Instructions for use:Clean and dry the magnet and metal surface before use. Place the magnet on a flat surface and avoid indentions and molding. Before applying magnet be sure that all paint, clear coat, and wax has been properly cured. Do not place magnet on horizontal surface such as a hood. Magnets will only hold to surfaces with high metal content, please be sure magnet is securely adhered to surface before use. Remove and clean magnet and surface daily. Remove by lifting entire magnet away from the surface. Do not pull magnet across surface. Do not use magnet in temperatures above 130 degrees.

Factory obligations of merchandise deemed as defective and which are returned to factory postage prepaid within (30) days of the date of shipping, is limited to a refund or replacement of merchandise at Factory’s discretion, without any further obligation or liability on the part of the Factory. With regards to signs and magnets, there is no warranty expressed or implied against loss of signs or damage of vehicle surface, as Factory has no control over how signs are cared for, altered, stored, and/or used, or the surface for which the signs are applied. Failure to provide Pepco with notice of any claim within thirty (30) days from the date of shipping and failure to return such products within said time shall constitute a waiver of all such claims in respect to such products.The stadium cups listed in this catalog are top rack dishwater safe, however, due to variables beyond the factory’s control, the imprint is not guaranteed to stay on.

RETURNS:All claims must be made within 15 days. Returns must be authorized by the factory, any returns not authorized will be refused and returned to sender. No returns will be accepted for imprinted, special order and some unimprinted merchandise unless it is determined to be defective by factory. When ordering unimprinted items it is the customers responsibility to inquire on whether that item is available for return. Returns on some unimprinted merchandise and cheerleading poms are subject to a 30% restocking fee. No replacement, discount or credit will be issued for merchandise which is unavailable for return to the factory.

GOVERNING LAW:By placing a purchase order with Pepco you agree that all transac-tions shall be governed and construed according to the laws of the State of Texas. Furthermore, you agree that all disputes shall be settled in Wharton County, Texas.

TERMS:New accounts are on a prepay or credit card basis until credit is established. Credit accounts are net 30 days. Aging begins day of shipment. Customers with a Net 30 account who wish to pay by credit card must do so at the time the order is placed. Orders billed Net 30 will be subject to a $5.00(Z) or 5%, (which is ever greater) processing fee if the customer wished to pay invoice by credit card. Past due invoices are subject to a 1.5% per month or maximum allowed by law finance charge. All accounts not kept current will be returned to prepay or credit card terms. Pepco reserves the right to bill end client direct if invoices are over 90 days past due. Customers with accounts requiring collections will be liable for all associated costs including legal fees. All returned checks will incur a $30.00(Z) charge. Production of merchandise will not begin until prepayment is received and/or account is current. In some instances, production will not begin until prepay-ment has cleared. We accept Visa, MasterCard and American Express. When using a debit card for payment, your financial institution may place a monetary “hold” on your account for several days. Pepco is not responsible for holds on our customer’s accounts. Please contact the financial institution issuing the debit card with any questions. Customers outside the U.S. must send certified funds in U.S. dollars, drawn on a U.S. bank, for merchan-dise and freight with order unless prior arrangements have been made. Unused credits on accounts of 12 months or older will be written off and not refundable. We reserve the right to revoke credit terms at our discretion.

CHANGES/CANCELLATIONS:All orders are considered firm. Any change, other than quantity, to the order once in production will be billed for any work done, plus any additional work required by the change. Changes in quantity must be made prior to the start of production. If a change in quantity occurs after the completion of any portion of production, the change will be treated as a separate order and billed accordingly. Any change made after start of production will delay shipping. If a cancellation is necessary, all costs associ-ated with work performed to date of cancellation will be invoiced. Cancellations must be in writing and acknowledged by Pepco.

