Specification Response Attachment

Clearing of vegetation

Confirmation that no clearing of vegetation is to occur at the premises, or details of the area to be cleared (by completing section 3.11 to 3.16 of the application form).

No clearing of vegetation will occur onsite. The original site layout figure presented the crushing and stockpiling of recycled materials area within the wrong area. Only hardstand and structures will be impacted and demolished as part of this project.

Prescribed Premises Category

Confirmation that the applicant intends to operate Category 62 in addition to Category 13.

The DWER Application form has been amended to reflect the request for a Category 13 and Category 62 licence.

Legal entity taking on storage of waste

Confirmation that the application is being made in the name of ‘Brajkovich Demolition and Salvage (WA) Pty Ltd’ Confirmation of the legal entity that will hold the licence for the storage of waste material following completion of category 13 activities.

Brajkovich Demolition & Salvage (WA) Pty Ltd will hold the licence for the category 13 licence. Adrian Brajkovich, as director of the company, has signed for the licence application. The category 62 licence is requested for a short time period while stockpiles are being sorted into aimed spec product of drainage aggregate and road base.

Authorised representative details and address for notices to be served under the EP act

Provide details of an authorised representative who is an employee of the Applicant’s company as per the instructions on page 3 of the application form.

The DWER application form has been amended to include relevant representative details (Adrian Brajkovich)

Proof of occupier status

Proof of occupier status, such as a contract signed by both parties, including the contract period and any related conditions or limitations.

A signed contractual agreement has been included as Attachment 3. This gives Brajkovich Demolition & Salvage Pty Ltd the relevant permissions to be onsite and conduct demolition and crushing works over the period of 6 to 10 weeks.

Clarification of Premises Boundary

Confirmation that the application is for the entirety of Lot 25 on Plan 44549 or details of the boundary with GPS co-ordinates for every point enabling the entire boundary to be identified.

The site boundary is reflective of the Development Application submitted. The amended site boundary can be seen in Attachment 1.

Estimated operating time of premises

Confirm length of time materials are proposed to be stockpiled (Category 62)

Stockpiling of materials has been requested for a period of two years within the Development Application (City of Swan Reference: DA-217/2018) Attached. It is expected that crushing and screening works to produce stockpiles will take 6-10 weeks granted all City of Swan and DWER approvals are listed. Subdivision is expected to take 8 months from mobilisation to practical completion.

Maximum production or design capacity

1. Confirm if the throughput of 200,000 tonnes relates to the total volume of material that will be crushed and screened.

2. Provide the total annual volume of material that is proposed to be stockpiled as a separate figure.

There was an initial error in the application stating 200,000tonnes of material was to be processed. The correct figure is 20,000tonnes. 20,000 tonnes of material are proposed to be crushed and screened. 20,000 tonnes of material are proposed to be stockpiled.

Scope of Works A budget that provides justification of the fee calculation of $200,000. Section 11.1 to 11.3 of the Application Form IR-F09 provides instructions on fee calculations for works approvals.

$200,000 relates to the cost of hiring the crusher/screener for the expected duration of the project (6 to 10 weeks). An amended licence and works approval fee calculation has been included to reflect the application for Category 13 and Category 62.

Asbestos Assessment

Asbestos emissions assessment to be completed according to DWER’s ‘Guideline for managing asbestos at construction and demolition waste recycling facilities’

An Environmental Due Diligence report was formed prior to the demolition of structures onsite. Further Information regarding the assessment of Asbestos onsite has been attached within Attachment 3.

Acknowledgement and Signature

Resubmission of the application form signed by the Applicant or a person with legal authority to represent the applicant.

The DWER application form has been resubmitted with Adrian Brajkovich’ s signature within the acknowledgement and signature section.

Acid Sulfate Soils assessment

Define extent of excavation and its impact on disturbing acid sulfate soils

The Acid Sulfate Soils occur onsite underneath the north eastern and south eastern corners of the site. The areas being demolished are not in these potions of the site and therefore Acid Sulfate Soils will not be disturbed as a result of these operations.

