8.500.94.B.6. HOME ACCESSIBILITY ADAPTATIONS 1

8.500.94.B.6.a DEFINITIONS 2

Case Management Agency (CMA) means a public or private not-for-profit or for-profit agency that 3 meets all applicable state and federal requirements and is certified by the Department to provide 4 case management services for specific Home and Community Based Services waivers pursuant 5 to sections 25.5-10-209.5, C.R.S. and 25.5-6-106, C.R.S. and pursuant to a provider participation 6 agreement with the state Department. 7

Case Manager means a person who provides case management services and meets all 8 regulatory requirements for case managers. 9

The Division of Housing (DOH) is a division State entity within the Colorado Department of Local 10 Affairs that is responsible for approving Home Accessibility Adaptation PARs, oversight on the 11 quality of Home Accessibility Adaptation projects, and inspecting Home Accessibility Adaptation 12 projects, as described in these regulations. 10 CCR 2505-10 section 8.500.94.B.6. 13

1. DOH oversight is contingent and shall not be in effect until approved by the Centers 14 for Medicare and Medicaid Services (CMS). Until approved by CMS, all oversight 15 functions shall be performed by the Department unless specifically allowed by the 16 Participant or their guardian to be performed by DOH. 17

Home Accessibility Adaptations meansare the most cost-effective physical modifications, 18 adaptations, or improvements in a Participant’s existing home setting which, based on the 19 Participant’s medical condition or disability: to the primary residence of the clientParticipant, that 20

1. Aare necessary to ensure the health, and safety of the clientParticipant; , or that 21

2. eEnable the clientParticipant to function with greater independence in the home; , 22 or 23

3. Prevent institutionalization or support the deinstitutionalization of the Participant. 24 All adaptations shall be the most cost effective means to meet the identified 25 need. 26

Home Accessibility Adaptation Provider means a provider agency that meets has met all the 27 standards for Home Accessibility Adaptation described in 10 CCR 2505-10 s/Section 28 8.500.94.B.6.e and is an enrolled Medicaid provider. 29

Person-Centered Planning as applieds to Home Accessibility Adaptations means that Home 30 Accessibility Adaptations that are shall be agreed upon through a process that is driven by the 31 individual Participant and can include people chosen by the Participant, as well as the appropriate 32 health care professionals, providers, and appropriate state and local officials or organizations; 33 and where the MemberParticipant is provided . The Home Accessibility Adaptation process 34 provides necessary information, support, and choice to the Participant to ensure that the 35 Participant directs the process to the maximum extent possible. 36

8.500.94.B.6.b INCLUSIONS 37

8.500.94.B.6.b.i Such Home Accessibility Aadaptations, modifications, or improvements 38 may include, but are not limited to the following: 39

a). The installation ofInstalling or building ramps;, 1

b). Installing grab-bars or other Durable Medical Equipment (DME) if such 2 installation cannot be performed by a DME supplier;. 3

c) Widening or modification of doorways;, 4

d)c. Modifying a fication of bathroom facilityties to allowfor purposes of accessibility, 5 health and safety, and assist with needsindependence in Aactivities of Ddaily 6 Lliving;, 7

e) Modifying a kitchen for purposes of accessibility, health and safety, and 8 independence in Activities of Daily Living;, 9

f)d. The installation ofInstalling specialized electric and plumbing systems that are 10 necessary to accommodate the medically necessary equipment and supplies; 11 that are necessary for the welfare of the client, and 12

g) Installing stair lifts or vertical platform lifts;, 13

h) Modifying an existing second exit or egress window to lead to an area of rescue 14 for emergency purposes; 15

i) The modification of a second exit or egress window must be approved by 16 the Department or DOH at any funding level as recommended by an 17 occupational or physical therapist (OT/PT) for the health, safety, and welfare, of 18 the Participant. 19

i)e. Safety enhancing supports such as basic fences, strengthened windows, and 20 door and window alarmsalerts. 21

8.500.94.B.6.b.ii Previously completed Home Accessibility Adaptations, regardless of 22 original funding source, shall be eligible for maintenance or repair within the Participant’s 23 remaining funds while remaining subject to all other requirements of 8.500.94.B.6. 24

8.500.94.B.6.b.iii All adaptations, modifications, or improvements must be the most cost-25 effective means of meeting the Participant’s identified need. 26

8.500.94.B.6.b.iv Adaptations, modifications, or improvements to rental properties should 27 be portable and able to move with the Participant whenever possible. 28

8.500.94.B.6.b.v The combined cost of Home Accessibility Adaptations, Vehicle 29 Modifications, and Assistive Technology shall not exceed $10,000 per Participant over 30 the five-year life of the waiver. 31

a) Costs that exceed this cap may be approved by the Department or DOH to 32 ensure the health, and safety of the Participant, or enable the Participant to 33 function with greater independence in the home, if:and 34

i) The adaptation It decreases the need for paid assistance in another 35 waiver service on a long-term basis, and 36

ii) Either: 37

1. There is an immediate risk to the Participant’s health or safety, or 1

2. There has been a significant change in the Participant’s needs 2 since a previous Home Accessibility Adaptation. 3

b) Requests to exceed the limit shall be prior authorized in accordance with all other 4 Department requirements found in this rule section 8.500.94.B.6. 5

8.500.94.B.6.c. EXCEPTIONS AND RESTRICTIONS 6

8.500.94.B.6.c.i. Home Accessibility Adaptations must be a direct benefit to the 7 Participant as defined in 8.500.94.B.6.a and not for the benefit or convenience of 8 caregivers, family Participants, or other residents of the home. 9

8.500.94.B.6.c.ii . Duplicate adaptations, such as adaptations to multiple bathrooms within 10 the same home, improvements or modifications are prohibited. 11

This includes, but is not limited to, multiple bathrooms within the same home. 12

8.500.94.B.6.c.iii. Adaptations, improvements, or modifications as a part of new 13 construction costs are prohibited.. 14

a) FThe finishing of unfinished areas in a home to add to or complete the 15 addition of inhabitable square footage is prohibited. 16

b) Adaptations that add to the total square footage of the home are 17 excluded from this benefit except when necessary to complete an 18 adaptation to: 19

i) improve entrance or egress to a residence; or, 20

ii) configure a bathroom to accommodate a wheelchair. 21

c) Any request to add square footage to the home must be approved by the 22 Department or DOH and shall be prior authorized in accordance with 23 Department requirements found in this rule section 8.500.94.B.6. 24

