writing then it should be signed by the authorized person.

Annexure-B GENERAL INSTRUCTIONS FOR TENDERERS

The following instructions must be carefully read by the tenderers for strict compliance. The tenders / offers not strictly in accordance with the instructions, will liable to be rejections. 1. Tender should be submitted duly sealed with wax by registered post or in person to the Executive

Engineer/GS, Divn., PTPS, Panipat, before or on due date. 2. Tender on prescribed form and duly completed in all respects should positively reach up to

13.00 h hrs. on or before the last date prescribed for its receipt . Those received late will not be considered.

3. The Tender form along with the General Term and Conditions of the contract and its Annexure should be returned in Part-I & Part-II consisting of following documents with each:-

1. Qualifying requirements as per NIT Envelope-1 PART-I

2. General Terms & conditions duly signed by the tenderer Envelope-2

3. Cost of EMD in shape of DD payable at PTPS, Panipat Envelope-3

4. Cost tender if down loaded from HPGCL website Envelope-4

5. Price bid on “Rate quoting Sheet” Envelope-5 PART-II

Note:- a) Envelope containing Part –I i.e. Cost of tender documents, credentials in support of qualifying criteria, earnest money, General conditions of contract, technical particulars.

b) Envelope containing Part –II i.e. Price Bid on the prescribed Rate quoting sheet and the same will be opened at subsequent date to be fixed after checking the qualifying criteria and technical discussion on part-I, which shall be intimated later on. The rates should be duly filled up at the appropriate place only.

4. The tender received without earnest money shall not be considered. The Tenderer should deposit the earnest money amount of Rs.38,000/- in the form of demand draft in favour of Sr. A.O./O&M-II, PTPS, Panipat payable on any schedule Bank at Panipat or BA-16 receipt which can be obtained by depositing cash at counter at PTPS, Panipat.

5. The rates should be written in the tenders both in figure as well as in words. Cutting if any should be attested by the Tenderer or his authorized person.

6. The tender should be valid at least for the period of 90 days from the date of opening. 7. The tender will be opened on the date as prescribed in the NIT. In case the date of opening is

declared as holiday, the tender will be opened on the next working day. 8. The quoted rates shall be firm for the complete contract period. The firm shall carry out the work

through the contract period at the quoted rates irrespective of any fluctuation in the market. 9. i) The successful Tenderer shall have to deposit a security deposit @2.5% of the total cost of the work

order. ii) The Earnest money will be treated as additional security deposit & will be released after the

completion of the contract period. 10. Conditional tender will not be accepted. 11. The telegraphic tender will not be accepted. 12. Terms of payment:- 100% payment shall be made on submission of monthly bill ( To be submitted in

Triplicate)of the previous month of the work done through cheque by the Sr. Accounts Officer/O&M-II,PTPS, HPGCL, Panipat. after deduction of statuary levies.

13. No interest what so ever shall be paid on the security deposit/earnest money or any overdue payment. In case of bank deposit receipt, the HPGCL shall not be responsible for any loss that may result on account of failure of bank. i) The contractor shall furnish an under taking on a NJSP of Rs.15/- to the effect that he will

comply with all provisions of the labour laws acts & the rules/ regulations framed their under. In the event of HPGCL is being asked to pay any compensation, the contractor shall pay the same to the HPGCL. The labour regulation shall be treated as part of the contract. Any break of labour regulation shall be treated as break of contract.(Annexure-D)

ii) It will be obligatory on the part of contractor to abide by the fair wage clause & he shall be registered contractor with labour Commissioner.

14. The contactor may employ such employees, as he may think fit to ensure the execution of the work to the entire satisfaction of the engineer in-charge. The Employees should not be deemed to be in the employment of HPGCL for any purpose what so ever. The contractor shall abide by all the rules, Laws & regulations that may be enforced from time to time regarding the employment conditions of service of his employees. Under no circumstances what so ever, HPGCL would be held responsible to the labour of the contractor. HPGCL shall have the right to pass on the responsibility on the labour contractor together with any expenses incurred by HPGCL as a result of certain dues on the part of employees of the contractor. HPGCL shall be entitle to recover / claim dues / compensation from the contractor in that event.

