Acknowledgements

The Ngarrindjeri people are the descendants of the original indigenous inhabitants of the lands and waters of the Murray River, Lower Lakes and Coorong and adjacent areas. Ngarrindjeri have occupied, enjoyed, utilised and managed these traditional homelands since time immemorial. The South Australian Government acknowledges Ngarrindjeri are the Traditional Owners of the land and that according to their traditions, customs and spiritual beliefs its lands and waters remain their traditional country. The State also acknowledges and respects the rights, interests and obligations of Ngarrindjeri to speak and care for their traditional country, lands and waters in accordance with their laws, customs, beliefs and traditions.

Background - Kungun Ngarrindjeri Yunnan Agreement (KNYA) The KNYA was signed in 2009 on behalf of the South Australian Government by the: Hon. Jay Weatherill Minister for Environment and Conservation

Minister for Aboriginal Affairs and Reconciliation Hon. Karlene Maywald Minister for the River Murray Hon. Paul Caica Minister for Agriculture, Food and Fisheries and on behalf of the Ngarrindjeri people and representing the Ngarrindjeri Regional Authority (NRA) by: Mr George Trevorrow Chair, Ngarrindjeri Tendi Inc. (deceased) Mr Tom Trevorrow Chair, Ngarrindjeri Heritage Committee Inc. (deceased) Mr Matt Rigney Chair, Ngarrindjeri Native Title Management

Committee (deceased) The KNYA acknowledges that Ngarrindjeri are the decedents of the original indigenous inhabitants of the Murray River, Lower Lakes, Coorong, and adjacent areas and are the traditional owners (as that term is defined in the Aboriginal Heritage Act, 1988 (SA). It also acknowledges that the Ngarrindjeri act through their peak representative body, the Ngarrindjeri Regional Authority (NRA), for the purpose of coordinating activities and resources for the Ngarrindjeri community and high level interactions with the State Government. For the purposes of achieving the objectives of the KNYA, the signatory Ministers were to be represented by an authorised representative from a relevant Government department under their jurisdiction to progress matters on a regular basis with the NRA. These representatives engage the NRA at the monthly KNYA Taskforce meetings, a forum that enables consultation and negotiation regarding matters relevant to the Agreement. The KNYA sought to establish a new relationship between the Ngarrindjeri and the State of South Australia. The signatory Ministers wished to provide support and resources to the NRA and enter into negotiations and consultations with the Ngarrindjeri about the maintenance and protection of Ngarrindjeri culture and cultural sites and the natural resources of the Land. As per Recital F The Parties seek to negotiate and consult to enable Ngarrindjeri cultural values to become integral to all planning and future management arrangements that are made with respect to the Land and aim to recognize and assure active Ngarrindjeri participation in those arrangements.

Strategic Implementation Plan The KNYA Taskforce Strategic Implementation Plan (the ‘Plan’) is a deliverable identified in the Taskforce’s Terms of Reference (TOR). The Taskforce has identified a range of issues through its regular meetings and the 2011 and 2013 KNYA Taskforce Planning Workshop that it wishes to address. The Plan has been developed to provide guidance to the Taskforce on how it can support and implement positive outcomes to the issues. Structure The Plan is structured around six high level objectives that cover the breath of issues identified by the Taskforce and align with the intent of the KNYA. Broad high level outcomes have been identified for each objective as well as range of strategies. An action plan to guide the implementation of the strategies is provided in Attachment 1. Implementation The KNYA Taskforce Executive Officers will be responsible for developing a six monthly meeting schedule for the Taskforce that integrates the relevant strategies from the Plan. It will be the responsibility of all Taskforce members to consider ways that they can support the Plan’s implementation. Review As per the KNYA Taskforce TOR, the Plan, will be reviewed in October annually as part of the KNYA Taskforce’s annual review meeting. Outcomes of the 2013 review have been documented against each of the Plan’s strategies using a performance score and an outcome statement included for each objective. Objective 1: Building upon and promoting the significance of the KNYA Taskforce

Description: The KNYA Taskforce is an innovation of the NRA and South Australian Government to coordinate Ngarrindjeri engagement in natural resource and cultural heritage management. The Agreement and the Taskforce governance arrangements establish a successful and effective framework for engagement and consultation that the Taskforce will seek to continually review, improve and promote.

Rationale: Monitoring, evaluation and improvement are foundational activities for any governance arrangement. The Taskforce will undertake these activities to ensure the effectiveness and efficiency of the framework continue to support progression of key matters under the KNYA. The Agreement and Taskforce model are innovations that the South Australian Government and the NRA need to continue to promote and could inform Aboriginal engagement at a State, National and International level.

