44. Definition of the term ‘appropriate and acceptable destinations’

44.2 International trade in live African elephants: Proposed revision of Resolution Conf. 11.20 (Rev. CoP17) on Definition of the term 'appropriate and acceptable destinations'

Zimbabwe stated that it did not wish for the agenda of the plenary session to move forward before the dispute it had raised in the previous session had been dealt with and reiterated that it did not believe that a Resolution should be used to amend an annotation to a species listing in the Appendices. The European Union reiterated that it believed that the amendments it had suggested to Resolution Conf. 11.20 (Rev. CoP17) on Definition of the term 'appropriate and acceptable destinations' detailed in summary record CoP18 Plen. Rec. 2 would provide a transparent way forward until the process described in document CoP18 Doc. 44.1 had been concluded and the issue was revisited at the next meeting of the Conference of the Parties. The European Union requested to proceed to a vote on its suggested amendments to the proposed revision of Resolution Conf. 11.20 (Rev. CoP17) in Annex 1 to document CoP18 Doc. 44.2, as detailed in summary record CoP18 Plen. Rec. 2.

Niger supported the request of the European Union to proceed to a vote and reminded Parties that the Rule 23 of the Rules of Procedure stated that “Whenever the Conference does not reach a consensus on the adoption or rejection of a draft resolution, draft decision or other document, the Presiding Officer

shall propose its adoption be put to a vote”. It raised concerns that, if accepted, the dispute raised by Zimbabwe would set a precedent that would allow Parties to block votes at any time.

The Secretary General reiterated the Secretariat’s clarification that the mechanism for declaring a dispute was intended to address issues between two or more Parties with respect to the interpretation or application of the provisions of the present Convention, and that the relevant Parties may only proceed with the dispute once discussions had been concluded on this agenda item.

The Chair invited the Parties to vote on the proposed revision of Resolution Conf. 11.20 (Rev. CoP17) in Annex 1 to document CoP18 Doc. 44.2 as amended by the European Union. With a vote of 87 Parties in favour, 29 opposed, and 25 abstentions, the proposed revision of Resolution Conf. 11.20 (Rev. CoP17) in Annex 1 to document CoP18 Doc. 44.2 as amended by the European Union was adopted.

I. 10 had been accepted in Committee I and were adopted. The eight draft decisions in Annex 3 to document CoP18 Doc. 46 had also been accepted in Committee I and were adopted. Decisions 17.114 to 17.117 were deleted.

47. Enhancement of quotas for markhor hunting trophies

This document was withdrawn.

48. Black rhinoceros hunting trophies: Export quota for South Africa

The amendments to Resolution Conf. 13.5 (Rev. CoP15) on Establishment of export quotas for black rhinoceros hunting trophies contained in summary record CoP18 Com. I Rec. 4 concerning operational paragraph 1 of this Resolution had been accepted in Committee I and were adopted. Additionally, a new operational paragraph 3, contained in paragraph J of the Secretariat’s comments on document CoP18 Doc. 48 had also been accepted in Committee I and was adopted.

The draft revisions to Resolution Conf. 10.13 (Rev. CoP15) on Implementation of the Convention for timber species as described in summary record CoP18 Com. II Rec. 10 had been accepted in Committee II and were adopted. It was noted that the Secretariat would consider future revisions to the table in paragraph 1 a) of this Resolution.

51. Stocks and stockpiles

The renewal of Decision 17.170 had been accepted in Committee II and was adopted, taking note of the need referred to by Parties and the Secretariat that work on this matter should be more focused than it was previously.

Two new draft decisions in document CoP18 Doc. 52 had been accepted in Committee II and were adopted. Decisions 16.48-16.51 (Rev. CoP17) were deleted. It was agreed to maintain Decision 17.181.

53. Purpose codes on CITES permits and certificates

The draft amendments to Resolution Conf. 12.3 (Rev. CoP17) on Permits and certificates recorded in summary record CoP18 Com. II Rec. 11, had been accepted in Committee II and were adopted, together with a draft amendment to Decision 14.54 (Rev. CoP17) recorded in the same summary record.