15. The labour / employees engaged by the contractor shall not be below the age of 18 years old & exceeding 60 years.

---2--- 16. The contractor shall abide by all labour laws required to be followed under factories act, 1948,

Industrial dispute act, 1947, workmen compensation act, 1923, employees State insurance ACT, 1948, EPF ACT,1952, payment of Wages ACT, 1936, minimum Wages ACT, 1948 & any other rules & regulations framed by Central/ Haryana Govt. from time to time in this regard.

17. The worker engaged by the contractor shall not be treated as employee of HPGCL. & the HPGCL shall have no relation with the worker of contractor.

18. The contractor shall arrange adequate insurance of appropriate value to cover the risk of injuries/ death of the worker employed by him. The contractor shall be wholly responsible for any miss happening with any of the worker at site of work. The HPGCL shall recover the same from the contractor.

19. The contractor shall submit an under taking from the individual workers on their letter head that they will not claim any employment from the HPGCL & all the dispute will be settled by the contractor who has engaged them.

20. The contractor shall be responsible to engaged good worker for the said work. If any worker/ Contractor is found is found miss behaving with HPGCL employee/ his colleague/any other staff at PTPS premises/ at site of work, causing any nuisance in the opinion of the officer in charge then the concerned person be terminated from the duty & the terminated person should not be taken on duty back to work without the prior written permission of the officer in charge & if the contractor desires to deploy any other person in his place, can apply for the entrance gate pass.

21. The HPGCL shall claim the adequate compensation from the contractor for the loss/damage caused to its property by his workers.

22. The contractor shall recover the EPF deduction from the wages of the workers engaged by him & the EPF amount of the staff shall have to be deposited by the firm in their individual EPF code no.& receipted thereof will be submitted with the monthly bill.

23. The contractor shall deduct Rs.5/-from each worker’ pay & Rs. 10/- from his share for each worker every month & shall deposit Rs. 15/- in the Employee Welfare Fund. The proof of deposit of contribution to the Labour Welfare Funds as per section 9A (I) of the labour welfare Act, 1965 is also required along with the bill.

24. The performance of the contractor will be reviewed by the Engineer In charge during every month & if found un satisfactory, the contract shall be terminated at any time & the security deposit shall be liable to be forfeited.

25. If the contractor fails to carry out the work with entire satisfaction of the of the Engineer In charge, the work shall be got executed from some other party at the risk & cost of the contractor. This shall be in addition to the penalty applicable. However before deploying some another agency , a notice of seven days shall be served upon the firm.

26. Canvassing in any form in connection with tenders is strictly prohibited &the tender submitted by the Tenderer who resorts to conversations will be liable to rejection .

27. The work order to be placed on successful bidder along with the terms & conditions. The contract agreement with the HPGCL on the NJSP of Rs.15/- shall be required to execute for the contract period within 15 days of the issue of LOI/Work Order.

28. The contractor to whom the work is allotted shall have to start the work as per schedule i.e. within seven days of issue of LOI/work order, whichever is earlier.

29. The Contractor shall submit the acceptance of the work order & intimate the name of the authorized person of the firm ,who will be responsible for taking instructions from the Engineer in charge to ensure that the execution of the contract is confirmed to the entire satisfaction.

30. Any dispute arising out of contract shall be subject to Panipat jurisdiction. 31. Sub-Contracting of the work will not be allowed without prior permission of HPGCL,PTPS, Panipat.

a) HPGCL does not bound itself to accept the lowest or any tender & reserve the right to itself to accept the whole or part of the tender and the tenderer shall be bound to perform the same at the quoted rates in their tender.

b) The work Shall be awarded to the overall Lowest bidder for complete Scope of Work. 32. SAFETY RULES:-

a) The contractor shall have to comply with all the safety rules. b) A safety clearance certificate the Chief safety officer has to be attached along with the bill.

