FLAG CONTROL PROCEDURES FOR MILITARY PERSONNEL IN NATIONALSECURITY CASES AND OTHER INVESTIGATIONS OR PROCEEDINGS

Effective 1 July 1969

This revision provides for pr\or DA approval for reassignment of all flagged personnel exceptas indicated in paragraph 6b\ requires additional distribution of flagging action on certainpersonnel; provides for removal of flag when commander who imposed punishment underArticle 15 has indicated that trie record of punishment will be filed in the personnel sectionof the individual's military personnel file; requires that information be furnished to theOffice of Personnel Operations for certain enlisted personnel for proper functioning of theDepartment of the Army Centralized Enlisted Promotion System. Local limited supple-mentation of this regulation is permitted but is not required. If supplements are issued,Army Staff agencies and major Arm}i commands will furnish one copy of each to The AdjutantGeneral, ATTN: AGPO; other commands will furnish one copy of each to the next higherheadquarters.

Section I. GENERAL

1. Purpose. This regulation prescribes proceduresfor suspending favorable personnel actions in thecase of a member of the U.S. Army while underinvestigation or implicated in matters of a de-rogatory nature.2. Definitions, a. Flagging action. Controls ini-tiated to suspend favorable personnel actions in the

• case of a member of the U.S. Army.

b. l Favorable 'personnel .actions. Favorable per-sonnel actions include but are not limited to thefollowing:

(1) Appointment, reappointment, enlistment,and reenlistmeW.

(2) Entry Vn active duty, active duty fortraining, or animal active duty for training forany purpose, incmding recall of retired or Re-

serve component personnel, unless otherwise di-,rected by Headquarters, Department of the Army.

(3) Reassignment, except as authorizedherein.

(4) Promotion.(5) Awards, decorations, or commendations.(6) Attendance at service schools, or civilian

schools or institutions under military service edu-cational or training programs.

(7) Unqualified resignation, discharge, or re-lease from active duty.

(8) Retirement.(9) Continuance on an Army retired list.

3. Scope. This regulation applies to all militarymembers of the Army irrespective of component(including active, inactive, and retired). Person-nel seeking entry into the Army in any status whoare not members of the Army are not included inthe scope of flagging actions contained in this reg-ulation; however, responsible officials will estab-lish local controls to insure that any adverseinformation is resolved before permitting the in-dividual to be enlisted, appointed, or inducted intothe Army.4. Responsibilities of commanders. Flaggingactions have a serious effect on the morale and pos-sibly the military careers of the individuals con-cerned. Commanders will insure that flaggingaction is initiated only when any of the criteria

•in paragraph 5 is met. Additionally, commanderswill establish rigid controls within their com-mands to insure that—

a. Knowledge of individual flagging actions isdisseminated on a need-to-know basis.

b. Individual cases are processed expeditiouslyand with due rega-rd for the interests of the serviceand the rights of the individual.

c. Flagging action controls are promptly re-moved when cases are closed.

d, DA Form 268 (Report for Suspension ofFavorable Personnel Actions) and correspondenceand references pertaining directly thereto are re-moved from personnel files and all sources of con-trol are destroyed when cases are closed,5. Initiation of flagging action, a. Immediateflagging action will be initiated in the case of—

(1) A military member to whom provisionsof AR'604-10 apply.

(2) A military member against whom actionis initiated which -may result in dismissal, dis-charge, courts-martial, disciplinary action, orelimination.

(3) A military member aguinst whom an in-vestigation is initiated concerning credible alliga-tions or incidents which reflect unfavorably uponhis character or integrity.

(4) A military member under charges or re-straintby civilian authorities.

(5) A military'member absent without leave.(6) An officer whose commander has recom-

mended removal of his name from a list of officersrecommended for promotion.

(7) An officer whose career branch at Head-quarters, Department of the Army has recom-mended removal of his name from u list of officersrecommended for promotion.

