5 PUBLIC QUESTION TIME Questions provided in writing prior to the meeting or at the meeting will receive a formal response. Sean Hickey, PO Box 2966, GERALDTON Question The proposal acceptance of the “CARDNO Design” by council is of great concern to many residents of Geraldton and beyond. The present situation inclusive of rock walling is of concern, as is the lack of data collection and modelling. Response The City refers the community member to the report of the Office of Appeals Convenor which dealt with this matter during the appeals process (Ground 1, pages 4-8). Question Can council show how it has arrived at promoting and selecting the doubtful CARDNO Model? Response The concept design is based on the outcomes of the Coastal Processes Study, which in turn was a key project in the Coastal Vulnerability and Risk Assessment Programme. The City also refers the community member to the report of the Office of Appeals Convenor which dealt with this matter during the appeals process (Ground 1, pages 4-8). Question How does it employ the principles of ecological sustainable development? What regard has council shown to recommendations by the National Committee on Coastal and Ocean Engineering (NCCOE) of Engineers Australia (EA)? Response In line with the document to which the community member refers (Engineers Australia [2004] Coastal Engineering Guidelines for working with the Australian coast in an ecologically sustainable way) the City is guided by WA State Planning Policy SPP 2.6 which sets the policy context. In addition the Coastal engineers from CARDNO are members of Engineers Australia and are bound to their code of ethics The costal engineers at Cardno refer to the document; Coastal Engineering Guidelines for working with the Australian coast, as it is about good best practice principles, however this document is a guideline, and was written in 2004, so there are documents which override this. Of particular note, is State Coastal Planning Policy - State

Planning Policy 2.6 (SPP2.6), which is government legislation, and the Cardno Costal Engineering group refers to this document on all projects, including Beresford Foreshore Coastal Protection and Enhancement. The modelling of Beresford Foreshore Coastal Protection and Enhancement was based on SPP2.6 Schedule One for sea level rise and coastal erosion. The model met the requirements of Schedule One of SPP2.6 to the satisfaction of the coastal engineers of the Department of Transport. This measured erosion as per the requirements of Schedule One at that time – i.e. using 0.34m for sea level over 100 years. The costal engineers are all members of the Institute of Engineers, and they all have a Professional Engineering Membership. In addition, the project team who worked on Beresford Foreshore Coastal Protection and Enhancement have a vast experience of costal planning project, both local and internationally. Barbara Pedersen, who worked extensively on the project was the Manager of WA’s Coastal Planning Branch in Department of Planning & Infrastructure when we developed and government gazetted of the first version of the State Coastal Policy Statement of Planning Policy 2.6 (SPP2.6). In addition she also had input into National Cooperative Approach to Integrated Coastal Zone Management document. Question They suggest in the guidelines (5.2 Ecologically sustainable development) coastal engineers and other practitioners need to recognize, understand and apply wherever practical the precautionary principle (Appendix 3). “This principle requires…. should act in advance of scientific certainty…” “It is also important to recognize and assess the immediate impact of continuing environmental degradation upon the viability of ecosystems, biodiversity, habitats and loss and decline in habitat quality…” Response The full description of the Precautionary Principal contained in the document to which the community member refers is provided below: “PRECAUTIONARY PRINCIPLE. States that the lack of full scientific certainty should not be used as a reason for postponing a measure to prevent degradation of the environment where there are threats of serious or irreversible environmental damage.” Source: Engineers Australia (2004) Coastal Engineering Guidelines for working with the Australian coast in an ecologically sustainable way, Appendix 3, p64. In reference to this precautionary principal the document Engineers Australia make the following statement in Section 5.2 (Ecologically Sustainable Development):

“Coastal engineers and other professional practitioners need to recognise, understand and apply, wherever practical, the precautionary principle (see Appendix 3). This principle requires that decision-makers should act in advance of scientific certainty to prevent harm to humans and the environment.” Source: Engineers Australia (2004) Coastal Engineering Guidelines for working with the Australian coast in an ecologically sustainable way, Section 5.2, p14. This project aligns with the precautionary approach identified in the document to which the community member refers. Question Where is the collected data showing the ecological effects of this infill and rock building program? Where is the data showing the effects of the ongoing ‘piece meal’ approach to rock walling at this coastal area? How does the practice affect the sand coastal area? How does the practice affect the sand infill program and at what rates has erosion increased along the coastal shoreline? CARDNO themselves are uncertain as to how this project will play out. Response The City refers the community member to the report of the Office of Appeals Convenor which dealt with this matter during the appeals process (Ground 1, pages 4-8; Ground 2, pages 8-10). Question At the first viewing of the proposed infill and groyne building program I asked why was there a need for the second groyne and the positioning of the possible third and fourth groynes. My question was answered to the effect “the second groyne is to counter the effects of the first built, and that the third and fourth locations are precautionary incase more protection is needed”. Doesn’t council have cause for concern about this approach? Response The statement misquotes the Consultants. The information provided to participants at the community consultation events was that the two headland structures are designed to stabilise the coastline and to provide an effective management point for the sediment deficit present at the Beresford Foreshore. Question Mr Dufour for the council recently stated when asked on ABC radio talk back “that the cause of the erosion is not understood. Just how does a council propose to convince the public that it knows exactly what is going to happen and that it has factored in all the present and future problems?

