Proposal is to construct two four-flex buildings, on the subject parcel (Block 19-20-21).

Original zoning on lots was Manufacturing but in 1988 changed to Residential 20. Then with Docs Place Subdivision this was changed to Commercial 51 a mixed use (residential and commercial zone).

In 2004, (Malyon Subdivision now known as Heron Court), only this small portion of land was left as commercial.

Planning is of the opinion that the historic concept of the CN use, as well as today's new convenience stores typically include a service station etc., however, such a use is not permitted in the CN and no longer permitted by the TSSA (Technical Standards and Safety Authority) or the municipality in such close proximity to residential land uses.

In addition, the dominant trend in any new or expanded Plan of Subdivision in Cornwall is to not include a CN Block, as those convenience-based services tend to now locate in Power Centre type developments.

The current application is to rezone the parcel back to a Residential 20 zone to allow the construction of two four-plex buildings on one lot. This provision, as well as a rear yard setback reduction, will be incorporated into the Bylaw.

The parcel is located on the exterior of the subdivision.

The proposal is in conformity with the Provincial Policy Statement and the Official Plan Designation is Urban Residential.

The Official Plan directs that diverse housing needs are satisfied for all life styles, income level and tenure.

Development will be subject to the Site Plan Review process at such time the exact location of the access will be determined. The OMB decision however identifies that only one access (which exists) will be permitted onto Second Street.

Site specific zone changes will be implemented.

Planning Division staff is supportive based on land use principles of compatibility.
