In 1996 the Missouri Legislature passed the Safe Schools Act to help make school districtssafer in Missouri by insuring that resident students are attending Missouri schools. At this timethe Parkway School District adopted stricter residency policies. The district began requiring twoproofs of residency be given at the time of new student enrollment and also that a student mustbe living with a parent or court-appointed guardian unless there was hardship or good cause.

In the past several years proof of residency procedures have been improved as situations havewarranted. For instance, it was discovered that some parents would show proof of residency fora home in which they were not residing. Thus the district adopted policy requiring that a parentprovide a lease agreement, sales contract, real estate tax receipt or mortgage statement as amust for one proof of residency. If a parent cannot provide one of these documents, then thehomeowner/leasee and parent sign a Residency Affidavit at the Student Records Office. Thesecond proof of residency that a parent may provide can be a current unpaid utility bill, creditcard statement, employer’s record of address, bank statement, or governmentalacknowledgment of address (i.e., Social Security, welfare, voter registration, etc.).

Periodic audits of student records at every Parkway school are necessary to ensure consistencywithin the district. The audit of student records in December 2006 indicated that 54% of therecords examined were incorrect. Mistakes varied from no residency documentation to only oneproof of residency in the student’s file. This could potentially create a problem for studentstransitioning to another level. Registrars are trained each year on the importance of maintainingadequate records on every student. Expectations are the same for each Parkway school in aneffort to create consistency within the entire Parkway School District.

To assure consistency across the district, all residency issues requiring decisions as to whethera student is eligible to attend the Parkway School District are handled at one central location,the Department of Pupil Personnel. Therefore, parents are given consistent information thatcan be applied to any school in Parkway that their children may attend. Likewise, if a studentfails to maintain certain criteria for continued enrollment in the district, revocation is madethrough the Department of Pupil Personnel. These guidelines help to maintain consistencyacross the district.

Following are different scenarios with direction that is given to the school registrar that mayoccur at time of registration:

• Family has just moved into district. Must have contract on house, current real estate taxreceipt, or lease agreement. Accept this as residency with understanding that parents willbring in another proof of residency within 30 days as specified in Policy JFAA.BP.

• Family has contract on house but has not moved into district. Must call Joyce Pezold,Administration (415-8006), to apply for a PERMIT TO ENROLL.

• Family has moved into district but living with relatives or friends. Family must contactMary Theriot to sign RESIDENCY AFFIDAVIT. Property owner will provide specified proofsof residency and sign affidavit. Parents must provide two proofs of residency at time theysign affidavit or within 30 days if they have just moved into district.

• School does not have to ask for residency if a resident moves within the district or if anotherchild of the family starts attending Parkway, unless unsure of where family is living.

• Family lives in an unaccredited school district and wishes to attend Parkway. Parentmust call Linda Lococo, Administration. (5-8029) Linda will give family registration packet.

Family will bring back packet to Linda. A school will then be assigned if appropriate. Lindawill contact the assigned Parkway School, send PI Form to the registrar, and contact thefamily and let them know what school has been assigned and instruct them to contact theschool registrar to set up an appointment for registration. Registrar will then follow normalenrollment procedures. Family must provide their own transportation.

Student must live with parent or court-appointed guardian. Mary Theriot (5-5062) must becontacted regarding all Power of Attorneys. Mary Theriot will send letter during summer forrenewal of power of attorney and hardship waivers. Power of Attorney and hardship waiversmust be renewed every year.

• Student is living with someone other than parents. Have relative or parent call MaryTheriot to set up appointment to discuss hardship waiver and other options. The Director ofPupil Personnel, Educational Equity and Pluralism meets with the family to determine thestandard of hardship or good cause. Athletic ability and educational purposes areunacceptable reasons for granting a waiver.

• Student is living with biological parent that is not the custodial parent. School mayaccept letter from custodial parent.

• Student is living in a foster or group home. Foster parent should provide courtpaperwork showing custody. Have foster parent fill out Foster Home Domicile Form andsend to Mary Theriot, ISC. Add appropriate tag on CIMS.

• VST students may live with relatives or friends without hardship waiver. The personwith whom the student is living must have power of attorney and show two proofs ofresidency. Send copy of Power of Attorney to Mary Theriot, ISC.

• Student coming from another country and living with relatives/friends.Relatives/friends must have court-appointed guardianship. Hardship waivers do not applyto foreign students. A Power of Attorney is not acceptable in this situation.

