5.2 GERMANTOWN MUTUAL INSURANCE COMPANY – UTAH NOV 2019

GENERAL

INTRODUCTION

Germantown Mutual’s two personal auto programs are Diamond Auto designed for the preferred driver and G-Pak Auto intended for the above average operator. In order to qualify for either plan, we expect individuals to display a high degree of stability, as well as possess good driving records. These plans are subject to a surcharge for certain types of accidents and violations. Our eligibility criteria and underwriting requirements apply to both plans unless otherwise noted.

PERSONAL AUTO POLICY ELIGIBILITY

1. Our Company’s personal auto policy will be used to provide coverage for private passenger autos if:

A. They are owned by an individual or by a husband and wife who are residents in the same household;

B. They are owned jointly by two or more relatives other than husband and wife.

2. Private passenger autos are defined as:

A. Four wheel automobiles of the private passenger or station wagon type, owned or leased for a continuous period of at least six months;

B. Motor vehicles that are pickups, panel trucks, or vans which are not used in the occupation, profession or business of the insured, other than farming;

C. Motor vehicles owned by a farm family co-partnership or farm family corporation that are owned by two or more relatives who are residents of the same household and are principally garaged on a farm.

Note: The above vehicles are limited to a gross vehicle weight of less than 10,000 lbs.

BINDING AUTHORITY

Risks meeting underwriting guidelines may be bound. All evidence of insurance accepted and bound by the agent must be forwarded to the company no later than the close of the fourth business day following the effective date or the acceptance date of such insurance, whichever occurs first. Properly completed applications must include the signatures of the applicant and agent.

POLICY PERIOD

All automobile policies will be written for a term of six months.

COVERAGES

1. Liability Bodily Injury Liability and Property Damage Liability must be written in conjunction with each other. Neither can be written alone.

2. Personal Injury Protection - This coverage is mandatory.

3. Uninsured Motorists - This coverage is mandatory. The coverage cannot be written without liability coverage, and the limits may not exceed the policy’s Bodily Injury Liability limits.

4. Underinsured Motorists - This coverage is mandatory. It provides coverage for the difference between the liable driver’s Bodily Injury Liability limits and the bodily injury damages incurred by the person insured. When Underinsured Motorists coverage is written, the limits must be equal to the Uninsured Motorists coverage limits.

5. Other Than Collision - This coverage will be written only on a policy with Liability or Collision coverage except when the described car is temporarily withdrawn from service.

6. Collision - This coverage may not be written without Other Than Collision coverage.

7. Emergency Roadside Assistance - This coverage may be written only with Collision and Other Than Collision coverages. The maximum limit is $100.00 per disablement.

SUSPENSION OF COVERAGE

If liability and collision coverages are to be suspended, please refer to the company.

UNDERWRITING GUIDELINES While final acceptance in our auto programs is determined by our underwriting department, you may bind coverage if the risk does not exceed the underwriting standards listed below.

In addition to the driving record eligibility displayed above, the following conditions must exist if the risk is to be bound:

Note: Any principal driver under the age of 21 is eligible if the company currently insures all the vehicles owned by the operator’s parents. In addition, those vehicles which are titled in the parents’ names and are driven by operators under age 21 who are residents of the parents’ household may be written in the Diamond program. Those vehicles titled in the youthful operator’s name will be written in the G-Pak program.

4. Motorhomes.

5. Vehicles used for emergency or law enforcement work.

6. Vehicles licensed and titled in other states.

7. LP gas or compressed natural gas fueled vehicles.

8. Vehicles normally parked overnight on street.

9. Vehicles used as a public or livery conveyance. This includes ride-sharing arrangements through transportation network companies.

INELIGIBLE DRIVER CHARACTERISTICS

Any driver or member of the household with the following characteristics is INELIGIBLE:

1. Does not have an established mailing address.

2. Has been convicted of any of the major traffic violations listed on Page 5.8 in the past 5 years.

3. Owns a vehicle garaged or principally used in a state where our company is not licensed.

4. Owns a vehicle which has an out of state vehicle registration.

5. Does not hold a valid Utah driver’s license.

6. Driver’s license has been under suspension or revocation at any time during the past five years for driving related offenses.

7. Does not comply with any special restrictions imposed on his/her operating privileges by the state drivers licensing authority.

8. Does not own a motor vehicle.

9. Fails to maintain his/her motor vehicle in accordance with the restrictions imposed by the state motor vehicle licensing authority relative to type or special mechanical control devices.