33. The firm shall be fully responsible for maintaining regular record/ register for its staff Viz-a-viz name, age, address, identification, attendance, payments ESI etc. as required under

wages act & comply with lab our laws/Rules& regulations framed under contract labour act (R&A) 1970 & also get issued gate passes for its staff. The contractor will submit the relevant records to respective Govt. authorities/Engineer in charge of HPGCL.

34. Validity:- The validity of the offer shall remain effective for 90 days. 35. The Chief Engineer, PTPS-II, HPGCL Panipat reserve the right to reject any or all the tenders without

Annexure- c SCOPE OF WORK Operation & Maintenance of AC Plants ( Frick Make ) of 210 MW Unit No.-5, PTPS, HPGCL, Panipat installed at following sites along with their allied equipments for the period of one year w.e.f. 01-12-2012 to 30-11-2013. A) AC Plant of Main Control Room having following Equipments

i) 2 Nos. FHP-6-0-6, AC Compressor ( Frick Make ) with Motor & allied accessories. ii) 2 Nos. air Handling Units Model FAH-170 with 20 HP Motor & allies accessories. iii) Fresh Air Supply assembly. iv) Refrigeration circuit, Condenser, Duct & Diffusers, Water lines, Valves etc. v) Electrical control panels etc.

B) AC Plant of ESP Control Room having following Equipments.

i) 2 Nos. FK- 750 model, 2x7.5 Tones AC Compressor ( Frick Make ) Package Type with

Motor &allied accessories. ii) Fresh Air Supply assembly. iii) Refrigeration circuit, Condenser, Duct & Diffusers, Water lines, Valves etc. iv) Electrical control panels etc.

C) AC Plant of Switch Yard Control Room Unit-5&6 ( Common )having following Equipments.

i) 2 Nos. FHP-2-0-2, AC Compressor ( Frick Make ) with Motor &allied accessories. ii) 2 Nos. air Handling Units Model FAH-115 with 15 HP Motor & allies accessories. iii) Fresh Air Supply assembly. iv) Refrigeration circuit, Condenser, Duct & Diffusers, Water lines, Valves etc. v) Electrical control panels etc.

Note:- i) Complete Over Hauling of the above AC Plants along with their allied equipments shall

also be carried out during December to February months or when the spares are made available by the HPGCL during the contract period.

ii) Maintaining of all the Electrical equipments, such as Electrical Motors, Panels, Electrical/ Electronic control system of AC System covered under the above scope of work.

iii) The Consumable such as Refrigerant Gas M-22, M-12 & Compressor Oil for AC Plants shall be given by HPGCL free of cost as details below during the contract period for maintaining the AC Plants installed at Various locations at Unit No.-5.

a) Refrigerant Gas M-22 = 5 Nos. Cylinders ( 61Kg.x 5 = 305 Kg.) b) Refrigerant Gas M-12 = 2 Nos. Cylinders ( 73Kg.x 2 = 146 Kg.) or Substitute

b) Compressor Oil = 200 Ltr.

Annexure-D

GENERAL TERMS AND CONDITIONS OF CONTRACTOR 1. Prices:- i) The prices are Firm. ii) No price escalation will be allowed during the contract period irrespective of any fluctuation in the

market expect Service Tax as applicable from time to time. 2. Period of Contract:- i) One year w.e.f. 01-12-2012 to 30-11-2013, with a provision of extension of three months on the

discretion of HPGCL at the Same Rates & Terms & Conditions after successful completion of one year contract period.

ii) The Contractor shall submit the acceptance of the Work Order. He shall also intimate the name of the Authorized / responsible person, who will be taking instruction from the Engineer-In charge & ensure that the execution of the work is done as per the specification.

iii) The firm shall execute the Contract Agreement on NJSP of worth Rs.15/- duly signed with in the 15 days from the receipt of the work order.

iv) Sub- contracting of the work is not allowed without the permission of the Chief Engineer/ PTPS-II,HPGCL, Panipat