• Student is living independently and supporting him/herself and is 18 years of age.Inquire concerning relationship with parents. Require two proofs of residency from student.(Call Mary Theriot. 5-5062)

• Student is 17 and living with someone other than parent, but not supportinghim/herself. Must live with someone 21 years or older. Student must apply for a HardshipWaiver. (Call Mary Theriot.5-5062)

• Student is 18 and living with someone other than parent, but not supportinghim/herself. Call Mary Theriot. (5-5062) These cases are reviewed individually.

From time to time a student will move and the parent does not inform the school about themove. Mail is returned which alerts registrar to check on student’s residency. Following is theprocedure that is recommended that a school follow in order to discover where the student isresiding:

1. Administrator or registrar will contact parent by phone to discuss where student is residing.If parent admits that the student has moved out of the district, the parent is asked to fill out aNon Resident No Tuition Waiver in order for the student to finish the semester or if the

student is a senior, school year.

2. If parent states that student has not moved, then parent is asked to provide two currentproofs of residency within two weeks. A residency letter (form letter) is sent to parent asfollow up to phone conversation.

3. If parent does not provide residency by designated time, then student is not allowed toattend school until residency issue has been cleared.

4. In extreme cases where school is still suspicious where family is living even after parent hasprovided residency, Director of Pupil Personnel, Educational Equity and Pluralism asksChief of Security to investigate residency of family.

Recently it has come to our attention that there is some confusion concerning the residency of (student’s name) . Enclosed is a document explaining Parkway School District residency criteria. According to Policy JFAA, residencyverification is required for all students who attend schools in the Parkway District. In order to attend Parkway (name of school) , students are required to reside with a parent, a court-appointed legal guardian or military guardian (pursuant to a military-issued guardianship) within the boundaries of the (area) Area of the Parkway School District.

If a student is residing with the custodial parent then proof of residency such as two or more of the following documents containingname and address must be presented to the school registrar:

• a contract to lease/rent or• current real estate tax receipt/mortgage statement

AND one other current proof of residency such as:

• Unpaid utility bill• Credit card statement• Employer’s record of address• Bank statement• Governmental acknowledgment of address

(i.e., Social Security, welfare, voter registration, etc.)

These documents should contain your name and address and should be presented to the school registrar by (give date that istwo weeks from date of letter) . If this information is not received by the above date, Student’s Name will be withdrawnfrom the Parkway School District on (day after deadline given) .

If the students’ residency changes without notification, upon discovery, the student may be immediately withdrawn and the parties maybe responsible for tuition from the time the student no longer resided in the district. A student will be immediately withdrawn if falseinformation is given.

“Any person who knowingly submits false information to satisfy any requirement of this section is guilty of a class Amisdemeanor. In addition to any other penalties authorized by law, a district board may file a civil action to recover, from theparent/legal guardian of the pupil, the costs of school attendance for any pupil who was enrolled at a school in the districtand whose parent/legal guardian filed false information to satisfy any requirement of this section (RSMO 167.151).”

If the student is living with a court-appointed legal guardian then court documents specifying custody must be on file in the schoolregistrar’s office, as well as proof of residency as specified in the previous paragraph.

Mrs. Charlotte Ijei, Parkway Director of Pupil Personnel, Educational Equity and Pluralism, must be contacted if student is not livingwith parent, court-appointed legal guardian, military guardian or is residing outside of the district. Please call Mary Theriot(314-415-5062) to schedule a conference with Mrs. Ijei to discuss tuition charges or application for a waiver of residency requirements.

Students who are approved participants in the Voluntary Interdistrict Transfer Program must reside within the boundaries of the city ofSt. Louis. For clarification, we are requiring two proofs of residency that show you are residing in the city of St. Louis. The two proofsof residency should be:

• a contract to lease/rent or• current real estate tax receipt/mortgage statement

AND one other current proof of residency such as:

• Unpaid utility bill• Credit card statement• Employer’s record of address• Bank statement• Governmental acknowledgment of address

(i.e., Social Security, welfare, voter registration, etc.)

These documents should contain your name and address and should be presented to the school registrar by (give date that istwo weeks from date of letter) . If this information is not received by the above date, Student’s Name will be withdrawnfrom the Parkway School District on (day after deadline given) .

Missouri’s Safe School Act compels us to comply with the following:

“Any person who knowingly submits false information to satisfy any requirement of this section is guilty of a class Amisdemeanor. In addition to any other penalties authorized by law, a district board may file a civil action to recover, from theparent/legal guardian of the pupil, the costs of school attendance for any pupil who was enrolled at a school in the districtand whose parent/legal guardian filed false information to satisfy any requirement of this section (RSMO 167.151).”

If student does not reside with custodial parent or court-appointed legal guardian, Mary Theriot (Pupil Personnel) at 314-415-5062must be contacted. Documents specifying parental responsibility must be on file in the school registrar’s office.

