THE PROCEDURE IN THE NATIONAL PHASE

NO.01 FORM FOR ENTERING THE NATIONAL PHASE. The Office has available a

special form for entering the national phase (see Annex NO.II). This form should preferably

(but need not) be used. This form is also available on the Office’s website at:

https://www.patentstyret.no/en/services/forms-PDF-format/

NO.02 LANGUAGE OF PROCEEDINGS. The description, the claims, any text matter of

drawings and the abstract of the international application must be in Norwegian or English1. If

the application has not been published in English, a translation into English or Norwegian has to

be furnished. Other documents and correspondence may be in Norwegian, Danish, Swedish or

English. The languages of opposition and appeal proceedings are Norwegian, Danish or

Swedish.

NPL Sec. 31(3) NO.03 TRANSLATION (LATE FURNISHING OF). If the translation of the international

application has not been furnished by the applicant within the time limit applicable under

PCT Article 22 or 39(1), the translation can still be furnished within a further period of

two months, provided that the basic fee and the additional fee for late furnishing of the

translation, indicated in the Summary, have been paid within the prescribed deadlines (the

deadlines being 30 days after the date of the invitations to pay those fees).

NO.04 TRANSLATION (CORRECTION). Errors in the translation of the international

application can be corrected with reference to the text of the international application as filed

(see National Phase, paragraphs 6.002 and 6.003).

NO.05 TRANSLATION (IN CASE OF LACK OF UNITY OF INVENTION). Where a

part of the international application was not subjected to an international search for reason of

lack of unity of the invention, a translation is required only of those parts of the international

application which were subjected to the international search. However, where the applicant

wants to maintain the part which was not searched, a translation of this part must also be

furnished. See also paragraph NO.9.

NO.06 FEES (MANNER OF PAYMENT). The manner of payment of the fees indicated in

the Summary and in this Chapter is outlined in Annex NO.I.

NPL Sec. 8(4) NO.07 DECLARATION OF RIGHT AND DEED OF TRANSFER. If someone other

than the inventor applies for a patent, the application shall contain a declaration from the

applicant stating his right to the invention, or a deed of transfer. For details, see the model of

such declaration and deed (not an official form) in Annexes NO.V and IV. Legalization is not

required.

NO.08 POWER OF ATTORNEY. An agent may be appointed by filing a separate power

of attorney or by use of the special form referred to in paragraph NO.01 (see Annex NO.II). A

model of a separate power of attorney is given in Annex NO.III. Where a lawyer in person is

appointed as agent to act on the applicant’s behalf for matters concerning the national phase, a

power of attorney is not mandatory. If a company is appointed, a power of attorney is necessary,

even if the employee representing the applicant is a lawyer.

NO.09 ADDITIONAL NORWEGIAN SEARCH OR EXAMINATION REPORT (IN

CASE OF LACK OF UNITY OF INVENTION). Where a part of the international

application was not subject to an international search or preliminary examination because the

international application did not comply with the requirement of unity of invention and the

applicant did not pay the additional search or preliminary examination fee to the International

Searching or Preliminary Examining Authority, the Office will decide whether the said finding

as regards the application translated into Norwegian or English was correct. If this is found to

be the case, the Office will invite the applicant to pay an additional fee within two months after

mailing of the notification of this decision. The amount of the said fee is indicated in

Annex NO.I. Where the applicant does not pay the additional fee, that part of the international

application which was not subjected to international search or preliminary examination will be

considered withdrawn.

NPL Sec. 20 21

NO.10 PATENT GRANT FEE. When the applicant has been notified that a patent may be

granted, a patent grant fee must be paid within two months. The amount of the fee is indicated

in Annex NO.I.

NPL Sec. 8(5) 8(6) 40 to 42

NO.11 ANNUAL FEES. Annual fees must be paid for each year following the international

filing date. For the due date of the annual fees for the first three years, see the Summary.

Payment of the subsequent annual fees must be made before the expiration of the month

containing the anniversary of the international filing date. Payment can still be made, together

with an additional fee for late payment, before the expiration of the sixth month after the month

containing the anniversary of the international filing date. The amounts of the annual fees are

indicated in Annex NO.I.