3. Payment of Terms:- i) 100 % payment shall be made against monthly bill on pro rata basis against bill ( to be submitted

in Triplicate ) of the work done of the previous month after deducting the statuary levies. ii) The firm shall submit the photo copies of EPF Challan , ESI, Service tax, Labour Welfare Fund, PAN

Card, Clearance certificates from Chief Safety Officer along with the monthly bill. The proof Service Tax deposit may also be furnished along with the Bill.

iii) The Contractor shall submit the requisite Form –12 duly completed along with the EPF deposit Challis, there by confirming that EPF in respect of all the worker s engaged against their contract is being deposited by the firm in the name of individual EPF Code no. The EPF contribution should not be less than the contribution calculated on the basis of minimum wages ACT. It will be the sole responsibility of the contractor for any shortage / depositing of the EPF amount with the EPF authority.

iv) The contractor shall certify that he had followed all the labour Laws at the time of submit of the monthly bill.

4. Security:- i) The firm will deposit security @ 2.5 % of the total annual cost of the work order in cash or

through Demand draft in favour of Sr. AO/O&M-II, PTPS, Panipat payable on any scheduled Bank at Panipat within 15 days from the issue of work order for its faith full execution. The security deposit shall, however be released within 30 days after successful completion of the contract.

ii) The earnest money will be treated as additional security deposit which can be forfeited on the following grounds:- a) On revocation of the work order. b) If the work is not started after awarding of work within 15 days from the date of issue of

work order/ LOI. iii) The additional security deposited however shall be released after satisfactory completion of the

contract period. iv) No interest shall be paid on the security deposit/earnest money or any over due payment, in case

of the bank deposit receipt , the HPGCL shall not be responsible for any loss that may result on account of failure of bank.

5. Staff:-The contractor shall provide sufficient qualified ,AC trained & experienced staff for the job round the clock ,so that none of the site remains unattended for the smooth & trouble free operation of the AC Plants. Similarly sufficient experienced & qualified AC trained staff shall also be provided for routine/ preventive Maintenance as well as break down & annual Over Hauling of the AC Plants. The contractor shall submit the duty roster of staff showing Nos. of persons in each shift/General Maintenance staff of various Sites of AC Plants.

6. The firm shall also follow all other agreed Terms and Conditions of the published NIT. 7. Registration of Establishment ( PTPS ) & obtaining the Labour License / Renewal. The Registration of Panipat Thermal Power Station with the List of working Contractor is required

under section –7 of the contract Labour act-1970. The name of working contractor must be on the List of contractor otherwise he ( Contractor )will not get Labour license / Renewal from the Labour department, Haryana Govt. So as & when the work is awarded to the contractor other then included in the List of the contractor attached with registration of Panipat Thermal Power Station, the contractor will ensure that his name on the prescribed Performa is intimated to the centralized agency by the officer in-charge of the work for getting his name included in the said List. Further after the need, the contractor will be under obligation to obtain Labour License/its renewal under section-12 of the ibid Act from the Labour Department, Haryana Govt. by completing the requisite formalities.

Labour Act-1970. The Contractor will be bound to pay wages to the workers deployed by him on the work as per

minimum wages fixed by the Labour Department, Haryana Govt. Chandigarh. & follow revision from time to time. He will display on the notice board of his site office, the date of making monthly wages payment which should be on 7th of every month. The payment shall be made in currency & coins in the present of authorized representative of the Principal Employer / Official from the Labour Department , Haryana Govt. In case of default , the Contractor will be liable for prosecution under ibid Act.

9. Maintaining the Registers and Records under Section –74 to 78 (a to d) of Contract Labour Act-1970. The Contractor shall maintain necessary records under the provisions of ibid act viz. Register of workman employed (section-75) issuing of employment card (saection-76), Attendance Register, Register of over time, Register of deduction, Register of advance, Register of fines, issuing of wages slip etc., the same shall be made available with the site in-charge of the work or authorized representative of the contractors for checking / inspection as and when required by the officer in-charge of the PTPS Authorities or Labour Deptt. ,Govt. of Haryana. Non maintaining/non production of the above Register/Forms, under Eection-23-24 of the ibid Act will be treated as offence and Contractor will be liable for prosecutions by the labour Deptt., Govt. of Haryana.