RESIDENCY CRITERIA

Under Missouri school law (RSMo 167.151), a student must be a resident in order to attend thatdistrict’s public schools without charge. “The term residency shall mean that a person physically resides withina school district. The residency of a minor child shall be the residence of a parent, court-appointed legalguardian, or military-issued guardian. The student and parent must provide proof of residency in the district.”

A student may not establish residency away from a legal guardian or parent for the sole purpose ofenrolling in a district without the obligation of paying tuition. Non-resident students may make application topay the district’s tuition and such a request will be reviewed by the Board of Education. The Parkway Board ofEducation is responsible to its taxpayers to assure that attending students meet the residency requirements orpay tuition.

A student who is NOT living with parent(s)/legal guardian(s), who are both residents and live in theParkway School District, and who wishes to be considered for enrollment in the Parkway School District, mustcomply with one of the following:

1. Pay the current rate of tuition $9,802.61 annually ..........................................................................OR2. Establish resident status in the district by:

• Living and residing within the Parkway School District boundaries with a legal resident of the district, AND• Providing an application defining the hardship for which the student is requesting a waiver.... AND• Presenting a notarized statement establishing a “Power of Attorney” to be given to the resident for

the purpose of being educationally, medically and financially responsible for the student whilehe/she is living in the district,................................................................................................. AND

• Presenting two proofs of occupancy (rental agreement, real estate tax bill, etc.) of the resident whowill be receiving the Power of Attorney, ...................................................................................OR

3. Establish that the student qualifies under the “Homeless” legislation of the Stewart B.McKinney

Act OR4. Pupils who qualify under Sections 167.121, 167.151, and 167.020 (1-6) RSMo. (See back ofsheet for explanation.)

All applications for any of the above must provide signatures. The signatures on the form will alsoacknowledge the understanding that if the student’s living arrangement changes, the student may beimmediately withdrawn and the parties held responsible for tuition. It is understood that the student’s status issubject to constant review and, if permission is granted to enroll, it could be withdrawn as circumstances changeor if the student does not remain in good standing.

“Any person who knowingly submits false information to satisfy any requirement of this section is guilty of a classA misdemeanor. In addition to any other penalties authorized by law, a district board may file a civil action torecover, from the parent/legal guardian of the pupil, the costs of the school attendance for any pupil who wasenrolled at a school in the district and whose parent/legal guardian filed false information to satisfy anyrequirement of this section (167.151RSMo.).”

RESIDENT STUDENTS - POLICY JFAA GUIDELINES

I. A. A child who lives within the boundaries of the district with a parent, court-appointed legal guardian, military-issued guardianship or other person having lawful custody ofthe child under an order of a court or governmental agency placement.

B. An orphan child, a child with only one parent living, a child whose parents do not contribute to his/her support who has a home within the boundaries of the ParkwaySchool District.

C. A child whose parents are divorced or separated and who lives with one of the parents within the boundaries of the District. The parent with whom the child lives musthave a letter from custodial parent indicating that he/she consents to the arrangement.

D. A married pupil who lives with his/her spouse within the boundaries of the District.E. A pupil 17 years of age or older and emancipated by the parents, and lives within the boundaries of the District. In this context, a child is “emancipated” if there has been

a total relinquishment of parental control by the parents and a freeing of the child from the care, custody, control, and service of the parents.F. A homeless child, meaning a child who lacks a fixed, regular, adequate nighttime residence, including a child who: (a) is living on the street, in a car, tent, abandoned

building, or some other form of shelter not designed as a permanent home; (b) is living in a community shelter facility; (c) in transitional housing for less than one full year;(d) is abandoned in a hospital; (e) is awaiting foster care placement; or (f) is migratory and who lives in any of the circumstances described above.

G. A child with a disability identified under state eligibility criteria if the child is living in district for reasons other than accessing the district’s educational program.H. A child who has been granted a waiver of proof of residency requirement on the basis of hardship or good cause.I. A pupil who becomes 21 years of age may continue to attend high school through that school year in which the 21st birthday occurs. In special situations, the

Superintendent of Schools may approve continued attendance of a pupil over 21 years of age until graduation from high school.II. A. One or both parents/legal guardians must accompany the student before student enrollment can begin.

B. 1. Student living with parent/guardian in the district shall provide:A. Deed/sales contract of residence, contract to lease/rent, current real estate tax receipt, or mortgage statement ANDb. One other current proof of residency such as: unpaid utility bill, credit card statement, employer’s record of address, bank statement, or governmental

acknowledgment of address (i.e., Social Security, welfare, voter registration, etc.).NOTE: All new enrollments must provide proof of residency.