Revision of Noise Assessment

Construction and demolition noise management plan will not apply to the prescribed premises – amendment to the Noise management plan to include crushing and screening as a separate activity

Herring Storer has been contracted to develop an assessment of noise emissions and their compliance with the Environmental (Noise) Regulations 1997. The report has been attached as Attachment 5.

I refer to your Application for Planning Approval on the above lot received on 11 April 2018.

In accordance with the provisions of the City's Local Planning Scheme No.17 and the Planning and Development (Local Planning Schemes) Regulations 2015 (Regulations) approval to commence development has been granted, subject to conditions. This application has been determined by delegated authority of Council in accordance with cl.83 of the Regulations. Attached is the form of approval stating the conditions that must be complied with.

In addition, acting under the authority delegated by the Western Australian Planning Commission (WAPC), the City has determined the application under the Metropolitan Region Scheme (MRS) on behalf of the WAPC.

If an applicant is aggrieved by this Determination, there is a right of review under Part 14 of the Planning and Development Act 2005. An application for review should be lodged with the State Administrative Tribunal (Level 4, 12 St George Terrace, Perth) within twenty eight (28) days of the date of this determination (application may be made to the Tribunal to extend this time period). The necessary "Application for Review" forms are available from the State Administrative Tribunal.

3. A Site Management Plan must be submitted and approved by the City prior to any works commencing on the site. The Site Management Plan should address, but not be limited to, the following:

a) The staging plan for the entire works; b) The on-site storage of materials and equipment; c) Traffic management; d) Hours of operation; e) Waste management practices; f) Dust management practices; g) Stormwater and drainage management practices, inclusive of the protection of

existing drainage flow paths and drainage detention area; h) The management of noise in accordance with the requirements of the

Environmental Protection (Noise) Regulations 1997;

that relates to any works to take place on the site. Once approved, the Site Management Plan is to be implemented in its entirety.

4. All crushing and stockpiling of material shall occur only in the designated areas as shown on the approved plan/s and shall be appropriately screened at all times to the satisfaction of the City.

5. Earthworks over the site and batters must be stabilised to prevent sand blowing, and appropriate measures must be implemented within the time and in the manner directed by the City in the event that sand is blown or drifts from the site.

6. Remediation, including validation or remediation of any contamination identified shall be completed prior to the filling of the land to the satisfaction of the City of Swan.

7. If the development causes any obstruction, alteration or interference with a wider drainage network, the landowner, applicant or developer must rectify the damage caused and reinstate to the City's satisfaction.

8. The applicant is to ascertain the location and depth of any services that may interfere with this development. Any adjustment to these services required as part of this approval , must be arranged by the applicant prior to works commencing on the site. Any adjustment must be approved by the relevant service authorities and will be at the applicant's expense.

ADVICE TO APPLICANT:

a) This is a Development Approval of the City of Swan under its Local Planning Scheme No. 17. It is not a building permit or an approval to commence or carry out development under any other law. It is the responsibility of the applicant to obtain any other necessary approvals, consents, permits and licenses required under any other law, and to commence and carry out development in accordance with all relevant laws.

b) Development may be carried out only in accordance with the terms of the application as approved herein and any approved plan.

c) This approval is not an authority to ignore any constraint to development on the land, which may exist through contract or on title, such as an easement or restrictive covenant. It is the responsibility of the applicant and not the City to investigate any such constraints before commencing development.

This approval will not necessarily have regard to any such constraint to development, regardless of whether or not it has been drawn to the City's attention.

d) Take notice that it is the responsibility of the applicant to advise the landowner(s) and/or builder(s) of the need to satisfy the requirements of the conditions of the planning approval for the subject lot, prior to or on lodgement of Building Applications.