(8) A noncommissioned officer whose com-mander has recommended removal of his namefrom a list of noncommissioned officers recom-mended for promotion under the Department ofthe Army Centralized Enlisted Promotion System.

b. Except for reassignments authorized byparagraph 6, no other favorable personnel actionwill be taken on flagged personnel without priorapproval or direction from Headquarters, Depart-ment of the Army. Reqviest for approval of favor-able personnel actions will .'be forwarded to TheAdjutant General, ATTN; AGPOSEF, De-partment of the Army, Washington, D.C. 20315,except requests for favorable personnel action onenlisted personnel reported in accordance with5a(8) will be forwarded to the Chief of PersonnelOperations, ATTN: EPPMS, Department of theArmy, Washington, D.C. 20310.

6. Disposition of flagged personnel, a. Flaggedpersonnel': whose discharge or release from activeduty is impending. This regulation does not con-stitute authority to retain personnel beyond ex-piration of term of service. In other than court-martial cases, and except -as indicated in (4)below, requests, for disposition instructions re-garding flagged personnel whose discharge or re-lease from 'active duty is impending will beforwarded 'by electrical means (except that -whenMINIMIZE is imposed, airmail will be used)

through major commanders to The AdjutantGeneral, as follows:

(1) In cases reported under section II, dis-position msf,rucf.ions wi l l be requester! fiom ThoAdjutant General, ATTN; AGPO-S'KF, at least00 days prior to the individual's expirat ion of termof service. In addition, major commanders wi l lcomply with the provisions of AR 004-10.

(2) In cases of commissioned officers and war-rant officers reported under section III, dispositioninstructions will be requested from The AdjutantGeneral, ATTN: AGPO-SKF, at least 60 daysprior to the individual 's expiration of tern) ofservice.

(3) In cases of enlisted personnel who holdappointments as commissioned officers or warrantofficers in the Reserve components reported undersection III, disposition instructions will be re-quested from The Adju tan t General. ATTN:AGPO-SS, at, least 60 days prior to individual 'sexpiration of term of service.

(4) In cases of enlisted personnel not holdingappointments as commissioned officers or warrantofficers in the Reserve components who are flaggedunder section III, the provisions of section II,chapter 2, AR 035-200 will apply.

b. Reassignment.(1) Personnel on active duty or active duty

for training who are under flagging action .will notbo reassigned without prior approval of Head-quarters, Department of the Army, unless such re-assignment is made—

(a) Within an installat ion by the installa-tion commander; or

(b} Of enlisted personnel within a major'oversea command by the major commander; or

(<?) As provided in AR 40-3, AR 604-10,or AR 014-30.

(2) Requests for authority to reassign officerswho are under flagging action under circumstancesother than described in (1) above will be for-warded together with justification for such reas-signment to the Office of Personnel Operations,ATTN: OPO—(Career branch or Colonel's Divi-sion) as appropriate, with the followingexceptions—

(a) Army Medical Department—The Sur-geon General's'Office, ATTN: MEDPT-S, De-partment of the Army, Washington, D.C. 20315.

(b) Chaplains—Chief of Chaplains,

(o) Requests for authority to reassign en-listed personnel who are under flagging actionunder circumstances other than described in (1)above wi l l 'be forwarded together with justifica-tion for such reassignment to the Chief of Person-nel Operations as follows:

(a) In grades E-7, E-R, E-9 and a-11 gradesof personnel identified as Special Category, Intel-ligence, Enlisted Aides, and NCO Logistics Per-sonnel should be forwarded to Chief of PersonnelOperations, ATTN: EPADS, Department of theArmy, Washington, D.C. 20310.

(l>) In grades E-l through E-6 should beforwarded to Chief of Personnel Operations,ATTN: EPADR, Department of the Army, Wash-ington, D.C. 20310.

" a. Transfer of flagging action.(1) Upon reassignment of an individual

under flagging action, the control of the flaggingactio.ii will be transferred to the gainingcommander.

