RESOLUTION: MINIMUM ACCEPTABLE CONSTRUCTION STANDARDS WHEREAS, Article 29, Section D. of the Amended and Restated to Deed Restrictions Pine Country of Tomball - Section Two empowers the Board of Directors of the Pine Country of Tomball Homeowner's Association, Inc. to adopt rules and regulations, and to establish fines, levies and enforcement provisions as deemed necessary; and WHEREAS, there is a need to establish minimum acceptable construction standards affecting property located within Pine Country; NOW THEREFORE be it resolved that the Pine Country of Tomball Homeowner's Association, inc., acting through its Board of Directors, hereby adopts the following minimum acceptable construction standards: All ACC modifications such as: roofing, fences, pool, driveway extensions, etc., must be approved through the City of Tomball prior to submission to the Pine Country of Tomball ACC Committee. Permits obtained from the City of Tomball must be provided with the ACC Application for approval from the ACC Committee. GAZEBOS & SHEDS The minimum acceptable construction standards for the placement of gazebos are as follows: 1. LOCATION: a. located in back yard only and must be at least five feet (5') from side property line and fifteen feet {15') away from the back property line and not encroaching on any easements. 2. PINE COUNTRY OF TOMBALL HOMEOWNER'S ASSOCIATION, INC.

RESOLUTION: MINIMUM ACCEPTABLE CONSTRUCTION STANDARDS

WHEREAS, Article 29, Section D. of the Amended and Restated to Deed Restrictions Pine Country of

Tomball - Section Two empowers the Board of Directors of the Pine Country of Tomball Homeowner'sAssociation, Inc. to adopt rules and regulations, and to establish fines, levies and enforcement

provisions as deemed necessary; and

WHEREAS, there is a need to establish minimum acceptable construction standards affecting property

located within Pine Country;

NOW THEREFORE be it resolved that the Pine Country of Tomball Homeowner's Association, inc.,

acting through its Board of Directors, hereby adopts the following minimum acceptable construction

standards:

All ACC modifications such as: roofing, fences, pool, driveway extensions, etc., must be approved

through the City of Tomball prior to submission to the Pine Country of Tomball ACC Committee.Permits obtainedfrom the City of Tomball must be provided with the ACCApplication for approval

from the ACC Committee.

GAZEBOS & SHEDS

The minimum acceptable construction standards for the placement of gazebos are as follows:

1. LOCATION:

a. located in back yard only and must be at least five feet (5') from side property line and

fifteen feet {15') away from the back property line and not encroaching on any

easements.

2. GAZEBO SIZE:

a. Maximum diagonal measurement or diameter shall be fourteen feet (14')

b. Roof peak shall not exceed ten feet {10') in height

3. MATERIALS:

a. Materials must be unpainted treated wood, cedar, unpainted redwood or treated woodpainted in harmony with the existing home. Creosoted wood is not acceptable.

b. Roof must be shingled to match the house

4. SHEDS:

a. Must be professionally built. Must follow fire code.

b. Roof peak shall not exceed ten feet (10') in height. Cannot be visible from front yard

c. Materials must match existing home; paint colors and roof shingles.

d. Must be approved by the ACC Committee.

5. All Exterior Additions to home must be professional designed and approved by board beforeconstruction begins. Check with FirstService Residential to see if permit is required.

No flags or weathervanes to be erected on top of roof accept those that have been approved by theArchitectural Control Committee. The Architectural Control Committee will approve on a case-by-casebasis.

Gazebos and sheds must be maintained in good condition.

GARBAGE/RECYCLING RECEPTACLES

Minimum acceptable standards for Garbage and Recycling receptacles are as follows:

LOCATION;

1. Garbage and Recycling receptacles shall be stored in the garage or behind backyard fence.2. You can add to your fence on side of your house to be level with the facade of garage. Fence

shall be six foot eight inches (6'8") and match existing wooden fence.3. Must be approved by the ACC Committee.

4. Must be removed from public view within 24 hours of your service dates.

PAINTING OF WOOD FENCES

The minimum acceptable operating standards for maintaining and the staining of wood fences are asfollows:

1. Fences must be preserved with clear coat. Ail stains and paints must be approved by the ACCCommittee.

2. Fences are jointly owned (50/50) by each adjoining property owner. It shall be the responsibilityof each adjoining property owner to maintain, repair, and replace all such fences.

3. Fences must be well maintained.

FLAGS

The minimum acceptable construction standards for flags to be flown in subdivision are as follows:

1. Flags to be flown are limited to state or national flags, i.e. United States or Texas Flags. Otherflags such as American War Veterans, Children's themes, etc are not to be flown.

2. Size of flag shall be limited to no larger than 3 feet by 5 feet.3. No clanging chains or otherwise noisy apparatus shall be attached to flag.4. The flagstaff must be mounted to the house and size of pole shall be limited to six feet (6') in

length.

5. Flag must be well maintained at all times.6. Flag etiquette must be followed at ail times.

7. Flags must not be mounted in windows, wails, or doors of exterior of house, garage, and fencefor driveway nor painted on any such area.

8. Maximum of two (2) flags exhibited per household at any on time.

PLANTERS. CLAY POTS. BARRELS. ETC.