PCT Art. 28 41 NPL Sec. 13

NO.12 AMENDMENT OF THE APPLICATION; TIME LIMITS. The applicant may

make the following modifications before the Office, provided that the scope of the subject

matter of the application is not broadened thereby:

(i) within 35 months from the priority date: corrections of defects and voluntary

amendments;

NPL Sec. 19 to 21 NPR Sec. 20 and 21

(ii) up to the decision that the application is to be granted a patent: amendments or

additions to the description and drawing(s) if they are necessary to comply with general

requirements under PCT Articles 5 and 7; amendments or additions to the claims, which, unless

the Office allows otherwise, must be made by filing a new document comprising all of the

claims in sequence; where additions are made to the claims, the applicant must at the same time

file a statement indicating the reference basis for these additions.

NO.13 REVIEW UNDER ARTICLE 25 OF THE PCT. The applicable procedure is

outlined in paragraphs 6.018 to 6.021 of the National Phase. If, upon review under PCT

Article 25, the Office denies an error or omission on the part of the receiving Office or the

International Bureau, an appeal against this decision may be lodged with the Board of Appeals,

within two months from the date of the decision. An appeal fee must be paid within 30 days

from the date of the invitation to pay that fee (for the amount, see Annex NO.I).

NO.14 EXCUSE OF DELAYS IN MEETING TIME LIMITS. Reference is made to

paragraphs 6.022 to 6.027 of the National Phase.

NO.15 Reestablishment of rights may be requested where the applicant, in spite of all due

care reasonably required, was unable to observe a time limit during the international phase or

before the Office, default of which is prejudicial to his rights. A request for reestablishment

must be presented in writing within two months after the removal of the cause of the failure to

perform the action but not later than one year from the expiration of the time limit which has not

been observed. The request must state the grounds on which it is based and set out the facts on

which it relies. Within the said two months, the omitted action must be completed. A fee for

reestablishment of rights (see Annex NO.I) must be paid within 30 days from the date of the

invitation to pay that fee.

NPL Sec. 15 NO.16 Resumption of proceedings concerning the application may be requested from the

Office where the applicant has missed a time limit which had been fixed for a certain action by

the Office. Resumption of proceedings may not be requested where the missed time limit is

fixed in the PCT, the PCT Regulations, the Norwegian Patents Act or the Norwegian Patent

Regulations. A request for resumption of proceedings has the effect that the proceedings for

grant will be resumed, provided that, within four months from the expiration of the missed time

limit, the said request is presented in writing, the resumption fee (see Annex NO.I) is paid and

the omitted act has been completed.

NPL Sec. 24 NO.17 OPPOSITION. Any person may file an opposition to a granted patent. A notice of

opposition shall be filed in writing, state the grounds for the opposition, and reach the Office

within nine months from the date of grant of the patent. There is an exception for oppositions

that assert that the patent is contrary to public order or morality; these can be filed within three

years from the time when the patent was granted.

Søker Både personer og foretak kan søke om patent. Eksempler på foretak er: Næringsdrivende selskaper, stiftelser og foreninger, samt statsforetak, kommunale og fylkeskommunale foretak. Flere personer kan søke i fellesskap. Søkes patent av flere søkere oppføres navn, adresse m.v. til en av søkerne på selve søknadsskjemaet. De øvrige søkernes navn, adresse m.v. oppføres på et eget vedleggsskjema. Inneholder søknaden flere søkere vil Patentstyret av praktiske grunner forholde seg til den søkeren som er oppført på selve søknadsskjemaet. All korrespondanse vedrørende søknaden vil følgelig bli rettet til denne personen. Kundenummeret kan oppgis hvis søker har vært kunde hos Patentstyret tidligere. Har søker et organisasjonsnummer ber vi om at dette også oppgis.

Kontaktperson Dersom Patentstyret skal henvende seg til en bestemt person internt hos søker (se ovenfor) eller hos søkers fullmektig vedrørende denne søknaden, oppgis navn og telefonnummer til denne personen her. Oversettelse og videreføring av internasjonal søknad Hvis søknaden er en internasjonal søknad som skal videreføres i Norge skal det innen 31 måneder fra den internasjonale innleveringsdag, eller hvis prioritet er begjært, 31 måneder fra den dag som prioritet er begjært fra, innleveres en oversettelse av den internasjonale søknaden til norsk eller engelsk, jf. patentloven § 31 første ledd. For å oppnå provisorisk vern må kravene i tillegg oversettes på norsk. Søknadsgebyr for videreførte internasjonale søknader vil bli fakturert. Innbetales ikke det fakturerte søknadsgebyret innen fastsatt frist vil søknaden bli ansett som trukket for Norge og søknadsbehandlingen kan følgelig ikke gjenopptas.