The City will not issue a Building Permit until all the conditions of planning approval and any other requirements pertaining to this planning approval have been met (including payment of fees and charges).

e) The noise generated by activities on-site, including machinery motors or vehicles is not to exceed the levels as set out under the Environmental Protection (Noise) Regulations 1997.

All development works are to be carried out in accordance with control of noise practices set out in Section 6 of AS 2436-1981 or the equivalent current Australian Standard.

No works shall commence prior to 7.00 am without the City's approval.

f) Any asbestos must be handled, used, removed and disposed of in accordance with the Health (Asbestos) Regulations 1992 and the Environmental Protection (Controlled Waste) Regulations 2001. Please contact the Department of Environmental Protection to ensure compliance with the removal and transport of the asbestos.

g) The carrying on of the development must not cause a dust nuisance to neighbours. Where appropriate such measures as installation of sprinklers, use of water tanks, mulching or other land management systems should be installed or implemented to prevent or control dust nuisance, and such measures shall be installed or implemented within the time and in the manner directed by the City's Principal Environmental Health Officer if it is considered that a dust nuisance exists.

If the development the subject of this approval is not substantially commenced within a period of 2 years, or another period specified in the approval after the date of the determination, the approval will lapse and be of no further effect. ·

Where an approval has so lapsed, no development must be carried out without the further approval of the local government having first been sought and obtained.

If an applicant or owner is aggrieved by this determination there is a right of review by the State Administrative Tribunal in accordance with the Planning and Development Act 2005 Part 14. An application must be made within 28 days of the determination.

Further to an Environmental Due Dilligence report issued by Aurora dated 3 July 2017, which deems the abovementioned site a low risk of containing hazardous materials stating ‘given the age of the facility there should be minimal or no asbestos in the fabric of the buldings.’

Brajkovich Demolition & Salvage (WA) Pty Ltd can confirm that the Site Supervisor, James Edwards, profressionally trained and experienced in asbestos identification and removal, has undertaken a comprehensive visual inspection and carried out sampling on suspected (PACM) materials prior to commencement of demolition works.

None of the materials were identified as ACM products or materials and the sample results returned a negative result for ACM visual inspection. Further anaylsis was completed at a NATA accredited laboratory, and all submitted samples returned a negative result for ACM.

Environmental Due Diligence Advice - 10 Bonner Drive, Malaga

1 BACKGROUND

Aigle Royal Properties (ARP) is investigating the option of purchasing 10 Bonner Drive for the purpose of

redeveloping the site as a commercial and industrial development. ARP has requested Aurora

Environmental to provide advice on any environmental risks associated with the site. The advice has

been based on the following information sources:

• A partial copy of Douglas Partners PSI (Figures and Appendices not supplied);

• A limited sampling program of the storrnwater sumps;

• A review of the DER Contaminated Sites Database; and

• A review of historical aerial photographs

The site consists of approximately 11.2 ha of commercial and industrial zoned land. It was developed as

brickworks approximately 30 years ago and consists mainly of hardstand and large sheds with a few

brick buildings which appear to be sales offices and displays. The south-east portion of the site is

vegetated with remnant bushland.

The brickworks and associated clay storage areas are contained inside the sheds. The brickworks

process consists of moulding clay to form various brick shapes and then drying and baking them in gas

fired kilns. The baking process releases acidic gases (primarily hydrogen fluoride (HF) and hydrogen

chloride (HCI)) which are captured in a dry gas scrubbing system. Some additives are used to alter the

properties of bricks, particularly the colour. These additives can include sources of carbon such as coal,

coke or oil and sugar is also used in some circumstances.

The brickmaking process uses mainly inert feedstocks and other than liquid hydrocarbon fuels

represents a relatively low risk of soil or water contamination, with key environmental control being the

scrubbers used to capture HF and HCI.