56. Simplified procedure for permits and certificates

The United States of America requested clarification regarding the final text agreed for the revised Resolution Conf. 12.3 (Rev. CoP17) on Permits and certificates. The Secretariat noted that a Notification to the Parties

CoP17) on Permits and certificates and a draft decision on this subject, in in-session document CoP18 Com. II. 14, with amendments recorded in summary record CoP18 Com. II Rec 15, had been accepted in Committee II and were adopted.

57. Implementation of the Convention relating to captive-bred and ranched specimens

The draft decisions in paragraph 13 of document CoP18 Doc. 57, with amendments recorded in summary record CoP18 Com. II Rec. 12 had been accepted in Committee II and were adopted. Decisions 17.101 and 17.106 were deleted.

58. Implementation of Resolution Conf. 17.7 on Review of trade in animal specimens reported as produced in captivity

The amendments to Resolution Conf. 17.7 on Review of trade in animal specimens reported as produced in captivity described in summary record CoP18 Com. II Rec. 12 and the two draft decisions in Annex 1 to document CoP18 Doc.58 had been accepted in Committee II and were adopted. Decisions 17.103, 17.105 and 17.107 were deleted.

59.2 Source codes for plant specimens in trade

The amendments to Resolutions Conf. 11.11 (Rev. CoP17) on Regulation of trade in plants, Conf. 12.3 (Rev. CoP17) on Permits and certificates and Conf. 12.8 (Rev. CoP17) on Review of Significant Trade in specimens of Appendix-II species, detailed in summary record CoP18 Com. II Rec. 13 had been accepted in Committee II and were adopted. The three draft decisions in Annex 3 to document CoP18 Doc. 59.2 were adopted, noting that they would need to be closely coordinated with the work foreseen to be undertaken by the Plants and Standing Committees in the draft decisions accepted under agenda item 57.

It was agreed to delete Decisions 16.156 (Rev. CoP17) and 17.175 to 17.177.

Species-specific matters

60. Illegal trade in cheetahs (Acinonyx jubatus)

Ethiopia requested to re-open the debate on this agenda item, arguing that inadequate time had been given to the agenda item during discussions in Committee II. This was seconded by Kenya. Kuwait, Qatar and Saudi Arabia were opposed to re-opening the debate.

The Chair called for a procedural vote on whether to reopen the debate. With 34 Parties voting in favour, 83 against, and 26 abstaining, the motion to reopen the debate was therefore rejected.

The draft decision in paragraph 16 of document CoP18 Doc. 60 had been accepted in Committee II and was adopted. Decisions 17.124 to 17.130 were deleted.

61. Sturgeons and paddlefish (Acipenseriformes spp.)

The Russian Federation requested to re-open the debate. This was not seconded.

Four draft decisions detailed in summary record CoP18 Com. II Rec. 15, which had been accepted by Committee II were adopted. The Conference of the Parties noted that Mexico had requested the opportunity to review the final text of the decisions once the summary record concerned was available.

The Chair of Committee II expressed his gratitude to the Parties and observers in Committee II who had worked hard to reach consensus for their entire working programme.

104. Review of Resolution Conf. 10.9 on Consideration of proposals for the transfer of African elephant populations from Appendix I to Appendix II

Resolution Conf. 10.9 on Consideration of proposals for the transfer of African elephant populations from Appendix I to Appendix II was repealed. Decision 16.160 (Rev. CoP17) was deleted.

105. Proposals to amend Appendices I and II

The Conference of the Parties noted that proposals CoP18 Prop. 1, Prop. 13 and Prop. 23 had been withdrawn. The Chair of Committee I explained that two draft decisions in summary record CoP18 Com. I Rec. 15 had been accepted by Committee I as an alternative to acceptance of proposal CoP18 Prop. 13, and these were adopted.

