has directed to the Board to settle the dispute through compromise and orally advised that pending cases are very old and have comes under action plan as per the direction of Hon’ble High Court, Chandigarh. Recently, the said court has dispose of four cases mentioned above in Sr. No.1 to 4 with a direction to District Collector, Jalandhar to recover the amount and inform the court. The firms mentioned as Sr. No. 5 to 7 have voluntarily deposited Octroi Tax and 2 times penalty and firm mentioned at Sr. No. 8 is also ready to deposit the same as their offer to effect compromise with the Board. In this regard a legal opinion dated 19.05.2017 is solicited from Sh. Mandeep Singh Sachdev, legal counsel of the Cantonment Board which are as under:- “Various petitions under section 324 of Cantonments Act, 2016 are pending before the Illaqa Magistrates at Jalandhar and in the said petitions, no recoveries are being effected with the help of District Magistrates. The JDs/ respondents are ready to compromise and have approached the courts to that effect. It would be better in case, the compromises are effected and the money is received as per compromise. It is to be mentioned herein that the orders which have been passed are not speaking orders and proper procedure has not been followed. Even otherwise, the goods were not confiscated at the spot, so there in likelihood that in case, the cases are decided then the same may be remanded by the courts. As the offenders are ready to compromise the matter, so the compromises may be effected taking into consideration the provisions of section 91 of Cantonments Act, 2006. Even otherwise, the court has given directions to the Cantonment Board to consider the cases of the offenders/respondents and accordingly to initiate the compromise within the frame work of law. Hereby, I give my opinion that the matter may be referred to the Board and in case, reasonable compromise is being offered by the respondents then the same may be compromised and the minimum compromise amount should not be less than the evaded taxes and two times to the value of the said Octroi, terminal tax and tole tax as the case may be. “ The concerned files and all of the relevant documents are placed on the table. 49. RESOLUTION:- Considered and resolved if the offenders are ready to compromise. four time penalty be imposed and the cases as mentioned in the agenda side be disposed off.
