FINAL REPORT

The IV Meeting of the Directing Council of the PanAmerican Sanitary Organization was held in Ciudad Trujillo,Dominican Republic, from September 25 to 30, 1950, thuscomplying with a resolution of the III lIeeting of the Direc-ting Council celebrated in the city of Lima, Peru, fromOctober 6 to 13, 1949, where the above city was designatedas the seat of the IV Ieieting by unanimous vote.

In accordance with the Provisional Agenda, the meetingproceeded to consider the Rules of Procedure of the DirectingCouncil, Doc. CD4/5 (Rev.l, Corr.l), as approved by the Exe-cutive Committee in its ilth riloting, and adopted thom provi-sionally.

The following point to be taken up was the election ofofficers, which was submitted to vote. Dr. Ricardo Cappe-letti, Representative of Uruguay, whose name wasproposed by theRepresentative of the Dominican Republic and seconded by theRepresentative of Brazil, was elected Chairman. The Repre-sentative of El Salvador nominated Dr. Felix Hurtado, Repre-sentative of Cuba, for the post of First Vice-Chairman, andthe Representative of Mexico nominated Dr. N.H. Swellengrebel,Representative of the Netherlands, for the post of SecondVice-Chairman; both nominees were elected.

This Committee, by unanimous vote, is composed ofthe Representative of Brazil, Dr. Heitor Praguer Froesand the Representative of MIexico, Dr. Jose Zozaya.

Agenda

The Directing Council approved the Provisional Agenda(Doc. CD4/2). The Representative of the Dominican Repub-lic submitted to the Council for its consideration the to-pic relating to the modification of the Constitution ofthe Pan American Sanitary Organization. This was acceptedand included among the items to be taken up by the Committeeon Administration, Finance and Legal Matters. With thisaddition, the Provisional Agenda was adopted as final.

Annual Report of the Director

The Annual Report of the Director of the Pan AmericanSanitary Bureau, as contained in the documents listed inthe second paragraph of Document CD4/7, was duly consideredand approved.

Sessions of the Directing Council

In addition to the Preliminary Session, three PlenarySessions were held, as well as twenty-three Committee Ses-sions, four Working Party Sessions, one Joint Ileeting ofthe Committee on Program and Budget and the Committee onAdministration, Finance and Legal Matters, and the ClosingPlenary Session at 6:45 pm., September 30, 1950.

WHEREAS:

The Final Report of the 11th Meeting of the ExecutiveCommittee-(Doc. CEll/R/I), in Resolution I on the 1951 Pro-gram and Budget of the Pan American Sanitary Bureau, submittedto the Directing Council for consideration the Proposed Pro-gram and Budget (Doc. CD4/PP/1) amounting to a total of$1,943,681.00 (U 9S. Cy), together with Annex I to that docu-ment, regarding the scale of contributions for the Proposed.1951 Budget;

The Committee on Program and Budget, after a detailedstudy of Document CD4/PP/l and Annex I, and lengthy discus-sions on the Program and the different items in the saidBudget, deemed it advisable to retain the total amount anddistribution of the Budget as submitted;

EL CONSEJO DIRECTIVO

CONSIDERANDO:

Que el Informe Final del Comite Ejecutivo en su lla.Reu-ni6n (Documento CE1i/R/t) en su Resoluci6n I sobre Programa yPresupuesto de la Oficina Sanitaria Panamericana para el aco1951 elev6 a la consideraci6n del Consejo Directivo el proyec-to de Programa y Presupuesto (Documento CD4/PP/1) cuyo Presu-puesto alcanza a la suma global de $1,943,681.00 (E.U.A.) y elAnexo I al documento citado referente a la escala de contribu-ciones para el Proyecto de Presupuesto correspondiente al aio1951; y

Que la Comisi6n de Programa y Presupuesto despues de es-tudiar detalladamente el Documento CD4/PP/l y su Anexo I y de-liberar ampliamente sobre el Programa y sobre las diferentespartidas de dicho presupuesto, consider6 conveniente conservarel monto total y distribuci6n del Presupuesto presentado;

RESUELVE:

1. Aprobar el Programa y el Presupuesto que asciende a$1,943,681.00 (E.U.A.) para el afio calendario de 1951.

2. Dividir el Presupuesto en las tres partes siguieptes:

The above items shall be used in the execution of theProgram submitted by the Executive Coim:.ittee (Doc. CD4/PP/1).

3. To authorize the Director of the Pan American Sani-tary Bureau to transfer credits from one to another of thethree above-mentioned Parts, in amounts not exceeding 10lO ofthe total of each Part, and advise the Executive Committee ofsuch action promptly. Transfers of credits in excess of 100from one to another of these Parts may be effected, subjectto prior approval by the Executive Committee.

4. To authorize the Director to effect transfers ofunallocated balances.

.,5. To assign quotas for the collection of funds onthe basis established by Art. 60 of the Pan American SanitaryCode.

The 1951 Budget of the Pan American Sanitary Bureaushall be divided among the Ilember Governments, in accord-ance with the scale of contributions adopted by the Councilof the Organization Of' American States for the Budget ofthe 'an American Union for the fiscal year 1950-1951.

WHEREAS:

The Third World Health Assembly approved the 1951Budget covering the total operating cost of the RegionalOffice in the Americas; and

This Budget did not include an amount tocover the cost of the meeting of the Regional Committee;


RESOLVES:

1. To express to the World Health Organization itssatisfaction on the approval'of the sum of $637,063.00(U.S. Cy) in the Budget, allotted to cover the operatingcosts in the Region of the Americas.