8.500.94.B.6.c.iv. The purchase of items available through the Durable Medical Equipment 25 (DME) benefit is prohibited. 26

8.500.94.B.6.c.v. Adaptations or improvements to the home that are considered to be on-27 going homeowner maintenance and are not related to the Participant’s individual ability 28 and needs are prohibited. 29

8.500.94.B.6.c.vi. Upgrades beyond what is the most cost-effective means of meeting the 30 MemberParticipant’s identified need, including, but not limited to items or finishes 31 required by a Homeowner Association’s (HOA), items for caregiver convenience, or any 32 items and finishes beyond the basic required to meet the need, are prohibited. 33

8.500.94.B.6.c.vii. f. The following items are specifically excluded from Hhome 34 Aaccessibility Aadaptations and shall not be reimbursed: 35

i) Adaptations or improvements to the home that are considered to be on-1

going homeowner maintenance and are not related to the client’s 2 disability, 3

ii) Carpeting, 4

aiii) Roof repair, 5

ivb). Central air conditioning, 6

cv) Air duct cleaning, 7

dvi) Whole house humidifiers, 8

evii) Whole house air purifiers, 9

fviii) Installation or repair of driveways and sidewalks, unless the most cost-10 effective means of meeting the identified need, 11

gix) Monthly or ongoing home security monitoring fees,. 12

, and 13

hx) Home furnishings of any type, 14

i) HOA fees., and 15

xi) Luxury upgrades. 16

g. When the HCBS-SLS waiver has provided modifications to the client’s home and 17 the client moves to another home, those modifications shall not be duplicated in the new 18 residence unless prior authorized in accordance with Operating Agency procedures. 19

Adaptation to rental units, when the adaptation is not portable and cannot move with the 20 client shall not be covered unless prior authorized in accordance with Operating Agency 21 procedures. 22

h. Adaptations that add to the total square footage of the home are excluded from 23 this benefit except when necessary to complete an adaptation to: 24

i. improve entrance or egress to a residence; or, 25

ii. configure a bathroom to accommodate a wheelchair. 26

i. Any request to add square footage to the home shall be prior authorized in 27 accordance with Operating Agency procedures. 28

8.500.94.B.6.c.viii. j. Home Accessibility Adaptation projects are prohibited in any type of 29 certified or non-certified congregate facility, including, but not limited to, Assisted Living 30 Residences, Nursing Facilities, Group Homes, Host Homes, and any settings where 31 accessibility or safety modifications to the location are included in the provider 32 reimbursement.All devices and adaptations shall be provided in accordance with 33 applicable state or local building codes or applicable standards of manufacturing, design 34

and installation. Medicaid state plan, EPSDT or third party resources shall be utilized 1 prior to authorization of waiver services. 2

k. The total cost of home accessibility adaptations, vehicle modifications, and assistive 3 technology shall not exceed $10,000 over the five-year life of the waiver without an 4 exception granted by the Operating Agency. Costs that exceed this limitation may be 5 approved by the Operating Agency for devices to ensure the health, and safety of the 6 client or that enable the client to function with greater independence in the home, or if it 7 decreases the need for paid assistance in another waiver service on a long-term basis. 8 Requests to exceed the limit shall be prior authorized in accordance with Operating 9 Agency procedure. 10

8.500.94.B.6.c.ix. If a Participant lives in a property where adaptations, improvements, or 11 modifications as a reasonable accommodation through federally funded assisted housing 12 are required by Section 504 of the Rehabilitation Act of 1973, the Fair Housing Act, or 13 any other federal, state, or local funding, the Participant’s Home Accessibility Adaptation 14 funds may not be used unless reasonable accommodations have been denied. 15

8.500.94.B.6.c.x. The Department may deny requests for Home Accessibility Adaptation 16 projects that exceed usual and customary charges or do not meet local building 17 requirements, the Home Modification Benefit Construction Specifications developed by 18 the Division of Housing (DOH), or industry standards. The Home Modification Benefit 19 Construction Specifications (2018) are hereby incorporated by reference. The 20 incorporation of these guidelines excludes later amendments to, or editions of, the 21 referenced material. The 2018 Home Modification Benefit Construction Specifications can 22 be found on the Department website. Pursuant to §24-4-103(12.5), C.R.S., the 23 Department maintains copies of this incorporated text in its entirety, available for public 24 inspection during regular business hours at: Colorado Department of Health Care Policy 25 and Financing, 1570 Grant Street, Denver Colorado 80203. Certified copies of 26 incorporated materials are provided at cost upon request. 27

8.500.94.B.6.d CASE MANAGEMENT AGENCY RESPONSIBILITIES 29

8.500.94.B.6.d.i. The Case Manager shall consider alternative fund ing sources to complete the 30 Home Accessibility Adaptation. The alternatives considered and the reason they are not available 31 shall be documented in the case record. 32

1) The Case Manager must confirm that the Participant is unable to receive the proposed 33 adaptations, improvements, or modifications as a reasonable accommodation through 34 federally funded assisted housing as required by section 504 of the Rehabilitation Act of 35 1973, the Fair Housing Act, or any other federal, state, or local funding. Case Managers 36 may request confirmation of a property owner’s’s obligations through DOH. 37

8.500.94.B.6.d.ii. The Case Manager may prior authorize Home Accessibility Adaptation projects 38 estimated at less than $2,500 without DOH or Department approval, contingent on Participant 39 approval authorization and confirmation of Home Accessibility Adaptation fund availability. 40

8.500.94.B.6.d.iii. The Case Manager shall obtain prior approval by submitting a Prior Authorization 41 Rrequest form (PAR) to DOH for Home Accessibility Adaptation projects estimated above $2,500. 42

1) The Case Manager must submit the required PAR and all supporting documentation 43 according to Department prescribed processes and procedures found in this rule section 44

8.500.94.B.6. Home Accessibility Adaptations submitted with improper documentation will 1 not be approved. 2

2) The Case Manager and CMA are responsible for retaining and tracking all documentation 3 related to a Participant’s Home Accessibility Adaptation funding use and communicating 4 that information to the Participant and Home Accessibility Adaptation providers. The 5 Case Manager may request confirmation of a Participant’s Home Accessibility Adaptation 6 fund use from the Department or DOH. 7

3) The Case Manager shall discuss any potential plans to move to a different residence with 8 the Participant or their guardian and advise them on the most prudent utilization of 9 available funds.the benefit. 10

