Retreat to your very own French cottage and relax in the garden as you take in its rural surroundings. La Croix Domjean is both the perfect holiday escape just a short journey from our doorstep here in Jersey as well as the ideal stepping stone for anyone looking to relocate further into France.

Purchased around ten years ago and meticulously renovated by a Jersey couple this French property is o ered fully furnished and ready to unlock and enjoy. Tiled fl oors fl ow through both rooms as well as the additional

WC that has been added to the property. The original wood fl ooring has been retained and restored elsewhere as well as the original handcrafted wooden staircase that leads from the dining room to the two bedrooms on the top level of the property.

Ample storgage is available in the form of built-in cupboards at the top of the stairs in the hallway that separates the two

bedrooms where the original roof beams are left exposed whilst the addition of modern insulation and drylining around them will ensure that you’re kept warm during the winter months. Rural vistas greet you from both bedroom windows facing to the front and rear of the house respectively where privacy through the period timber windows is maintained with the use of quick and easy to operate tilt and fold shutters as fi tted to all of the glazing throughout the property that require very little maintenance.

The main fl oor comprises the aforementioned kitchen, bathroom and separate WC as well as a nicely proportioned dining area and cosy living room featuring two leather sofas, a television and a wood burning fi re, all boasting a ceiling height of around 10ft.

Can you help me to work out how much I can borrow?Yes, we’ll help you work through your fi nances: your earnings, cash position, deposit amount, current liabilities (credit cards and loans) and your assets. How long does it take to get a mortgage approved? The formal approval process can be as quick as 48 hours. It all depends on the number of parties involved, like lawyers or surveyors, and the speed at which they progress. We can also o er you an “approval in principle” on line, so you can instantly see how much you can borrow and if you will be approved.

What information will I need to provide? You will need to provide information on your fi nancial position, personal identifi cation and proof of your address. Most people use their passport and a utility bill and / or bank statement, but you can use a driver’s licence.

Do you provide short-term mortgages?Yes, we provide Standard Mortgages (5 to 30 years) and Private Mortgages which are generally between 3 and 5 years and designed to serve a specifi c purpose.

What happens if I have had a mortgage refused in the past? This does not mean that you will be refused if you try again. Talk to us. If anyone can help, we can.

What happens to my mortgage if anything happens to me?Most people take out life insurance to ensure that loved ones are taken care of should something happen to you.  To fi nd out more about these products, visit our on-line Resource Centre.

BASE RATE COUNTDOWN

The latest news on Bank of England base Rate, which has now been pegged at 0.50% for the past 75 months, is that it is likely to start going up from August/September 2016. As we have seen so many times before this deadline has been pushed back time and time again, so watch this space!

FIXED RATE OR TRACKER RATE?

Fixed rates seem to have bottomed out and in fact three of the rates that we feature have increased marginally from last month. With

base rate likely to remain low for some time to come, a tracker option is starting to look more attractive for the long term.

JERSEY LENDING MARKETRegulations introduced in the UK last year continue to restrict the ability of local lenders to o er the maximum size mortgage that many borrowers, especially First Time Buyers are looking for.

Shopping around the lenders can be time consuming and depressing, especially if you have to wait up to six weeks to see an adviser and to then be told that your bank can’t help you! Fortunately no two lenders use the same lending criteria, so there are still facilities available to satisfy most borrowers’ expectations. The lending market is constantly changing, which is the reason why many people, especially First Time Buyers prefer to consult The Mortgage Shop for an honest and accurate opinion of what is available to them.

Tel: 789830www.mortgageshop.je

In times past when arranging a mortgage, funds could only be released if the borrower had su cient life cover in place to ensure the loan could be repaid upon their death, so that any surviving joint borrower or their children were not left with a debt they might not be able to repay.

Everyone is now required to take a more active role in making sure they have adequate cover in place and must fi nd and arrange the cover themselves from a qualifi ed professional.

Without doubt, one of the most contentious areas of property ownership is in relation to boundaries. The legal status of the boundaries of a property appear to take on an importance all of their own (and perhaps understandably so).

From the Jersey perspective, this may in part stem back to previous centuries when Jersey’s main source of income was agriculture and the Island was heavily planted with potatoes, tomatoes and other crops and with every spare piece of land available being utilised.