2. To recommend the inclusion in the said Budgetof an additional sum of $9,875.00 to cover the expensesof the Meeting of the Regional Committee of the said Or-ganization in this Hemisphere.

WHEREAS:

It is desirable that the Governments of MemberStates know well in advance the amount of their contri-butions, so that they may include them in their respec-tive budgets; and

It is desirable that the Pan American SanitaryBureau know well in advance the funds available forcarrying out its programs, so that it may plan themsufficiently in advance and contract the technical per-sonnel that will be in charge of them;


RESOLVES:

1. To take note of Document CD4/PP/8, and compli-ment the Director of the Bureau for the preparation ofthe budgets two years in advance.

2. To instruct the Director of the Pan AmericanSanitary Bureau to distribute this Document to theMinistries of Public Health and Foreign Relations of theMember States.

3. To present the said document, with the commentsof the Governments, to the Executive Committee for don-sideration at its 13th Meeting in Washington.

CONSIDERANDO:

Que es conveniente para los gobiernos de los PaisesMiembros conocer con suficiente antelacion el monto de lacontribuci6n que les corresponde a fin de incluirla opor-tunamente en sus presupues-tos;

nue es conveniente para la Oficina Sanitaria Paname-ricana conocer con suficiente antelaci6n los creditos deque podra disponer para el desarrollo de sus programas, afin de planearlos oportunamente y contratar el personaltecnico que deba dirigirlos;

RESUELVE:

1. Toma:r nota del Documento CD4/PP/8, y felicitar alDirector de la Oficina por la preparaci6n de presupuestosa dos aftos de plazo.

2. Instruir al Director de la Oficina Sanitaria Pan-americana pare que circule este Documento a los Ministeriosde Salubridad y de Relaciones Exteriores de los PaisesMiembros.

RESOLVES :,

To state that the Regional Committee has taken noteof the said Program and Budget, and to instruct the RegionalDirector to submit it to the Director-General for his consi-deration in the preparation of the 1952 Budget.

V. COORDINATION OF REGIONAL PROJECTS AND ACTIVITIES

WHEREAS:

The General Assembly of the United Nations, in its FourthMeeting, and the Third World Health Assembly, have considered theproblem of coordination of international agencies; and

Important steps have been taken within the United Nationsand the Organization of American States system, and by regionaloffices of the WHO to bring about adequate coordination of ac -tivities;


RESOLVES:

1. To recommend to Member Countries to take through theirhealth authorities such measures within their respective govern-mental structures as may be necessary to facilitate coordinationof international activities.

2. Further to recommend to Member Countries that have notalready done so, the creation within their Health Administrationsof a Bureau or Office charged with the coordination of theirinternational health relations.

CONSIDERANDO:

Que la Asamblea General de las Naciones Unidas,en su Cuarta Reuni6n, y la Tercera Asamblea Mundial de laJalud, han considerado el problema de la coordinaci6n de lasagencias internacionales; y

Que dentro de las Naciones Unidas y del'sistemade la Organizaci6n de Estados Americanos, asi como de.partede las oficinas regionales de la OMS se han dado pasos impor-tantes para lograr la coordinaci6n adecuada de actividades;

RESUELVE:

1. Recomendar a los Paises Miembros.que por in-termedio de sus autoridades de salubridad y dentro 'de susrespectivas estructuras gubernamentales adopten las medidasnecesarias para facilitar la coordinaci6n de las actividadesinternacionales.

2. Recomendar ademas a los Palses: Miembros, queno lo hayan hecho, la creaci6n dent-ro de sus Administracionesde Sanidad, de una Oficina o Negociado- encargado de-.coordirarlas relaciones sanitaiias internacionales.

The Economic and Social Council of the United Nationsapproved a resolution governing cooperative programs and theircoordination; and

The Executive Board of the World Health Organizationadopted resolution on the development of relationships with non-governmental organizations;


RESOLVES:

To recommend to the Governments and the Pan AmericanSanitary Bureau that for the solution of the above mentionedproblems of coordination, they apply the appropriate re-solutions adopted by the World Health Organization, theOrganization of American States and the United Nations.

Que el Consejo Ejecutivo de la Organizac.i6nMundial de la Salud adopt6 decisione.s sobre el desarrollode relaciones con organizaciones no..guibernamentales;.

RESUELVE:

Recomendar a los Gobiernos y a..la Oficina Sa-nitaria ganamericana utilizar,en la soluci6n de los pro-blemas de coordinaci6n mencionados, las resoluciones-respec-tivas de la Organizacion MIundial de la Salud, de la Organi-zaci6n de los Estados Americanos y de las Naciones Unidas.

VII, PROGRAM AND BUDGET POLICY OF THE ORGANIZATION

WHEREAS:

The Pan American Sanitary Bureau finds it difficult tocarry forward working programs based on budgets adopted shortlybefore the beginning of the fiscal year;

The present schedule for study and approval of the bud-gets of the Organization does not allow the Member Govern-ments sufficient time to include provision for their assessedcontributions to -the Organization in their national budgetsfor the year in question, thus delaying payments; and

The comments of the Director presented on this problemin Doc. CD4/PP/3 have been considered;


RESOLVES:

1. To take note of the interest shown by the Directorin his search for an adequate budget policy for the Organi-zation.

2. To suggest to the XIII Pan American SanitaryConference that it instruct the Directing Council to studythe possibility of establishing the program and adoptingthe budget of the Organization for the second year follow-ing the year of its Meeting.