Informasjon om biologisk materiale og/eller tradisjonell kunnskap For oppfinnelser som gjelder eller anvender biologisk materiale og/eller tradisjonell kunnskap skal følgende tilleggsopplysninger gis som vedlegg på et eget ark, hvis de ikke er oppgitt i søknadens beskrivelse: a)) Angivelse av hvilket land oppfinner mottok eller hentmaterialet og/eller kunnskapen fra (leverandørland), og atet eventuelt samtykke for uttak av materialet og/eller brukav kunnskapen er innhentet fra leverandørlandet.b)) Angivelse av opprinnelsesland hvis dette er et annet eleverandørlandet, og at et eventuelt samtykke for uttak avmaterialet og/eller bruk av kunnskapen er innhentet fraopprinnelseslandet. Hvis opprinnelseslandet ikke er kjent,skal dette opplyses.c)) Hvis biologisk materiale er ervervet i samsvar martikkel 12 nr. 2 og 3 i den internasjonale traktat omplantegenetiske ressurser for mat og jordbruk av 3.november 2001, skal det i stedet for opplysningene ipunktene a og b vedlegges en kopi av standard avtale omoverdragelse av materiale som nevnt i artikkel 12 nr. 4 itraktaten.d)) Hvis patentsøknaden gjelder eller omhandler biologimateriale fra menneske, skal det bare angis om personenmaterialet stammer fra har gitt samtykke til anvendelse avmaterialet.

Kravene om tilleggsopplysninger gjelder ikke for internasjonale patentsøknader.

Fullmaktsdokument Dersom du har oppnevnt en fullmektig til å representere deg i forbindelse med denne søknaden, må det sendes inn et fullmaktsdokument som bekrefter fullmaktsforholdet (se også punktet om fullmektig ovenfor).

Fullmakten må inneholde navn og signatur fra den som gir fullmakten, navn på den som får fullmakten, og en bestemt angivelse av hva fullmakten omfatter. Fullmakten må legges ved patentsøknaden. Skjema for utfylling av fullmaktsdokument kan lastes ned fra patentstyret.no.

Søkers erklæring om retten til oppfinnelsen Dersom patentsøker er en annen enn oppfinner(ne) må det vedlegges en erklæring om at søkeren har fått overdratt retten til oppfinnelsen. Det er tilstrekkelig at patentsøker selv gir en slik erklæring. Erklæringen må inneholde navnet på den som har fått rettigheten overdratt til seg og dennes eventuelt fullmektigens signatur. Er søker eller fullmektig et foretak skal en representant fra foretaket signere på foretakets vegne.

Erklæringen må også inneholde en bestemt angivelse av hva overdragelsen gjelder (søknadsnummer eller tittel) og en beskrivelse av hva som er grunnlaget for søkers rett til oppfinnelsen. Erklæringen legges ved patentsøknaden. I søknader uten prioritetskrav vil en orientering bli sendt til oppfinneren om atvedkommende står oppført som oppfinner i søknaden. Skjemaet «Erklæring om retten til oppfinnelsen» kan lastes ned fra patentstyret.no.

Søker kan i stedet for å legge ved en erklæring om retten til oppfinnelsen, legge ved et overdragelsesdokument eller annen form for dokumentasjon på at retten til oppfinnelsen er overdratt. Overdragelsesdokumentet må inneholde både navn og signatur fra oppfinner(ne). Dokumentet må inneholde navnet til den som får overdratt retten til seg, og det må inneholde en angivelse av hvilken rett overdragelsen gjelder (søknadsnummer eller tittel).

Dato og underskrift Den som står som søker må datere og signere søknaden. Er søkeren representert ved en fullmektig, kan denne datere og signere søknaden. Er søker eller fullmektig et foretak, skal en representant fra foretaket signere på foretakets vegne. Navnet på foretaket (søker eller fullmektig) skal også oppgis her.

Vedleggsskjema Flere søkere Flere personer kan søke i fellesskap. Søkes patent av flere søkere oppføres navnet, adresse m.v. til en av søkerne på selve søknadsskjemaet. De øvrige søkernes navn, adresse m.m.v. oppføres på et eget vedleggsskjema. Inneholdsøknaden flere søkere vil Patentstyret av praktiske grunnerforholde seg til den søkeren som er oppført på selvesøknadsskjemaet. Forretningshemmeligheter Du kan be om at forretningshemmeligheter kan unntas offentligheten. En slik begjæring om unntak må være skriftlig. I tillegg må du tydelig markere hvilke opplysninger i dokumentet som du ønsker unntatt. Vi vil deretter foreta en vurdering av om opplysningene kan unntas offentligheten.