8.500.94.B.6.d.iv. Home Accessibility Adaptations estimated to cost $2,500 or more shall be 11 evaluated according to the following procedures: 12

1) An occupational or physical therapist (OT/PT) shall assess the Participant's needs and 13 the therapeutic value of the requested Home Accessibility Adaptation. When an OT/PT 14 with experience in Home Accessibility Adaptation is not available, a Department-15 approved qualified individual may be substituted. An evaluation specifying how the Home 16 Accessibility Adaptation would contribute to a Participant's ability to remain in or return to 17 his/her home, and how the Home Accessibility Adaptation would increase the 18 MemberParticipant’s individual's independence and decrease the need for other services, 19 shall be completed before bids are solicited. This evaluation shall be submitted with the 20 PAR. 21

a) The evaluation must be performed in the home to be modified. If the Participant 22 is unable to access the home to be modified without the modification, the OT/PT 23 must evaluate the Participant and home separately and documentnote why the 24 Participant was not able to be evaluated in the home. 25

2) The evaluation services may be provided by a home health agency or other qualified and 26 approved OT/PT through the Medicaid Home Health benefit. 27

a) A Case Manager may initiate the OT/PT evaluation process before the 28 Participant has been approved for waiver services, as long as the Participant is 29 Medicaid eligible. 30

b) A Case Manager may initiate the OT/PT evaluation process before the 31 Participant physically resides in the home to be modified, as long as the current 32 property owner agrees to the evaluation. 33

c) OT/PT evaluations performed by non-enrolled Medicaid providers may be 34 accepted when an enrolled Medicaid provider is not available. A Case Manager 35 must document the reason why an enrolled Medicaid provider is not available. 36

3) The Case Manager and the OT/PT shall consider less expensive alternative methods of 37 addressing the Participant's needs. The Case Manager shall document these alternatives 38 and why they did not meet the Participant’s needs in the Participant’s case file. 39

8.500.94.B.6.d.v. The Case Manager shall assist the Participant in soliciting bids according to the 40 following procedures: 41

1) The Case Manager shall assist the Participant in soliciting bids from at least two Home 1 Accessibility Adaptation Providers for Home Accessibility Adaptations estimated to cost $2,500 or 2 more. Participant choice of provider shall be documented throughout. 3

2) The Case Manager must verify that the provider is an enrolled Home Accessibility 4 Adaptation Provider for Home Accessibility Adaptations. 5

4) The bids for Home Accessibility Adaptations at all funding levels shall include a 6 breakdown of the costs of the project and the following: including: 7

a) Description of the work to be completed, 8

b) Description and estimate of the materials and labor needed to complete the 9 project. Material costs should include price per square foot for materials 10 purchased by the square foot. Labor costs should include price per hour, 11

c) Estimate for building permits, if needed, 12

d) Estimated timeline for completing the project, 13

e) Name, address and telephone number of the Home Accessibility Adaptation 14 Provider, 15

f) Signature of the Home Accessibility Adaptation Provider, 16

g) Signature or other indication of approval, such as email approval, of the 17 Participant or their guardian, that indicates all aspects of the bid have been 18 reviewed with them, 19

h) Signature of the home owner or property manager if the home is not owned by 20 the Participant or their guardian. 21

5) Home Accessibility Adaptation Providers have a maximum of thirty (30) days to submit a 22 bid for the Home Accessibility Adaptation project after the Case Manager has solicited 23 the bid. 24

a) If the Case Manager has made three attempts to obtain a bid from a second 25 Home Accessibility Adaptation Provider and the provider Home Accessibility 26 Adaptation Provider has not responded within thirty (30) calendar days, the Case 27 Manager may request approval of one bid. Documentation of the attempts shall 28 be attached to the PAR. 29

6) The Case Manager shall submit copies of the bid(s) and the OT/PT evaluation with the 30 PAR to the Department. The Department shall authorize the lowest bid that complies with 31 the requirements found in this rule section 8.500.94.B.6. and the recommendations of the 32 OT/PT evaluation. 33

a) If a Participant or home owner requests a bid that is not the lowest of the 34 submitted bids, the Case Manager shall request approval by submitting a written 35 explanation with the PAR. 36

7) A revised PAR and Change Order request shall be submitted for any changes from the 37 original approved PAR according to the procedures found in this rule section 38 8.500.94.B.6.. according to Department prescribed processes and procedures. 39

8.500.94.B.6.d.vi. If a property to be modified is not owned by the Participant, the Case Manager 1

shall obtain signatures from the home owner or property manager on the submitted bids 2 authorizing the specific modifications described therein. 3

1) Written consent of the home owner or property manager, as evidenced by the above 4 mentioned signatures, is required for all projects that involve permanent installation within 5 the Participant’s residence or installation or modification of any equipment in a common 6 or exterior area. 7

2) The authorization shall include confirmation that the home owner or property manager 8 agrees that if If the Participant vacates the property, these signatures evidence that the 9 home owner or property manager agrees to allow the Participant may choose to either to 10 leave the modification in place or remove the modification, that the home owner or 11 property manager may not hold any party responsible for removing all or part of a Home 12 Accessibility Adaptation project, and that if the Participant chooses to remove the 13 modification, the property must be left in equivalent or better than its pre-modified 14 condition. 15

in than 8.500.94.B.6.d.vii. If the CMA does not comply with the process described above resulting 16 in increased cost for a Home Accessibility Adaptation, the Department may hold the CMA 17 financially liable for the increased cost. 18

8. 500.94.B.6.d.vii. The Department or DOH may conduct on-site visits or any other investigations 19 deemed necessary prior to approving or denying the Home Accessibility Adaptation PAR. 20

8.500.94.B.6.e PROVIDER RESPONSIBILITIES 21

8.500.94.B.6.e.i. Home Accessibility Adaptation Providers shall conform to all general certification 22 standards and procedures set forth in 10 CCR 2505-10 sSection 8.500.98. 23

8.500.94.B.6.e.ii. Home Accessibility Adaptation Providers shall be licensed in the city or county in 24 which the they propose to provide the Home Accessibility Adaptation services will be performedto 25 perform the work proposed, ,if required by that city or county. 26

8.500.94.B.6.e.iii. Home Accessibility Adaptation Providers shall begin work within sixty (60) days 27 of signed approval from the Department. Extensions of time may be granted by DOHthe Division 28 of Housing (DOH ) or the Department for circumstances outside of the provider’s control upon 29 request by the provider. Requests must be received within the original 60 day deadline period 30 and be supported by documentation, including Participant notification. Reimbursement may be 31 reduced for delays in accordance with Section 8.500.94.B.6.f.vi. 32