The programs and recommendations adopted at the Con-ferences and Meetings, for which no appropriate funds arevoted, become automatically ineffective;

The Pan American Sanitary Bureau at present functionson the basis of a budget, which has not been the case inprevious years; and

The recommendations accumulated from previous Con-ferences and Meetings only demonstrate the interest of:Member States in the development of certain activities,rather than serve as injunctions to the Bureau, as long asno corresponding funds are assigned;


RESOLVES:

To recommend to the XIII Pan American Sanitary Con-ference that it relieve the Sanitary Bureau from thoseresponsibilities imposed by previous Conferences andMeetings which were not supported by appropriate programsand funds.

Que el Programa y Presupuesto de Asistencia Tecnica dela Oficina Regional de la Organizaci6n Mundial de la Salud pa-ra el Hemisferio Occidental, presentado por el Director Regio-nal al Comite Regional de la Organizapi6n Mundial de la Salud,amplia y complementa en forma considerable los proyectos y ac-tividades para el Hemisferio Occidental ;

RESUELVE:

1. Tomar nota del proyecto de programa y presupuesto pre-sentados; y

2. Solicitar que este sea transmitido al Director Generalde la Organizaci6n Mundial de la Salud para su consideraci6n.

X. COOPERATION IN THE ORGANIZATION OF A PAN AMERICANA1NTI-AFTOSA FEVER (FOOT-AND-MOUTH DISEASE) CENTER

WHEREAS:

Aftosa fever (foot-and-mouth disease), a livestock-disease of wide distribution in the Americas affecting humannutrition through substantial reductions in meat and milksupplies, is fully recognized as a matter of greatimportance;

The Organization of American States and its Special-ized Agencies have received numerous requests from MemberGovernments for the inclusion of an aftosa project under theexpanded Technical Assistance Program, and the Pan AmericanSanitary Bureau is the only Specialized Agency of the OASnow equipped with the Veterinary Service necessary for prepa-ration of such a project;

The formal agreement between the Council of theOAS and the Directing Council of the Pan American SanitaryOrganization (May 23, 1950) provides that (Article IV) "thePan American Sanitary Organization shall give technical adviceon matters of public health and medical care to the Councilof the OAS and its organs, and to the Pan American Union,upon request";

The Secretary General of the OAS has made writtenrequest to the Director of the Pan American Sanitary Bureaufor preparation and sponsorship of a Technical Assistanceaftosa fever project;

The Pan American Sanitary Bureau, in collaborationwith the Inter-American Institute of Agricultural Sciences,has prepared the project for a Pan American Aftosa Center to beoperated on Technical Assistance Funds; and

The Director of the Bureau has made any furtherparticipation in this project subject to specialauthorization by the Directing Council;

EL CONSEJO DIRECTIVO,

CONSIDERANDO:

Que la fiebre aftosa que ataca al ganado y tiene una am-.plia distribuci6n geogrdfica en las Americas, afecta la nutri-ci6n humana.por la considerable reducci6n de leche y carne de-bida a esta epizootia;

Que la Organizaci6n de los Estados Americanos y sus Agen-cias Especializadas han recibido mdltiples solicitudes de Go-biernos Miembros para que se incluya un programa contra la fie-bre aftosa dentro del Programa de Ayuda Tecnica, y que la Ofi-cina Sanitaria Panamericana es la dnica Agencia Especializadade la OEA que actualmente dispone de un servicio de veterinariaindispensable para la preparaci6n de un programa como el enun-ciado;

Que el Articulo IV del Acuerdo entre el Consejo de la OEA.y el Consejo Directivo de la Organizaci6n Sanitaria Panamericanadel 23 de mayo de 1950, dispone que: "La Organizaci6n SanitariaPanamericana prestarA asesoramiento t6cnico en materia.de salu-bridad y asistencia medica, al Consejo de la Organizaci6n de losEstados Americanos, a sus Organos, y a la Uni6n Panamericana, asolicitud de estosl";

Que el Secretario General de la OEA ha solicitado por es-crito del Director de la Oficina Sanitaria Panamericana la prepa-raci6n y patrocinio de un programa de asistencia t6cnica contrala fiebre aftosa;

Que la Oficina Sanitaria Panamericana ha preparado un pro-grama en colaboraci6n con el Instituto Interamericano de Cien-cias Agricolas, para el establecimiento de un Centro Panamerica-no contra la Fiebre Aftosa, que funcionara con fondos proceden-tes de la Asistencia Tecnica; y

Que el Director de la Oficina Sanitaria Panamericana ha in-dicado que cualquier participaci6n adicional en este programa es-td sujeta a autorizaci6n especial del Consejo Directivo;

XII9 EMERGENCY FUND

WHEREAS:

Under authority of Resolution II of the Directing Coun-cil, at its III Meeting the Director of the Pan AmericanSanitary Bureau was instructed to set aside and administer$50,000 as of 1 January 1950 as an Emergency ProcurementRevolving Fund;

On authority of the Resolution mentioned above theDirector of the Pan American Sanitary Bureau has made pur-chases of medical supplies costing $1,744.91 to be shippedto Cuzco, Peru, as an emergency measure at the time of therecent earthquake;

It will be necessary to provide an amount of $1,744.91to bring the total of the Emergency Procurement RevolvingFund back to its authorized level of $50,000; and

No general unallocated funds of the Bureau exist, fromwhich the amount of $1,744.91 can be transferred to restorethe Fund to its authorized levels


RESOLVES:

1. That the Emergency Procurement Revolving Fund bemaintained at the previously authorized level of $50,000 byrestoration of the amount expended; and

2. That the expenditure of $1,744.91 by the Directorbe noted and approved.

CONSIDERANDO:

Que basindose en las facultades conferidas por la Re-solucion II adoptada por el Consejo Directivo en su Ter-cera Reuni6n, se encomend6 al Director de la Oficina Sani-taria Panamericana que a partirdel lo. de enero de 1950separara y administrara $50,000.00 como un Fondo Rota-torio para Compras de Emergencia;

Que bas4ndose en las facultades conferidas por la Re-solucion anterior, el Director de la Oficina SanitariaPanamericana compro materiales medicos que costaron$1,744.91, para ser enviados a Cuzco, Peru, en ocasi6n delreciente desastre, como una medida de emergencia;

Que sera necesario proporcionar fondos que ascienden a$1,744.91 para que el Fondo Rotatorio para Compras deEmergencia vuelva a su nivel autorizado de $50,000.00; y

Que no existen fondos generales no comprometidos de laOficina, de los cuales se pueda transferir la suma de$1,744.91 para que el Fondo vuelva a su nivel autorizado;

RESUELVE:

1. Mantener-el Fondo de Emergencia o Fondo Rotatoriopara Compras de Emcrgencia al nivel proviamento autorizadode Q50,000.00, modiante el reembolso al mismo de la canti-dad gastada.

XIII. CONTINGENCY FUND

WHEREAS:

The Pan American Union has indicated that the PensionFund Committee would entertain a proposal from the Pan Ameri-can Sanitary Bureau to share in the benefits and advantagesof its contingency fund;

The Pan American Sanitary Bureau is without adequatemeans for handling cases of retirement due to disability, andparticipation ii the contingency fund would alleviate thiscondition; and

The cost to the Bureau would be proportionate to thenumber of positions, and participation in the fund would savefor the Bureau's use forfeited office credits left by partici-pating staff members whose short service does not permit theirclaiming any or only a part of such credits;


RESOLVES:

1. To have the, Pan American Sanitary Bureau apply tothe Pan American Union for participation in its contingencyfund.

2. That the initial contribution by the Pan AmericanSanitary Bureau to the Contingency Fund be negotiated by theDirector, with the Pan American Union as regards the amountand the date of payment, and basing it on the number of par-ticipating'staff members of the Pan.American Sanitary Bureau.

3. That the Director will make a semi-annual reviewof the state of the contingency fund as it affects the Bureauand will. ,.recommend for the approval of the subsequent meetingof the Executive Committee any adjustments in contributionwhich may be necessary to discharge the Bureau's obligationto the fund.

XIV. CONTRIBUTION OF THIE PAN ANERICAN SANITARYBUREAU TO THE PENSION PLAN

WHEREAS:

By action of the Council of the Organization of AmericanStates the Pan American Union has increased its contributionto the pension fund from 6% to 7% of the salaries of participatingstaff members; and

The Pan American Union has made this increase in thecontribution retroactive by increasing by one-sixth the amountof the Bureau's contribution to the Pension Fund;


RESOLVES:

1. Effective 1 January 1951, to increase the rate ofcontribution to the Pension Fund from 6% to 7% of the salariesof staff members participating in the Pan American Union PensionPlan.

2. Effective on the same date, to increase existingcredits of the Bureau by one-sixth for each staff member accountnow active.

WHEREAS:

Having reviewed the proposals of the Director set forthin Document CD4/AFL/3 relating to the retirement age of em-ployees of the Pan American Sanitary Bureau;

It is desired that Bureau personnel be admitted to theUnited Nations Joint Staff Pension Plan to which the employ-ees of the World Health Organization now belong; and

It has been noted that the United Nations Joint StaffPension Plan establishes a retirement age of 60, which mightcause hardship to certain employees of the Bureau;


RESOLVES:

1. To approve the text of Regulation 20 and Staff Rule610 as proposed by the Director in Document CD4/AFL/3 in theevent of admission of the Staff of the Pan American SanitaryBureau to the United Nations Joint Staff Pension Plan; and inthe event of rejection of the request for participation therein,to approve the alternative proposal presented in the mentionedDocument,

2. To authorize the Director, upon decision on the requestfor participation in the United Nations Joint Staff Pension Plan,to place in operation whichever of the alternative proposals isappropriate.

XVI. STAFF RULES: INDEKTNITY ON TERMINATIONOF EMPLOYMENT

7T.HEREAS:

The proposals set forth in Document CD4/AFL/3 andits Corr.l, relating to the modification of the Staff Rulesand Regulations on notice and indemnity on termination of em-ployment would introduce policies and procedures in the PanAmerican Sanitary Bureau which would be different from thoseof the World Health Organization; and

It is desired to have uniform policies and proceduresfor employees of the two organizations working side by side;


RESOLVES:

1. Not to accept the recommendations proposed by theDirector relating to the change of Article 21 and Staff Rules620.1, 620.2, 632.1, 632.3 and 641.4 on Notice and Indemnityon Termination; and

2. To authorize the Director to take necessary actionto insure that all employees of the Pan American SanitaryBureau are governed by the provisions of the Staff Rules andRegulations in the form accepted by the Directing Council.