10. Has been convicted of operating while intoxicated or under the influence of drugs within the past 5 years.

11. Is required to file proof under any Financial Responsibility Law.

12. In military out of state.

Any driver or member of the household convicted of any of the following major traffic violations within the past five years is ineligible for either auto program:

RATING PROCEDURE

RATING SEQUENCE

Bodily injury liability, property damage liability, medical payments, other than collision and collision premiums are determined as follows:

1. Determine Classification

A. Primary Classification -

(1) Classify the automobile according to the age, sex and marital status of the operators, the use of the automobile and the eligibility of youthful operators for the good student classes.

(2) Determine the applicable factor from the primary rating factor tables.

B. Secondary Classification –

(1) Determine if the auto is:

(a) A single car, or

(b) Part of a multi-car risk.

(2) Refer to the Symbol and Identification section to determine the symbol and also whether the auto is classified:

(a) Standard performance,

(b) Intermediate performance,

(c) High performance, or

(d) Sports.

(3) Refer to the accident and violation surcharge plan to determine if any “driver record” points apply.

(4) Refer to the secondary rating factor table to determine the appropriate factor to be added to or subtracted from the primary rating factor.

2. Determine territory of principal garaging and select base rates from proper territorial page.

3. Multiply base rates by final factor (primary + or - secondary).

Premiums for other coverages are not subject to the rating factor treatment and apply as shown in the manual.

USE CLASSIFICATIONS

1. PLEASURE USE LESS THAN 8,000 MILES means:

A. No Business Use

B. Personal use of less than 8,000 road miles annually and including driving to or from work or school:

(1) Less than 5 road miles one way, or

(2) 5 or more, but less than 15 road miles one way for not more than 2 days per week or not more than 2 weeks in any five week period.

2. PLEASURE USE means:

A. No Business Use

B. Personal use of 8,000 or more road miles annually and including driving to or from work or school:

(1) Less than 5 road miles one way, or

(2) 5 or more, but less than 15 road miles one way for not more than 2 days per week or not more than 2 weeks in any five week period.

3. WORK LESS THAN 15 MILES means:

A. No Business Use

B. Personal use including driving to or from work or school:

(1) 5 or more, but less than 15 road miles one way if such usage is more than 2 days per week or more than 2 weeks in any 5 week period; or

(2) 15 or more road miles one way, for not more than 2 days per week or not more than 2 weeks in any 5 week period.

4. WORK 15 OR MORE MILES means:

A. No Business Use

B. Personal use including driving to or from work or school 15 or more road miles one way more than 2 days per week or more than 2 weeks in any 5 week period.

5. BUSINESS USE means that the use of the auto is required by or customarily involved in the duties of the applicant or any other person customarily operating the auto, in an occupation, profession or business, other than going to or from the principal place of occupation, profession or business.

6. FARM USE means the auto is principally garaged on a farm or ranch, and

A. It is not customarily used in going to or from work other than farming or ranching, or driving to or from school, and

B. It is not customarily used in any occupation other than farming or ranching.

7. An auto driven part way to or from work or school, such as to a railroad or bus depot, whether or not the auto is parked at the depot during the day, shall be considered as driving to or from work or school.

8. An auto used in the business of the U.S. Government by one of its employees may be classified and rated as PLEASURE USE, WORK LESS THAN 15 MILES or WORK 15 OR MORE MILES when the “federal employees using autos in government business endorsement” is used to limit coverage.

AGE, SEX AND MARITAL STATUS CLASSIFICATIONS

1. AGE means the age attained on the last birthday.

2. MARRIED means a married person living with his or her spouse and includes a person widowed, divorced or legally separated only if such person has custody of one or more resident children.

3. YOUTHFUL OPERATOR means an applicant or any other operator resident in the same household as the applicant, who customarily operates the auto, and is one of the following:

A. YOUTHFUL UNMARRIED FEMALE OWNER OR PRINCIPAL OPERATOR - unmarried female under 25 years of age who is an owner or principal operator;

B. YOUTHFUL UNMARRIED FEMALE OPERATOR - unmarried female under 25 years of age who is not an owner or principal operator;

C. YOUTHFUL MARRIED MALE OPERATOR - married male under 25 years of age;

D. YOUTHFUL UNMARRIED MALE OPERATOR - unmarried male under 25 years of age who is not an owner or principal operator;

E. YOUTHFUL UNMARRIED MALE OWNER OR PRINCIPAL OPERATOR - unmarried male under 30 years of age who is an owner or principal operator.