1. Age Limit of Workers. No labour below the prescribed limit of age i.e. 18 years and above 60 years shall be employed by the contractor on his allotted works.

11. Compliance of Various Labour Acts. i) The contractor shall aide by all the labour laws required to be followed and he shall furnish an

under taking on NJSP of appropriated value duly attested by the Notary public to the effect that he will comply with all the Act, Laws and Regulations as may be applicable with regard to performance of work including Factory Act-1948, Industrial dispute Act-1947, Employees state insurance Act-1948, Employees provident fund Act-1952, payment of wages Act-1936, minimum wages Act-1948, Contract labour Act(R&A) –1970, workman compensation Act-1923 & other rule and Regulations as framed Central/State Govt. in this regard from time to time.

ii) The contractor will also specify in the above under undertaking that all the labour/ workmen engaged by him for rendering the services under the contract, will be the employee of contractor for all intents and purposes and shall have no claim/right on the HPGCL. All the risks, responsibilities, Liabilities towards his labour shall be owned by him. The contractor will take such steps as may be directly responsible for any dispute arising between him and his labour/workman and keep the HPGCL and its officers indemnified from and against all losses, damages and any claim/liability arising there from. Under no circumstances whatsoever HPGCL would be held responsible in respect of contractor’s workers. In case any expenditure incurred by HPGCL as a result of certain dues on the part of contractor’s labour or otherwise the HPGCL is entitled to recover/claim such dues/compensation from the contractor’s pending payments of bills or through court of laws.

iii) Besides the above, the contractor shall obtained an affidavit on NJSP of appropriate value duly signed and witnessed by him under his seal and duly attested by the Notary public from his each and every individual worker/employee that they will not claim any employment in HPGCL in lieu of services rendered by them to the contractor namely M/s.________________________________ against Work Order No._____________________ dt.____________ and all the disputes whatsoever and of any nature, will be settled by the contractor who has engaged them. These affidavits along with his own under taking as per para –A&B above, shall be submitted by the contractor to the officer in-charge (for ARC/AMC).

12. Deposit of EPF contribution of the worker along with employer share. It is statutory obligation for the contractor to deduct EPF contribution for the employee drawing

wages up to Rs.6500/-per month. The rate of deduction i.e. 12% of the Minimum Wages fixed of the labour by the Govt. or actual wages drawing (i.e. Basic Pay + DA+ Cash value of food concession + Leave Encashment) and deposit the same with his share @ 12% (8.33% in Pension Fund and 3.67% in Employees Contribution) and deposit the same with the EPF Deptt. with 1.61% of Administrative charges in their EPF Code No. up to 15th of due month, failing which interest and damages will be charged. Copy of deposit Challan for 25.61% as mentioned above shall be submitted along with running bill in their office of officer in-charge of the work by the Contractor. The Monthly Return on R-1 form by mentioning the Social Security No. of each worker which may be obtained from EPF Deptt. shall also be submitted in the office of Regional Commissioner and copy of the same shall be submitted to the officer in-charge of the work/Account Branch. The Contractor possessing the EPF Code of out of State of Haryana, where R-1 form is not applicable/introduced, they will supply the form 3A, 6A, 12A, 5, 10 as applicable in the state by the EPF Deptt. It is the responsibility of the contractor to make the inspection of Record of deposit of EPF contribution of their labour from the EPF Deptt. and copy of the same will be submitted to the officer in-charge of the work/Account Branch. The contractor having out of state EPF Code will also get their record inspected from local EPF office Panipat.

Contd…3… ---3--- 13. Deposit of ESI Contribution of the workers along with employer’s share.