Que es el deseo tener normas y procedimientos uniformes pa-ra los empleados de las dos Organizaciones que trabajan conjunta-mente;

RESUELVE:

1. No aceptar las recomendaciones propuestas por el Direc-tor, relativas al cambio del Articulo 21 del Estatuto y de lasReglas 620.1, 620.2,. 632.1, 632.3 y 641.4, en relaci6n con Avisoe Indemnizacion a la Terminaci6n del Empleo; y

XVII. STAFF RULES: ADMINISTRATIVE TRIBUNAL

WHEREAS:

The proposal of the Director set forth in DocumentCD4/AFL/3 for the establishment of a Board of Review wouldactually create a second internal organ in addition to theexisting Board of Inquiry and Appeal, and that an additionalorgan does not provide adequately for the independent andunbiased determination desired;

The WJorld Health Organization will in the futureprobably utilize the Administrative Tribunal of the UnitedNations; and

Desiring to have uniform policies and proceduresgoverning the personnel of the World Health Organizationand the Pan American Sanitary Bureau;


RESOLVES:

The development of a bilingual or multilingual staffwould facilitate the Inter-American objectives of the Bureau;


RESOLVES.:

1. To ask the Director, on establishing salary levelsfor officials and employees of the Bureau, to take into con-sideration the ability to speak two or more languages, inaddition to other qualifications.

To recommend that the Pan American Sanitary Bureauhave on their staff a corps of secretaries whose nativetongue is one of the four official languages, and who havethe ability to work equally as well in English as in theirrespective native language, and also have a good knowledgeof a third language.

Resolution 9 of the Third Meeting of the DirectingCouncil at Lima provided for the invitation of Denmark,France, the Netherlands and the United Kingdom to participateon the same basis as the American Republics in meetings ofthe Directing Council as.Regional Committee of the WorldHealth Organization;

Article 2B of the Constitution of the Pan AmericanSani;ary Organization provides "that territories or groupsof territories within the Western Hemisphere which are notresponsible for the conduct of their international relationsshall have the right to be represented and to participate inthe Organization," and that "the nature and extent of therights and obligations of these territories or groups ofterritories in the Organization shall be determined in eachcase by the Directing Council after consultation with theGovernment or other authorities having responsibility fortheir international relations;"

The Director of the Pan American Sanitary Bureau hasbeen authorized to negotiate with Denmark, France, the Nether-lands and the United Kingdom for the purpose of obtainingcontributions from these States to the funds of the PanAmerican Sanitary Bureau to assist in defraying expensesincurred by the Pan American Sanitary Bureau in connectionwith that portion of the Pan American Sanitary Organizationoperations not covered by contributions from the World Health'Organization; and

The Directing Council has authorized studies leadingtoward a constitutional revision of the Pan American SanitaryOrganization;

In accordance with the Final Act of the XII Pan AmericanSanitary Conference, the Directing Council of the Organizationadopted the present Constitution, which should be modified witha view to reducing the number of organs in the Organization, andrevised in general to adapt and assign the functions pertainingto each organ; and

The Constitution in force assigns to the Conference thefaculty to introduce constitutional amendments or modificationsinto the Organization;


RESOLVES:

1. To submit to the consideration of the XIII Pan AmericanSanitary Conference a project drawn up by the Directing Councilamending the present Constitution, with the request that the Con-ference authorize the Executive Committee to return it to the Di-recting Council at its V Meeting, together with the expressedopinions of the Member Governments, the members of the RegionalCommittee of the World Health Organization and of the Council ofthe Organization of American States.

CHAPTER I

THE ORGANIZATION

Article 1. The fundamental purposes of the Pan AmericanSanitary Organization shall be to promote and coordinate theefforts of the countries of the Western Hemisphere to combatdisease, lengthen life, and promote the physical and mentalhealth of the people.

Article 2. All self-governing nations of the WesternHemisphere shall be entitled to membership in this Organization.

Article 3. Territories or groups of territories withinthe Western Hemisphere which are not responsible for the conduct,of their international relations shall have the right to be re-presented and to participate in the Organization. The natureand extent of the rights and obligations of these territoriesor groups of territories in the Organization shall be determinedin each case by the Conference after consultation with the Govern-ment or other authorities having responsibility for their inter-national relations.

It is understood that Member Governments having under theirrespective jurisdictions dependent territories and peoples withinthe Western Hemisphere will comply with the provisions of the PanAmerican Sanitary Code and of this Constitution with regard tosuch territories and peoples.

Article 4. The Pan American Sanitary Organization shallcomprise the following organs-

1. The Pan American Sanitary Conference (hereinaftercalled the Conference);

2. The Executive Committee of the Conference (hereinaftercalled the Conmmittee); and

3. The Pan American Sanitary Bureau (hereinafter calledthe Bureau).

CAPITULO I

LA ORGANIZACION

Articulo 1 La Organizaci6n Sanitaria Panamericanatcrndr como proposi.tos fundamentales promover y coordinar losesfuerzos de los paises del Hemisferio Occidental para comba-tir las enfermedades, prolongar la vida y estimular el mejo-ramiento fisico y.mental de sus habitantes.

Articulo 2 . Todos los Estados del Hemisferio Occi-dental con go;ierno propio tienen derecho a ser miembros deesta Organizaci6ni

Articulo 3 .. Los territorios o grupos de territoriosdel Hemisferio Occidental que no tengan relaciones interna-cionales independientes, tendran derecho a ser representadosy a participar en la Organizaci6n. La naturaleza y extensi6nde los derechos y las obligaciones de estos territorios ogrupos de territorios en la Organizaci6n, seran determinadasen cada caso por la Conferencia despues de consultado el go-bierno u otra autoridad responsable de sus relaciones inter-nacionales.