Response The statement misquotes the officer. The City in conjunction with multiple agencies has undertaken studies and investigations into the coastal erosion processes. These are understood. Question Further guideline recommendations suggest “wherever possible coastal engineers should seek to recommend environmentally friendly solutions for their clients needs”. Where are these recommendations to council? What in fact was the brief to CARDNO from council? Will council make the brief available for public viewing? Response The complete statement to which the community member refers is: “This [The Coastal Engineering Guidelines and the Towards Sustainable Engineering Practice (Greene, 1997)] implies, among other things, that wherever possible coastal engineers should seek to recommend “environmentally friendly” solutions for their clients’ needs, consistent with satisfactory performance standards, sustainability and the available resources.” Source: Engineers Australia (2004) Coastal Engineering Guidelines for working with the Australian coast in an ecologically sustainable way, Section 5.2, p14-15. The concept design brief was based on the outcomes from the Worley Parsons Coastal Processes Study where recommendations (based on modeling and community feedback) for coastal protection along the Beresford Foreshore consistent with the statement above were made. The concept design brief for tender was made available on the tenders webpage of the City’s website between 31 March 2011 and 19 April 2011, after which the tender closed. Four opportunities to ask questions about the brief were available to the community member. Council received no questions on notice or for public question time from the community member at the Agenda Forum Meeting of Council held on 12 April 2011, the Ordinary meeting of Council held on 19 April 2011, and the Agenda Forum Meeting of Council held on 17 May 2011. The community member will be aware that he presented questions regarding coastal issues (including the Beresford Foreshore) during public question time at the Ordinary Meeting of Council held on 24 May 2011, but none of the questions made reference to the concept design brief. With no challenges to the content of the brief the tender for the concept design was subsequently awarded to Cardno at the Ordinary Council meeting of 24 May 2011. Question Amongst checklist items recommended to authorities (councils) are that “low impact engineering alternatives be considered” and “is physical and numerical modeling of the impact of a structure or development

required?” Where is this data and does it clarify what CARDNO and council seemingly don’t know themselves? Response The City refers the community member to the previous answer. The City also refers the community member to the report of the Office of Appeals Convenor which dealt with this matter during the appeals process. (Ground 1, p4-8).

SUMMARY: The purpose of this report is seek Council adoption of the CP042 Community Engagement Policy as the basis to ensure community engagement is coordinated and integrated in a consistent manner across the City.

PROPONENT: The proponent is the City of Greater Geraldton. BACKGROUND: Community engagement and consultation is a regular and important part of the City’s regular activity, involving interaction of Council, stakeholders and the local community in a variety of settings and circumstances. The CP042 Community Engagement Policy aims to:

provide a consistent approach across City departments as to how City engages with the local community;

strengthen the partnership between City, government stakeholders, service providers, local organisations and the local community through ongoing community engagement; and

improve knowledge and skills of staff and to improve internal coordination.

The policy has been developed to ensure that meaningful public participation and community engagement activities are coordinated and integrated in a consistent manner across the organisation. It is important that Councillors and staff have a shared and strong understanding of the importance of community engagement and the various levels at which engagement can occur from informing, to consulting and to active participation. Inform One way communication that provides balanced and objective information to assist the community in understanding the problems, alternatives, and/or solutions. Consult A process of obtaining public feedback on predetermined analyses, alternatives or decisions.