4. RESIDENT means anyone residing in the same household.

Exceptions to Resident Classification:

A. A person in active military service with the armed forces of the United States of America is not considered a resident in the applicant’s household unless this person customarily operates the auto.

B. If a YOUTHFUL UNMARRIED FEMALE OPERATOR or a YOUTHFUL UNMARRIED MALE OPERATOR is a student residing at an educational institution over 100 road miles from the auto’s place of principal garaging, the auto is rated as if the student is MARRIED.

Note: For the purpose of Exception B - if the rating factor for a married youthful operator is greater than the factor for an unmarried youthful operator, use the lower factor and corresponding statistical code.

GOOD STUDENT CLASSIFICATION

The Good Student Classification applies provided:

1. The owner or operator is

A. At least 16 years of age, and

B. Not more than 25 years of age, and

C. A full time high school, college, or university student.

2. A certified statement from a school official is presented to the Company on each anniversary date of the policy indicating that the student has met one of the following requirements during the immediately preceding school semester:

A. Is in the upper 20% of his/her class scholastically, or

B. Maintains a “B” average, or its equivalent. If the letter grading system can not be averaged, then no grade can be below a “B”.

C. Has a 3 in a 4, 3, 2, 1, point system or its equivalent

D. Is included in a “Dean’s List,” “Honor Roll” or comparable list indicating scholastic achievement.

A classification change resulting from a change in the scholastic standing of the student can not be effected between anniversary dates of the policy.

VEHICLE CLASSIFICATION ASSIGNMENT

1. Primary Rating Classification

A. Youthful Operators

(1) Single Car Risks

If there are more youthful operators than autos, the youthful operator classification with the highest Primary Rating Factor shall apply. The good student rules shall apply.

(2) Multi-Car Risks

(a) When a single youthful operator is the principal driver of an auto, the principal youthful classification will be assigned to that vehicle.

(b) Assign the other youthful operators to the remaining autos as follows:

• Determine the primary rating factor for each youth at the pleasure use classification.

• Assign the youthful operator with the highest primary rating factor to the auto developing the highest total base premium.

• Assign any remaining youthful operators to the remaining autos in the order of the highest rated youthful operator to the auto with the next highest total base premium.

• After assigning the youthful operators to autos on the basis of primary pleasure use rating factors, each factor must be adjusted for the actual use of the auto before determining and applying the Secondary Rating Factor.

• Any remaining autos are rated at the appropriate NO YOUTHFUL OPERATOR classification.

B. Operators Age 45 and Over

(1) The Principal Operator Age 45 - 64 Class shall apply if the principal operator of the auto is age 45 - 64.

(2) The Principal Operator Age 65 - 74 or 75 or Over Classes shall apply if the principal operator of the auto is age 65 or over.

(3) If there are operators in the household under age 45;

(a) Any youthful operator class shall apply in accordance with the youthful operator rules.

(b) The age of the operator shall be disregarded for the purposes of rating automobiles in excess of the number of operators age 45 and over (unless a youthful operator classification is applicable).

(c) Autos principally operated by an adult under age 45 shall be rated at the “All Other” or “Only Operator in Household Female Age 30 - 44” Classification (unless a youthful operator classification is applicable).

C. Multi-Car Discount

The applicable Multi-Car Rating Factor applies:

(1) If more than one private passenger auto is owned by an individual or owned jointly by two or more relatives or resident individuals, and

(2) If two or more autos are insured in one or both auto programs for any of the following coverages: Bodily injury and property damage liability,

medical payments, other than collision or collision.

2. Secondary Rating Classification

A. Driving Record Sub-Classification

The driving record sub-classification shall be determined from the number of driving record points accumulated during the experience period as follows:

Any points developed under the surcharge plan are assigned to the two cars with the highest total base premiums. The remaining automobiles are rated as sub-class 0.

Total Base Premium is the sum of the base premium for Bodily Injury and Property Damage Liability, Medical Payments, Other Than Collision and Collision coverages that apply to the automobile.

C. The experience period shall be the three years immediately preceding the date of application or the preparation of the renewal.

D. Driving record points are assigned as follow: Points

Note: In this section, an accident and a violation occurring at the same time and place are treated as two separate incidents.

Exceptions:

(1) No points are assigned for accidents incurred by an operator demonstrated to be a named insured or a principal operator of an auto insured under a

separate policy.

(2) No points are assigned for accidents occurring under the following circumstances;

(a) Auto lawfully parked (if the parked vehicle rolls from the parked position, then any such accident is charged to the person who parked the auto).