The minimum acceptable standards for planters, clay pots, barrels, etc. are as follows:

1. Planters, clay pots, barrels, etc. are allowed in Pine Country of Tombali, provided the plants arewell maintained and thriving. If the planters do not contain flowers, they must be removed

2. Planters, clay pots, barrels, etc. must be well maintained3. If planters, clay pots, barrels, etc. are painted, the color must be in harmony with the color of

the house

LANDSCAPING MAINTENANCE

The minimum acceptable standards for landscaping maintenance are as follows:

1. Yards must be mowed and free of weeds on a regular basis. Overgrown lawns will be fined.2. All dead trees/bushes/plants must be removed and/or replaced3. All bushes must be trimmed and dead parts removed.4. Flowerbed should be weeded on regular basis. No overgrown flowerbeds.5. All dead grass to be replaced and watered.

PARK BENCHES. PORCH SWINGS, and OUTDOOR LAWN FURNITURE

The minimum acceptable operating standards for placement of park benches, porch swings, andoutdoor furniture are as follows:

1. Park Benches

a. Must be well maintained

b. Must be in harmony with exterior design and color of the house and with thesubdivision, and must be approved by the Modifications Committee.

c. Black, brown, forest green, white and bronze are acceptable colors as well as a colornearest to the darkest color of the exterior of the home, brick variation included.

2. Porch Swings

a. Must be well maintainedb. Must be in harmony with the exterior design and color of the housec. Porch swings can only be on the front porch, not in the front yard

3. Outdoor Furniture

a. Must be well maintainedb. Must be in harmony with the exterior design and color of the house

c. Must not be located in the front yard of any lot, and must not be located in the visibleside yard on any corner lot or driveway

4. Tree Swings

a. Must not be visible from the front or side yard, they can only be located in the backyard.

PORTABLE BASKETBALL GOALS - No permanent basketball goals allowed

The minimum acceptable operating standards for erection and/or placement of a portable basketballgoal are as follows:

1. All portable basketball goals must be approved by the ACC Committee prior to placement.2. Portable basketball goals must never be more than ten (10') feet in front of the most setback

portion of the fagade on houses.

3. Permanent basketball goals are not permitted. Including but not limited to: garage mountedbasketball goals, in-ground basketball goals.

4. All basketball goals supports, backboards, rims and nets must be well maintained at all times.5. Homeowner liable for any damage caused by the basketball goals and/or players.6. Basketball Goals must be removed from street and out of sight when not in use. If left in street,

cul-de-sac or front yard - Fees will be enforced.

The minimum construction specifications are as follows:

a. Pole must be metal, Creosoted posts are not acceptable.b. Backboards, must be commercially manufactured out of materials that will not weather, warp

or disintegrate,

c. Net must always be well maintained.

PLAYGROUND EQUIPMENT

The minimum acceptable construction standards for playground equipment are as follows:

1. Playground equipment shall be well maintained.

2. LOCATION:

a. Playground equipment shall not be located in the front yard of any lot or side yard ofany lot.

b. Any playground equipment over seven (7') feet in height shall be located no closer thansixteen (16') feet from the rear or side property lines.

3. HEIGHT:

a. The maximum allowable height for playground equipment is eleven (11') feet excludinga canopy or twelve and a half (12 14 ') feet including a canopy.

b. Standing platforms shall not exceed four (4') feet above natural ground4. Any canvas exposed to public view shall be any one of the following colors: brown, beiee.

burgundy, dark green, blue or rainbow tri-color only. No day glow or fluorescent colors areallowed.

5. Materials used must be metal, treated wood, cedar, redwood, commercially manufactured

plastic or treated wood painted to be in harmony with the existing home. Creosoted wood isnot acceptable.

6. Under no circumstances shall playground equipment be approved with elevated platforms or

other structures that may infringe upon the privacy of neighboring property owners. Thisrequirement may be temporarily waived by obtaining written permission from any affectedneighboring property owners. The committee shall make the determination of who is anaffected property owner.

7. Tree swings shall not be visible from the front or side yard8. Swing sets shall be well maintained

9. Swing sets shall not be located in the front yard or visible side yard of any lot10. The maximum allowable height for swing sets is eight feet (8')11. Frame must be metal or treated wood. Creosoted wood or untreated, unpainted wood is not

acceptable.

12. Swing sets permanently affixed to the ground must not be located in the ground utilityeasement.

13. Playground equipment that is viewed from the street is not well maintained, fee will beenforced.

14. Trampolines must be located in back yard only and must be at least five feet (5') from sideproperty line and fifteen feet (15') away from the back property line and not encroaching onany easements.

SECURITY LIGHTS

The minimum acceptable construction standards for installation of security lights are as follows:

1. Mercury vapor or Sodium vapor or metal halide liquids are not acceptable.2. The only acceptable lights are restricted to lumens & LED

3. Flood lights are acceptable up to 100 watts4. The mounting of lights on the front of house or front half of either side of house must be

approved by the Modifications Committee5. Light position should not Impair drivers vision. If repositioning is not made after request by

modification committee, a fee will be enforced until compliance is met.

HOLIDAY DECORATIONS shall be removed within 2 weeks following the holiday.

STORM DOORS

The minimum acceptable construction standards for installation of storm doors are as follows:

1. Storm doors must be clear glass only. No divided light doors.2. Trim color of storm door must match existing color of house, or bronze anodized aluminum

screen doors - full view glass/screen. No wooden screen doors.