It is statutory requirement for the contractor under ESI Act-1948 that the workers drawing gross wages up to Rs,10,000-00, 1.75% contribution is deducted from the wages of such workers & deposit along with employer share of 4.75% i.e. 6.5 % with the authorized Bank /Branches of ESI Department by the contractor to cover their workers under the scheme up to 21st of due month, other wide interest & damages will be charged on deposit of delayed payment. The contractor will get their ESI code. It is also responsibility of the contractor to get the facilities as provided under ESI scheme, extended to their workers viz. issuance of ESI Cards, filling returns on the prescribed Form-6 on due dates i.e. 12th may, 11th November, every year in local ESI office, other wise he will be prosecution by ESI Deptt. As provided in the ibid Act. Incase of non issuance of ESI cards, the workers will not get the medical facilities /Pension benefits to the widow which are provided by the ESI Deptt. & contractors will be responsible for consequences.

14. Deposit of Labour Welfare Fund Along with Employer share. In pursuance of Haryana Govt. Labour Deptt. Gazette Notification dated 4th April, 2007, the contractor are required to deduct Labour Welfare fund @ RS.5/- from each worker & deposit the same with Employer’s share @ Rs.10/- per worker (Total RS.15/ each worker) with the welfare Commissioner, Haryana , Chandigarh in shape of Demand Draft in favour along with list of workers for whom the same is being deposited. The copy of proof in this respect shall be submitted along with bill to the in-charge/ Account Branch.

15. Safety Rules & Regulations:- i) The Contractor shall observe & abide by all the fire & Safety Regulations. All the accident to the

contractor staff will be the reported to the Chief Safety Officer ,PTPS, Panipat promptly. This will however not relieve the contractor of any statuary obligations.

ii) The contractor shall have to comply with all the safety rules. The chief safety Officer shall impose penalty of Rs. 200/-per day per head if the worker of the contractor are found to be working carelessly & /or in violation of use of proper protective equipments. Against Safety violation of any other clause, a penalty pf Rs.500/- per violation ( Minimum ) shall be levied. In case of repeated violation of serious nature resulting in very serious accident or direct loss to the corporation/threaten to cause severe consequences, higher penalty rate may be imposed including suspension /termination of the contract. In case of any fatal/non fatal accident or any other violation of Factory ACT,1948,Punjab, Haryana, Factory Rules, 1952 or any other industrial or Labour ACT are made by /with the worker of the contractor & if any prosecution is launched by Chief Inspector of Factories, Chandigarh against occupier/ Factory manager or any other authority of HPGCL, the contractor shall be liable to deposit the amount of fine/penalty decided by the court on the same day. In case of default the amount shall be recovered from the outstanding dues/liabilities of the contractor against this contract or any other contract at PTPS besides other action which HPGCL may deem fit.

iii) The contractor shall arrange adequate insurance of appropriate value to cover the risk of any injuries/ death of the workers employed by the him. The contractor shall be wholly responsible for any kind of miss-happening with any of the worker at site of work. If HPGCL is asked to pay any compensation to the worker engaged on the work, the HPGCL shall recover the same from the contractor.

iv) All the statuary Labour Laws & Safety Laws applicable at site shall be observed by the firm. The contactor may employ such employees, as he may think fit to ensure the execution of the work to the entire satisfaction of the engineer in-charge. The Employees should not be deemed to be in the employment of HPGCL for any purpose what so ever. The contractor shall abide by all the rules, Laws & Regulations that may be enforced from time to time regarding the employment conditions of service of his employees. Under no circumstances what so ever, HPGCL would be held responsible to the labour of the contractor. HPGCL shall have the right to pass on the responsibility on the labour contractor together with any expenses incurred by HPGCL as a result of certain dues on the part of employees of the contractor. HPGCL shall be entitled to recover/claim dues/ compensation from the contractor in that event. Safety Clearance Certificate of CSO shall be attached with the bill.

16. Service Tax:- No service Tax will be paid extra until & unless it is livable on the service provided by the

contractor & specifically demanded for the same in his offer. However due to not claiming of Service Tax from HPGCL the contractor can not escape from his liability to the Govt. against taxable service. Incase the service tax is to be paid by the HPGCL, the contractor will have to submit an under taking in the Performa enclosed as per Annexure-B attached. Service Tax shall be paid after submission of documentary proof of its deposition.