(2) The losing commander will—(a} Notify the gaining commander by elec-

trical message (except that where MINIMIZE isimposed, airmail will be used). Information copywill be forwarded to The Adjutant General,ATTN: AGPO-SEF, only in those cases involv-ing officers, warrant officers and those enlisted per-sonnel who have reserve commissions or who areflagged for security reasons. The notification willinclude name, grade, service number, and SSANof individual; the authority for reassignment; andestimated time of arrival.

(b) Forward the complete flagging file andany report of investigation to the gaining com-mander, except when transfer does not remove in-dividual from jurisdiction of the commander con-trolling the flagging action and/or investigation.In those cases where the losing commander retainscontrol of investigation, copy of Report of In-vestigation and all subsequent progress reports willbe forwarded to the gaining commander. Theflagged individual will not be permitted to hand-carry the flagging fie or the Report of Investiga-tion to the gaining commander.

(3) The gaining commander will—(a) Assume control of the flagging action.(&) Furnish the agencies in his chain of

command copies of the flagging action (if theseagencies are different from those of the losingcommand).

(c) Submit reports as required by this reg-ulation. Transfer of flagging action does not inter-rupt the reporting requirements. Thus, date ofinitiation of the case remains unchanged and in-terim reports will be submitted as though transferhad not taken place.

(4) In case of personnel assigned to a transferactivity or returned from overseas for dischargeor relief from active duty, the flagging action willbe transferred in accordance with (3) above andwill not be closed until separation is final.

7. Reports, a. Flagging actions, including the re-moval of flagging actions, will be reported on DAForm 268 (Report for Suspension of FavorablePersonnel Actions), except; for reports required tobe transmitted by electrical priority message (ex-cept that where MINIMIZE is imposed, airmailwill be used). When report is submitted by mes-sage, followup by DA Form 268 is required.

b. Separate reports will be submitted on eachflagging action. For example, an individual maybe flagged for an incident under investigation andbefore close of this flag becomes involved in anotherincident.

G. These reports are exempt from reports con-trol under the provisions of paragraph 7-27), AR335-15.

Section II. CONTROL OF MILITARY PERSONNEL SECURITY GASES

8. Application. This section applies to all mem-bers of the U.S. Army against whom action isinitiated under AR 004-10 or for w;hom flaggingaction is required under other security regulationsor directives. (A loss or compromise of a classifieddocument which requires investigation under AR380-5 would not require flagging action under thissection unless activities of the type described inparagraphs 18 and 19, AR. HS1-130 are involved.Instead, flagging action under sec III would beappropriate.)9. Control. Major commanders are responsiblefor submission and control of flagging actions in-stituted under this section.10. Reports, a. Initial-report. Immediately uponreceipt of credible derogatory information withinthe purview of AR G04-10, or when reqtiired byother security regulations or directives, an initialreport will be transmitted by priority electricalmessage (except that where MINIMIZE is im-posed, airmail will be used) to The Adjutant Gen,-eral, ATTN: AGPO-SEF. Reference to this sec-tion and this regulation, and items 1 through 12,DA Form 268, will be included. The Chief, U.S.Army Personnel Security Group, Fort Holabird,Md. 21219, will be included as an information ad-dressee. Concurrently with the dispatch of themessage, DA Form 268 will be completed and dis-tributed as follows:

(1) Original and two copies to The AdjutantGeneral, ATTN: AG-PO-SEF.

(2) One copy to the Chief of Personnel Oper-ations, ATTN:'EPPMS, Department of theArmy, Washington, D.C. 20310, in those cases in-volving noncommissioned officers whose name ap-pears in a zone of consideration-or recommendedlist for promotion under Department of the ArmyCentralized Enlisted Promotion Program.

(3) One copy to Chief, U.S. Army Person-nel Security Group, Fort Holabird, Md. 21219.

(4) One copy to Commanding General, U.S.Army Intelligence Command, ATTN: DCSOPS,Post Office Box 398, Fort Holabird, Md. 21219.

