The subject property is a well-established industrial site containing six industrial buildings, associated parking and outdoor storage.

DISCUSSION

Official Community Plan

Fraser Highway and Industrial (zoned 12) beyond; Pinegrove Street and industrial (zoned 12) beyond; and Agriculture (zoned A 1 ).

1. The Official Community Plan (OCP) designates the subject property as "Industrial­Business" which is intended for industrial land uses, including the manufacture, processing, transportation, distribution, wholesale, warehousing and storage of material and equipment along with related activities. The existing microbrewery is consistent with the Industrial-Business designation.

Under the draft 2016 OCP the property is designated General Industrial which means industrial buildings and structures generally 1 to 2 stories in height with buildings oriented around primarily onsite circulation, surface parking and storage.

The existing microbrewery and lounge is consistent with the intent of both the current and draft OCPs.

Zoning

2. Under the Abbotsford Zoning Bylaw, 2014 the subject property is zoned General Industrial Zone (12) which permits Microbreweries and Restaurants. The existing Brewery Lounge is consistent with the 12 Zone, and therefore is in compliance with the Zoning Bylaw.

Traffic and Parking

3. An increase in traffic to the site is not anticipated for the extension in the closing hours since Old Abbey Ales will be the only business operating in the area after 7:00pm. However, staff anticipates a potential increase in traffic and parking demand due to the earlier opening hours as there are other businesses operating during the day within the same development. Staff is further aware of parking concerns from existing tenants on the site as they were brought forward for Council consideration when Old Abbey Ales applie9 for and was granted a Brewery Lounge Endorsement (LQ15-001 ). The existing parking on-site is a gravel area along the frontage; staff believes that if this parking was more formalized additional parking spaces would be

achieved. To address the parking concern the applicant is currently in the process of installing 30 curb stops as part of an effort to formalize the on-site parking along the frontage. The installation of the curb stops is anticipated to be completed by June 3rd, 2016. The City has not received any formal complaints for Old Abbey Ales since they have been in operation outside of the Council Hearing process for the Brewery Lounge Endorsement. The applicant has further indicated that they do not intend to be open every day from 9:00am to 1:OOam but rather would like the option for special events such as charity fundraisers and sporting events. As Old Abbey Ales is actively addressing staffs concern regarding the quantity of on-site parking, staff supports the extension of hours.

Business Licencing

4. As specified in the Liquor Licence issued by Liquor Control and Licencing Branch (LCLB), the current hours of operation of the brewery lounge are from 2:00pm to 7:00pm Monday and Tuesday, from 12:00pm to 8:00pm Wednesday to Saturday and from 12:00pm to 6:00pm on Sundays. The applicant proposes to amend these service hours to 9:00am to 1:OOam daily. The proposed hours of operation are consistent with the permitted hours of operations set out in the Business Licence Bylaw which limits Liquor service from 9:00am to 1:OOam seven (7) days a week.

Liquor Licence Amendment

5. Under the provincial Liquor Control and Licencing Branch (LCLB) regulations·, an operator of a Brewery Lounge who wishes to extend hours of liquor sales and service beyond that specified in the applicable provincial Liquor Licence must obtain a resolution from the local government regarding the application.

6. Staff considered the following when making the recommendation to support the application

(a) The potential for noise if the application is approved.

Noise from the establishment impacting residents within the area should be limited. The nearest residential neighbourhood is over 500m away. Single family dwellings within the agricultural land are located approximately 300m from the establishment.

(b) The impact on the community if the application is approved.

Staff has a concern that the extension of hours may result in an additional demand for parking for the subject property, however the applicant is currently installing curb stops to formalize the parking area which will result in additional on-site parking. No further impacts to the community are anticipated.

COMMUNICATION PLAN

If supported by Council, the Liquor Licence Amendment application under reference number PRJ16-048 will proceed to an upcoming Council Hearing. The City will notify in writing the owners and occupiers of land within a 100 meter radius of the property. Staff will provide Council with copies of the feedback received.

FINANCIAL PLAN IMPLICATION

No financial plan implications are anticipated.

IMPACTS ON COUNCIL POLICIES, STRATEGIC PLAN AND/OR COUNCIL DIRECTION

The proposal is consistent with both the City's 2005 and Draft 2016 Official Community Plans and also has no impact on the four cornerstones of Council's 2015-2018 Strategic Plan.

SUBSTANTIATION OF RECOMMENDATION

The proposal to increase the hours of operation for the liquor license is consistent with the Business Licence Bylaw that regulates the hours of operation of all establishments in the City to be between 9:00am and 1:OOam. Staff recommends support for the application given that the outlined concerns have been addressed.

Old Abbey Ales is one of Abbotsford's premier craft breweries and currently operates as a lounge and tasting room at 1A- 30321 Fraser Hwy. The tasting room, retail area, and lounge responsibly serves customers hand-crafted beers in a comfortable warehouse/manufacturing environment and growler fills. Due to our increasing acceptance by local residents who enjoy our offerings, we are submitting an amendment to increase our hours of operation. The maximum hours of operation are:

Monday- Sunday: 9:00AM to 1:00AM

Our operational hours will be much shorter than that. The maximum hours are taking into account the seasonality in our business (busier in the summertime) and preventing the need to re-apply for changes in hours.
