The purpose of this report to Planning Advisory Committee is to bring forward a change in fac;ade . The overall look of the building will remain, however, the owner is proposing to use a stucco finish with trim. The approved application identified stone on the first floor and siding on the remaining two floors . The entire building is proposed to be a stucco finish.

The residential area on King Street W features a number of different type of finishes on dwelling units- brick, siding , board on baton, log.

As the Development Permit System adopts plans with details such as elevations the change is being brought forward to Planning Advisory Committee.

Overall, staff have no objection to the amendment. The change in fac;ade materials does not change or impact the neighbourhood.

Development Permit: The Development Permit currently designates the property as Highway Commercial. The proposal is to designate it to Residential.

The application is a Class Ill permit as it is identified as a Discretionary Use.

The Committee recently recommended approval of the Official Plan Amendment to Council which was approved under By-law 2013-48 on June 18, 2013.

Parking The total number of apartment units is 23 and there is a requirement of 1.25 parking spaces per unit which is 29 parking spaces plus 2 spaces for the residential dwelling. For every 20 spaces an accessible parking space is required and 2 have been identified. The plan has identified a total of 31 spaces. All parking is within the rear yard .

The parking area along the rear of the property is 1.25m from the parking lot behind the apartment building and 1m from the parking lot behind the existing dwelling. Staff would seek a 3m buffer in these areas, however, it is noted that there will be a 1.5m solid fence all along the rear of the property, along both side yard to the existing buildings which is considered sufficient.

Entrance/Traffic One entrance is on the site which is preferable as King Street West is an Arterial Road in the Official Plan meaning it is intended to handle large volumes of traffic to provincial roads.

The traffic study identified that the conversion of the motel to the residential unit will be an increase in traffic at this location during peak hours.

It was noted that the site entrance was being relocated , however, the site plan submitted does not reflect a change.

Garbage Enclosure The area of the garbage enclosure is to be constructed of block with wood doors.

Landscape All non-building and non-parking areas have been identified to be landscaped with grass. Five trees are being placed along King Street East and four in the rear yard . Additional shrubbery will be located at the entrance door.

Staff would recommend that given that the applicant shows a walkway from the west side of the property to the roadway that the applicant place a sidewalk from this point to connect to the existing .

Design Criteria Section 4.5 of the Lowertown-Mixed Use speaks to buildings being located on the side and attention to fagade details. In these circumstances the building is existing with portions being removed. For this portion of the Development Permit, the applicant should provide a palette and elevation plan of the building with landscape details.

No objection The new electrical service will come from the North side of King Street. This will require either an overhead primary crossing to a pole in front of the 665 King Street property or having the Developer of the property install an underground duct bank from their service location to a pole on the north side of King Street. This underground option will require the developer to cut the road to install the necessary electrical plant. The Developer has placed their driveway where an existing stub pole and anchor exists. The removal , or relocation , of this stub pole and anchor would be quite a challenge and could have considerable negative impact on the property at 15 Garfield. As such, I would encourage the Developer to reconfigure their entranceway so that the pole and anchor can remain in their present location.

Overall, staff have no objection to the applications before the committee. The application demonstrates that they have taken into consider all parking requirements, landscaping, setbacks and the site will be redeveloped into rental units which is good for the Town.

The applicant is seeking a minor variance from the Sign Bylaw 2005-41. Section 3.10 permits an applicant to file for a minor variance should they wish to deviate from the bylaw.

Overview: Section 6.1 of the Sign Bylaw limits the number of signs that one is permitted to have on a property. Businesses are permitted to have one fascia sign per business plus one of the following:

i) Wall sign, ii) Canopy sign, iii) Soffit sign, iv) Window sign, v) Reversed graphics sign, or vi) A projecting sign

Section 6.1 d) i) also indicates the following:

i) One (1) additional ground sign may be erected for a lot having a street frontage greater than 125 m.

ii) Where a lot abuts two or more streets an additional sign may be erected on the second street frontage provided that said street has a minimum frontage of 15.0 m.

For the purposes of this application, a sign is the identification of the business or business name. The Thousand Islands Boat Museum are permitted three signs; one fascia, one as per i) - vi) and one addition sign due to the street frontage.

The Museum is proposing to have two projecting signs on the smaller building (red and green), a hanging sign in the court yard area of the blue building and one wall sign on the cream building.

It is noted that the Town has three signs being installed at the Heritage Village that identify the Heritage Village- 125 Water Street. This was ordered at the end of 2013 to identify individual businesses at the time but was not erected due to the change to the Museum. These signs will be installed at the T-section of Water/Main Street, Water/Market Street and on the docks. They are as follows:

Staff have no objection to the individual signs being located on the building at 125 Water Street. The Arthur Childs Museum has an individual sign on its' building and staff would agree that the museum is comprised of more than one building and a campus style.

The materials being used are wood which is in keeping with the provisions of the Sign Bylaw for the Heritage Village.

Two members of the public were in attendance. Applicants are seeking approval to create a right-of-way in favour of adjacent property owners.

Application is for a parcel of land within the Residential designation of the Official Plan and Residential and Estate Residential in the Development Permit Bylaw.

The application is concurrently with an application to the County of Leeds and Grenville has the proposed right-of-way also crosses into the geographical area of the Township of Leeds and a Thousand Islands.

There is an existing right-of-way in Favour of three property owners; Lyttle, Cowan and Jackson. The proposed right-of-way is intended to be for the same owners. The intent is to eventually abandon the existing right-of-way upon all approvals being in place.

Correspondence was received from the Leeds Grenville District Health Unit with regards to undertaking a maintenance inspection of existing sewage systems on the site.

Conditions of Severance: New reference plan describing right-of-way New deeds to reflect right-of-way in favour of adjacent property owners; Lyttle, Jackson and Cown. Leeds Grenville District Health Unit be contacted for a maintenance inspection Balance of outstanding taxes, shall be paid to the Town of Gananoque All costs related to fulfilling the conditions are born by the applicant.

Applicants are proposing to sever a parcel of land which is currently being used as a driveway to an adjacent property owner. The adjacent property owner is Randy and Dale Neal.

The retained lands are commercial (known as Neal's Garage) and the conveyed lands will be merged to residential use. The conveyance of lands to the adjacent residence increases the lot frontage of said lot bringing it into compliance.

Two structures on the property will require either a Class I application or relocation of structures to comply with the bylaw. The proposed lot line is between the two structures reducing the side yard setback from accessory structures to 0.3 I m and 0.36m

Staff contacted the Ministry of Environment with regards to the lands being conveyed from commercial to residential which is a more sensitive use. MOE has requested a condition be included to consult with their office.
