INSTRUCTIONS TO TENDERER

1.01 Sealed and superscribed items rate tenders are invited from reputed experienced licensed Electrical Contractors having experience in State Electricity Board/ MSEDCL, P.W.D., etc.

1.02 The scope of work covered under the tender shall comprise of attending Overhead H.T/LT lines fault & under ground H.T./L.T. cable fault ,erection of Overhead H.T/LT lines & under ground H.T./L.T. cable and transformer centre with allied works as per the instructions of concerned S.D.O.’s / S.O. after receipt of order from the Office and completing of all formalities. The value of this tender is Rs. 5 Lakhs only.

1.03 The earnest money to be deposited with tender shall be Rs. 5000 (Rs. Five Thousand Only). Tenders submitted without earnest money shall be summarily rejected.

1.04 Payment of earnest money as indicated in clause 1.03 shall be accepted in the form of cash / demand draft in favour of Executive Engineer, MSEDCL, Padmavati Divn , Pune payable at any Scheduled Bank, Pune. The Earnest Money Deposit will be forefeited in case successful tenderer fails to pay security deposit and execute the contract agreement within the prescribed period. Payment of Earnest Money by “Cheque” shall not be accepted.

1.05 The tenders must be filled in prescribed forms only. The blank tender form will be available at the cost of Rs. 1040/- in cash at office of Executive Engineer, Sangam Society, Padmavati water works, Pune Satara road, Pune - 411 037 from 17.06.09 to 24.06.09.

1.06 Tenderer must return the tender form together with the specifications and the rates duly filled in and other schedule duly signed. Any tender not bearing the signature of tenderer on all the documents accompanying the tender is liable to be rejected. The tenderer shall also fill up the PARTICULARS OF TENDERER and submit the connected documents with tender in envelop No. 1.

1.07 The tenderer will have to submit solvency certificate from any Nationalised Bank to the extent of 50% of value of the tender.

1.08 The tenderer shall be deemed to have studied the specifications and all other documents attached to the tender papers, on his having filled in tender. The rate shall be in % above /% below / at par of the rate schedule The % rates offered by the Tenderer shall be quoted at the end of the schedule ‘D’ only.

1.09 The tender duly completed sealed and super scribed with the subject of tender and due date of opening on the face of cover will be received upto 13.00 hrs. on the due date and opened on the same day, if possible in the said Office in the presence of tenderer or the representatives who may choose to remain present.

1.10 It shall be definately understood that the MSEDCL does not accept any responsibility for the correctness or completeness of the Schedules enclosed for given part and the schedules are liable to alterations by commissions, deductions or addition in the item or quantities at the discretion of the Executive Engineer or his authorised representative and contractor would be bound to execute all the quantities actually ordered / encountered during execution at the corresponding tender prices.

1.11 The rates in the schedule shall be quoted in figures as well as in words. In case of any differences in the rates quoted in words and figures, the lowest of the two will only be considered. All the entries by the tenderer should be in ink erasing and over writings are not permissible. All corrections and insertions should be initiated by the tenderer.

1.12 The contractor on award of the contract will have to pay a security deposit for work contract at the rate of 5% of the value of contract by cash or Bank Guarantee for the same value in the prescribed Company’s format.

1.13 Tenders which do not fulfil any or all the conditions or are found incomplete in any respect are liable for rejection.

1.14 The undersigned reserves the right to accept or reject any part or all tenders without assigning any reasons. Further the undersigned reserve the right to bifurcate the tender order and work to more than one contractor.

1.15 Tenders shall remain open for acceptance subject to the provisions of clause 1.14 above for a period of 6 months from the date on which they are due for submission in accordance with clause 1.09 above and during the period no tenderer would be allowed to withdraw his tender. Any such withdrawal during the said period will entail forfeiture of the Earnest Money Deposited by the Tenderer.

1.16 The Sale Tax VAT on material or on transfer of property in goods involved in the execution of work contract or any other tax on raw material or on any fabricated material of works shall not be separately paid as an addition to tender rates by the Company. The rates for the several items of work indicated in attached schedule are deemed

to include all local and general taxes excise duty etc. royalties and any other incidental charges payable by the contractors at any instant of works. Tenderer should attach a certified photocopy of sales tax registration under works contract. The work contract tax as specified by the Government will be deducted directly from contractor’s bills, as per applicable rates.