(5) One copy to the commander of the unitto which the member is assigned. Because of thenature of a complaint type investigation (AR381-130), this copy will not be filed in the mem-ber's DA Form 201 (Military Personnel RecordsJacket U.S. Army). Major commanders are re-sponsible, however, for establishment of proced-ures insuring control of these cases.

(6) One copy to the appropriate generalcourts-martial authority.

(7) For Army National Guard of the UnitedStates personnel not on active duty, one copy to—

(a] Chief, National Guard Bureau, Wash-ington, D.C. 20310.

(b) The State adjutant general of thein which individual's home of record is located.See AR 635-5.

(8) For U.S. Army Reserve personnel not onactive duty and assigned to a unit, one copy to thecommander of the appropriate area command (AR140-1).

(9) For USAR officers assigned to USARControl Group (Oilicer Active Duty Obligor) Ft.Benjamin Harrison, Ind. 46249. one copy to theCommanding Officer, U.S.'Army Reserve Compo-nents Personnel Center, ATTN: RCPO, FortBenjamin Harrison, Ind. 4.6249.

b. Interim, reports. Pending completion of acase, interim reports,will be forwarded on DAForm 268 as follows:

(1) First interim report. Not later than 60days after date.of initial report.

(2) Second interim report. Not later than 120days after date of first interim 'report.

(3) Subsequent interim reports. Every 30thday following second interim report.Distribution of interim reports will be the same asthe first DA Form 268 report, unless it is changedbecause of transfer of flag control. Current statusof case, reason for delay, and expected date ofcompletion will be shown on each interim report.

c. Final report. The major commander havingcurrent control of the flagging action is responsi-ble for removal of such action. Removal will beaccomplished when a case is closed in accordancewith AR 604-10 or other security regulations ordirectives. Distribution of this report will be thesame as the initial report or as changed by transferof flag control.11. Classification. Reports submitted under thissection will be marked "FOR OFFICIAL USEONLY" under AR 345-1.5, unless classified defenseinformation is involved. In latter case, they willbe classified as required by AR 380-5.

Section III. CONTROL OF OTHER THAN SECURITY CASES

12. Application. This section applies to commis-sioned officers, warrant officers, and enlisted per-sons of all components on active duty, not on activeduty, and in retired status, when suspension offavorable personnel actions is required under para-graph 5a (2), (3), (4), (5), (6), (7), or (8). •13. Control. The commander having knowledgeof information or initiating action within thescope of paragraph 5a (2), (3), (4), (5), ((!), (7),or (8), will establish required flagging action andmaintain control until the case is closed or trans-ferred to another commander under the provisionsof paragraph 6.14. Reports, a-. Cases of enlisted persons who donot hold appointments as commissioned officers orwarrant officers in the Reserve will not be reportedto Headquarters, Department of the Army exceptas provided in b below. Flagging actions for thesepersons required by this section will be reported onDA Form 268 and distributed as follows:

(1) One copy to commander of the unit towhich the member is assigned or attached.

(2) One copy will be filed as the top docu-ment, in the DA Form 201, unless the security clas-sification requires other filing, in which case ap-propriate cross-reference will be made.

(3) One copy to each intermediate com-mander up to and including the general court-martial jurisdiction. The general court-martial au-thorities will establish local procedures to insureproper reporting and control and prompt closingof these cases, and in cases involving minor viola-tions, ma.y decentralize submission of these reportsto commanders authorized to take final action onsuch violations.

(4) In cases of enlisted personnel who aresubjects of CID Reports of Investigation, onecopy of the initial and final reports will be for-warded to the Criminal Records Division, U.S.Army Investigative Records Repository, FortHolabird, Md. 21219. In cases closed unfavorably,final reports of action will include one copy of therecord of punishment- -under Article 15, UCM.I,one copy of court-martial orders, -and/or one copyof separation orders.