Outcome: KNYA successfully implemented in the Ngarrindjeri region.

Strategies Status at end 2013

1.1 Monitor and Evaluate Taskforce Operations On track – Annual review workshop undertaken and Annual Report for 2012 and 2013 drafted. Annual review has been utilised to inform improvements in Taskforce operations.

1.2 Promote the KNYA Taskforce operations On track –Annual Report for 2010 and 2011 published, and 2012 and 2013 report on track. No media articles relating to Taskforce have been published and there is inconsistent internal Government promotion of the KNYA. SA Water has incorporated participation at Taskforce meetings in their Reconciliation Action Plan.

1.3 Promote the KNYA innovation and the use of the KNYA Taskforce engagement mechanism

On track - NRA completed Australian Reserve Council (ARC) project assessing KNYA process. KNYA has been promoted at conferences including the World Indigenous Network conference in 2013 and State committees (CEGAA / SOGAA)

Progress statement: Taskforce is annually monitoring and evaluating its progress and has published on its work and achievements in implementing the KNYA through its Annual Report. The NRA has been leading promotion of the KNYA innovation through ARC Linkage, International conference and publications, and through representation at State and Murray-Darling Basin level committees.

Objective 2: Supporting Ngarrindjeri education, training and capacity building

Description: The KNYA Taskforce provides a forum in which to identify and facilitate opportunities for Ngarrindjeri engagement and involvement in natural resource and cultural heritage matters. These opportunities seek to build the core capacity of Ngarrindjeri and the NRA and create linkages between training, education, employment and economic development.

Rationale: Monitoring, evaluation and improvement are foundational activities for any governance arrangement. The Taskforce will undertake these activities to ensure the effectiveness and efficiency of the framework continue to support progression of key matters under the KNYA. The Agreement and Taskforce model are innovations that the South Australian Government and the NRA will continue to promote to inform Aboriginal engagement at a State, National and International level.

Outcomes: The NRA has the organisational capacity to fully engage with Caring for Country programs in the region

2.1 Support and promote NRA education, training and employment priorities

Limited progress – NRA undertaking a wide range of initiatives and strategic planning, but no formal presentations of priorities at KNYA Taskforce meetings. Working Group established between NRA and NR SAMDB assisting in establishment of Murray Bridge Aboriginal Learning on Country (ALoC) program.

2.2 Facilitate Ngarrindjeri engagement in educational, training and employment opportunities

Limited progress – DEWNR offered project management training and mentoring to NRA in 2012/13 but no delivery occurred. DEWNR coordinated summary of agency traineeship, scholarship and work experience opportunities.

2.3 Support departmental capacity development in Aboriginal engagement and consultation

On track - DEWNR (Major Projects, River Murray Operations, NR SAMDB and NR AMLR), SA Water, and Alexandrina Council raised cultural awareness training needs to NRA. Some of these have been delivered by the NRA through Camp Coorong.

Progress statement: Establishment of the Murray Bridge ALoC is a significant achievement under the objective. Taskforce is not currently being used to progress support for Ngarrindjeri education, training and employment priorities. Taskforce has facilitated development and delivery of cultural awareness training to government agencies.

Objective 3: Supporting Ngarrindjeri and the South Australian Government to Care for Country (not the Australian Government program)

Description: The KNYA Taskforce provides a forum in which a greater understanding of Ngarrindjeri perspectives of Caring for Country can be shared and used to inform natural resource and cultural heritage management. The Taskforce provides a forum to further enable Ngarrindjeri to fulfil their cultural obligations and responsibilities to Care for Country.

Rationale: Western Science and NRM is largely based on a process of separation of issues into units, where Aboriginal heritage or culture is seen as separate, or an ‘add on’ issue, to the NRM matter being discussed. Ngarrindjeri perspectives are based on connectedness, that all things are connected to something else. Caring for Country is an Aboriginal English term Ngarrindjeri use to describe this connectivity and their responsibilities, and includes a wide variety of components including amongst others politics, heritage, culture, NRM, wellbeing and traditional practices which connect people to Country. This objective aims to incorporate Ngarrindjeri perspectives of connectivity into regional natural resource and cultural heritage management, and in so doing better accommodate their interests.

Outcome: Ngarrindjeri interests, values and cultural obligations are central to Caring for Country activities in the Ngarrindjeri region

Strategies Status at end 2013

3.1 Facilitate advancement of NRA involvement in the planning and management of land vested in the Crown within the Ngarrindjeri and Others Native Title claim area.