There is a saying that an Englishman’s home is his castle and, in local terms, that is an even greater truism. The boundaries of a property (be they natural or man-made) are considered by the property owners to be an integral part of their domain and are therefore protected and guarded jealously.

This position and approach has to be tempered with the fact that people have to live next door to each other and any disputes on boundaries can certainly a ect and possibly sour, beyond repair in some cases, neighbourly relationships.

That is why such importance is placed upon the legal status and integrity of property boundaries by law fi rms acting on behalf of prospective purchasers. It should be remembered that if your legal advisers are raising boundary concerns with you, it is because they simply wish to ensure that your decision to purchase a property (possibly in spite of those stated concerns) is an informed one.

It is perfectly natural for a purchaser to get caught up in the excitement of a new purchase and (at that time) to consider boundary issues as irrelevant to their enjoyment of the property. However, and in the most severe of cases, such a decision made in haste can be regretted for a much longer period.

The signifi cance of unclear boundaries and the e ect of neighbourly disputes in that regard have been recently highlighted in the widely reported judgement given by the Baili in the case of Fogarty v. St Martin’s Cottage Limited.

Any proposed purchaser should expect to be able to enjoy and occupy his property peaceably and without concern and clear and concise legal boundaries are a critical part of that process.

We are all encouraged to ‘love thy neighbour’ but the message must be to

make sure that we are doing so from the confi nes of the clear and legally established boundaries of our property!

Gaudin & Co emphasises very early on, to both vendors and purchasers how important site visits from conveyancers are and determining contentious boundaries to allow for a smooth transaction process.

We work closely with the Property Law team at Ogier, and keep in regular contact with them, because there is nothing worse than a boundary dispute being identifi ed a few days prior to a proposed court transaction.

For an informal chat on any of the above, please contact Tim Bechelet at Ogier on 01534 504060 or Bradley Vowden at Gaudin & Co on 01534 670333. Alternatively, visit us online at www.ogierproperty.com

An 87 year-old grandmother’s second appeal against plans for a development of fl ats next to her 19th century home, Seymour Cottage, was upheld by the Royal Court in May. The decision provides some helpful guidance on the application of planning policy for developers and a ected parties alike.

WORDS Greg Herold-Howes Trainee Solicitor, Viberts

Round 1

When plans were passed for a development of fl ats on the coast of Grouville Bay next to Mrs Herold’s home, she lodged an appeal against it. The fi rst appeal succeeded because the Court agreed that the Minister had failed to take into account that Seymour Cottage was a ‘potentially listed building’. Island Plan Policy HE1 o ers protection for listed buildings and their settings. The Minister argued that the policy did not apply to mere ‘potential’ listings, but the Court disagreed. This decision was key to the success of her appeal.

However, the Court also decided that, apart from the Policy HE1 failure, the original decision to grant permission was within what is known as the Minister’s ‘margin of appreciation’ as to what is reasonable. Given the complexities of the Island Plan, it is inevitable that development policies will pull in di erent directions. A proposed development might comply with some policies and yet be contrary to others. The margin of appreciation permits decision makers to look at the overall impact of a plan and, if justifi ed, to grant permission even when certain policies are not fully satisfi ed.

Round 2

So, following the fi rst appeal, the developer commissioned a report which e ectively concluded that the setting of Seymour Cottage (now a Grade 4 listed building) would not be adversely a ected by the development. Unaltered plans were submitted reliant on this new report.

However, the Historic Environment Team (HET) on behalf of the Planning Department also assessed the impact on Seymour Cottage. They concluded that the plans did not comply with Policy HE1 and would have a detrimental impact upon the setting of Seymour Cottage.  Certain steps were recommended for how to mitigate the impact, but the developer chose not to alter the plans to the extent proposed by the HET or to address similar objections fi led by members of the public. A sca old profi le was erected on site so that the Minister could visualise the impact for himself. After visiting the site he suggested minor amendments to the plans, which still did not address the concerns of the HET.

Planning permission was granted.