Se entiende que los Gobiernos Miembros que tenganbajo sus respectivas jurisdicciones, territorios y poblacio-nes dependientes en el Hemisferio Occidental, cumpliran lasdisDosiciones del Codigo Sanitario Panamericano y las de es-ta Constitucion en tales territorios y sus poblaciones.

Articulo 4 . La Organizaci6n Sanitaria Panamericanacomprendera los siguiontes Organismos:

1. La Conferencia Sanitaria Panamericana (denominadaen adelante la Conferencia)

2. El Comit6 Ejecutivo de la Conferencia (denominadoen adelante el Comitc);

3. La Oficina Sanitaria Panamericana (denominadaen adelante la Oficina).

CHAPTER II

THE CONFERENCE

Article 5. The Conference is the supreme governingauthority of the Organization, and its functions shall be:

A) To determine the policies of the Organization;

B) To designate the Members entitled to comprisethe Committee ;

C) To designate the Director;

D) To review and approve reports and activities ofthe Committee and of the Director and to instructthe Committee in regard to matters upon whichaction, study, investigation or report may beconsidered desirable ;

E) To supervise the financial policies of the Organi-zation and to review and approve the budget;

F) To instruct the Committee and the Director to bringto the attention of Members any matter relating topublic health, as the Conference may deem advisable;

G) To promote and conduct research in the field ofhealth by the personnel of the Organization, bythe establishment of its own institutions or bycooperation with official or non-official insti-tutions of any Member with the consent of theGovernment ;

H) To establish other institutions as it may deemadvisable.

Article 6. The Conference shall serve as theRegional Committee of the world Health Organization in theWestern Hemisphere.

Article 7. The Conference shall be composed ofdelegates of Miember Governments of the Organization and ofdelegates of territories or groups of territories to whichthe right of representation has been extended.

Article 8. Each member shall be represented by notmore than three delegates, one of whom shall be designated bythe respective Member Government as Chief Delegate. Delegatesmay have alternates and advisers. Delegates selected by theMember Governments should include specialists in public health,preferably of the national public health services.

Article 9. The Conference shall meet periodically oncein two years in the country determined by its immediately pre-ceding meeting and on the date fixed by the host Governmentafter consultation with the Director. No two successive Con-ferences shall be held in the same country.

Article 10. The agenda of the Conference shall be pre-pared by the Director and approved in advance by the Committee.

Article 11. The Conference shall adopt its own rulesof procedure.

CHAPTER III

THE EXECUTIVE COI'MITTEE

Article 12. The functions of the Executive Committeeshall be:

A) To carry out the instructions and the policies ofthe Conference;

B) To act as the executive body of the Conference;

C) To carry out such other functions as may be delegatedby the Conference.;

D) To prepare the agenda of meetings of the Conference;

E) To advise the Conference regarding matters referredto it by that body, and regarding other mattersreferred to the Organization as a result of agree-ments, conventions and regulations;

F) To advise and submit proposals to the Conference onits own initiative;

Articulo 8 . Cada Liembro estara representado por nomrs de tres delegados, uno de los cuales ser. nombrado Presi-dente de la delegaci6n por su Gobierno. Los delegados' pue-den tener suplentes y a-sesores.. Entre los delegados de losGobiernos i4iembros deberan incluirse especialistas en saludpdblica, preferentemente de los departamentos nacionales desalubridad.

Articulo 9 . La Conferencia se reunira peri6dicamren-te cada dos afios en el pais elegido en la reuni6n inmediataanterior, y en la fecha' fijada por el Gobierno huesped enconsulta con el Director. No deberfni celebrarse en 'un mismopais dos Conferencias sucesivas.

Articulo 11. La Conferencia adoptara su propio regla-mento interno.

CAPITULO III

EL COMITE EJECUTIVO

Articulo 12 . Las funciones del Comite Ejecutivoseran:

A) llevar a efecto las instrucciones y politica dela Conferencia;

B) actuar como 6rgano ejecutivo de la Conferencia;

C) desempenfar toda otra funci6n que la Conferenciale encomiende;

D) preparar el programa de las sesiones de la Confe-rencia;

E) asesorar a la Conferencia en asuntos que 6sta leencomiende y en los que se asigne a la Organiza-ci6n por acuerdos, convenciones y reglam6eros;

F) asesorar y presentar propuestas a la Conferenciapor iniciativa propia;

G) tomar medidas de emergencia.. de conformidad conlas funciones y recursos financieros de la Orga-

G) To take emergency measures, in accordance with thefunctions and financial resources of the Organization,in-order to deal with matters requiring immediateaction ;

H) To study such matters as lie within its scope.

Article 13.

The Executive Committee shall be composed of 9 (nine)Members elected by the Conference for three years.Each Member shall designate to the Committee a re-presentative sechnically qualified in the field ofpublic health, who may be accompanied by alternatesand advisers. A Member Government, upon completingits term of office, shall not be eligible for re-election to the Executive Committee until (X) yoarshave elapsed.

Article 14.

A) The Executive Committee shall meet at least onceevery year, and shall determine the place of eachmeeting ;

B) At each meeting, the Executive Committee shall electa Chairman from among its members, and shall adoptits own rules of procedure.

CHAPTER IV

THE PAN AMERICAN SANITARY BUREAU

Article 15. The Pan American Sanitary Bureau shallcomprise a Director and such technical and administrative person-nel as required by the Organization.

Article 16. The Pan American Sanitary Bureau shall serveas the Regional Office of the World Health Organization in theWestern Hemisphere.