The Chair of Committee I informed the meeting that proposals CoP18 Prop. 2, Prop. 22, Prop. 24, Prop. 26 and Prop. 27 had been accepted by Committee I after having been amended. Amended CoP18 Prop. 2 to maintain both Saiga tatarica and Saiga borealis in Appendix II with the annotation “A zero export quota for wild specimens traded for commercial purposes” was adopted. Amended proposal CoP18 Prop. 22 to include the annotation: “zero export quota for wild specimens for commercial purposes” was adopted. Amended Proposal CoP18 Prop. 24 to include Ceratophora karu, C. erdeleni and C. tennentii in Appendix I, and to include Ceratophora aspera and C. stoddartii in Appendix II with the annotation “zero quota for wild specimens for commercial purposes” was adopted. Two draft decisions relating to these species contained in summary record CoP18 Com. I Rec. 15, which had been accepted by Committee I, were adopted. Amended proposal CoP18 Prop. 26 to include Lyriocephalus scutatus in Appendix II with the annotation: “zero quota for wild specimens for commercial purposes” was adopted. The two draft decisions relating to this species in summary record CoP18 Com. I Rec. 15, which had been accepted by Committee I, were adopted. Proposal CoP18 Prop. 27 was amended to read “Goniurosaurus spp. (except the species native to Japan)” and was adopted.

The Chair of Committee I reported that proposals CoP18 Prop. 5, Prop. 7, Prop. 28 and Prop. 37 had been accepted by the Committee following votes. Proposals CoP18 Prop. 5, Prop. 7, Prop. 28 and Prop. 37 were adopted.

As part of the consideration of proposal CoP18 Prop. 31, it was agreed to include Iverson et al., 2016, in Resolution Conf. 12.11 (Rev. CoP17) on Standard nomenclature as a standard nomenclature reference for Ctenosaura spp.

Proposal CoP18 Prop. 6 had been accepted following a vote and was adopted. Indonesia asked that the Secretariat and Parties note that it would need 18 months to implement the decisions made on proposals CoP18 Prop. 6, Prop.7 and Prop. 28 due the time and resources required by national processes.

The Chair of Committee I noted that proposals CoP18 Prop. 8 and Prop. 9 had been rejected by a secret ballot. Proposals CoP18 Prop. 10 and Prop. 11 were also rejected by a secret ballot after having been amended. Proposal CoP18 Prop. 12 had been rejected by Committee I after a vote. Proposals CoP18 Prop. 8, Prop. 9, Prop. 10, Prop. 11 and Prop. 12 were rejected.

The Chair of Committee I reported that proposal CoP18 Prop. 38 to include glass frogs of the genera Hyalinobatrachium, Centrolene, Cochranella, and Sachatamia in Appendix II had been rejected after a vote. Costa Rica, supported by Honduras, asked to open debate on this issue, in order to give more range States the opportunity to comment on the proposal. Guyana, supported by the European Union, opposed this motion. Following a vote with 68 in favour, 61 against and 14 abstentions, the motion received the required support to reopen debate of the proposal.

Peru, also on behalf of the following Parties: Antigua and Barbuda, Argentina, Bahamas, Belize, the Plurinational State of Bolivia, Brazil, Chile, Cuba, Ecuador, Guatemala, Jamaica, Nicaragua, Paraguay, the Dominican Republic, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines and Uruguay, supported the proposal, highlighting the difficulty in differentiating amongst species of glass frog, and arguing that the international pet trade was putting pressure on wild populations in the majority of the range States. Mali, echoed by India, Kenya, Mongolia, Niger and Qatar, also expressed their support for the proposal, noting that threats to the four genera included habitat destruction and international trade. Defenders of Wildlife, also speaking on behalf of Animal Welfare Institute, Eurogroup for Animals, Humane Society International (HSI), International Fund for Animal Welfare (IFAW), ProWildlife, World Animal Protection and Species Survival Network, supported the proposal.

Guyana argued that certain species included in the proposal did not meet criteria for listing on Appendix II as they were not subject to international trade. It noted that alongside Suriname, it had not been consulted for the proposal, despite both being range States. Guyana suggested that action at the national level by range States would be more appropriate and requested that these countries focus on filling knowledge gaps for the four genera. The European Union opposed the proposal on the basis that enforcement issues would arise from challenges in distinguishing between protected and non-protected species and referred to the instability of the group’s taxonomy. Guyana and the European Union believed that adopting this proposal was premature but were committed to working with other range States to improve the proposal for consideration at the 19th meeting of the Conference of the Parties.

With a vote of 83 votes in favour, 46 against and 11 abstentions, proposal CoP18 Prop. 38 was rejected.