Participation Participation is achieved by involving the community in a participatory process designed to help identify issues and views to ensure that concerns and aspirations are understood and considered prior to solutions being considered. Participation recognises and acknowledges the importance of working collaboratively with the community and stakeholders to develop an understanding of all issues and interests to work out alternatives and identify preferred solutions. Participation is achieved through a range of deliberative techniques that can encourage or enable participants to take responsibility for their contribution to solutions. Attachment 2 provides a detailed overview of the levels of engagement within the engagement spectrum, how they can occur, examples of engagement at each level, assumptions, risks and risk management measures and resourcing required. Increasing Councillors and staff knowledge about the various levels of engagement and the associated resources and risks will allow better evaluation regarding what level of engagement is needed/possible for each situation. It will also provide clear direction and shared understanding of expectations when staff to engage with the community on a particular issues/projects. COMMUNITY CONSULTATION: The community expectation and desire to be able to contribute to decision-making via a robust community engagement process has been a recurring theme in various community engagement exercises. The Community Strategic Plan and Community Charter articulate the community input regarding expectations for good community engagement. COUNCILLOR CONSULTATION: Cr Gabelish and Cr Brick as the Council nominated Community Engagement Champions have been involved in the development of the draft policy. The draft policy principles were a topic of discussion with Councillors at Concept forum on 5 June 2012. STATUTORY IMPLICATIONS: There are no statutory implications. POLICY IMPLICATIONS: Should Council support the Executive Recommendation, the draft CP042 community engagement policy will be enacted. FINANCIAL AND BUDGET IMPLICATIONS: There are no financial or budget implications.

SUMMARY: The Midwest Aero Club (Inc) MWAC has made a request to the City to relocate its club rooms to an alternate airport site. The MWAC have requested that the new site be provided by the City. The City has negotiated with (MWAC) through their Club Futures Committee and has offered MWAC the interim use of the building known as the WWII Power House with an agreement in principle to enter into a lease agreement for 240m2 of Airport land for development of a permanent club room.

PROPONENT: The proponent is the Midwest Aero Club (Inc). BACKGROUND: As a result of the introduction of Passenger and Baggage Security screening at Geraldton Airport and growing need for expansion, a new General Aviation Apron is being constructed adjacent to the Airservices Australia (ASA) building. Light aircraft General Aviation (GA) operations are being relocated to the north of the (ASA) building. ASA are in the final process of vacating the building, after which the building will be handed over the City of Greater Geraldton. It is intended that after some renovation the ASA building will become a new GA terminal servicing the new GA apron users and RAAF. The Midwest Aero Club (Inc) currently subleases the majority of the ASA building on a weekly tenure and have requested alternate accommodation be provided by Council for their club activities. Their move will allow development of the site to accommodate safety and security operational needs. COMMUNITY CONSULTATION: Council staff have met and corresponded with the MWAC Futures Committee and the Geraldton Airport User Group on this matter since November 2011 prior to the introduction of the second Regular Public Transport (RPT) airline introduction. CONCLUSION: Recreational clubs and organisations assist in the development of valuable social, educational, and community skills for the community. Aero Clubs form an integral part of the Airport community, they encourage young and old to pursue their interest in Aviation. Geraldton Airport has a long aviation history with the first Commercial Air Service in Australia departing Geraldton 5 December 1921 and subsequently a prominent WW11 air training base. The Midwest Aero Club carry on this aviation tradition today and forming a link with the past by becoming caretaker tenants of the WW11 Power House, pending their development of a new club rooms would be appropriate if approved by the Council. The equipment in the generator room is to remain and modifications to that room are to be limited. EXECUTIVE RECOMMENDATION: That Council by Simple Majority pursuant to Section 3.58 of the Local Government Act 1995 RESOLVES to:

1. AGREE that the Mid West Aero Club (Inc) be given occupancy of the WW11 Power House at Geraldton Airport subject to a Memorandum of Understanding for use as interim club room free of fees, commencing from 24 July 2012 and ceasing on 23 July 2014. SUMMARY: The purpose of this report is to seek a Council resolution to include another Councillor representative on the Heritage Advisory Committee. PROPONENT: The proponent is the Heritage Advisory Committee. BACKGROUND: The Heritage Advisory Committee, as an advisory committee of Council was established after the election of Council in 2011. The Committee is diverse in membership and includes two Councillors (Mayor, Ian Carpenter and Cr Neil Bennett), three community representatives, representatives of the three historical museums, the Geraldton Greenough Historical Society and heritage professionals including the Manager of the WA Museum, Geraldton, the National Trust, the Department of Indigenous Affairs and the Heritage Council’s Mid-West Heritage Advisor. Relevant Council staff attend the meetings as required. At the May Meeting of the Heritage Advisory Committee the Mayor reported that Cr Tarleah Thomas has expressed an interest in joining the Committee. The Committee is unanimous in supporting Cr Thomas’ inclusion on the grounds that further representation of Mullewa is important for the Committee’s considerations. (See Minutes of the Heritage Advisory Committee meeting held on 21 May 2012 under Reports to be received.) Barbara Thomas is currently the only representative from Mullewa. Cr Thomas is a Heritage, Culture and Arts Champion under Council’s Champions Policy. The Committee resolved to recommend Cr Thomas’ inclusion to Council. This report brings that recommendation before Council. COMMUNITY CONSULTATION: Community representatives are included in the Committee membership. COUNCILLOR CONSULTATION: Two Councillors are members of the Committee. This report recommends that this be increased to three.