Article 17. The Director shall be designated by theConference on the proposal of the Committee and under the con-ditions specified by the Conference, to serve for-a period offour years. Under the authority of the Committee, the Director

CAPITULO IV

LA OFICINA SANITARIA PANAiERICANA

Articulo 1' . La Oficina.Sanitaria Panamericanaconsistira de un Director y del personal tecnico y adminis-trativo que requiera 1-a Organizaci6n.

Articulo 16 . La OficinaSanitaria Panamericanaservira como oficina regional de la Organizaci6n Mundial dela Salud en el Hemisferio Occidental.:

Articulo 17,. El.Director sera' nombrado ,por la Con-ferencia a propuesta del Comit6 en las condiciones que de-termine la Conferencia por. un periodo. de cuatro afios.. Suje-to a la autoridad.del Comite, el Director se~r,. el funciona-rio principal tecnico y administrativo de la Organizaci6n.

shall be the principal technical and administrative officialof the Organization.

Article 13. The Director shall be ex-officio Secretaryof the Conference, of the Executive Committee, and of all com-mittees of the Organization. lIe shall have the right to dele-gate such functions.

Article 19. The Director shall act as Regional Directorof the World Health Organization in the Western Hemisphere (sub-ject to Articles 49 and 52 of the Constitution of the WorldHealth Organization).

Article 20. The Director shall prepare and submit an-nually to the Codmmittee the financial statements and proposedbudgets of the Organization.

Article 21. The Director shall appoint the personnelof the Bureau in accordance with the staff rules establishedby the Conference. His primary consideration when appointingpersonnel shall be to insure that the efficiency, integrity andinter-American character of the Bureau is maintained at thehighest possible level.

Due regard shall be paid to recruiting the staff on aswide a geographical basis as possible.

Article 22. In the performance of their duties, theDirector and all personnel shall not seek nor receive instruc-tions from any government or from any authority external tothe Organization. Each ITember Government on its part, shallundertake to respect the exclusively international characterof the Director and the personnel and shall not seek to in-fluence them.

CHAPTER V

BUDGET AND EXPENDITURES

Article 23. The Director shall prepare and submit tothe Committee the proposed annual budget of the Organization.The Committee shall review the proposed budget and submit itto the Conference with the recommendations it deems advisable.

Articulo 18 . El Director serA Secretario ex-off.t'icioce la Conferencia, del Comite y de todas las comislones dela Organizaci6n. Podra delegar tales funciones.

Articulo 20 . El Director preparara y presentaraanualmente al Comit6 los balances y proyectos de presupues-tos de la Organizaci6n.

Articulo 21 . El Director nombrara el personal dela Oficina de acuerdo con el reglamento de Personal queestablezca la Conferencia. La consideraci6n primordial quese tendra en cuenta al nombrar el personal sera ase.gurarque la eficiencia, integridad y caracter interamericanode la oficina se mantenganen el nivel mas alto posible.

Articulo 22 . En el cumplimiento de sus deberes elDirector y el personal no solicitaran ni recibiran instruc-ciones de ningfn gobierno, ni de ninguna autoridad ajena ala Organizaci6n. Cada uno de los miembros de la Organiza-ci6n se compromete, por su parte, a respetar el caracterexclusivamente internacional del Director y.del Personal ya no tratar de influir sobre ellos.

CAPITULO V

PRESUPUESTOQ Y- EOGACIONES-

Articulo 23 . El Director preparara y sometera alComit6 el Proyecto de Presupuesto Anual de la Organizacion.El Comit6 considerara y sometera a la Conferencia dichoproyecto de presupuesto con las recomendaciones que estimeconvenientes.

Articulo 24 . La Conferencia estudiara y aprobaralos presupuestos y prorrateara su monto entre los miembrosde conformidad con la escala que fije la Conferencia (Sedeja en blanco la participaci6n de los Territorios sin Go-bierno propio).


Article 24. The Conference shall study and approve thebudgets and shall assess the total amount thereof among the Menm-bers in accordance.with the scale established by the Conference.(The participation of the non-self-governing territories has notbeen determine().

Article 25. The Director, as Regional Director of the WorldHealth Organization, shall prepare the regional budget and submitit for consideration and approval to the Conference, which shallact as the Regional Committee.

Article 26. The Conference.or the Committee in its nameand on its behalf, may accept and administer donations and be-quests made to the Organization, provided that any conditionsattached to such donations or bequests are acceptable to theConference or to the Committee and consistent with the purposesand policies of the Organization.

Article 27. A special fund shall be established to be usedat the discretion of the Committee in order to cover unforeseenemergencies and o ntingencies.

CHAPTER VI

VOTING

Article 28.

A) Each member shall have one vote at the Conference ;

B) Each Metropolitan Government having responsibilityfor the conduct of the international relations ofterritories in the Western Hemisphere shall be en-titled to one vote.

Article 29.

A) The decisions of the Conference on matters of importanceshall be taken by the vote of a two-thirds majority ofthe Members and States with voting rights present andvoting;

B) Decisions on other matters, including the determinationof additional categories of items.which must be re-solved by a two-thirds majority, shall be taken by themajority of the Members and States with voting rightspresent and voting ;

Articulo 25. El Director, como Director Regionalde la Organizaci6n .lundial:de la Salud preparara y someterae-l presupuesto regional a-la consideraci6n de la Conferencia,que sorvira como Comite Regional, para su aprobaci6n.