1.17 Income tax, Works Contract Tax and/or other taxes applicable at appropriate rate will be deducted from the contractors bill at the prevailing rates and applicable surcharges thereon of the gross value of the bill as per instructions laid down in Government of India Notification unless the necessary exemption certificate from the income tax department authorised for the purpose is produced in time.

1.18 The contractor on placement of the work order enumerating the contract conditions shall within the prescribed period have to execute a written agreement on the prescribe standard form as per Company Rules. The regular stamp fees etc. necessary for completing the agreement shall have to be borne by the contractor.

1.19 No tender will be considered for acceptance unless it is accompanied by the latest income tax clearance certificate issued by the competent authority in favour of Tenderer and attested copies should be attached with tender.

1.20 The latest attested copies of valid Electrical Contractor License from Competent Authority should be attached with the tender.

1.21 This instructions to tenders shall also form part of the contract.

1.22 The bidder shall submit his offer in two envelopes viz. Envelope No. (1) Qualifying Bid (2) Price Bid. Envelope No. 1 will be for qualifying bid and shall have following documents with attested copies.

a) Valid Electrical contractor licenses b) Valid Income Tax Clearance Certificate c) Valid Sales Tax Registration Copy and clearance

certificate issued by Competent Authority. d) Valid works contract registration. e) Experience certificate regarding completion of work

of said type having amounting more than Rs. 2 lakhs in one calendar year (During the last 3 years.)

f) Solvency certificate of 50% of value of tender issued by National Bank after 01.04.2007.

g) Copy of receipt regarding payment of EMD.

1. Initially while opening the tenders, the envelope No. 1 i.e. Qualifying Bid will be opened first. The price bids of only those bidders who are qualified in the Qualifying Bid will be opened later. For qualification, all the documents duly attested as mentioned in Clause 1.22 above are required. The price bids of bidders who have submitted all the valid documents as per clause 1.22 above shall only be qualified for opening of price bids.

4. Above rates are inclusive of transportation with loading and unloading of materials by contractor from concerned store to work site or vice-versa.

5. If the poles / stay in hard rock to be erected where blasting machine is to be used for digging of required pits, the charges of machine used will be paid extra on actual basis after producing the original receipt and verification of concerned Dy. E.E. only and rates for erection of pole / stay for soil, murum as schedule above item No. 1,2 and 3 will be paid under such circumstances and not the rate of hard rock.

6. For erection of strut pole of any size R.S.J. pole the rates are as same as above for erection of pole.

5. For new works whereby the road cutting are required to be done on traffic or congested roads the same shall be carried out if required at night hours on which however, the Clause No. 1 above is not applicable i.e. no separate charges will be paid.

6. For earthing of feeder pillar, SFU, RMU, the earthing pipe and G.I. wire will be given by MSEDCL (double body earth). The contractor shall use each 5 Kg. salt and coal and earthing to be done as per standard practice and method of construction.

4. For earthing of D.B./F.P., the earthing pipe and G.I. wire will be given by MSEDCL (double body earth). The contractor shall use each 5 Kg. salt and coal and earthing to be done as per standard practice and method of construction.

5. The erection of feeder pillar shall be done in accordance with MSEDCL’s approved method.

GENERAL CONDITIONS OF CONTRACT

1.1 All works shall be measured by standard measurements and

according to the rules and customs and usual method used in

MSEDCL and more particularly as mentioned in the itemwise detailed

technical specifications contained in these documents.

1.2 All tenders shall accompany solvency certificate from Nationalised

bank of his financial stability for 50% of value of tender.

1.3 The work should be carried out within stipulated Period given by

concern SDO / S.O. from the date of handing over of site and

material.

1.4 If it is found that the quality of work as well as performance is

unsatisfactory the contract is liable for termination without giving any

notice and at the entire risk of contractor. The security deposit paid

in such cases shall be forfeited.

1.5 The contractor shall not entrust the work on sub contract, transfer or

assign the contract or any part thereof to any other party. In case if it

is not followed it will be treated as breach of contract and will be

terminated at contractors risk and cost.

1.6 The materials to be supplied by the Company are specified in

respective schedule attached to the tender documents. The rest of

material shall be arranged by the contractor and it should be as per

IS Standard and should be approved by Company’s authorised

representative, before its use.

1.7 The contractor should have his own workmen, tools and tackles

required to carry out the job. The workers employed for the job

should be well conversent with the work. In case of any accident to

the workers or outsiders the total responsibility lies with the

contractors.