Avgifter og gebyrer Søknadsgebyret blir fakturert, og må være innbetalt innen angitt frist. Søknadsbehandlingen starter ikke før betalingen er mottatt. Søknadsgebyret tilbakebetales ikke selv om søknaden avslås eller trekkes tilbake. Innbetalte avgifter og gebyrer tilbakebetales i henhold til betalingsforskriften.

Design og varemerke Hvis du ønsker å søke beskyttelse på oppfinnelsens utseende, skal du være oppmerksom på at design- og patentsøknaden ofte bør innleveres samtidig fordi søknadene ellers kan bli nyhetsskadelige i forhold til hverandre. Notes to power of attorney

Signature The form must be signed by the applicant/holder. Copies of the form will be accepted only if all the submitted information is legible. If the notification concerns a transfer of power of attorney, the signature of the current representative is sufficient. If a trademark, design or patent has more than one applicant/holder, all must confirm the appointment of the representative. Separate powers of attorney must be submitted if the applicants/holders have different addresses.

Trade secrets Trade secrets may be exempted from public disclosure. A request for exemption must be in writing. In addition, you must clearly mark the information in the document that you wish to be excluded. We will then make an assessment of whether the information may be exempted.

Notes to the notification of change in ownership/merger

Merger Check box if the transfer follows a company merger.

Former holder (transferor) Enter the full name and address of the holder as shown on our records. Please submit any customer ID the holder/transferee may have with the Norwegian Industrial Property Office.

New holder (transferee) Enter the full name and address of the new holder. Please submit any customer ID the holder/transferee may have with the Norwegian Industrial Property Office.

Change of representative Check box if the change of ownership results in a change of representative, or if the change of ownership does not result in a change of representative. Both events require that you send a power of attorney to NIPO. A change of representative must be submitted on separate forms. These are downloadable at patentstyret.no.

Sender and signature Please state name or company name of the sender in typed or capital letters. A notification regarding change of ownership/merger concerning an application may only be signed and sent by the registered applicant or his representative. When a design or a trademark is registered or a patent is granted, the registered holder, the new owner or their representative may sign and submit the form. If available, include your reference concerning this notification.


Form This form is a notification of transfer of a trademark, design or patent. The changes will only be registered if the form is filled in correctly. If the form is inadequately completed, the transfer will not be registered and a new form must be submitted. It is sufficient to send a copy of the form as long as all the information contained therein is legible.

If the assignment consists of several trademarks, designs or patents, please add a separate list. Documentation of the transfer is not required. Any documentation exceeding 15 pages must be submitted electronically.

Subject area Indicate whether a trademark, design or patent has been transferred. Separate forms must be submitted if the holder wishes to notify transfers of different kinds of intellectual property rights.

Application/Registration number To record a transfer, the application, registration or patent number must be submitted. Where applicable, also state the name of the trademark, design or patent. For trademarks, if there are no verbal elements in the trademark, please indicate the type of mark.

Partial change in ownership It is possible to transfer a design partially. Please check the box if the notification is of such a transfer. Documentation must be attached, clearly specifying what the transfer covers. It is also possible to divide a trademark application/registration, and transfer each unit as a total transfer of a divided right. Partial transfers of patents are not permitted.

Notes to the declaration of right to the invention

Form Any person who has made an invention has the right to apply for a patent. The inventor(s) may at any point transfer his/their rights to a third party. If someone other than the inventor(s) applies/apply for a patent, this form must be submitted, containing a declaration from the applicant stating his right to apply for and to be granted a patent. It is sufficient that the applicant submits this declaration. This form is only applicable at the time of filing a patent application. If the right to the invention has been transferred after an application has been filed or patent has been granted, use the Change of ownership form.

Applicant Enter full name of the applicant.

Indication The declaration must indicate the invention concerned. Enter application number, title or short description of the invention.

Specification of entitlement The declaration must specify whether the applicant's entitlement is based on an agreement with the inventor(s), national law, gift, inheritance etc.

Signature The applicant must sign this form. If the applicant has registered a representative at The Norwegian Industrial Property Office (NIPO), this representative may sign the form on his behalf.

Information to the inventor If the application is filed without a priority claim, information will be sent to the inventor(s) stating that he is/they are named as inventor(s) of the patent application.