Articulo 26. La Conferencia o el Comite, en.nombrey representaci6n de aquella, pueden aceptar y administrarlas donaciones y legados que se hagan a la Organizaci6n,siempre que las condiciones a que estn .sujet.os sean acepta-bles por la Conferencia o por el Comite y compatibles con lafinalidad y politica de la Organizaci6n.

Articulo 27. Se establecera un fondo especial paraser utiTizado a la discreci6n del Comite para hacor frentea emergencias y contingencias impreyistas.

CAPITULO VI

VOTACIONES

Articulo 28.

A) Cada Miembro tendra un voto en la Conferencia;

B) Cada Gobierno metropolitano responsable de laconducci6n de las relaciones internacionales delos territorios en el Hemisferio Occidental,tendra derecho a un voto.

Articulo 29.

A) Las decisiones de la Conferencia en asuntos im-portantes se tomaran por el voto de una mayoriade dos tercios .de los I.liembros y Estados con de-recho a voto, presentes y votantes;

B) Las decisiones sobre otros asuntos, inclusive ladeterminaci6n de categorias adicionales de asun-tos que deban resolverse por mayorla de dos ter-cios.se tomaran por la mayoria de los Miembrosy Estados con derecho a voto, presentes y votan-tes;

C) Las votaciones sobre asuntos analogos en el Co-mit6ey en las comisiones de la Organizaci6n seharan de conformidad con los parrafos A) y B) deeste artfculo.

C) Voting on analogous matters in the Executive Committeeand the committees of the Organization shall be inaccordance with paragraphs A) and B) of this article.

CHAPTER VII

RELATIONS

Article 30. The relations between the Organization asan Inter-American Specialized Agency and the Organization ofAmerican States shall be determined by means of agreements bet-ween the two Organizations within the limits of their respectivestatutes.

Article 31. The Pan American Sanitary Organization shallestablish, by means of agreements with the World Health Organiza-tion, the relations which shall exist between these two Organiza-tions, taking into consideration Article 54 of the Constitutionof the World Health Organization.

The Conference shall authorize the Director to implementthese agreements.

Article 32. The Organization shall establish effectiverelations and closely cooperate with other inter-governmentalorganizations as it deems advisable. Any formal agreement shallbe subject to a two-thirds affirmative vote of the Conference.

Article 33. The Organization may, in matters within itsscope, make suitable arrangements for consultation and coopera-tion with non-governmental international organizations and, withthe consent of the interested State, with non-governmental orgovernmental national organizations.

CHAPTER VIII

MODIFICATIONS

Article 34. The text of amendments which may be proposedto this Constitution shall be communicated by the Director to theMembers at least six months before their consideration by the Con-ference. The amendments shall enter into force for all Memberswhen approved by the affirmative vote of two-thirds of the Members.

CAPITULO VII

RELACIONES

Articulo 30. Las relaciones entre la Organizaci6n,como Organismo Especializado Interamericano y la Organiza-ci6n de los Estados Americanos se determinara por medio deacuerdos entre las dos Organizaciones, dentro de los lfmi-tes de sus respectivos instrumentos basicos.

Articulo 31. La Organizaci6n Sanitaria Panamerica-na establecera por medio.de acuerdos- con la OrganizaQi6n.Mundial de la.Salud las relaciones que deben existir entreestas dos organizaciones tomando en consideraci6n el artfcu-lo 54 de la Constituei6n de la Organizaci6n Mundial.de laSalud,

La Conferencia autorizara al Director para lIevar aefecto estos acuerdos.

Articulo 32. La Organizaci6n establecera relacio-nes efectivas y cooperara estrechamente con otras organiza-ciones intergubernamentales cuando lo Juzgue conveniente.Todo acuerdo formal estari suJeto al':voto de aprobaci6n delas dos terceras partes de la Conferencia.

Art{culo 33. La Organizacion, en asuntos de su com-petencia, puede hacer arreglos apropiados para consultar ycooperar con organizaciones internacionales no gubernamenta-les, y, con el consentimiento del Estado interesado, con or-ganizaciones nacionales gubernamentales o no gubernamentales.

CAPITULO VIII

REFORMAS

Artfculo 34. Los textos de las reformas que se pro-pongan a esta constituci6n seran comunicados por el Directora los Miembros por lo menos seis meses antes de su considera-ci6n por la Conferencia. Las reformas entraran en vigor pa-ra todos los Miembros cuando hayan sido adoptadas por el vo-to de aprobaci6n de las dos terceras partes de los Miembros.

Artfculo 35. El Director preparara las revisionesperi6dicas del C6digo Sanitario Panamericano de acuerdo

Article 35. The Director shall prepare periodic revi-sions of the Pan American Sanitary Code in accordance withgeneral needs and policies determined by the Conference.

Article 36. The revisions of the Pan American SanitaryCode prepared by the Director shall be reviewed by the ExecutiveCommittee and submitted to the Conference for approval.

Article 37. The revision of the Pan American SanitaryCode accepted by the Conference shall be submitted to the Membersfor appropriate action as recommendations of the Conference.

CHAPTER IX

ENTRY INTO FORCE

Article 38. This Constitution shall enter into forcewhen approved by the Conference thereby revoking the previousConstitution.

Articulo 37 . Las revisiones del C6digo SanitarioPanamericano aceptudas por la Conferencia seran sometidasa los Miembros para su debida ejecucion como recomendacio-nes de la Conferencia.

CArITULO IX

VIGENCIA

Articulo 38 . Esta Constituci6n entrara en vigenciauna vez aprobada por la Conferencia, quedando asi derogaaala Constituci6n anterior.