TRADEMARKS:The names, artwork, designs, logos and trademarks or similar reproduced throughout this catalog are solely intended to show the type and quality of imprinted products available. It does not imply a product/service endorsement by Pepco, nor does it imply an endorsement of Pepco by the respective owners of the marks. By placing an order with Pepco, you represent and warrant that you have the right to order, purchase and distribute merchan-dise containing the names, artwork, designs, logos, trademarks or similar identified in your order. The distributor also agrees to indemnify, defend and hold harmless Pepco and its parent company, from and against all claims, liabilities and expenses (including attorney’s fees) arising out of or related to an actual or alleged infringement or misappropriation of any trademark, copyright or any other proprietary right of such merchandise. This provision will continue to remain in effect after the delivery of your order. All trademarks are the property of their respective owners. Unless indicated on purchase order at time of order in writing, Factory reserves the right to use any items produced in displays, advertisements, catalogs, brochures and other promotional uses without liability at to trademark, copyright or other propriety rights. HOW TO ORDER:All orders must be faxed, mailed or e-mailed. Phone orders are not accepted due to the potential for error. Orders are not put into production unless order is complete. Orders are consid-ered complete with a correct purchase order, approved terms, complete shipping address, camera-ready art and any artwork approvals if required. The in-hand dates must be clearly stated on purchase order and fall within factory production schedule.

ORDER ACKNOWLEDGEMENTS:Order acknowledgements will be automatically faxed/e-mailed within 1 - 2 business days on standard orders. Estimated ship date cannot be confirmed until art, proof and credit are approved. Please review carefully and and contact us to correct any errors. Additional charges due to artwork correction etc. as well as shipping charges will only appear on the invoice.

PRODUCTION TIME:Standard Production time is 5 to 7 working days.Please Note: Production starts once the order and the art are approved for production. Production time does not include the day the order was received. Production time is usually less than 2 weeks, depending on quantity. However, from the beginning of July to the end of October production time could be longer. Call for production schedule. Production time for below minimum orders could be up to 3 weeks. See chart for average produc-tion times.NO CHARGE FOR RUSH SERVICE:Depending on the season, rush orders are accepted if the production schedule allows. Rush orders must be approved by factory before sending order. Please note however, that overnight shipping charges may apply and can be expensive. Pepco will ship "best-way" or least expensive when possible. Please call for shipping quote prior to order. During peak season times (Aug. - Oct.) rush service may not be available.

NO CHARGE FOR COLOR MATCH:We match to pantone colors. Exact color match is not available. Colors will be produced within an acceptable shade of the color requested. If accurate color reproduction is critical, please request a pre-production sample prior to final production.

NO CHARGE FOR RANDOM SAMPLES:Random samples for promotional products are provided free of charge at the discretion of Pepco. If an exact color combination is needed and is not available as a random sample it is consid-ered a spec sample. Samples are shipped back to the distribu-tor. We do not drop ship samples. If samples are to be shipped other than U.S. Mail, you will be billed for the shipping cost. We do not provide free samples of cheerleader poms or cheerleader megaphones. These samples will be billed at the regular catalog price.

ARTWORK REQUIREMENTS:All artwork must be supplied in a digital format either via e-mail or disk. Faxed artwork is not acceptable. There is a $12.50(V) charge for art not submitted digitally. All art should be either black and white or PMS spot color and a minimum of 300 dpi at actual size. If artwork is below 300 dpi or in a unusable format a typesetting and/or art charge will apply. All images submitted are printed as is and scaled as needed unless otherwise specified. It is your responsibility to have all images proofed and adjusted to your satisfaction before submission. Please note: due to the taper of stadium cups, sports balls and megaphones some artwork may appear distorted when printed. Always include a faxed hard copy of artwork with your order.

REPRODUCTION OF ART:Due to the textures and surfaces of products such as plastic balls, pennants and foam, it may not be possible to reproduce art with extremely sharp detail or with fine lines and halftones. Generally darker inks reproduce better on lighter surfaces or substrates.

EVENT/ IN HAND DATES:If shipping is “Best Way” or not specified, Pepco will ship, at our discretion, the least expensive way to meet in hand date. Shipments are not insured unless specifically requested on PO. Pepco is not responsible for any freight arrangements made by distributor. Once shipment has left our dock, title is transferred to recipient. Pepco is not responsible for delays or damages by carrier. The distributor must make all claims directly to carrier within 10 days of receipt of merchandise. When it is necessary for factory to ship parts of an order at a future time, the entire order will be produced and invoiced at the time of the first shipment. Freight will then be billed for each subsequent shipment.

FREIGHT QUOTES:Pepco makes every effort to provide accurate freight quotes. However, factory is not responsible for differences in the quoted estimate and the actual freight charge.

SHIPPING WEIGHTS:Weights are APPROXIMATE based on quantities shown and are not guaranteed. Variance may occur due to product density and carton availability. Weights represent-ed are based on Actual Weight or Dimensional Weight where applicable. Dimensional weight is determined based on current carrier guidelines for domestic shipments.