(b) The applicant, owner or other resident operator is reimbursed by, or on behalf of, a person who is responsible for the accident or has judgment against such person. The payment or judgment must be sufficient to pay 51% or more of the damages incurred by the person being reimbursed.

(c) Auto is struck in the rear by another vehicle and the applicant or other resident operator has not been convicted of a moving traffic violation in connection with this accident.

(d) Operator of the other auto involved in the accident was convicted of a moving traffic violation and the applicant or resident operator was not convicted of a moving traffic violation in connection with the accident.

(e) Auto operated by the applicant or any resident operator is struck by a “hit-and-run” vehicle, if the accident is reported to the proper authority within 24 hours by the applicant or resident operator.

(f) Accidents involving damage by contact with animals or fowl.

(g) Accidents involving Physical Damage, limited to and caused by flying gravel, missiles, or falling objects.

(h) Accidents occurring when using auto in response to an emergency if the operator of the auto at the time of the accident was a paid or volunteer member of any Police or Fire Department, First Aid Squad, or any law enforcement agency. This exception does not include an accident occurring after the auto ceases to be used in response to such emergency.

DRIVING RECORD POINT ASSIGNMENT PROCEDURE

1. New Business

Initial information necessary to assign the proper Driving Record Sub-Classification shall be obtained from an application signed personally by the applicant.

The signature of the applicant on all applications received from an agent shall be certified by the agent.

2. Renewal Business

Information necessary to assign the proper renewal Driving Record Sub-Classification shall be determined from any one or combination of the following:

A. Company’s own record; or

B. Motor Vehicle records; or

C. A renewal questionnaire signed by the applicant.

AUTO PHYSICAL DAMAGE COVERAGES

1. Age Group Definitions

Refer to the Symbol and Identification Section of this manual for the applicable symbol groups. For newly announced models use the symbol group shown for the latest corresponding model.

If there is no corresponding model, the symbol group may be determined by the tables included in the Symbol and Identification Section of the manual.

For purposes of rating pick-ups and vans use the tables in the Symbol and Identification Section of the manual if no symbol is given.

If the symbol is greater than 18, refer to Company.

3. Deductibles

Deductibles for Collision and Other Than Collision coverages can be modified as listed on the territory pages.

OPTIONAL COVERAGES AND ENDORSEMENTS

EMERGENCY ROADSIDE ASSISTANCE

This coverage is available only to private passenger automobiles, vans and pickup trucks rated as private passenger automobiles. Collision and Other Than Collision coverages must be written on the vehicle to which Emergency Roadside Assistance coverage applies.

Limit Per Vehicle Six Months Premium Per Vehicle

$100 per disablement $7.00

The Emergency Roadside Assistance endorsement will be attached to the policy.

INCREASED LIMITS TRANSPORTATION EXPENSES COVERAGE

This endorsement provides higher coverage limits for any temporary transportation expenses incurred by the insured as the result of a loss to a covered auto.

Coverage Six Months Premium Per Vehicle

$30 Per Day - $900 Maximum $12

Basic transportation expenses are provided by the Personal Auto Policy for a limit of $20 per day up to a total of $600. However, higher limits of $30 per day/$900 total limits will apply if the vehicle is insured for Increased Limits Transportation Expenses.

This coverage is available only if Other than Collision and Collision coverages are written on the automobile. The rate for this endorsement is not subject to any rating classification or premium modifications.

COVERAGE FOR AUDIO, VISUAL AND DATA ELECTRONIC EQUIPMENT AND TAPES, RECORDS, DISCS AND OTHER MEDIA

1. Coverage is available without application of a deductible for direct and accidental loss to any electronic equipment that receives or transmits audio, visual or data signals and is not designed solely for the reproduction of sound. This coverage applies only if the equipment is permanently installed in the covered auto at the time of loss. Coverage is also provided for any accessories used with any of the previously mentioned electronic equipment permanently installed in the covered auto.

$200 worth of tapes, records, discs are included at no additional charge.

TRUCK TOPPERS OR CAPS

Toppers valued under $500 new require no change in rating.

For toppers valued between $500 and $1,000 new, increase the symbol by one. For those valued over $1,000, use the trailer rating.

CUSTOMIZED VEHICLES

Customizing furnishings or equipment in or upon a van or pickup are excluded from coverage.

The coverage may be purchased by completing the van questionnaire and by increasing the symbol as follows:

• For new vehicles determine the total cost of the van or pickup including customization and assign the appropriate symbol from the table found in the Symbol and Identification section of the manual.

• For used vehicles assign a symbol based upon the cost new of the vehicle plus the total customization and complete van questionnaire.