1) If any changes to the approved scope of work are made without DOH or Department 33 authorization, the cost of those changes will not be reimbursed. 34

2) Projects shall be completed within thirty (30) days of beginning work. Extensions of time 35 may be granted by DOH or the Department for circumstances outside of the provider’s 36 control upon request by the provider. Requests must be received within the original 30 37 day deadline period and be supported by documentation, including Participant 38 notification. Reimbursement may be reduced for delays in accordance with Section 39 8.500.94.B.6.f.vi 40

8.500.94.B.6.e.iv. The Home Accessibility Adaptation Provider shall provide a one-year written 41 warranty on materials and labor from date of final inspection on all completed work and perform 42 work covered under that warranty at provider’s their expense. 43

1) The Pprovider shall give the Participant or their guardian all manufacturer’s or seller’s 1

warranties on completion of work. 2

8.500.94.B.6.e.v. The Home Accessibility Adaptation Provider shall comply with the Home 3 Modification Benefit Construction Specifications (2018) developed by the DOH, which can be 4 found on the Department website, and with local, and state building codes. 5

8.500.94.B.6.e.vi. A sample of Home Accessibility Adaptation projects set by the Department shall 6 be inspected upon completion by DOH, a state, local or county building inspector in accordance 7 with state, local, or county procedures, or a licensed engineer, architect, contractor or any other 8 person as designated by the Department. Home Accessibility Adaptation projects may be 9 inspected by DOH upon request by the Participant at any time determined to be reasonable by 10 DOH. or the Department. Participants must provide access for inspections. 11

1) DOH shall perform an inspection within fourteen (14) days of receipt of notification of 12 project completion for sampled projects, or receipt of a Participant’s reasonable request. 13

2) DOH shall produce a written inspection report within the time frame agreed upon in the 14 Home Accessibility Adaptations work plan that notes the Participant’s specific complaints. 15 The inspection report shall be sent to the Participant, Case Manager, and provider. 16

3) Home Accessibility Adaptation Pproviders must repair or correct any noted deficiencies 17 within twenty (20) days or the time required in the inspection report, whichever is shorter. 18 Extensions of time may be granted by DOH or the Department for circumstances outside 19 of the provider’s control upon request by the provider. Requests must be received within 20 the original 20 day deadline period and be supported by documentation, including 21 Participant notification. Reimbursement may be reduced for delays in accordance with 22 Section 8.500.94.B.6.f.vi. 23

8.500.94.B.6.e.vii. Copies of building permits and inspection reports shall be submitted to DOH. In 24 the event that a permit is not required, the Home Accessibility Adaptation Provider shall formally 25 attest in their initial bid that a permit is not required. Incorrectly attesting that a permit is not 26 required shall be a basis justification for non-payment or recovery of payment by the Department. 27

1) Volunteer work on a Home Accessibility Adaptation project approved by the Department 28 shall be completed under the supervision of the Home Accessibility Adaptation Provider 29 as stated on the bid. 30

a) Volunteer work must be performed according to Department prescribed 31 processes and procedures found in this rule section 8.500.94.B.6. 32

b) Work performed by an unaffiliated party, such as, but not limited to, 33 volunteer work performed by a friend or family of the Participant, or work 34 performed by a private contractor hired by the Participant or family, must 35 be described and agreed upon, in writing, by the provider responsible for 36 completing the Home Accessibility Adaptation, according to Department 37 prescribed processes and procedures found in this rule section 38 8.500.94.B.6. 39

8.500.94.B.6.f REIMBURSEMENT 40

8.500.94.B.6.f.i Payment for Home Accessibility Adaptation services shall be the prior authorized 41 amount or the amount billed, whichever is lower. Reimbursement shall be made in two equal 42 payments per Home Accessibility Adaptation. 43

8.500.94.B.6.f.ii. The Home Accessibility Adaptation Provider may submit a claim for an initial 1

payment of no more than fifty percent of the project cost for materials, permits, and initial labor 2 costs. 3

8.500.94.B.6.f.iii. The Home Accessibility Adaptation Provider may submit a claim for final payment 4 when the Home Accessibility Adaptation project has been completed satisfactorily as shown by 5 the submission of the following documentation below to DOH: 6

1) Signed lien waivers for all labor and materials, including lien waivers from sub-7 contractors; 8

2) Required permits; 9

3) One year written warranty on materials and labor; and 10

4) Documentation in the Participant’s file that the Home Accessibility Adaptation has been 11 completed satisfactorily through: 12

a) Receipt of the inspection report approving work from the state, county, or local 13 building, plumbing, or electrical inspector; 14

b) Approval by the Participant, representative, or other designee; 15

c) Approval by the home owner or property manager; 16

d) A final By conducting an on-site inspection report by DOH or its designated 17 inspector; or 18

e) DOH acceptance of photographs taken both before and after the Home 19 Accessibility Adaptation. 20

8.500.94.B.6.f.iv. If DOH notifies a Home Accessibility Adaptation Provider that an additional 21 inspection is required, the Home Accessibility Adaptationp Pprovider may not submit a claim for 22 final payment until DOH has received documentation of a satisfactory inspection report for that 23 additional inspection. 24

8.500.94.B.6.f.v. The Home Accessibility Provider shall only be reimbursed for materials and labor 25 for work that has been completed satisfactorily and as described on the approved Home 26 Accessibility Adaptation Provider Bid form or Home Accessibility Adaptation Provider Change 27 Order form. 28

1) All required repairs noted on inspections shall be completed before the Home 29 Accessibility Adaptation Provider submits a final claim for reimbursement. 30

2) If a Home Accessibility Adaptation Provider has not completed work satisfactorily, DOH 31 shall determine the value of the work completed satisfactorily by the pProvider during an 32 inspection. The pProvider shall only be reimbursed for the value of the work completed 33 satisfactorily. 34

a) A Home Accessibility Adaptation Provider may request DOH perform one (1) 35 reconsideration of the value of the work completed satisfactorily. This request 36 may be supported by an independent appraisal of the work, performed at the 37 pProvider’s expense. 38

8.500.94.B.6.f.vi. Reimbursement may be reduced at a rate of 1% (one percent) of the total project 1

amount every seven (7) calendar days beyond the deadlines required for project completion, 2 including correction of all noted deficiencies in the inspection report.deficiencies. 3