On appeal, Mrs Herold invited the Court to conclude that given the public opposition and the HET’s repeated concern that the development did not comply with Policy HE1, the decision to approve the development was outside the margin of appreciation a orded to the Minister.

Policy HE1 clearly states that proposals which do not ‘preserve or enhance’ the setting of a listed building ‘will not be approved’. The Court found that because the setting was not being preserved or enhanced, the development was contrary to Policy HE1. Under these circumstances, the appeal was again successful.

This case underlines the importance of presumptions within the Island Plan and specifi cally those relating to historic buildings. Approximately 4,000 buildings in Jersey are listed as having historic interest. We all know that listing creates restrictions for owners, but this case makes it clear that listing can also provide useful protections against potentially harmful changes to a building or its setting.

“Given the complexities of the Island Plan, it is inevitable that development policies will pull in di erent directions. A proposed development might comply with some policies and yet be contrary to others. The margin of appreciation permits decision makers to look at the overall impact of a plan and, if justifi ed, to grant permission even when certain policies are not fully satisfi ed.”

Rise and shine. It’s a beautiful summer’s morning and blistering heat is bursting through the windows, blinding you with light. This is your call to arms. You spring out of bed like an Indian Brave from his teepee, claim your Ray Bans from the kitchen table and slap on your UV war paint. Battle ready, you slide back the doors and triumphantly step out onto your very own private balcony.

Adding a balcony creates a new level of class and sophistication to your property, adding value when you come to sell. It means you can appreciate your surroundings with a greater perspective. It can add extra outdoor living space if your property has little or no garden at all. Building one is easier than you may think. You can buy your own balcony kit online to provide you with all of the essentials and instructions you need. South-facing is ideal, but it’s important to bear in mind is that it doesn’t cut o light to the fl oor below. Local contractors are also a great source of help when it comes to seeking advice and resources.

If you choose to build your balcony out of wood you need to think carefully about the type you use. We suggest using wood that has been pressure treated as this type can withstand the harsher weather in colder months. Be creative with your space: scatter pillows on rattan furniture, add a few fl owerpots and turn up the heat with fi re-lanterns.

You will need to seek planning permission before going ahead with your balcony. Once approved, take a look at the JeCC members list where you will fi nd trusted experts who are on hand to help you design and construct the perfect balcony to suit your home. Better hurry, it’s cocktail hour on your patio in the sky.

CALLING ALL ESTATE AGENTS

The Jersey Estate Agents’ Association is committed to raising the standards in estate agency in Jersey.  For reliable information please see our list of members on this page or visit our website at www.jeaa.co.uk The Jersey Estate Agents’ Association is committed to raising the standards in estate agency in Jersey.  For reliable information please see our list of members on this page or visit our website at www.jeaa.co.uk

Next month sees the JEAA and the National Association of Estate Agents (NAEA) join forces to host a bespoke conference to be held at The Radisson Blufor all registered estate agents and associated professionals in Jersey. Non-members welcome.

The conference will invite guest speakers to talk on a range of subjects concerning the property market here in jersey, to include talks from representatives of the NAEA, JFSC, The Mortgage Shop/Henley Financial and Ogier Property.

President, John Quemard, said: “As part of our 50th anniversary celebrations, we are delighted to co-host a local event with the NAEA. It is the fi rst time the JEAA has ever held a conference inviting all estate agents in Jersey to attend under the same roof to receive the same informative instruction and enjoy an evening of association together”.

Personal invitations are currently being sent out to all estate agents and associated professionals to attend this exciting venue which will take place at The Radisson Blu on July 16th 2015 from 4.30pm onwards.

The JEAA isworking hard with other local professionals to organise regular seminars throughout the year which are both informative and constructive for its members to keep up to date with current legislation.

As it stands, the JEAA now represent about 1/3 of the island’s estate agents with enquiries on the increase and new members signing up.

At some point, over the years, the majority of estate agents have been involved with the JEAA in one way or another.

“The JEAA is now a di erent ship and one that is focused on working more closely with all estate agents in the island.

We would very much like to reach out and re-connect with previous members and invite them to join us once again”said John Quemard.

To learn more about the conference to be held in July, or for further information on becoming a member of the JEAA, please contact John Quemard on 879879 or email [email protected].
