Property Description: The subject property is a 3,412± sq. ft. parcel that is improved with a single-family home and a 430± sq. ft. marine improvement that includes decking extending along the water frontage line, a Captain’s Walk and a boat slip. The property is located in The Waterfront at Cape Harbour Subdivision,

which was developed as a part of a Planned Development Project (PDP) that was approved by Ordinance 89-06. The property has frontage and driveway access from Shell Cove Drive (private street) and has 52.5 ft. of water frontage along a waterway in the Cape Harbour Marina area. While this waterway has varying widths, the width of the waterbody measured from the applicant’s waterfrontage line to the opposite shore is approximately 260 ft. The immediate surrounding area primarily consists of undeveloped lots and a single-family home to the east of the subject property. South of the subject property is a parcel developed with a parking lot. North of the subject property and waterway, properties with single-family homes and a large tract developed with a parking lot is present. Project Description:

The applicant is requesting a 10 ft. deviation from LUDR, Section 3.16.2 that limits the projection of marine improvements to 25% of the width of a waterway, with a maximum projection of 30 ft., in order to allow a marine improvement with a projection of 40 ft. into the waterbody. The applicant proposes to install two (2) mooring pilings and an additional 40 sq. ft. of decking that will extend northward from the existing marine improvement. The proposed marine improvement once completed will extend 40 ft. from the outer edge of the seawall. Analysis:

The Planning Division has reviewed this application based on LUDR, Section 3.16.9.B.2, Marine Improvements, and offers the following analysis for consideration: LUDR, Section 3.16.9 allows for deviations for marine improvements based upon the following: “That the deviation will not be contrary to the public interest and will be in harmony with the general

intent and purpose of this section and where conditions exist that are not the result of the applicant and which are such that a literal enforcement of the regulations involved would result in unnecessary or

undue hardship.”

The intent of the regulation that restricts the projection of marine improvements is to ensure that safe navigability is maintained throughout the waterways of Cape Coral. The majority of waterbodies with in the City are less than 100 ft. wide, therefore, maintaining an appropriate distance between marine improvements located on opposite sides of these waterbodies is a priority for boater safety. The waterway along the subject property is approximately 260 ft. wide, which is substantially wider than most waterbodies. The requested deviation will allow the applicant to moor a boat that is 41 ft. in length. Since the existing marine improvement is oriented perpendicular to the shore, and the applicant’s property has only 52.5 ft. of waterfrontage, reorienting the marine improvement to run parallel with the shoreline is probably not feasible. Planning staff also notes that while subject property is located in close proximity to the Cape Harbour Marina there is ample width in the waterway to accommodate the proposed marine improvement. Furthermore, the proposed marine improvement will not likely impair navigability or

views along the waterway. Planning staff has also taken into consideration that the marine improvement will be well within the maximum square footage allowed for a dock. Therefore, Planning staff finds that the deviation would not be contrary to the public interest and would be in harmony with the intent of the ordinance.

Recommendation:

Planning staff finds that the proposed marine improvement will not negatively impact the navigability of the waterway, will not be an endangerment to existing marine structures, and that the deviation request is consistent with the general intent of the LUDRs and the public interest. Consequently, the Planning Division recommends approval of the requested deviation with the following condition:

1) The proposed marine improvement shall be consistent with the site plan identified as Sketch F, dated September 3, 2015, prepared by Honc Docks & Lifts, and that appears as Exhibit “A” to this report.

DEVIATION (MARINE IMPROVEMENT) – APPLICATION

CRITERIA APPLICABLE TO DEVIATIONS Cape Coral Land Use & Development Regulations Section 3.16

A. Any person aggrieved by the effect of this section shall have the right to request a deviation from the provisions

of this section.

B. Deviations from the provisions of this section may be approved by the Board of Zoning Adjustment and Appeals provided that the deviation will not be contrary to the public interest and will be in harmony with the general intent and purpose of this section and where conditions exist that are not the result of the applicant and which are such that a literal enforcement of the regulations involved would result in unnecessary or undue hardship. In determining whether a particular deviation request should be approved, factors the Board of Zoning Adjustment and Appeals shall consider include, but are not limited to, the following: the effect the proposed deviation would have on the navigability of the waterway involved; the design, size, and proposed location of the marine improvement for which deviation is sought; the effect, if any, that the proposed deviation would have on any extant marine improvements in the subject waterway. Subject to these standards and criteria, the Board of Zoning Adjustment and Appeals shall approve only the minimum deviation from the provisions of this section necessary to avoid the unnecessary or undue hardship required herein. C. Any person aggrieved by the decision of the Board of Zoning Adjustment and Appeals or the Director of the Department of Community Development or the Director's designee concerning the interpretation and application of this section with respect to a waterfront parcel located on a lake or basin or concerning a requested deviation from the provisions of this section may appeal such decision to the City Council provided that a written notice of appeal is filed within 30 days after the date of the action appealed from. The notice of appeal shall be considered filed when it is received by the Department of Community Development.