1) Extensions of time may be granted by DOH or the Department for circumstances outside 4 of the provider’s control upon request by the provider. Requests must be received within 5 the original 7 day deadline period and be supported by documentation, including 6 Participant notification. 7

2) The Home Accessibility Adaptation reimbursement reduced pursuant to this subsection 8 shall be considered part of the Participant’s remaining funds. 9

8.500.94.B.6.f.vii. The Home Accessibility Adaptation Provider shall not be reimbursed for the 10 purchase of DME available as a Medicaid state plan benefit to the Participant. The Home 11 Accessibility Adaptation Provider may be reimbursed for the installation of DME if such 12 installation is outside of the scope of the Participant’s DME benefit. 13

8.503.40.A.5. HOME ACCESSIBILITY ADAPTATIONS 21

8.503.40.A.5.a DEFINITIONS 22

Case Management Agency (CMA) means a public or private not-for-profit or for-profit agency that 23 meets all applicable state and federal requirements and is certified by the Department to provide 24 case management services for specific Home and Community Based Services waivers pursuant 25 to sections 25.5-10-209.5, C.R.S. and 25.5-6-106, C.R.S. and pursuant to a provider participation 26 agreement with the state Department. 27

Case Manager means a person who provides case management services and meets all 28 regulatory requirements for case managers. 29

The Division of Housing (DOH) is a division within the Colorado Department of Local Affairs that 30 is responsible for approving Home Accessibility Adaptation PARs, oversight on the quality of 31 Home Accessibility Adaptation projects, and inspecting Home Accessibility Adaptation projects, 32 as described in these regulations, S 33

2. DOH oversight is contingent and shall not be in effect until approved by the Centers 34 for Medicare and Medicaid Services (CMS). Until approved by CMS, all oversight 35 functions shall be performed by the Department unless specifically allowed by the 36 Participant or their guardian to be performed by DOH. 37

Home Aaccessibility Aadaptations are means the most cost-effective physical modifications, 1

adaptations, or improvements in a Participant’s existing home setting which, based on 2 the Participant’s medical condition or disability: to the primary residence of the Client, 3 that 4

1. Aare necessary to ensure the health and safety of the ClientParticipant, or 5

2. or that eEnable the ClientParticipant to function with greater independence in the 6 home, or 7

3. Prevent institutionalization or support the deinstitutionalization of the Participant. 8 All adaptations shall be the most cost-effective means to meet the identified 9 need. 10

Home Accessibility Adaptation Provider means a provider agency that meets all the standards for 11 Home Accessibility Adaptation described in ,Ssection 8.503.A.5.e and is an enrolled Medicaid 12 provider. 13

Person-Centered Planning means Home Accessibility Adaptations that are agreed upon through 14 a process that is driven by the Participant and can include people chosen by the Participant, as 15 well as the appropriate health care professionals, providers, and appropriate state and local 16 officials or organizations; and where the Participant is provided necessary information, support, 17 and choice Participant to ensure that the Participant directs the process to the maximum extent 18 possible. 19

8.503.40.A.5.b INCLUSIONS 20

8.503.40.A.5.b.i. Such Home Accessibility Aadaptations may include, but are not limited 21 to, the following: 22

a). The installation of Installing or building ramps;, 23

b). Installing grab-bars or other Durable Medical Equipment (DME) if such 24 installation cannot be performed by a DME supplier; 25

c) Widening or modification of doorways;, 26

cd). Modifying aication of bathroom facilityies to allowfor the purposes of accessibility, 27 health and safety, and assist with needs independence in Activities of Daily 28 Living;. 29

e) Modifying a kitchen for purposes of accessibility, health and safety, and 30 independence in Activities of Daily Living; 31

d). The installation ofInstalling specialized electric and plumbing systems that are 32 necessary to accommodate the medically necessary equipment andor supplies; 33 that are necessary for the health and safety of the Client, and 34

g) Installing stair lifts or vertical platform lifts; 35

h) Modifying an existing second exit or egress window to lead to an area of rescue 36 for emergency purposes; 37

i) The modification of a second exit or egress window must be approved by 1

the Department or DOH at any funding level as recommended by an 2 occupational or physical therapist (OT/PT) for the health, safety, and welfare, of 3 the Participant. 4

i)e. Safety enhancing sSupports such as basic fences, strengthened windows, and 5 or basic door and window alarmsalerts.; 6

8. 503.40.A.5.b.ii Previously completed Home Accessibility Adaptations, regardless of 7 original funding source, shall be eligible for maintenance or repair within the Participant’s 8 remaining funds while remaining subject to all other requirements of Section 9 8.503.40.A.5. 10

8. 503.40.A.5.b.iii All adaptations, modifications, or improvements must be the most cost-11 effective means of meeting the Participant’s identified need. 12

8. 503.40.A.5.b.iv Adaptations, modifications, or improvements to rental properties should 13 be portable and able to move with the Participant whenever possible. 14

8. 503.40.A.5.b.v The combined cost of Home Accessibility Adaptations, Vehicle 15 Modifications, and Assistive Technology shall not exceed $10,000 per Participant over 16 the five-year life of the waiver. 17

a) Costs that exceed this cap may be approved by the Department or DOH to 18 ensure the health, and safety of the Participant, or enable the Participant to 19 function with greater independence in the home, if: 20

i) The adaptation decreases the need for paid assistance in another waiver 21 service on a long-term basis, and 22

ii) Either: 23

1. There is an immediate risk to the Participant’s health or safety, or 24

2. There has been a significant change in the Participant’s needs 25 since a previous Home Accessibility Adaptation. 26

b) Requests to exceed the limit shall be prior authorized in accordance with all other 27 Department requirements found in this rule section 8.503.A.5. 28

8. 503.40.A.5.c EXCEPTIONS AND RESTRICTIONS 29

8. 503.40.A.5.c.i Home Accessibility Adaptations must be a direct benefit to the 30 Participant Section and not for the benefit or convenience of caregivers, family 31 Participants, or other residents of the home. 32

8. 503.40.A.5.c.ii Duplicate adaptations, such as adaptations to multiple 33 bathrooms within the same home, are prohibited. 34

8. 503.40.A.5.c.iii Adaptations, improvements, or modifications as a part of new 35 construction costs are prohibited. 36

a) Finishing unfinished areas in a home to add to or complete habitable 37 square footage is prohibited. 38

b) Adaptations that add to the total square footage of the home are 1

excluded from this benefit except when necessary to complete an 2 adaptation to: 3

i) improve entrance or egress to a residence; or, 4

ii) configure a bathroom to accommodate a wheelchair. 5

c) Any request to add square footage to the home must be approved by the 6 Department or DOH and shall be prior authorized in accordance with 7 Department procedures. 8