Limited progress – Taskforce facilitated the development of partnership between NRA, DEWNR and SA Water to prepare a Biodiversity Fund project application to undertake restoration on Sir Richard Peninsula. SA Water and NRA commenced discussions about heritage protection and broader land management planning in late 2013 in regards to Sir Richard Peninsula. Discussions regarding heritage management of Roonka Conservation Park were also progressed through Taskforce in 2013.

3.2 Support information sharing regarding future risks such as climate change, population, food security.

Limited progress - NRA notified of NR SAMDB project ‘Climate Change Impact, Adaptation and Emerging Opportunities’.

3.3 Facilitate greater understanding of NRM related legislative and policy arrangements

On track – Taskforce has supported several meetings between NRA and NR SE / SAMDB / AMLR in 2012 and 2013 regarding NRA input to Regional NRM Strategic and Business Plans. The establishment of the NRA and NR SAMDB working group has also improved greater awareness and understanding, as well as input to regional planning activities.

3.4 Support a greater understanding of Ngarrindjeri perspectives and interests regarding caring for country

On track – Riverine Recovery Project (RRP) Sugar Shack Wetland Management Planning, Ecological Character Description Statement of Commitment, LLCMM Icon Site Environmental Watering Plan, Draft Aboriginal Fire Project proposal.

3.5 Facilitate coordinated engagement with Ngarrindjeri across the SA MDB, SE and AMLR NRM Regions, and where relevant KI

No progress – conflicting perspectives on capacity and value of working group comprising NRA and the four Natural Resource areas. DEWNR understands that NRA want to progress with NR SAMDB working group first. NRA seeking an annual meeting of DEWNR Regional Managers to discuss coordination opportunities.

3.6 Secure funding to support Ngarrindjeri re-burials and heritage management planning

Limited progress – NRA identified potential re-burial locations on Crown lands in the region. Historical Ngarrindjeri re-burials proposal directed at SA Cabinet was never submitted. Although no progress has been made regarding heritage planning at Sunnyside, NRA has provided cultural heritage advice on numerous government proposals through Taskforce.

3.7 Promote the need for State Government programs to resource Ngarrindjeri participation in project development

Limited progress – DEWNR has discussed its project management framework (PMF) at Taskforce, and specific amendments are being built into the Natural Resources SAMDB PMF template to consider cultural heritage, regional agreements and native title.

Progress statement: Taskforce has provided an important forum in which SA Government can consult with the NRA regarding natural resource and cultural heritage proposals affecting the Ngarrindjeri Native Title claim area. It has enabled an increased awareness of Ngarrindjeri interests, and sought to ensure those interests are incorporated into government proposals. Opportunity exists for agencies to integrate cultural heritage considerations formally into their project management frameworks to ensure these issues are appropriately addressed in project development.

Objective 4: Supporting Ngarrindjeri economic development opportunities

Description: The KNYA Taskforce provides a forum in which a greater understanding of Ngarrindjeri perspectives of Caring for Country and associated economic development interests can be shared and used to inform NCRM. The Taskforce provides a forum to support linkages between regional economic development opportunities and Ngarrindjeri interests.

Rationale: The Ngarrindjeri have aspirations to become more self-sustaining and to reinvigorate their economic status. The Taskforce forum provides an opportunity for Ngarrindjeri, through their community businesses such as Ngarrindjeri Enterprises Pty Ltd (NEPL) and Ngarrindjeri Ruwe Contracting Pty Ltd (NRC), to build relationships with identified industries and sectors that are prevalent within the region, and explore partnerships and joint management proposals.

Outcome: Ngarrindjeri economic development interests are integrated, diverse and sustainable across different industry sectors in the Ngarrindjeri region.

4.1 Undertake economic analysis of opportunities in Ngarrindjeri nation

No progress – new proposal raised at 2013 Annual Review.

4.2 Support and promote Ngarrindjeri economic development interests

Limited progress – NRA currently not utilising Taskforce as a forum to identify and seek support for economic development opportunities. Further discussions with Ngarrindjeri could assist government in understanding, and supporting, Ngarrindjeri economic development interests.

4.3 Support and promote Ngarrindjeri capabilities Limited progress – NRA currently not fully utilising Taskforce to disseminate contracting capabilities. SA Water and DEWNR provided input and advice to NRA Biodiversity Fund application in 2013. NRC going through pre-qualification processes with Rural City of Murray Bridge and is on the contractor panel for Natural Resources SAMDB.

Progress statement: NRA currently not utilising Taskforce to identify and seek support for economic development opportunities. This approach limits Taskforce and relevant agencies providing assistance to the NRA.