SUMMARY: The premises at 203 Lester Avenue are vested in the City of Greater Geraldton and are currently occupied by the Midwest Multicultural Association on a short term tenancy that expired on June 30 2012. PROPONENT: The proponent is the City of Greater Geraldton. BACKGROUND: In January 2012 Council granted a six month lease of the building at 203 Lester Avenue located on Reserve 22257 which is vested in the City of Greater Geraldton by way of a Management Order for the purpose of “Community Purposes” with the power to lease for a period of up to 21 years subject to Ministerial consent. It was intended to undertake a full review to explore options for the future of the site and the building by March 2012, however the review has not yet been finalised. COMMUNITY CONSULTATION: Community consultation will be undertaken as part of the full review. COUNCILLOR CONSULTATION: No Councillors consultation has been undertaken. STATUTORY IMPLICATIONS:

Pursuant to section 3.58 of the Local Government Act 1995 – Disposing of Property (1) In this section –

“dispose” includes to sell, lease, or otherwise dispose of, whether absolutely or not;

“property” includes the whole or any part of the interest of a local government in property, but does not include money.

(3) A local government can dispose of property other than under

subsection (2) if, before agreeing to dispose of the property – (a) it gives local public notice of the proposed disposition –

Pursuant to Regulation 30 (1) and (2)(b)(i) of the Local Government (Functions and General) Regulations 1996 - a disposition of property under s 3.58 of the Local Government Act 1995 is an exempt disposition if the land is disposed of to a body, whether incorporated or not where the objects of which are of a charitable, benevolent, religious, cultural, educational, recreational sporting or other like nature.

POLICY IMPLICATIONS: There are no policy implications FINANCIAL AND BUDGET IMPLICATIONS: A commencement fee of $305.00 per annum plus GST for sporting and community groups reviewed annually as per the adopted City of Greater Geraldton Schedule of Fees and Charges will apply. Social: The accessibility of the premises for the Midwest Multicultural Association will be invaluable as they offer assistance with language classes, support for visas and assist families from Culturally and Linguistically Diverse backgrounds as they settle in the region. Environmental: There are no environmental impacts in the proposal. Cultural & Heritage: Organisations such as the Midwest Multicultural Association and the Midwest African Association are all volunteers who offer assistance to families from Culturally and Linguistically Diverse backgrounds as they settle in the region. RELEVANT PRECEDENTS: The City leases land and/or buildings to other community organisations such as Lotteries House, the Menshed Geraldton and Girl Guides Association. The City of Greater Geraldton’s Schedule of Fees and Charges apply in all situations. DELEGATED AUTHORITY: There is no delegated authority existing related to this proposal. VOTING REQUIREMENTS: Simple majority is required. OPTIONS: Option 1: As per Executive Recommendation in this report. Option 2: That Council by Simple Majority pursuant to Section 3.58 of the Local Government Act 1995 (as amended) RESOLVES to:

CONCLUSION: The Executive Recommendation would ensure that the building is tenanted while the review of the future of the building is finalised. Tenancy of the building will enhance the vibrancy of the area and reduce the possibility of vandalism. Adoption of the Executive Recommendation would also provide the Midwest Multicultural Association (MWMA) short term office space and meeting rooms from which they can continue to work with people from Culturally and Linguistically Diverse backgrounds. EXECUTIVE RECOMMENDATION: That Council by Simple Majority pursuant to Section 3.58 of the Local Government Act 1995 (as amended) RESOLVES to:

1. APPROVE short term tenure of 203 Lester Avenue to the Midwest Multicultural Association Inc;

2. SET the proposed conditions as: a. the term to be of not more than six months commencing 1 July

2012 and concluding 31 December 2012; b. a pro rata fee to be calculated based on the lease fee of

$305.00 per annum as per the adopted City of Greater Geraldton Schedule of Fees and Charges 2012/13;

c. the lessee to be responsible for separately paying all outgoings including all utilities, rates and minor maintenance; and

d. any costs associated with the preparation and execution of the lease document are to be borne by the lessee.