8. 503.40.A.5.c.iv The purchase of items available through the Durable Medical Equipment 9 (DME) benefit is prohibited. 10

8.503.40.A.5.c.v. Adaptations or improvements to the home that are considered to be on-11 going homeowner maintenance and are not related to the Participant’s individual ability 12 and needs are prohibited. 13

8.503.40.A.5.c.vi. Upgrades beyond what is the most cost-effective means of meeting the 14 Participant’s identified need, including, but not limited to, items or finishes required by a 15 Homeowner Association’s (HOA), items for caregiver convenience, or any items and 16 finishes beyond the basic required to meet the need, are prohibited. 17

8.503.40.A.5.c.vii.f. The following items are specifically excluded from Hhome Aaccessibility 18 Aadaptations and shall not be reimbursed: 19

i. Adaptations or improvements to the home that are considered to be on-20 going homeowner maintenance and are not related to the Client’s 21 disability, 22

ii. Carpeting, 23

iii.a) Roof repair, 24

iv.b) Central air conditioning, 25

v.c) Air duct cleaning, 26

vi.d) Whole house humidifiers, 27

vii.e) Whole house air purifiers, 28

viii.f) Installation and repair of driveways and sidewalks, unless the most cost-29 effective means of meeting the identified need, 30

ix.g) Monthly or ongoing home security monitoring fees, 31

x.h) Home furnishings of any type, 32

i) HOA fees. 33

xi. Adaptations to rental units when the adaptation is not portable and cannot move 34 with the renter, and 35

xii. Luxury upgrades. 1

g. Adaptations that add to the total square footage of the home are excluded from this 2 benefit except when necessary to complete an adaptation to: 3

i. Improve entrance or egress to a residence; or, 4

ii. Configure a bathroom to accommodate a wheelchair. 5

h. Any request to add square footage to the home shall be prior authorized in accordance 6 with the Department’s procedures. 7

i. All devices and adaptations shall be provided in accordance with applicable state or local 8 building codes and applicable standards of manufacturing, design and installation. Medicaid State 9 Plan, EPSDT or third-party resources shall be utilized prior to authorization of HCBS-CES waiver 10 services. 11

8.503.40.A.5.c.viii.j. The total cost of home accessibility adaptations, vehicle modifications, 12 and assistive technology shall not exceed ten thousand (10,000) dollars over the five (5) year life 13 of the HCBS-CES waiver without an exception granted by the Department. Costs that exceed this 14 limitation may be approved for services, items or devices to ensure the health and safety of the 15 Client, enable the Client to function with greater independence in the home, or decrease the need 16 for paid assistance in another HCBS-CES waiver service on a long-term basis. Requests to 17 exceed the limit shall be prior authorized in accordance with the Department’s procedure. 18

Home Accessibility Adaptation projects are prohibited in any type of certified or non-19 certified congregate facility, including, but not limited to, Assisted Living Residences, Nursing 20 Facilities, Group Homes, Host Homes, and any settings where accessibility or safety 21 modifications to the location are included in the provider reimbursement. 22

8.503.40.A.5.c.ix. If a Participant lives in a property where adaptations, improvements, or 23 modifications as a reasonable accommodation through federally funded assisted housing are 24 required by Section 504 of the Rehabilitation Act of 1973, the Fair Housing Act, or any other 25 federal, state, or local funding, the Participant’s Home Accessibility Adaptation funds may not be 26 used unless reasonable accommodations have been denied. 27

8.503.40.A.5.c.x. The Department may deny requests for Home Accessibility Adaptation 28 projects that exceed usual and customary charges or do not meet local building requirements, the 29 2018 Home Modification Benefit Construction Specifications developed by the Division of 30 Housing (DOH), or industry standards. The Home Modification Benefit Construction 31 Specifications (2018) are hereby incorporated by reference. The incorporation of these guidelines 32 excludes later amendments to, or editions of, the referenced material. The 2018 Home 33 Modification Benefit Construction Specifications can be found on the Department website. 34 Pursuant to §24-4-103(12.5), C.R.S., the Department maintains copies of this incorporated text in 35 its entirety, available for public inspection during regular business hours at: Colorado Department 36 of Health Care Policy and Financing, 1570 Grant Street, Denver Colorado 80203. Certified copies 37 of incorporated materials are provided at cost upon request. 38

8. 503.40.A.5.d.i. The Case Manager shall consider alternative funding sources to complete the 1

Home Accessibility Adaptation. These alternatives considered and the reason they are not 2 available shall be documented in the case record. 3

1) The Case Manager must confirm that the Participant is unable to receive the proposed 4 adaptations, improvements, or modifications as a reasonable accommodation through 5 federally funded assisted housing as required by section 504 of the Rehabilitation Act of 6 1973, the Fair Housing Act, or any other federal, state, or local funding. Case Managers 7 may request confirmation of a property owner’s obligations through DOH. 8

8. 503.40.A.5.d.ii. The Case Manager may prior authorize Home Accessibility Adaptation projects 9 estimated at less than $2,500 without DOH or Department approval, contingent on Participant 10 approval and confirmation of Home Accessibility Adaptation fund availability. 11

8. 503.40.A.5.d.iii. The Case Manager shall obtain prior approval by submitting a Prior Authorization 12 Request form (PAR) to DOH for Home Accessibility Adaptation projects estimated above $2,500. 13

1) The Case Manager must submit the required PAR and all supporting documentation 14 according to Department prescribed processes and procedures found in this rule section 15 8.503.40.A.5. Home Accessibility Adaptations submitted with improper documentation will 16 not be approved. 17

2) The Case Manager and CMA are responsible for retaining and tracking all documentation 18 related to a Participant’s Home Accessibility Adaptation funding use and communicating 19 that information to the Participant and Home Accessibility Adaptation providers. The 20 Case Manager may request confirmation of a Participant’s Home Accessibility Adaptation 21 fund use from the Department or DOH. 22

3) The Case Manager shall discuss any potential plans to move to a different residence with 23 the Participant or their guardian and advise them on the most prudent utilization of 24 available funds. 25

8. 503.40.A.5.d.iv. Home Accessibility Adaptations estimated to cost $2,500 or more shall be 26 evaluated according to the following procedures: 27

