Attorney Steve Epstein called me about a week ago, apparently having had a conversati on with you in which you related your recollection of a conversation I had with you earlier. You apparently recounted to Mr. Epstein your recollection of the issue of the tax payment and your contention that there had been a big conspiracy involving the federal government, the state government, your attorneys and the Judge to prevent you from presenting evidence of payment or accord in satisfaction in an effort to estop the state from proceeding.
I had expressed considerable amazement at the scenario that you outlined for me, but that of course assumes that that scenario is correct. Mr. Epstein indicates that the check appears a number of times in the file, so it obviously played some role in the case and I suspect that the issue of payment or estoppel was raised by your legal counsel at some point in some context. It's probably a losing proposition for a number of reasons, but I want to make it clear that I'm not being critical of either your trial counsel or Mr. Epstein who is now undertaking the difficult challenge of dealing with your sentencing. Having known you, Leo, for probably 14 years, I know you present many very challenging legal and factual issues in all of your legal matters.

That on or about June 11, 1991, at the City of Madison, County
of Dane, the above- named defendant, Leo E. Wanta, did feloniously
and intentionally render a false and fraudulent Wisconsin
individual income tax return for the calendar year 1988 with the
intent then and there to evade the income tax due and owing to the
State of Wisconsin by reporting in the said income tax return zero
taxable income for said calendar year, whereas said defendant had
a net taxable income for said calendar year of approximately
$166,372, upon which there was of Wisconsin a
net income tax of to sec.

MEMORANDUM OPINION
THIS MATTER is before the Court on Defendants the United
States of America, et al . 's, motion to_ dismiss Plaintiff
Ambas sador Leo Wanta's claim of breach of contract based on lack
of subject matter jurisdiction and on Plaintiff's motion to amend
his complaint. The issue before the Court is whether the Court
should dismiss an alleged secret government ' s claim against
the Attorney General, the Director of the
Agency, the Secretary of the Treasury a tl the Goverrunent· based on
lack of subject matter jurisdiction The Court grants
Defendants' motion to dismiss p suant to Federal Rule of Civil
Procedure 12(b) (1 ) because e Government has not waived
sovereign immunity and P. lie policy forbids the adjudication of '--' t1
a suit relating to m ters of an alleged national securi ty
contract. The C rt denies Plaintiff's motion to amend his
complaint und r Federal Rule of Civi l Procedure 15{a) because
such ion would be futile.

cases holding that a corporation can only be. represented by

Vending Service is not a corporation,~nta lacks standing
because his affidavit testimony indicates he is only an
