Executive Summary Advantage Land, LLC has requested approval of the final plat of Terneus Estates First Addition. The subject site is located within the 3500 block of North Harmony Townhall Road east of Sheiffer Park (see Attachments, page 1). This addition would create 17 single-family residential lots from approximately 6.5 acres of land. The subject property is primarily undeveloped and in agricultural use. On December 16, 2019, the Plan Commission reviewed and conditionally approved the preliminary plat of Terneus Estates. The final platting of the subdivision has occurred in two phases, with this final plat of Terneus Estates First Addition representing the second phase (see Attachments, page 2). Subject to the conditions listed below, the final plat complies with the conditions of preliminary plat approval. City Recommendation The City recommends approval of File Resolution No. 2021-1937 to approve the final plat of Terneus Estates First Addition, subject to the following: 1. The final plat is subject to the payment of monies in-lieu-of parkland dedication totaling $3,946.25. 2. The final plat of Terneus Estates First Addition is subject to payment of special assessments and/or installation of streetlights, storm sewer, and sidewalk improvements according to the terms of a memorandum of understanding (MOU) executed between the City and the developer. The MOU is subject to and conditioned upon separate action and approval by the City Council.

Suggested Motion I move to adopt File Resolution No. 2021-1937 approving the final plat of Terneus Estates First Addition, subject to the conditions noted in the City Recommendation section of the Planning Division memorandum dated November 8, 2021. Background Advantage Land LLC has requested approval of the final plat of Terneus Estates First Addition to create 17 single-family residential lots. The subject site is located within the 3500 block of North Harmony Townhall Road east of Sheiffer Park. The subject property is primarily undeveloped and in agricultural use. On December 16, 2019, the Plan Commission reviewed and conditionally approved the preliminary plat of Terneus Estates. The final platting of the subdivision has occurred in two phases, with this final plat of Terneus Estates First Addition representing the second phase. Options

• Adopt File Resolution No. 2021-1937 approving the final plat of Terneus Estates First Addition.

• Do not adopt File Resolution No. 2021-1937, thereby rejecting the final plat of Terneus Estates First Addition. Any motion to deny must substantiate the Council’s reasons for rejection of the final plat.

Analysis A. The final plat proposes to establish the second phase of residential development for the

Terneus Estates subdivision. The plat is situated between the Rotamer Ridge Estates and Emerald Estates subdivisions to the north and south, respectively. The platted area is zoned R1, Single-Family and Two-Family Residence District. The final plat complies with the subdivision and zoning ordinance requirements.

B. The land use designation provided by the City of Janesville Comprehensive Plan for this

area is Planned Neighborhood. Single-family residential development is intended to be the predominant land use within this future land use category. Thus, the development proposed by the plat is consistent with the Comprehensive Plan.

C. The plat would extend Scottys Drive and McCann Drive, which will continue to utilize 60-

and 70-foot-wide right-of-way widths, respectively. Consistent with past practice with 60-foot street sections, parking will be restricted along one side of the street. In this case, on-street parking is restricted along the north side of Scottys Drive. Right-of-way will be dedicated along the west side of North Harmony Townhall Road. Due to the steep topography in the area, this dedication transitions from 50 to 70 feet which is necessary for the installation of public infrastructure. A note has also been included indicating that no direct access is permitted to North Harmony Townhall Road.

D. Lot 37 is located along the northern boundary of the platted area. The adjoining property

to the north is outside City limits and owned by another party. The McCann Drive roadway will be extended to the northern boundary of the platted area. Sufficient distance must be maintained between the driveway on Lot 37 and the edge of the roadway pavement. This is necessary to facilitate public service vehicle maneuverability and provide sufficient space for backing vehicles to exit the driveway without driving off the edge of the McCann Drive pavement. A note has been added to the final plat reflecting that no driveway access will be permitted within the northerly 30 feet of Lot 37.

E. Utility easements have been added to the final plat as requested by the Engineering

Division and utility companies serving the platted area. The platted area will be served by municipal water supply mains and gravity-flow sanitary sewer extended from the Scottys Drive and McCann Drive right-of-ways. Stormwater drainage originating within the platted area will be conveyed via storm sewer to existing regional stormwater management facilities in the surrounding area. The Engineering Division has approved the master grading and drainage plan for this second phase of development.

F. The subdivision ordinance requires that five percent of the total land area within each

subdivision plat be dedicated to the City for public parkland and open space if those areas are specifically delineated on established City plans. In instances where land dedication is not recommended, payment of monies in-lieu-of parkland dedication shall be required. As identified in conjunction with the review of both the preliminary plat and first phase of final platting, the final plat of Terneus Estates First Addition is subject to payment of $3,946.25 in-lieu-of parkland dedication. Along with the 0.75-acre parcel previously dedicated as public parkland by the developer with the first-phase final subdivision plat, this payment will fully satisfy the parkland dedication requirement for both phases of the Terneus Estates subdivision.

G. The plat will be subject to special assessments and/or installation requirements for street

lighting, sidewalks, and storm sewer improvements. Details regarding payment of land division assessments and the construction of public improvements will be defined pursuant to the terms of an MOU executed between the City and the developer. The MOU is subject to and conditioned upon separate action and approval by the City Council.

H. Consistent with the City sidewalk ordinance and policy, sidewalk is planned along both

sides of the public streets within and adjoining the platted area. Sidewalk on each residential lot must be installed at the property owner’s expense and prior to occupancy of each respective residence. A note reflecting these requirements related to sidewalks has been added to the final plat.

I. At its meeting of October 18, 2021, the Plan Commission voted unanimously by consent to approve the final plat, subject to the conditions noted in this memorandum.

Conclusions Approval of this request would facilitate the creation of 17 single-family residential lots within the Terneus Estates subdivision. Restated City Recommendation The City recommends approval of File Resolution No. 2021-1937 to approve the final plat of Terneus Estates First Addition, subject to the following:

1. The final plat is subject to the payment of monies in-lieu-of parkland dedication totaling $3,946.25.

2. The final plat of Terneus Estates First Addition is subject to payment of special

assessments and/or installation of streetlights, storm sewer, and sidewalk improvements according to the terms of a memorandum of understanding (MOU) executed between

the City and the developer. The MOU is subject to and conditioned upon separate action and approval by the City Council.

A resolution approving the final plat of Terneus Estates First Addition. WHEREAS, a plat of "Terneus Estates First Addition", a subdivision lying in the SE.1/4 of the NE.1/4 of Section 16, T.3N., R.13E. of the 4th P.M., City of Janesville, Rock County, Wisconsin was duly approved by the City Plan Commission on the 18th day of October 2021, and is incorporated herein by reference; and WHEREBY, this certain tract of land is platted into blocks, lots, outlots and streets. NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL of the City of Janesville, Rock County, Wisconsin, that said plat of “Terneus Estates First Addition” be and is hereby accepted and approved for the purposes thereon shown.