1) An occupational or physical therapist (OT/PT) shall assess the Participant's needs and 28 the therapeutic value of the requested Home Accessibility Adaptation. When an OT/PT 29 with experience in Home Accessibility Adaptation is not available, a Department-30 approved qualified individual may be substituted. An evaluation specifying how the Home 31 Accessibility Adaptation would contribute to a Participant's ability to remain in or return to 32 his/her home, and how the Home Accessibility Adaptation would increase the individual's 33 independence and decrease the need for other services, shall be completed before bids 34 are solicited. This evaluation shall be submitted with the PAR. 35

a) The evaluation must be performed in the home to be modified. If the Participant 36 is unable to access the home to be modified without the modification, the OT/PT must 37 evaluate the Participant and home separately and document why the Participant was not 38 able to be evaluated in the home. 39

2) The evaluation may be provided by a home health agency or other qualified and 40 approved OT/PT through the Medicaid Home Health benefit., 41

a) A Case Manager may initiate the OT/PT evaluation process before the 1

Participant has been approved for waiver services, as long as the Participant is 2 Medicaid eligible. 3

b) A Case Manager may initiate the OT/PT evaluation process before the 4 Participant physically resides in the home to be modified, as long as the current 5 property owner agrees to the evaluation. 6

c) OT/PT evaluations performed by non-enrolled Medicaid providers may be 7 accepted when an enrolled Medicaid provider is not available. A Case Manager 8 must document the reason why an enrolled Medicaid provider is not available. 9

3) The Case Manager and the OT/PT shall consider less expensive alternative methods of 10 addressing the Participant's needs. The Case Manager shall document these alternatives 11 and why they did not meet the Participant’s needs in the Participant’s case file. 12

8. 503.40.A.5.d.v. The Case Manager shall assist the Participant in soliciting bids according to the 13 following procedures: 14

1) The Case Manager shall assist the Participant in soliciting bids from at least two Home 15 Accessibility Adaptation Providers for Home Accessibility Adaptations estimated to cost 16 $2,500 or more. 17

2) The Case Manager must verify that the provider is an enrolled Home Accessibility 18 Adaptation Provider for Home Accessibility Adaptations. 19

3) The bids for Home Accessibility Adaptations at all funding levels shall include a 20 breakdown of the costs of the project and the following: 21

a) Description of the work to be completed. 22

b) Description and estimate of the materials and labor needed to complete the 23 project. Material costs should include price per square foot for materials 24 purchased by the square foot. Labor costs should include price per hour. 25

c) Estimate for building permits, if needed, 26

d) Estimated timeline for completing the project, 27

e) Name, address and telephone number of the Home Accessibility Adaptation 28 Provider, 29

f) Signature of the Home Accessibility Adaptation Provider, 30

g) Signature or other indication of approval, such as email approval, of the 31 Participant or their guardian, that indicates all aspects of the bid have been 32 reviewed with them, 33

h) Signature of the home owner or property manager if the home is not owned by 34 the Participant or their guardian. 35

4) Home Accessibility Adaptation Providers have a maximum of thirty (30) days to submit a 36 bid for the Home Accessibility Adaptation project after the Case Manager has solicited 37 the bid. 38

a) If the Case Manager has made three attempts to obtain a bid from a Home 1

Accessibility Adaptation Provider and the provider has not responded within thirty 2 (30) calendar days, the Case Manager may request approval of one bid. 3 Documentation of the attempts shall be attached to the PAR. 4

5) The Case Manager shall submit copies of the bid(s) and the OT/PT evaluation with the 5 PAR to the Department. The Department shall authorize the lowest bid that complies with 6 the requirements found in this rule section 8.503.40.A.5 and the recommendations of the 7 OT/PT evaluation. 8

a) If a Participant or home owner requests a bid that is not the lowest of the 9 submitted bids, the Case Manager shall request approval by submitting a written 10 explanation with the PAR. 11

6) A revised PAR and Change Order request shall be submitted for any changes from the 12 original approved PAR according to the procedures found in this rule section 13 8.503.40.A.5. 14

8. 503.40.A.5.d.vi. If a property to be modified is not owned by the Participant or their guardian, the 15 Case Manager shall obtain signatures from the home owner or property manager on the 16 submitted bids authorizing the specific modifications described therein. 17

1) Written consent of the home owner or property manager is required for all projects that 18 involve permanent installation within the Participant’s residence or installation or 19 modification of any equipment in a common or exterior area. 20

2) The authorization shall include confirmation that the home owner or property manager 21 agrees that if the Participant vacates the property, the Participant may choose to either 22 leave the modification in place or remove the modification, that the home owner or 23 property manager may not hold any party responsible for removing all or part of a Home 24 Accessibility Adaptation project, and that if the Participant chooses to remove the 25 modification, the property must be left in equivalent or better than its pre-modified 26 condition. 27

8. 503.40.A.5.d.vii. If the CMA does not comply with the process described above resulting in 28 increased cost for a Home Accessibility Adaptation, the Department may hold the CMA financially 29 liable for the increased cost. 30

8. 503.40.A.5.d.vii. The Department or DOH may conduct on-site visits or any other investigations 31 deemed necessary prior to approving or denying the Home Accessibility Adaptation PAR. 32

8. 503.40.A.5.e PROVIDER RESPONSIBILITIES 33

8. 503.40.A.5.e.i. Home Accessibility Adaptation Providers shall conform to all general certification 34 standards and procedures set forth in ,Ssection 8.500.98. 35

8. 503.40.A.5.e.ii. Home Accessibility Adaptation Providers shall be licensed in the city or county in 36 which the Home Accessibility Adaptation services will be performed, if required by that city or 37 county. 38

8. 503.40.A.5.e.iii. Home Accessibility Adaptation Providers shall begin work within sixty (60) days 39 of signed approval from the Department. Extensions of time may be granted by DOH or the 40 Department for circumstances outside of the provider’s control upon request by the provider. 41 Requests must be received within the original 60 day deadline and be supported by 42

documentation, including Participant notification. Reimbursement may be reduced for delays in 1 accordance with Section 8.503.40.A.5.f.vi. 2

1) If any changes to the approved scope of work are made without DOH or Department 3 authorization, the cost of those changes will not be reimbursed. 4

2) Projects shall be completed within thirty (30) days of beginning work. Extensions of time 5 may be granted by DOH or the Department for circumstances outside of the provider’s 6 control upon request by the provider. Requests must be received within the original 30 7 day deadline and be supported by documentation, including Participant notification. 8 Reimbursement may be reduced for delays in accordance with Section 8.503.40.A.5.f.vi. 9