When auto physical damage coverages are written on customized vans or pickups, minimum deductibles of $50 on Other Than Collision and $250 on Collision are required.

AUTO LOAN/LEASE COVERAGE

A policy providing both Comprehensive and Collision coverage may be extended to provide coverage for the difference between the outstanding indebtedness on a loan/lease agreement on a new vehicle, and the actual cash value of the vehicle.

1. Eligibility

A. Auto Loan/lease coverage may be provided only to a vehicle that is a private passenger auto, pickup or van; and

B. The insured must request the Auto Loan/Lease coverage within thirty (30) days of leasing or financing a new vehicle.

C. The vehicle loan or lease agreement must not contain any carry-over balances(s) from previous loans or leases.

2. Rates

Charge 7% of both the Other Than Collision and Collision coverage premiums for the Auto Loan/Lease Coverage.

3. Endorsement

Attach the Auto Loan/Lease Coverage endorsement to the policy (PP 03 35).

AUTO REPAIR OR REPLACEMENT COVERAGE

If a vehicle is endorsed with this coverage, the Limit of Liability provisions for Part D. Coverage for Damage to your Auto, is changed from Actual Cash Value to Replacement Cost for losses caused by other than fire, theft, larceny, or vandalism to the insured vehicle. The Limit of Liability for other than these losses will be the lesser of the reasonable cost of repair with parts of like kind and quality or the cost of a new vehicle of the same make, if possible; similar vehicle size class; and similar body type and equipment as the damaged vehicle. 1. Eligibility

A. Available only for newly purchased and newly manufactured private passenger autos, pickups and vans with a replacement cost at time of purchase up to $75,000.

B. The insured must request the Auto Repair or Replacement coverage within thirty (30) days of the new car purchase.

C. Other Than Collision and Collision coverages must be maintained continuously while this endorsement is in effect. This coverage cannot be reinstated once it has been discontinued.

D. The auto must not be more than five (5) years old. The age of the auto shall be determined by subtracting the year the endorsement was first added to the policy for that auto from the year of inception of the current annual period of the policy.

E. If this coverage is currently being provided by another carrier and the insured wishes to continue this coverage under their Germantown Mutual policy, the age of the vehicle must not be more than 3 model years old, and the vehicle cannot be leased.

A new vehicle is classified as a vehicle that has not previously been titled under the motor vehicle laws of any state, is not more than one model year old, has not been driven for more than 200 miles prior to purchase, and is not leased.

DISCOUNTS/CREDITS

AUTO-HOMEOWNERS DISCOUNT

A 15% discount will be applied to the Personal Auto policy and to the Homeowners policy. If both are written by Germantown Mutual and qualify for the discount. Qualification requirements are:

A Personal Auto policy must insure all eligible vehicles in the household.

A Homeowners policy covers the principal residence HO-3/HO-5/HO-6.

HO-4 policies will receive a 10% discount.

Discount Inception Situations:

Situation 1—A current policyholder has one qualifying policy and submits a new application for the second qualifying policy. The “auto-homeowners” discount must be requested when the second application is submitted. The new application will then be processed with the discount, and the next renewal of the existing policy will include the discount.

Situation 2—A new policyholder submits applications for both qualifying policies. A request for the “auto-homeowners” discount must accompany the application. Both new policies will then be issued with the discount, provided that the effective date of the second policy is within 180 days of the effective date of the first policy.

Termination of Discounted Policies:

If one of the qualifying policies lapses or is cancelled, the discount will be removed from the other policy when its next renewal is issued.

PREFERRED CLIENT - INSURANCE SCORE DISCOUNT

The following discounts will be allowed against the total premium according to the Attract Auto insurance score obtained from LexisNexis at the time of application.

A discount of 5% is applied after continuous personal auto coverage for a period of 3 years from the inception of the auto policy with GMIC. The discount after 6 years of uninterrupted coverage is 10%.

SENIOR SAFE DRIVER DISCOUNT

A discount of 5% from the base Bodily Injury Liability, Property Damage Liability, Personal Injury Protection and Collision premiums will be allowed on any vehicle listed on the policy when the principal operator of that vehicle is age 55 or older and has successfully completed a safe drive course with a curriculum meeting the criteria outlined under Utah Code Section 31A-19a-211. Proof of completion of the course must be submitted at the time the discount is requested. The discount will be deleted if the principal operator to whom the discount applies has been convicted or plead guilty or nolo contendre to a moving traffic violation resulting in points assessed against the license of that driver except for a violation under Utah Code Subsection 53-3-221(11).