2 DESKTOP REVIEW

2.1 Douglas Partners PSI

Douglas Partners completed a Preliminary Site Investigation with limited soil sampling in September

2015. The site was commissioned by Brickworks Limited, the current owner of the site. The PSI was

conducted in accordance with DER guidelines and the National Environment protection measure on

Contaminated Sites (As amended in 2013)

The Douglas Partner PSI identified the following possible areas of concern:

• Diesel UST: A 21,200 L diesel UST is present on the site. Possible leakages from the UST and spills

whilst fueling plant have the potential to result in localised soil and groundwater contamination;

• Oil/Chemical storage: ASTs, IBCs (including one burnt IBC) and drums of lubricating oil, diesel and

glycerine were observed to be stored within the production building;

• Drainage sumps: Two drainage sumps which receive waste water and stormwater were observed

on the site. Drainage of possibly contaminated waste water or stormwater into these water

bodies has the potential to result in localised soil and groundwater contamination; and

• Waste Clay Area: Stored waste clay material may present a source of localised soil and

groundwater contamination. Manganese glaze is also stored in IBCs adjacent to this area.

The report concludes based on the desktop investigations and a limited soils testing program that the

potential area concern do not represent a significant environmental risk. The PSI indicates that with the

exception nickel within the waste clay material, all contaminants of potential concern (CPC) were

reported at concentrations below the adopted soil assessment criteria, indicating an absence of soil

contamination at the targeted test locations.

Assessment of groundwater quality was beyond the scope of work for the PSI.

The PSI recommended that the UST be removed and the soils beneath be assessed for the presence of

contamination. The PSI also presented some information on soil sampling completed in several

locations on the site. The results of this sampling were reported as containing no unacceptable

contaminant levels. No observations of discoloured or stained soil were made nor were any odours

detected whilst drilling the boreholes. Foreign inclusions such as demolition rubble, including potential

asbestos containing materials were not observed within any of the boreholes. On this basis the risk of

contamination being present was assessed as low,

The copy of the PSI report provided for review was incomplete (no appendices or figures) so it is difficult

to comment meaningfully on this assessment but based on the conclusions presented, it appears that

there is a tow risk of significant contamination issues on the site.

In summary, based on the Douglas Partners PSI, the risk of significant soil or groundwater

contamination was assessed as tow.

2.2 Historical Aerial Photographs

Aurora Environmental assessed the available historical aerial photographs on the Landgate site until

1981 the site was vegetated. Over the period from 1981 - 1985 some clearing occurred and then by

1995 the brickworks was established. The photographs show no evidence land uses that would

contribute to a risk of contamination of soil or groundwater on or beneath the site.

2.3 DER Contaminated Sites Database

A search of the DER Contaminated Sites Database failed to find any record for 10 Bonner Drive, Malaga,

nor were there any references to lots in the near vicinity being contaminated.

3 AURORA SITE INVESTIGATION

Aurora Environmental conducted a site inspection of the site on Monday 26 June 2017. Not all areas of

the site could be accessed as another contractor was in control of the site to remove the brick making

equipment.

A limited soil sampling program was completed in the stormwater sumps. Apart from minor elevations

of zinc above the historical Ecological Investigation level of 200 mg/kg in the very surface layer of soils

in the sump (no elevation of zinc was detected at a depth of 0.3 m) there was no evidence of

contamination. The slight elevation of zinc is not a concern as in an industrial setting such as this site as

the Ecological Investigation level can be adjusted to a much higher figure in a commercial and industrial

setting under new guidance provided in the DER Contamination Guidelines issued in 2014. The highest

measured zinc concentration was 400 mg/kg and the average of the 16 samples was around 150 mg/kg.

The land use based criteria for zinc in industrial land is up to 400,000 mg/kg.

A copy of the laboratory certificate for the soil analysis is attached for your records.

During the site investigation, quantities of waste bricks were noted around the north-east sump with

smaller quantities around the south-east sump (See attached Photo). Any purchase offer made by ARP

should be conditional on the site being cleaned of rubble and rubbish at the owner's expense.

