HARMONIZATION with the EU ACQUIS

Serbia transposed in its entirety the REGULATION (EU) No 1007/2011 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 September 2011 on textile fibre names and related labelling and marking of the fibre composition of textile products, and repealing Council Directive 73/44/EEC and Directives 96/73/EC and 2008/121/EC,

and,

Commission delegated REGULATION (EU) No 286/2012 of 27 January 2012 amending, in order to include a new textile fibre name, Annex I, and, for the purposes of their adaptation to technical progress, Annexes VIII and IX to Regulation (EU) No 1007/2011

CURRENT LEGAL FRAMEWORK in RoS

Serbia has aligned its legislation with REGULATION (EU) No

1007/2011 and REGULATION (EU) No 286/2012 by adopting the Rulebook on marking and labeling of textile products (Official Gazette of Republic of Serbia No. 1/14); the Rulebook was promulgated on January 6, 2014, and came into force on January 14, 2014.

The Rulebook shall apply as of July 1, 2015.

ADMINISTRATIVE AND INSTITUTIONAL FRAMEWORK

RESPONSIBLE AUTHORITY in RoS for harmonisation and further monitoring/compliance with the EU acquis: Ministry of Economy of RoS RESPONSIBLE AUTHORITY for market surveillance:

Ministry of Trade, Tourism and Telecommunications

Currently, market surveillance authorities in Serbia have 100 trained inspectors in area for technical conformity assessment and product safety (including textile products)

CONFORMITY ASSESSMENT BODIES for TEXTILE PRODUCTS IN SERBIA

There are 15 accredited CABs in Serbia at the moment, out

of which 8 are testing laboratories and 7 are inspection

bodies for textile products,

These CABs can be used by manufacturers as well as by the market surveillance authorities in the Republic of Serbia for determination of textile fibre composition and compliance of the results with data on labels and markings on textile products

NEW SERBIAN RULEBOOK – SHORT DESCRIPTION OF THE CONTENT (1)

New Serbian Rulebook lays down requirements for marking and labelling of fibre composition of textile products, requirements concerning use of textile fibre names for marking and labelling, marking and labelling of textile products containing non-textile parts of animal origin and rules concerning the determination of the fibre composition of textile products marked or labelled according to this rulebook.

NEW SERBIAN RULEBOOK – SHORT DESCRIPTION OF THE CONTENT (2)

Second part of the Serbian Rulebook contains requirements for additional marking and labelling of data of manner of garment care, data regarding shrinkage during a garment care, as well as data about garment size.

The above mentioned part of the Rulebook constitutes a national addition to the EU regulation, provisions of which will cease to apply on the date of accession of Serbia to the EU.

OLD NATIONAL LEGISLATION IN THE AREA OF TEXTILE PRODUCTS

On the date of entry into force of the new Rulebook, the following old Serbian regulations ceased to apply:

1) Rulebook on mandatory attestation of jute and the requiremnts that must be met by organizations of associated labor authorized to

attest jute ("Official Gazette of SFRJ", No. 8/ 91);

2) Order on the mandatory attestation of cotton ("Official Gazette SFRJ”, No. 65/ 84 and 44/88);

3) Order on the mandatory attestation of wool ("Official Gazette of SFRJ "No. 65/ 84).

OLD NATIONAL LEGISLATION IN THE AREA OF TEXTILE PRODUCTS (2)

On the date when the Rulebook shall become applicable, the following shall cease to apply:

1) Rulebook on technical and other requirements for marking, labelling and packing of textile products ("Official Gazette of RS " No. 56/ 09)

2) Order on textile products which must be supplied with quality certificate when traded ( "Official Gazette of FRY " No. 14/ 92).

As of date of cessation of applicability of the Order on textile products, the obligation to obtain a certificate of

product quality shall be abolished; hence the easier conditions for trade are stipulated in the Rulebook already

GENERAL REQUIREMENTS FOR TEXTILE

PRODUCTS

In accordance with the new Rulebook, textile products shall be delivered on the market of Republic of Serbia only if they are:

labelled, or marked, or accompanied with commercial documents in compliance

with this Rulebook, when the products are being supplied to economic operators within supply chain

Note: When textile products are subject to provisions of other laws and technical requirements in Serbia, those provisions are also applicable (for example, requirements prohibiting the use of certain hazardous substances in textile products)