(5) The provisions of 5(3) (g] below 'applyin cases of absentees dropped from the rolls of anorganization as absent, in desertion under AR630-10.

b. In cases of commissioned officers and warrantofficers, including those of the Reserve componentsserving in enlisted status and those noncommis-sioned officers whose names appear in a zone of

consideration or recommended list for promotionunder the Department of the Army CentralizedEnlisted Promotion System, flagging actions re-quired by th is section will be reported as follows:

(1) Initial report. Immediately upon initia-tion of action or receipt of information within thepurview of paragraph 5«(2), (3), (4), (5), (0),or (7), an initial report will be transmitted 'bypriority electrical message (excepi: that whereMINIMIZE is imposed, 'airmail will be used) toThe Adjutant General, ATTN: AGPO-SEF.For personnel within the purview of paragraph5a(8) an initial report will be transmitted bypriority electrical message (except that whereMINIMIZE is imposed, airmail wil l be used) tothe Chief of Personnel Operations, ATTN:EPPMS, Department of the Army, Washington,D.C. 20310. Reference to this section and this regu-lation 'and items 1 through 12 and 10, DA Form268, will be Included. The Chief, U.S. Army Per-sonnel Security Group. Fort Holabird, Md.21219, will be included as an information ad-dressee. Concurrently with above, DA Form 268will be initiated and distributed as follows:

(a] Original and two copies to The Ad-jutant General, ATTN: AGPO-'SEF, except forthose in (b} below.

(b} One copy to the Chief of PersonnelOperations, ATTN: EPPMS, Department of theArmy, Washington, D.C. 20310. in those cases in-volving noncommissioned officers whose namesappear in a zone of consideration or recommendedlist for promotion under the Department of theArmy Centralized Enlisted Promotion System.

(d) One copy to the commander of the uni tto which the member is assigned! This copy wi l l befiled as the top document in the DA Form 201^unless the security classification requires other fil-ing in which case •appropriate cross-reference willbe made.

(e} One copy to the appropriate generalcourt-martial authority.

(/) One copy to Chief, U.S. Army Per-sonnel Security Group, Fort Holabird, Md. 21219.

(g) For Army National Guard of theUnited States personnel not on active duty, onecopy to Chief, National Guard Bureau, Washing-ton, D.C. 20310, and one copy to the State adjutant

..general of the State in which individual's home ofrecord is located. See AR 635-5.

( h ) For U.S. Army Reserve personnel noton active duty, one copy to Commanding Officer,U.S. Army Administration Center, 9700 PageBoulevard, St. Louis, Mo. 63132, and one copy tocommanding general of the appropriate area com-mand for reservists assigned to a uni t or controlgroup under jurisdiction of the area commander.

(2) Interim- reports. Pending completion ofa case, interim reports will be forwarded on DAForm 268 as follows:

(a) First interim re-/>ort. Not later than60 days after date of initial report.

(&) Second interim report. Not later than120 days after date of first interim report.

(o) Subsequent interim, reports. Every 30thday following second interim report, except whereindividual is serving sentence or under suspendedsentence to include punishment under Article 15,UCM.J, 01- in cases pending appellate review,of board action in Headquarters, Department ofthe Army. Subsequent interim reports for theseparticular cases will be submitted when there isa change in status of case and/or individual con-cerned. The first, second, or a subsequent interimreport will contain a statement in section II, DAForm 268, clearly identifying the specific type ofcase and anticipated date next interim or finalreport will be submitted. Another interim or finalreport must be submitted within 10 days of thisanticipated date. Distribution of interim reportwill be the same as the first. DA Form 268, unlessit is changed because of transfer of flag control.Current status of case, reason for delay, and ex-pected date of completion will be shown on eachinterim report.

. (3) Final report.(a) The commander having current control

of the flagging action is responsible for removal ofsuch action. Distribution of this report, will be thesame as the initial report or as changed by transferof flag control.