8. 503.40.A.5.e.iv. The Home Accessibility Adaptation Provider shall provide a one-year written 10 warranty on materials and labor from date of final inspection on all completed work and perform 11 work covered under that warranty at provider’s expense. 12

1) The Provider shall give the Participant or their guardian all manufacturer’s or seller’s 13 warranties on completion of work. 14

8. 503.40.A.5.e.v. The Home Accessibility Adaptation Provider shall comply with the Home 15 Modification Benefit Construction Specifications developed by the DOH, which can be found on 16 the Department website, and with local, and state building codes. 17

8. 503.40.A.5.e.vi. A sample of Home Accessibility Adaptation projects set by the Department shall 18 be inspected upon completion by DOH, a state, local or county building inspector in accordance 19 with state, local, or county procedures, or a licensed engineer, architect, contractor or any other 20 person as designated by the Department. Home Accessibility Adaptation projects may be 21 inspected by DOH upon request by the Participant at any time determined to be reasonable by 22 DOH. Participants must provide access for inspections. 23

1) DOH shall perform an inspection within fourteen (14) days of receipt of notification of 24 project completion for sampled projects, or receipt of a Participant’s reasonable request. 25

2) DOH shall produce a written inspection report within the time frame agreed upon in the 26 Home Accessibility Adaptations work plan that notes the Participant’s specific complaints. 27 The inspection report shall be sent to the Participant, Case Manager, and provider. 28

3) Home Accessibility Adaptation providers must repair or correct any noted deficiencies 29 within twenty (20) days or the time required by the inspection, whichever is shorter. 30 Extensions of time may be granted by DOH or the Department for circumstances outside 31 of the provider’s control upon request by the provider. Requests must be received within 32 the original 20 day deadline and be supported by documentation, including Participant 33 notification. Reimbursement may be reduced for delays in accordance with Section 34 8.503.40.A.5.f.vi. 35

8. 503.40.A.5.e.vii. Copies of building permits and inspection reports shall be submitted to DOH. In 36 the event that a permit is not required, the Home Accessibility Adaptation Provider shall formally 37 attest in their initial bid that a permit is not required. Incorrectly attesting that a permit is not 38 required shall be a basis for non-payment or recovery of payment by the Department. 39

1) Volunteer work on a Home Accessibility Adaptation project approved by the 40 Department shall be completed under the supervision of the Home Accessibility 41 Adaptation Provider as stated on the bid. 42

a) Volunteer work must be performed according to Department prescribed 1

processes and procedures found in this rule section 8.503.40.A.5. 2

b) Work performed by an unaffiliated party, such as, but not limited to, 3 volunteer work performed by a friend or family Participant, or work 4 performed by a private contractor hired by the Participant or family, must 5 be described and agreed upon, in writing, by the provider responsible for 6 completing the Home Accessibility Adaptation, according to Department 7 prescribed processes and procedures found in this rule section 8 8.503.40.A.5. 9

8. 503.40.A.5.f REIMBURSEMENT 10

8. 503.40.A.5.f.i Payment for Home Accessibility Adaptation services shall be the prior authorized 11 amount or the amount billed, whichever is lower. Reimbursement shall be made in two equal 12 payments. 13

8. 503.40.A.5.f.ii. The Home Accessibility Adaptation Provider may submit a claim for an initial 14 payment of no more than fifty percent of the project cost for materials, permits, and initial labor 15 costs. 16

8. 503.40.A.5.f.iii. The Home Accessibility Adaptation Provider may submit a claim for final payment 17 when the Home Accessibility Adaptation project has been completed satisfactorily as shown by 18 the submission of the following documentation to DOH: 19

1) Signed lien waivers for all labor and materials, including lien waivers from sub-20 contractors; 21

2) Required permits; 22

3) One year written warranty on materials and labor; and 23

4) Documentation in the Participant’s file that the Home Accessibility Adaptation has been 24 completed satisfactorily through: 25

a) Receipt of the inspection report approving work from the state, county, or local 26 building, plumbing, or electrical inspector; 27

b) Approval by the Participant, guardian, representative, or other designee; 28

c) Approval by the home owner or property manager; 29

d) A final on-site inspection report by DOH or its designated inspector; or 30

e) DOH acceptance of photographs taken both before and after the Home 31 Accessibility Adaptation. 32

8. 503.40.A.5.f.iv. If DOH notifies a Home Accessibility Adaptation Provider that an additional 33 inspection is required, the provider may not submit a claim for final payment until DOH has 34 received documentation of a satisfactory inspection report for that additional inspection. 35

8. 503.40.A.5.f.v. The Home Accessibility Adaptation Provider shall only be reimbursed for 36 materials and labor for work that has been completed satisfactorily and as described on the 37

approved Home Accessibility Adaptation Provider Bid form or Home Accessibility Adaptation 1 Provider Change Order form. 2

1) All required repairs noted on inspections shall be completed before the Home 3 Accessibility Adaptation Provider submits a final claim for reimbursement. 4

2) If a Home Accessibility Adaptation Provider has not completed work satisfactorily, DOH 5 shall determine the value of the work completed satisfactorily by the provider during an 6 inspection. The provider shall only be reimbursed for the value of the work completed 7 satisfactorily. 8

a) A Home Accessibility Adaptation Provider may request DOH perform one (1) 9 reconsideration of the value of the work completed satisfactorily. This request 10 may be supported by an independent appraisal of the work, performed at the 11 provider’s expense. 12

8. 503.40.A.5.f.vi. Reimbursement may be reduced at a rate of 1% (one percent) of the total project 13 amount every seven (7) calendar days beyond the deadlines required for project completion, 14 including correction of all noted deficiencies in the inspection report. 15

1) Extensions of time may be granted by DOH or the Department for circumstances outside 16 of the provider’s control upon request by the provider. Requests must be received within 17 the original 7 day deadline and be supported by documentation, including Participant 18 notification. 19

2) The Home Accessibility Adaptation reimbursement reduced pursuant to this subsection 20 shall be considered part of the Participant’s remaining funds. 21

8. 503.40.A.5.f.vii. The Home Accessibility Adaptation Provider shall not be reimbursed for the 22 purchase of DME available as a Medicaid state plan benefit to the Participant. The Home 23 Accessibility Adaptation Provider may be reimbursed for the installation of DME if such 24 installation is outside of the scope of the Participant’s DME benefit. 25