1.8 In case of any damage or loss to the Company’s materials, receipts

and appropriate cost of the same will be recovered from the

contractor bill or security deposit.

1.9 Bill for the purpose of accepting bills the work carried out during the

last month will be considered. The bill should be submitted in triplicate

to the concerned engineer incharge for recording the measurement

and for onward transmission to Executive Engineer. The part payment

will be made by this Office within 60 days subject to availability of

funds from the receipt of measurements recorded bill from the

concerned SDO duly accepted by the contractor.

1.10 In case work is not fully carried out by the contractor the Company will

get the work done from some other parties and expenditure incurred

for which should be recovered from the contractor bill / security deposit

who fail to execute the work order.

1.11 In case the contractor fail to carry out work in stipulated time penalty at

the rate of ½% per delayed week or part thereof subject to maximum

10% of the contract value of work done will be recovered from the bill.

1.12 The contract or any part thereof shall not be subject to change without

the permission of accepting authority.

1.13 The contractor shall be responsible for and shall pay all the

Compensation Act 1923 (hereinafter called the said Act for injuries

caused to the workman).

1.14 he contractor shall comply with all the laws and statutory regulations

dealing with employment of labour such as payment of wages Act

1936, the minimum wages act 1938, The Workmens Compensation

Act, 1923, The Industrial Dispute Act, 1947, the Maturity Benefit Act,

1938, The Provident Fund Registration Act etc. in the employment of

his labour He shall obtain licenses, wherever required and maintain

all the required and prescribed records in the connection. Besides

the above this work contract will be governed by General Terms and

Conditions of M.S.E.D. Co.Ltd. He has to comply all R.T.O. B & C,

P.M.C. & P.C.B. & M.E.S. Rules & especailly for road cutting walls. 1.15 Any loss or damage to Company’s or public property or accident to

labour during the work is to be made good by you at your cost

ANNEXURE ‘D’

CONDITIONS OF WORKS 2. The work should be strictly carried out as per the M.S.E.D.C.L.’s method of constructions.

2. The SDO concerned or any other Officer Authorised by SDO will

supervise the work.

3. No tools and plants will be provided by M.S.E.D.C. L.

4. The line Shut down for erection of lines will be arranged by our SDO

under Padmavati Divn Pune after written request from the contractor

but this will be normally arranged on Thursday.

5. The problem of labour their lodging, boarding, medical aid payment,

accident compensation etc. will be entirely contractor’s responsibility

and Company will not be paid to it.

6. Besides all the terms and conditions incorporated in the tender,

Company’s General Terms and Conditions of the contract shall be

applicable to the tender.

7. The contract or part thereof shall not be sublet.

8. Any dispute between contractor and Engineer-in-charge will be settled

by Executive Engineer (Padmavati Divn) and his decision will be final.

9. Guarantee :- The work shall be guaranteed for a period of 18 months

From the date of erection or 12 months from the date of

commissioning.

10. The permission from R.T.O. for the transportation of heavy and

lengthy material if required will have to be arranged by the contractor.

The Company will not take any responsibility towards any accident /

damage to the poles or to anyone’s property while transporting the

poles.

11. The contractor shall not be entitled to any claim for extra executed due

to change or alteration unless the same has been ordered in writing

by Executive Engineer Pune and the payment thereof will be decided

mutually.

12. In the event of any dispute arising out of the validity of the claim or as

to the amount to be paid or allowed in respect thereof the decision of

the Executive Engineer shall be final and binding.

13. MEASUREMENTS AND TERMS OF PAYMENT

13.1 Measurement of work completed shall be taken jointly by the

authorised representative of the Co’s who will give an intimation

one week in advance to the contractor for recording the

measurement and if the contractor or his representative fails to join

the Co’s representative,the former will record the measurements and

the contractor shall have to accept these measurements as correct

and binding on him.

13.2 On the basis of joint measurements, payment will be made to the

contractor by the Executive Engineer (Padmavati Divn ) according to

the procedure and as far as possible within 2 months of recording the

measurements.

13.3 Payment will be made as per tender rate for all the works done

according to the specifications and measurements.

13.4 All materials and work for which payment is made in part or full shall

become the sole property of the Co. but this provision shall not relieve

the contractor of his responsibility for the care and protection of the

materials and works at his own cost or of his liability to make good the

damage, if any unless and until the whole work is deemed to have

been completed and handed over to the Co.

