COMMON SCREEN ITEMS

Header Box (Mandated): When clicked by the consumer, the API will present the “About Payforit” screen.

Merchant Detail (Mandated): Must carry the Merchant Identity and must be recognisable from the consumer journey to this screen. Images not to exceed 2/3 of the total screen.

Charge Notification (Mandated): A short, clear, unambiguous explanation of the service being offered for purchase must be displayed on every page of the flow used. This should explicitly state “This will be charged to your mobile phone” (non-phone devices must reference the device).

Call to Action First Purchase button (Mandated): Dependant on the Flow it can read “Buy Now”, “Subscribe Now”, “Donate Now”. All have price on and subscriptions also have billing frequency.

Call to Action Second Purchase button (Mandated): When the MSISDN is confirmed the charging notification along with the price must appear on the second payment button: “Confirm this charge to your mobile.”

Help (Mandated): Must contain the Merchant or API support details with links to Merchant and Payforit terms and information

Error reason (Mandated): API will present the reason for the error using the Error Reasons permitted

Retry button (Mandated): This will return the consumer to the Payment page to retry the transaction or cancel and return to the Merchant.

MSISDN Entry box Instruction can be either above or below the box. A dropbox for consumers to select their own network can be provided. Instructions should be appropriate to the flow being used.

Payment Received Notification (Mandated): Advises the consumer the amount that they have paid from their mobile account and must match the price shown on previous screens. (or Subscription Activated) Exit button optional on this screen. Option to secure consumer’s agreement to waive their right to a refund.

“Don’t know your mobile number?” link (Optional): eg when using broadband. This clickable link switches the Consumer Experience Flow from MT to MO flow.

Marketing Opt–In (Optional): Allows the Merchant to conduct marketing to the consumer. Box must be unticked unless prior permission has been given to pre-tick it.

5. CCR Regulation 16 (2) states the text receipt confirmation must include:

(a) the main characteristics of the goods or services, to the extent appropriate to the medium of communication and to the goods or services;

(b) the identity of the trader (such as the trader’s trading name) and address (where available, the trader’s telephone number, fax number and e-mail address)

(f) the total price of the goods or services inclusive of taxes, or where the nature of the goods or services is such that the price cannot reasonably be calculated in advance, the manner in which the price is to be calculated,

(g) where applicable, all additional delivery charges and any other costs or, where those charges cannot reasonably be calculated in advance, the fact that such additional charges may be payable;

(h) in the case of a contract of indeterminate duration or a contract containing a subscription, the total costs per billing period or (where such contracts are charged at a fixed rate) the total monthly costs;

(i) the cost of using the means of distance communication for the conclusion of the contract where that cost is calculated other than at the basic rate;

(s) the duration of the contract, where applicable, or, if the contract is of indeterminate duration or is to be extended automatically, the conditions for terminating the contract;

“Payforit is a technical payment scheme developed by the UK mobile network operators ("networks"), to make buying digital products and services via a

mobile phone or other device simple and clear for you and enabling you to charge these purchases to your mobile monthly account or prepaid credit.

The scheme is operated by parties (called Payment Intermediaries) that contract to your network to provide the relevant information to you so that you can

make your own decision about the purchase. Payforit is not a legal entity and is not a party to any transaction for products or services.

When you make the decision to purchase and indicate your decision by pressing a button or an appropriately worded icon, you agree a contract with the party

selling the product or service ("the seller") that you will pay the price detailed by charging the purchase to your monthly account or prepaid account provided

by your network. Your contract is with the party selling the product or service ("the seller") not with your MNO. Your MNO has agreed with the seller simply to

charge the amount directly to your bill or prepay account. Once this charge has been authorised by you, the seller must provide the product or service detailed

and you must pay your network (for monthly accounts) the amount charged. You are therefore wholly responsible for checking that you are happy with the

price, the product or service and the seller before making a purchase commitment.

When choosing to pay by your mobile account or prepaid credit, you have either provided your mobile number to the payment intermediary or you have

agreed for your network to pass your number directly. If you did not opt out of marketing (by un-ticking the relevant box), the seller may use your mobile

number in accordance with its privacy policy, terms and conditions.

You have 14 days from the date of the purchase to change your mind, cancel the purchase and receive a refund. You will need to contact the

[seller][merchant] on the contact number given in the receipt that you will receive after the purchase is made. The [seller][merchant] may have asked you to

agree to an immediate delivery of the service or content and in doing so, you will have waived your right to cancel. If your purchase is a subscription service

with a recurring charge, then you have the right to cancel the service and all future charges by following the instructions given in the text message sent to you

after your purchase. Other rights that you may have (statutory or otherwise) including rights related to faulty or incorrectly described goods are between you

and the [seller][merchant] and any enquiries or disputes must be addressed directly with them using the phone number provided in the receipt message. Your

network has added value in terms of access, search, the Payforit scheme and the charging mechanism and you can escalate any dispute between you and the

seller to your network for them to take a decision as long as you have discussed the dispute with the seller and can provide evidence of that discussion to your

network.

The operation of this payment facility is regulated under the PhonepayPlus Code of Practice and is bound by the Consumer Contracts (Information,

Cancellation and Additional Charges) Regulations.