17. T&P:-All the T&P including special T&P, Mechanical& Electrical Hand Tools etc. required for operation & maintenance of AC Plants shall be arranged by the firm. Necessary welding set, DA/ Oxygen Gas/Nitrogen Gas, Brazing/ Cutting Sets, Grinding Tool, Chain Pulley Block & other like wise T&P,s for Lifting / Shifting of defective equipments during Maintenance/Repair /Replacement etc. & Over Hauling of the equipments etc. & Gas leakages Tests etc. shall also be arranged by the firm.

18. Spares & consumable:- i) All the consumable such as Compressor oil, Refrigerant Gas , lubricant oil, Grease,

Mechanical/electrical Spares will be arranged by HPGCL. Other consumable such as dusters, waste cloth, sand paper, torch cell, & like wise consumables shall be arranged by the firm at their cost & no separate charges shall be paid by HPGCL for these items.

ii) Power & water supply required for maintaining the AC Plants will be made available by HPGCL free of cost.

19. Accommodation:-No accommodation will be provided to the contractor & its labour at site of works. However a temporary shed shall be allowed to the contractor till such time the contract is over.

20. Service Planning:-The services of the AC Plants shall be planned in such away that there is least interruption in the System. The firm will maintain a detail of operation & maintenance schedules, equipment wise to upkeep the equipments on Daily, Weekly, Monthly, Quarterly & Annually basis.

21. Damage due to negligence:- i) Any loss or damage to the AC plant equipments & other related equipments in the plant due to

negligence of the staff of the contractor, the same shall have to be paid by the contractor. ii) If the contractor fails to maintain / operate any of the AC plant up to the entire satisfaction of the

Engineer in charge on any day except for the forced closer/ shut down, a penalty @ 2% of the value of the monthly order bill will be deducted from the monthly bill of the contractor for that day.

iii) The contractor shall be responsible for engaging good workers for the said work. If any worker is found miss- behaving or causing any nuisance at the site in the opinion of the Shift in charge or the officer in charge then, the concerned worker shall be terminated from duty.

iv) In case any worker remains absent from the site of works then the amount as per detail given below will be deducted from the monthly bill.

22. Watch & Ward:- i) Watch & ward of the AC Plants and its related equipments in the safe custody shall be the

responsibility of the firm during the contract period. ii) The firm will maintain the log sheets for all the important equipments to make a detail records

of operation & maintenance scheduled, equipment wise to upkeep the equipments on Daily, Weekly, Monthly, & Annually basis.

iii) The firm will maintain log sheets for Hourly Reading of all the Gauges, Meters & other measuring instruments provided at various equipments of the AC System.

iv) To maintain the record of the servicing carried out by the contractor as per the manufacturer’ recommendation or as desired by the Engineer In charge.

v) The performance of the work of the contractor will be reviewed by the engineer in charge every month or in case of any abnormal-ability appears in the system & if found unsatisfactory, the contract shall be terminated at any time & security deposited shall be liable to be forfeited .

vi) If the contractor fails to carry out the work up to the entire satisfaction of the engineer in charge, the work shall be got executed from some other firm purely at the risk & cost of the contractor. However , before deploying some other agency ,a notice of seven days shall be served upon the contractor.

vii) Temperature & Humidity limits required to be maintained in all the circumstances / seasons for all the specified areas as mentioned below:-

o o a) Temperature : 24 C + - 1.5 C b) Humidity : 55 % + - 5 % 23. The firm will carry out the Periodical Checks & Preventive Mtc. Schedule for the satisfactory

function of the Equipments of AC Plants as per detail given below:- A. Daily:- i) Record the hourly reading for all the parameters. ii) Attending the break down if any. iii) Checking the AC System for refrigerant gas leakages. iv) Checking of AHU fillers & cleaning there of if required. v) Cleaning of AC Plant sites. vi) Check up the water level & top up the same for condensate water tank.

vii) Refrigerant gas charging, if required.

