The JAG ReportThird quarter 2015 military justice actions

By Maj. David Coggin Air Force Recruiting Service Staff Judge Advocate

During the third quarter of 2015, Air Force Recruiting Service squadron commanders administered three nonjudicial punishment actions under Article 15 of the UCMJ. The punishments imposed reflect each commander’s determination of an appropriate punishment after considering the circumstances of the offense and the offender’s record. In addition, three courts-martial were completed.

Nonjudicial Punishments A staff sergeant was selected for a random urinalysis and tested positive for marijuana. The member was charged with wrongful use of a controlled substance under Article 112a of the UCMJ. The member’s punishment consisted of a reduction to E-4, and forfeiture of $1,225 suspended for six months. A master sergeant violated the Air Force policy against discrimination and sexual harassment, and created a hostile work environment. The member was charged with failure to obey a lawful general order under Article 92 of the UCMJ. The member’s punishment consisted of forfeiture of $1,092 per month for two months, one month suspended, and a reprimand. A staff sergeant abused his position by utilizing recruits for personal errands, and encouraged overly friendly and informal interactions with recruits, to include use of first names and inappropriate stories, in violation of AFRSI 36-2001. The member was charged with three counts of failure to obey a lawful general order under Article 92 of the UCMJ. The member’s

punishment consisted of reduction to E-4, suspended, forfeiture of $310 per month for two months, one month suspended, and a reprimand.

Courts-Martial A master sergeant from the 361st Recruiting Squadron was tried and sentenced at a special court-martial July 13-17. The member was convicted of wrongful use of hydrocodone under Article 112a of the UCMJ, and a good order and discipline violation under Article 134 of the UCMJ. The member was sentenced to reduction to the grade of E-6, 45 days confinement, and forfeiture of $2,448 pay per month for six months. A technical sergeant from the 361st RCS was charged with wrongful use of marijuana in violation of Article 112a of the UCMJ. The member was tried at a special court-martial Aug. 19-21, and was acquitted. A senior airman from the 332nd RCS was tried and sentenced at a special court-martial Sept. 8. The member was convicted of four counts of misleading an applicant under Article 92 of the UCMJ, and three counts of good order and discipline violations under Article 134 of the UCMJ. The member was sentenced to reduction to the grade of E-1 and a bad conduct discharge.

All courts-martial actions are open to the public. They can be accessed at the USAF Public Docket website, located at: http://www.afjag.af.mil/docket/index.asp. Sexual assault convictions are listed by base on the On-Line Sexual Assault Reports of Conviction website, located at: http://www.afjag.af.mil/shared/media/ document/AFD-130917-061.pdf.