13.5 The periodical measurements and payments will not entitle the

contractor to any claim that the work for which payment has been

made are accepted as completed. In accordance with the

specification, drawings or other contract documents and in no way

will curtail the right of contract documents and in no way will curtail

the right of the Engineer to subsequently direct the removal of

imperfect work or apply at lower reduced rate or to re-measure the

works. These periodical payments shall be treated only as

advance on account to be adjusted finally after the works are finally

measure on completion and the final bill is prepared. The bill for

the work carried out should be submitted to the concerned

Sectional Engineer / Dy. Executive Engineer for onward

transmission to the Executive Engineer Padmavati Divn duly

countersigned and having check by Executive Engineer for passing in the following manner :

a) When bill amount reaches Rs. 50,000/-

b) Bill for one month for works carried out 90% payment will be made

after receipt of bill duly recorded the balance 10% will be made after inspection of the line by Electrical Inspector.

14. Due to exigency of works if any extra item is used with the permission

of Executive Engineer (Padmavati Divn) the cost of thereof will be

decided by Executive Engineer, Pune.

15. Before commencement of the work, material to be used should be got

approved from the Co’s representative i.e. Dy. Executive Engineer of

the concerned Sub Division.

16. Submission of tender offer by contractor implies that

1. Tenderer has read all the terms and conditions.

2. Tenderer has made himself acquainted / familiar with site conditions, where proposed work is to be carried out.

3. Tenderer has made himself conversant with technical specification for the proposed work to be carried out.

17. Due to non registration of yourself & your labours, any risk that will

be involved under regulations of the employment and Welfare Act 1969 lies on your part.

18. AGENDA ‘CORRIGENDUM’ :

18.1 Agenda / Corrigendum to the tender document may be issued prior

to the date of opening of the tenderes, to clarify documents or to

reflect modification in the contract terms.

18.2 The agenda / corrigendum if necessary will be issued in

triplicate to each person or organisation to whom a set of tender

documents has been issued. Each recipient will retain one copy of

each addendum / corringendum and submit two copies alongwith

this tender. All Agenda / Corrigendum issued shall become part of tender document.

19. All the works under this tender would be subject to M.S. Electricity

Distribution Co’s General Conditions of Contract for work as

stipulated in Booklet.

20. Special attention is invited to the requirements that corrections /

overwriting must be initiialed and dated by the Tenderer and that all

pages should bear full signature of the Tenderer at the feet of each

page, so also rates should be quoted in words and figures.

21. Any amount or amounts due on account of damages or compensation

for default or breach of contract by the tenderer in which case instead

of deduction of the said amount / amounts shall retained and the Co.

shall have the right or lean on amount / amounts so retained or

withheld. Any amount / amounts which become / becomes payable

by the contract to the Co. under a particular contract may be

deducted by the Co. from any amount due or being due by the Co.

the contractor or under the same or any other contract.

22. All quotations, disputes or differences arising under out of or in

connection with the contract, if concluded shall be subject to the

exclusive jurisdiction of Poona Court.

23. Income Tax at the rate as applicable at the time will be deducted

from your bill.

24. ½% penalty per delayed week will be levied, but maximum upto 10%

of work order value will be levied.

25. In case of your failure to co-up in execution of any of the work order,

the same will be got done through other agencies even at higher

rates and the difference in amount shall be recovered from your bills

or any other means available.

26. The inspection fee for inspection of line will be borne by Company,

however contractor has to rectify the defects pointed out by the

Electrical Inspector. No extra payment will allowed for said work.

27. The work order / s will be issued by the Dy. Executive Engineer of the

concerned Sub division indicating execution period proportionate to

work involved. The execution period will be counted from the date of

handing over of poles and other major materials to be supplied by Co.

28. Rates should be inclusive of all taxes. No separate work tax will be

allowed, if applicable. It should be noted that no consideration will be

given by this Office of on account of payment of work tax to

Government and it will be entire responsibility of contractor.

29. The work should be executed as per enclosed specification.

In case no specification / drawing is specified the material should be

supplied as per specification of relevant I.S.

30. 10% checks for the material used / works executed shall be exercised

by Division office if necessary.

31. All material listed in the schedule will be supplied by the Co.

32. Materials will be supplied by Company at Division Store to transport

the said material to work site. No extra payment will be made by the

Company to the contractor.

33. In case due to urgency if contractor has to supply any materials, the

contractor will require to submit his bills / excise gate pass.

34. The execution period of this contract is 12 months.