2. In the event that the parent lives but does not own or rent in the Parkway School District, the parent/guardian shall provide:a. A signed affidavit of residency by the property owner/lessee approved by superintendent’s designee including proof of residency as in “B” above andb. Parent/guardian proof of residency same as in “b” above.

C. Residency requirements of an orphan shall be established by the person having custody of said child in the same manner as set forth in “B” above. In addition:1. Official birth certificate of child shall be provided and2. Death certificate of one or both parents.

D. Residency requirements of a person having custody of a child under court order or governmental agency placement shall be established by the person having custody ofsaid child in the same manner as set forth in “B” above. In addition:1. Court order of agency placement document shall be provided and2. Official birth certificate.

E. Residency of a child whose parents are divorced or separated shall be established by the person with whom the child is living in the same manner as set forth in “B”above. In addition:1. If student is residing with custodial parent, copy of divorce decree.2. If student is residing with noncustodial parent, copy of divorce decree and letter from custodial parent indicating that he/she consents to the arrangement.3. If student is residing with both parents equally, court documentation indicating that child is residing an equal amount with both parents.

F. Residency requirements of a married student who lives with his/her spouse shall be established by the student in the same manner as set forth in “B” above.G. Residency requirements of a student 17 years of age and who is emancipated by the parents shall be established by the student in the same manner as set forth in “B”

above. In addition:1. Emancipation papers signed by parents.

H. Residency requirements of a student 18 years of age shall be established by the student in the same manner as set forth in “B” above.I. Residency requirements of a student who is considered homeless shall be approved by district homeless coordinator.J. A resident who has a child residing with them and said resident is other than parent/court-appointed guardian must apply for residency waiver. If residency waiver is

approved, residency requirements shall be the same as set forth in “B” above.K. New students in grades 9-12 who are 16 years of age or older and residents of the district will be allowed to enroll at the beginning of the semester, or upon transferring

from another education setting. If there has been a period of six (6) weeks or more where a child has not been enrolled and attending another school, the enrollment maybe denied. The student will then have to wait to enroll at the beginning of the next semester.

L. The building registrar can process all applicants’ enrollment when they provide appropriate documents except:1. Parents residing with a Parkway resident (B-2) and2. Student living with someone other than parent or court-appointed guardian (J).

III. When a child is living (or plans to live) in the district with an adult other than the child’s parent/guardian, such adult may apply for waiver of proof of residency on the basis ofhardship or good cause. The applicant must provide the following: (a) Evidence that the adult lives in and is a resident of the district. (b) An application explaining the hardshipor good cause which is the basis for the requested waiver. (c) Except where clearly not appropriate, an executed and enforceable Power of Attorney giving the resident theauthority to make educational and medical decisions on behalf of the child. All applicants must schedule an appointment with the superintendent’s designee to complete thewaiver application process.

IV. Foreign pupils will not be permitted to enroll unless they satisfy the residence requirements set out in Section I.V. The administration may investigate the residence and other circumstances of any child and may request appropriate persons to supply affidavits, certification and other

information and documents concerning any factor relevant to the child’s enrollment in the Parkway schools.

NONRESIDENT STUDENTS – JFAB BOARD POLICY

Except as provided herein, children not entitled to free instruction may attend the district’s schools only by paying tuition and only with the formal approval of the Board ofEducation.

I. A child’s whose custodial parent, legal guardian, military-issued guardianship, or other person having lawful control under a court order has a present intention to move to aParkway residence. A Permit to Enroll may be issued according to administrative guidelines.

II. Regularly enrolled children who move out of the district during the school year may request approval to complete the current semester. A senior may complete an entire schoolyear if s/he submits a formal request and successfully completes the junior year.

III. Students whose custodial parents/guardians maintain property within the Parkway and pay school tax may apply to attend a Parkway school by submitting an Application.IV. Students who apply through the St. Louis Voluntary Student Transfer Program.V. A nonresident child attending a regional or cooperative alternative education program or an alternative education program on a contractual basis.

VI. A child who is a ward of the state and has been placed in a residential care facility located in the district.VII. A child placed in a residential care facility due to mental illness or developmental disability.VIII. A child placed in a residential facility by juvenile court.IX. Other nonresident children who have statutory right to enroll with the district of residence paying the tuition.X. Other nonresident school age children may attend only with formal approval of the BOE.

XI. The MO Commissioner of Education may assign nonresident students to Parkway School District.

It is also understood that when the student’s residency changes, parents/legal guardian willimmediately notify the school.
