Right-of-Way (ROW) Access: The subject property has frontage and ROW access along SW 53rd Terrace. Background: The subject property has an area of approximately 10,060 ft2 and is located along SW 53rd Terrace in southwestern Cape Coral. The site accommodates a single-family home that has a living area of 2,197 ft2. The property is located in Block 4538, where a majority of parcels are built-out with single-family homes. The property abuts the Britannia Lake to the south; overall the property has approximately 110 feet of water frontage. Britannia Lake has approximately 850 feet of width at the subject property’s waterfrontage, which permits the property owner to extend marine improvements thirty (30) feet into the lake. Just west of the subject property, near the center of the Britannia Lake complex which is shaped like a four-leaf clover, Britannia Lake narrows to approximately 190 feet of width. The subject property current has two finger docks which encompass a boat lift, and another dock area with a sun shelter. Based on aerial data from the City’s GIS, all properties south of SW 53rd Terrace (12 in all) supports a water dependent structure. It should be noted that no deviations for an extension of beyond the 30 feet permitted have been sought by any property owner within 500 ft. of the subject property. Applicable Regulations: LDR, Section 3.16.2.B.2 states, “Except as provided below, no part of any marine improvement, including but not limited to docks, mooring posts, boat lifts, lift structures, and/or walkways shall project into a waterway to a point more than 25% of the calculated waterway width or 30 feet, whichever is less, as measured from the water frontage line.
a. Marine improvements located within the Caloosahatchee River shall be subject to the projection requirements of state and federal regulations.

b. A marine improvement may project farther into a canal than would be otherwise
allowed by this subsection, if the marine improvement is projecting from an outside corner parcel that projects into two canals at the intersection, excluding a "T" intersection, of two canals. Such farther projection, however, may only occur in the area that results from the following calculation: Each of the two waterfrontage lines of the property shall be extended from the point immediately preceding where it begins to curve to meet the other waterfrontage line or from where it angles to meet the other waterfrontage line, whichever is applicable, to a point 25% of the calculated canal width or 30 feet, whichever is less. Then, in each intersecting canal, a line shall be drawn that is parallel to the extension of each of the waterfrontage lines and that runs through a point that is located at 25% of the calculated waterway width or 30 feet from the waterfrontage line, whichever is less. A marine improvement, including but not limited to docks, mooring posts, boat lifts, lift structures, and/or walkways may project up to 30 feet from the waterfrontage line within the area formed by the intersection of the aforesaid four lines, even if such distance is farther than would be otherwise allowed by this subsection.
c. In the event a significant portion of a waterway is not developable on one side due to ecological, or other constraints, a marine improvement located on the opposite side of the undevelopable portion shall be permitted to project into the waterway up to 50% of the calculated waterway width or 30 feet, whichever is less, as measured from the waterfrontage line.”
The subject property does not meet any of the three exceptions, and as such, may only extend marine improvements 30 feet into the adjacent water body. LDR, Section 3.16.9.C.2 states, “All other deviations from the provisions of this section may be approved by the Board of Zoning Adjustment and Appeals provided that the deviation will not be contrary to the public interest and will be in harmony with the general intent and purpose of this section and where conditions exist that are not the result of the applicant and which are such that a literal enforcement of the regulations involved would result in unnecessary or undue hardship. In determining whether a particular deviation request should be approved, factors the Board of Zoning Adjustment and Appeals shall consider include, but are not limited to, the following: the effect the proposed deviation would have on the navigability of the waterway involved; the design, size, and proposed location of the marine improvement for which deviation is sought; the effect, if any, that the proposed deviation would have on any extant marine improvements in the subject waterway. Subject to these standards and criteria, the Board of Zoning Adjustment and Appeals shall approve only the minimum deviation from the provisions of this section necessary to avoid the unnecessary or undue hardship required herein.”

Analysis: The Planning Division has reviewed this application based on LDR, Section 3.16 which provides guidance in evaluating deviation requests associated with marine improvements. LDR, Section 3.16.9.C.2 states that “a deviation … may be approved by the Board of Zoning Adjustment and Appeals provided that such deviation will not be contrary to the public interest and will be in harmony with the general intent and purpose of this section and where conditions exist that are not the result of the applicant and which are such that a literal enforcement of the regulations involved would result in unnecessary or undue hardship.” This section further states that the Board shall consider factors such as the effect the deviation would have on the navigability of the waterway; the design, size, and proposed location of the marine improvement; and the effect that the proposed deviation would have on any extant marine improvements in the subject waterway. According to the letter of intent, the deviation for the extension of the marine improvement is sought to expand a finger dock 7 feet further into the adjacent water body. No hardship has been identified by the applicant as to why this projection of 7 feet would be necessary for the continued enjoyment or utilization of the subject property. As mentioned above, many nearby residential properties appear to have water-dependent structures. However, no nearby residential property has requested an extension into Britannia Lake beyond the permitted 30 feet. The applicant’s request might interfere with the navigability of the waterway, as the proposed extension of the dock occurs just east of the lake’s narrowest point. The design, size, and proposed location of the marine improvement might interfere in any views down the lake basin. The deviation request to extend beyond 30 feet is the first of its type in this area, and therefore would disrupt the harmony of neighboring existing water-dependent structures which are consistent with the requirements in Section 3.16.2.B.2. No hardship exists currently as the applicant enjoys full usage of their property without the projection; furthermore, no hardship would be placed upon the applicant should this be denied. Recommendation: Based on the above analysis, the information provided in the application, and the physical conditions of the property, Planning Staff finds that the requested deviations pursuant to a projection of 37 feet into the waterway would be contrary to the public interest and will not be in harmony with the general intent and purpose of Section 3.16. Consequently, the Planning Division recommends denial of the requested deviation.

We are requesting a deviation to extend the existing finger docks, at 520 SW 53rd Terrace, 7'
further out into Britannia Lake. The existing finger docks are 30' from the seawall and meet the
guidelines of 3.16 ofthe land use regulations. The 7' extension will accommodate the longer
boat that will be delivered in October of this year. By granting this request, the existing utilities
(water and electric) can be utilized. This 7' extension requested will not impede boat
navigation. We have calculated there is 80' from the requested 7' extension to the ingress and
egress portion of the lake.