OTHER MATTERS

Other potential issues include:

1. Your ability to obtain approva I for clearing the remnant vegetation in the south-east corner of the

site. Our assessment, without conducting a thorough assessment of the type and quality of the

vegetation, is that this should be manageable through the subdivision process;

2. Part IV EPA Approvals. The site is the subject of several approvals under Part IV of the

Environmental Protection Act. Your purchase offer should be conditional on the current owner

obtaining release for you from any residual controls or conditions applied under such approvals.

This should be readily achievable given the closure of the brickworks.

3. Hazardous materials assessments. It is understood that you are looking at the cost of demolition.

Prior to implementing this you should have a hazardous material assessment done (Aurora can

deliver this for you). Given the age of the facility there should be minimal or no asbestos in the

fabric of the buildings.

4. Scrubber reagents. The kiln scrubbers generally use lime or a similar material to capture the HF

and HCI. The spent scrubber medium will consist of a lime based material saturated with calcium

fluoride and chloride. It is not clear to me where this was disposed of and you should check with

the operator to ensure that this was disposed of off-site as it may present a cost to you if dumped

on site.

SUMMARY

In summary, I confirm that Aurora is of the view (based on this limited assessment) that the site appears

to represent a low environmental risk but draw your attention to the following matters:

1. You may wish to condition your offer to exclude any contamination issues associated with the

UST given the fact that no information is available on its status. Aurora can arrange and supervise

the removal of the UST including provision of the contamination report.

2. Your offer should be conditional on the current owner removing all waste bricks and other

rubbish on the site.

3. Your offer should also be conditional on the current owner closing out any residual

responsibilities with respect to the approvals issued under Part IV of the Environmental

Protection Act.

1. INTRODUCTION  Herring Storer Acoustics was commissioned by SERS on behalf of  Brajkovich Demolition & Salvage  (WA)  Pty  Ltd  to  undertake  an  acoustical  assessment  of  noise  emissions  from  a proposed site located at 10 Bonner Drive, Malaga.   The  proposed  site  will  be  utilised  as  a  temporary  crushing  and  stockpiling  facility  to  sort demolition waste  into proposed products to aid the sites future subdivision.     The site has been cleared of hardstand and structures through a council approved demolition contract.  The proponent is applying for a Category 13 Crushing licence to crush cement materials and then stockpile into two piles, anticipated to be road base and drainage aggregate materials. The stockpiles will come under a Category 62 waste storage licence (concurrently applied with the Category 13) whilst materials are being sorted into spec product compliant with relevant standards.   The  crushing will  take place over  a  6‐10 week  period with  the  operation of  the  following equipment:  ‐ 2x Crushers (McCloskey Impact Crusher and Kleeman Jaw Crusher) ‐ 1 x Excavator  ‐ 1 x Screen ‐ 1 x Loader  

   It is not proposed that materials will be transported offsite as part of the crushing operation.   The closest highly noise sensitive receivers are approximately 470m north of the site, located within Ballajura.   Operational hours for the site are to be Monday to Saturday 0700 to 1800 hours.   Zoning for the land use at the proposed site and surrounding area is industrial.  As part of the study, the following was carried out: 

 

Determination of noise  levels associated with recycling operations at  the proposed site in Malaga. 

 

Assess the predicted noise levels at the nearest surrounding noise sensitive premises for compliance with the appropriate criteria. 

 

If  exceedances are predicted,  comment on possible noise amelioration options  for compliance with the appropriate criteria. 

 For information, a locality plan is attached in Appendix A.  This assessment has been conducted to identify the acoustic impacts of the operations, with the report provided for support of the Works Approval and Licences.