B. Weekly:- i) Checking of leakages of refrigerant lines & attending the leakages if any. ii) Checking & tightening of all electrical connections of the Main Control Panels as well as MCC

panels of all the equipments. iii) Cleaning of water lines strainers. iv) Refrigerant gas charging, if required. vi) Checking of Oil level of Compressors. vi) Cleaning of AHU’s Filters. C. Monthly:- i) Checking of oil level of Compressors & top up if required. ii) Cleaning of suction line Strainers of Compressor. iii) Cleaning of cooling coils of AHU with dilute acid or water. iv) Checking & tightening of foundation bolts of Compressors & other allied equipments. v) Checking loading & unloading of compressors of AC System. vii) Oiling & Greasing of various bearings of pumps/Fans/ motors & other rotary equipments. viii) Cleaning of liquid line strainers of the Compressors. ix) Cleaning of Diffusers /Grills for all the Control Rooms. ix) Checking & calibration of all the Safety & Auto controls. x) Replacements of Mechanical/Electrical defective parts of the AC System if any. xi) Refrigerant gas charging, if required. D. Quarterly:- i) Cleaning of Air Cooled Condensers Coils. ii) Check healthy ness of operation of safety devices. ii) Check tightness of all electrical terminations. iv) Top of grease of all Motors/Bearings. v) Check condition of oil & test the sample if required. vi) Check & clean refrigerant strainers. vii) Check the condition of the refrigerant drier. viii) Check any abnormal noise & vibration. ix) Check and tighten the bolts of all the Mechanical parts of the AC Plants E. Annually:- i) Over Hauling of Compressors shall be done under the supervision of manufacturer’s authorized

representative. ii) Changing of compressor oil. iii) Checking of suction & discharge valves assemblies & replacement if required. iv) Checking of oil pumps seals of compressors & replacement if required. v) Checking of bearing clearances for the smooth operation of AC Plants. vi) Descaling of condensers tubes with dilute acid & changing of all gaskets. vii) Cleaning, greasing & oiling of all the bearing of the equipments of AC system, AHU Units. viii) Cleaning of all the water lines, valves & strainers etc. ix) Checking of loading & unloading of AC compressors. x) Adjustment of all the Air Distribution System. xi) Maintenance of all the Electrical Equipments, contractors, Starters, switches, thermal over load

relays & other electrical parts which needs to be replaced for AC System. xii) Refrigerant gas charging if required. xiii) Cleaning of all the Air Duct & Diffusers of AC System.

16. RISK & COST i) If the contractor fails to take work in hand within the stipulated period OR if his services are found to

be unsatisfactory at any stage; the HPGCL will be entitled at its option:- ii) EITHER to cover the damages of non execution/delay and to get the same executed from other

source(s) at his risk and cost besides forfeiting the Earnest Money as well as security deposit. iii) OR to get the work completed departmentally OR through any other agency purely at the risk and

cost of the first contractor. In that case no payment liable to be made for work already done besides forfeiting the Earnest Money & Security Deposit.

ADDITIONAL TERMS AND CONDITIONS

1. The tenders shall be filled in English / Hindi languages only. The specimen signatures

along with the complete address of the contractor of his native place & his present place

of working on their letter head shall be enclosed with the Tender documents.

2. The contractor to whom the work is awarded shall be required to execute the contract

agreement on NJSP of Rs.15/- as required under Indian Contract Act with in 15 days from

the award of work.

3. The Tender to whom the work is awarded will have to start the work with in 7 days of

issue of work order/LOI which ever is earlier.

4. If the contractor fails to execute the work within contract period , the HPGCL shall get

the work completed from other source at the risk & cost of the firm besides security

forfeited.

5. The contractor shall ensure while quoting the rates that he shall fulfill all the statuary

obligations for the payments of minimum wages as per the DC/ Haryana Govt. rates shall

deposit of EPF by the contractor in addition to worker’s own contribution arrange

insurance of all the workers as per the labour laws & rules in respect of all the persons

engaged for the contract, other wise HPGCL may Cancel / Reject his offer.