(b) For individuals who arc subjects ofcriminal investigations, one copy to CriminalRecords Division, U.S. Army Investigative Rec-ords Repository,'Fort Holabird, Md. 21219 (finalreport only). In cases closed unfavorably, finalreport of action will include one copy of the recordof punishment under Article 15, UCMJ, one copy

of court-martial orders, and/or one copy of sepa-ration orders.

(G) In cases'closed unfavorably, copies offinal actions taken, will be forwarded to The Adju-tant General, ATTN: AGPO-SEF, with the finalDA Form 208 as follows: One copy of separationorders, except those included in orders issued byHeadquarters, Department of the Army; twocopies of court-martial orders; and original and1st copy of the record of punishment imposedunder Article 15, UCM J.

(d) In commissioned officer and warrantofficer cases, reports and copies of corrective actionwithin the meaning of paragraph 128e, MCM 1968,will not be included with final reports.

(e] Flagging action will be removed whenthe individual is undergoing punishment underArticle 15 or during a suspension of such punish-ment imposed, when the commander has indicatedthat the nonjudicial punishment will be admin-istered in a manner that will preclude its consid-eration in a possible promotion or other favorableaction (sec AR 27-10). Except as indicated above,flagging action will not be removed while an indi-vidual is undergoing punishment imposed underArticle 15, UCMJ, or sentence of courts-martial,or during the term of any suspension of punish-ment imposed. An individual is considered to beundergoing punishment with respect to anyforfeiture or detention of pay as follows:

/. When forfeiture or detention of payhas been imposed by sentence of court-martial,until the day following the last day of the periodof forfeiture or detention of pay specified in thesentence of the court as finally approved, if allother portions of the sentence have been com-pletely executed. In computing the period of for-feiture or detention of pay, periods of unauthor-ized absence (computed in accordance withDepartment of Defense Pay and Allowance En-titlements Manual (DoDPM)) which occur duringsuch period will be excluded.

S. When a forfeiture or detention of payhas been imposed under Article 15—

(a) When the forfeiture or detentionis to be applied for not more than 1 month, onlyduring the remainder of the month in which the

punishment of forfeiture or detention was imposedor in which the suspension thereof was vacated,

(b) When the forfeiture or detentionisto be applied for more than 1 month^ only duringthe number of months for which the forfeiture ordetention is to be applied, counting as the firstmonth the remainder of the month in which thepunishment of forfeiture or detention was imposedor in which the suspension thereof-was vacated, theother months following consecutively withoutinterruption.

(/) Courts-martial cases undergoing appel-late reviews will not be closed until completion ofsuch review. In cases of Reserve component officersreleased from active 'duty pending completion ofappellate review, the current flagging control com-mander will transfer control to the CommandingOfficer, U.S. Army Administration Center, 9700Page Boulevard, St. Louis, Mo. 63132, who willthen submit, interim and final reports when due.

(g) In cases of Reserve component officersreleased from active duty while under eliminationaction wherein such action will continue after re-lease, such cases will not be closed until completionof the elimination action. On release from activeduty of such officers, the current flagging controlcommander will transfer control to the Command-ing Officer, U.S. Army Administration Center,9700 Page Boulevard, St. Louis, Mo. 63132, whowill then submit interim and final reports whendue.

(h) In cases of absentees dropped from therolls of an organization-as absent in desertion un-der AR 630-10, a copy of the closing DA Form 268will be filed as the top document in the Field FileSection of the member's DA Form 201 unless se-curity classification requires other filing, in whichcase appropriate cross-reference -will 'be made.

G. Commanders may remove flagging actions ini-tiated under the provisions of paragraph 5<j(4)after disposition by civil authorities, if the memberis not in confinement.15. Classification. Reports submitted under thissection will not be classified, unless defense infor-mation involved requires classification under AR380-5. Marking under AR '345-15, "FOR OFFI-CIAL USE ONLY", is authorized if determinednecessary by control commander.