2. SUMMARY  Assessment has been conducted on the proposed crushing and stockpiling facility at 10 Bonner Drive, Malaga.  

Assessed noise levels at the neighbouring noise sensitive premises has, in the worst case, been determined as 48 dB(A) for day time operations (ie 07:00 to 19:00). This can be compared to the applicable assigned noise level criteria of 53 dB(A). Note, due to the ambient noise levels and the distance  to  the noise sensitive premises,  it  is unlikely  the noise  levels  received  from the operations would contain annoying characteristics such as tonality, hence the above does not include any adjustment  for penalties.  It  is noted  that  this  is  a  conservative assessment as  it includes all noise sources operating at the same time.   Assessed  noise  levels  at  the  neighbouring  industrial  premises,  in  the  worst  case,  without barriers, has been determined at  less than 65 dB(A) for all operations occurring at the same time. This can be compared to the applicable assigned noise level criteria of 65 dB(A) at all times. Due to the distance of the boundary industrial premises, it is likely the noise levels received from the  operations  would  contain  annoying  characteristics  such  as  tonality,  hence  the  above includes a +5 dB(A) penalty.  

Given  these  operating  parameters  and  the  inclusion  of  barriers  for  noise  control  (outlined further in this report), noise levels received at all neighbouring premises would comply with the Environmental Protection (Noise) Regulations 1997 for the operating times as outlined in this assessment.  

  

3. CRITERIA  The  allowable  noise  level  at  the  surrounding  locales  is  prescribed  by  the  Environmental Protection (Noise) Regulations 1997.  For noise sensitive premises, Regulations 7 & 8 stipulate maximum  allowable  external  noise  levels  determined  by  the  calculation  of  an  influencing factor, which is then added to the base levels shown below. The influencing factor is calculated for the usage of land within two circles, having radii of 100m and 450m from the premises of concern. For industrial premises, the allowable noise levels are fixed. The baseline assigned noise levels are listed in Table 1.

It is a requirement that received noise be free of annoying characteristics (tonality, modulation and impulsiveness), defined below as per Regulation 9.  

“impulsiveness”   means a variation in the emission of a noise where the difference between LApeak and LAmax Slow is more than 15 dB when determined for a single representative event; 

 “modulation”   means a variation in the emission of noise that – 

 (a) is more than 3dB LA Fast or is more than 3 dB LA Fast  in any 

one‐third octave band; (b) is  present  for  more  at  least  10%  of  the  representative 

assessment period; and (c) is regular, cyclic and audible; 

 “tonality”   means the presence in the noise emission of tonal characteristics 

where the difference between –  

(a) the  A‐weighted  sound  pressure  level  in  any  one‐third octave band; and 

(b) the arithmetic average of the A‐weighted sound pressure levels in the 2 adjacent one‐third octave bands, 

 is greater than 3dB when the sound pressure levels are determined as LAeq,T levels where the time period T is greater than 10% of the representative assessment period, or greater than 8 dB at any time when the sound pressure levels are determined as LA Slow levels. 

 Where  the  noise  emission  is  not  music,  if  the  above  characteristics  exist  and  cannot  be practicably removed, then any measured level is adjusted according to Table 2 below.

 The  nearest  potential  noise  sensitive  premises  to  the  proposed  development  have  been identified using the area map in Figure A2 in Appendix A.   The  influencing  factor  for  the  nearest  residential  premises,  located  to  the  north  of  the proposed  operations,  has  been  assessed  as  8  dB  based  on  the  amount  of  industrial  land contained in the inner and outer circle. Therefore, the assigned noise levels for the nearest noise sensitive premises are contained in Table 3.3.

4. CALCULATED NOISE LEVELS  Noise  immissions  at  the  nearest  neighbouring  premises,  due  to  noise  associated with  the proposed  facility, were modelled with  the computer programme SoundPlan.  Sound power levels used for the calculations are based on measured sound pressure levels of the same type of equipment for use on this site or if equipment is to be purchased, on manufacturer data.  Predictive noise modelling for the proposed site has been undertaken based on the site layout plan provided  (Appendix A). Assumptions used  in  the noise model are as  listed  in Table 4. Note, worst case noise propagation conditions have been assumed. 

