Utility Patent – Protects the way an invention is used or works.

Design Patent – Protects only the ornamental appearance of an invention not its utilitarian features.

Plant Patent – Protects newly invented strains ofplants.

Provisional Application – Establishes an early filing date for filing a regular patent later (good for1 year).

Patents have 2 types of claims

Independent Claims• They stand alone.

• Contains one or more elements.

Dependent Claims• They “depend” on an Independent claim.

• Contains one or more elements.

How to infringe on a Patent.

Physical Property - You must “step on” someone’s

physical property to “encroach” on it.

Intellectual Property (Patent) – Your invention

must “read on” (step on) all the elements of at least one

independent claim in order to “infringe” (encroach) on

someone’s else’s patent.

If your invention does not infringe on any of their independent

claims, you do not infringe on their entire patent.