Objective 5: Support coordinated and appropriate engagement with Ngarrindjeri on water related planning and management issues that affect the Ngarrindjeri Nation.

Description: The Ngarrindjeri are inextricably connected to the fresh and saltwater of the Lower Murray, Lakes and Coorong. Water resource planning for this region and within the broader Murray-Darling Basin affect water quality and quantity flowing into Ngarrindjeri country.

Rationale: The Ngarrindjeri are recognised as important partners in water resource management in the CLLMM region and have strong representation at the Murray-Darling Basin level through their representation on the Murray, Lower Darling Indigenous Nations (MLDRIN) group. The Murray-Darling Basin Authority are progressively recognising the importance of acknowledging and considering Indigenous interests in water resource planning, particularly in regards to Cultural flows/water. The KNYA Taskforce can provide support to Commonwealth and State Government water resource planners in engaging Ngarrindjeri.

Outcome: Ngarrindjeri interests, values and cultural obligations are central to water management and planning in the Ngarrindjeri region

5.1 Facilitate greater understanding of water related legislative and policy arrangements

On track – KNYA Water Workshop held in 2013 to address this strategy and agenda for 2014 follow up workshop prepared. Taskforce assisted consultation regarding River Murray and Lower Limestone Coast Water Allocation Plans, as well as the LLCMM Icon Site Environmental Watering Plan and annual water bidding process. DEWNR utilising Taskforce to consult regarding water planning issues.

5.2 Facilitate a greater understanding of appropriate Ngarrindjeri engagement in water related planning and policy development

On track - KNYA Water Workshop held in 2013 and upcoming workshop proposing to develop a Statement of Commitment to guide engagement between NRA and DEWNR’s Climate Change and Water Branch as part of implementing the MDB Plan.

5.3 Influence State Government water policy regarding Ngarrindjeri engagement and participation in water related planning.

On track – NRA input to the LLCMM Icon Site Environmental Watering Plan. Ramsar Ecological Character Description (ECD) working group established between NRA and DEWNR. Draft ECD Statement of Commitment developed to guide Ngarrindjeri engagement and input to the review of the ECD.

5.4 Support a greater understanding of Ngarrindjeri perspectives and interests regarding water

On track - KNYA Water Workshop held in 2013 to address this strategy and agenda for 2014 follow up workshop prepared. NRA engagement in The Living Murray (TLM) Icon Site planning, annual water bidding, and input to RRP funded wetland planning have also enabled the integration of Ngarrindjeri interests in water.

Progress statement: Much progress has been made related to two-way knowledge sharing and capacity building around water. The KNYA Water Workshops have been key drivers of this progress, along with the ongoing relationship between NRA and TLM Icon Site program.

Objective 6: Encourage respectful and best practice research engagement with Ngarrindjeri

Description: The Ngarrindjeri have long recognised the link between research and policy development but have been largely excluded from the research arena. Nationally and Internationally, NCRM research organisations are embracing more inclusive and culturally appropriate methodologies to develop and conduct their research in partnership with Indigenous people.

Rationale: Ngarrindjeri wish to start a new relationship with research organisations and their partners that respects Ngarrindjeri interests, priorities and Cultural perspectives and support greater and culturally appropriate involvement in research.

Outcome: Research undertaken in the Ngarrindjeri region supports and enhances Ngarrindjeri interests, priorities and cultural obligations.

Strategies Status at end 2013

6.1 Support and promote NRA Research priorities

Limited progress – NRA engaged in a wide range of research activities, some of which directly analysing the KNYA, however these do not involve partnerships with government. NRA has also prepared a research plan and partnership guideline but this has yet to be presented to Taskforce.

6.2 Facilitate Ngarrindjeri partnership in regional research and monitoring proposals

Limited progress – NRA engaged in a wide range of research activities, but not currently engaging agencies in partnership development. DEWNR and NRA Research and Monitoring Working Group increasing NRA awareness of Coorong, Lower Lakes Recovery Project and TLM activities in the region, but no partnerships established to date.

6.3 Promote the importance of human ethics and Cultural Knowledge protection and management issues

Limited progress – NRA’s cultural knowledge protection and management clause integrated into funding and service agreements with DEWNR. This is promoted regularly at Taskforce meetings, but no progress has been made regarding joint research.

Progress statement: NRA is engaged in a range of research activities related to the KNYA, but these do not involve government agencies. Taskforce not currently being utilised to establish research partnerships, however some opportunities have been identified through associated DEWNR and NRA working groups.