 For the purpose of this assessment, processing equipment has been located within the centre of  the  site.  Initial  noise  modelling  showed  that  compliance  at  the  boundary  of  the neighbouring  industrial  premises would be difficult without  the  inclusion of  some  form of noise barrier(s). Therefore, sea container barriers (two high) have been included in the model generally  located  within  20  metres  of  the  operating  crushers.  It  is  noted  that  the  noise modelling does not include any barriers from the stock piled materials. As there is no transport off  site, expectations are  that  the stockpiles will  increase around  the operating processing area. These stockpiles will attenuate noise levels further with the expectation being that once at  a  height  equal  to  the  sea  containers,  the  container  barriers  could  be  removed.     With appropriate  sound  barriers  in  place,  such  as  those mentioned  above,  noise  levels  will  be attenuated to suit the location of the crushing equipment as outlined in Figure A1.  Additional to these sources, a truck (semi‐trailer) source has been located on the access road, with  the maximum  noise  level  at  any  point  on  the  access  road  used  for  the  assessment. Utilising this method allows for an individual truck pass noise level at any location around the site,  therefore  considering  the  worst‐case  impact  regardless  of  the  quantity  of  truck movements.

Based on noise emissions  from the above equipment, a worst case operating scenario has been  developed.  These  scenarios  represent  periods  of worst  case  noise  emissions  for  the operations and includes all noise sources operating at the same time.  

Note:  We understand that any reversing alarms will be of the broadband type. Hence, apart from our understanding, exempt from needing to comply with the Regulations, they would not influence the overall noise levels.

5. RESULTS  

Calculated noise levels associated with the noise emissions from the facility, are summarised below in Table 6. The calculated noise contour plots are contained in Appendix C. The receiver locations are shown on the area plan attached in Appendix A.

6. ASSESSMENT  

The applicable adjustments to the calculated noise levels, in accordance with the Environmental Protection (Noise) Regulations 1997, are listed in Table 7. Given the location and the distance to the  nearest  residence,  it  is  considered  that  noise  emissions  would  not  contain  a  tonal characteristic as the traffic noise influence from other noise sources would mask tonality at the time  of  day  associated  with  the  proposed  operation  hours  of  the  facility.  However,  at  the boundary to the neighbouring industrial premises, noise could be considered as tonal, thus the +5 dB(A) penalty for a tonal component has been applied.

7. CONCLUSION  

Assessment has been conducted on the proposed crushing and stockpiling facility at 10 Bonner Drive, Malaga.  

Assessed noise levels at the neighbouring noise sensitive premises has, in the worst case, been determined as 48 dB(A) for day time operations (ie 07:00 to 19:00). This can be compared to the applicable assigned noise level criteria of 53 dB(A). Note, due to the ambient noise levels and the distance  to  the noise sensitive premises,  it  is unlikely  the noise  levels  received  from the

operations would contain annoying characteristics such as tonality, hence the above does not include any adjustment  for penalties.  It  is noted  that  this  is  a  conservative assessment as  it includes all noise sources operating at the same time.   Assessed  noise  levels  at  the  neighbouring  industrial  premises,  in  the  worst  case,  has  been determined at  less  than 65 dB(A)  for all operations occurring at  the same  time. This  can be compared  to  the applicable assigned noise  level  criteria of 65 dB(A) at all  times. Due  to  the distance  of  the  boundary  industrial  premises,  it  is  likely  the  noise  levels  received  from  the operations would contain annoying characteristics such as tonality, hence the above includes a +5 dB(A) penalty.  

Given these operating parameters and the inclusion of barriers for noise control , noise levels received  at  the  nearest  neighbouring  premises  (both  noise  sensitive  and  industrial)  would comply with the Environmental Protection (Noise) Regulations 1997 for the operating times as outlined in this assessment.     Noise Assessment was conducted with crushing operations occurring central to the site.  As the proponent  intends  to  operate  in  the  north  eastern  portion  of  the  site,  this  will  still  ensure compliance with the Environmental Protection (Noise) Regulations 1997 as long as the proposed acoustic barriers are installed and maintained throughout the duration of the works.
