1. Executive Summary

1.1. In terms of highways and transportation the main comments are as follows:

The existing access arrangement is considered to be of sufficient design as to accommodate the change in use.

The increase in vehicle movements attributable to the new use is unlikely to present an adverse impact on the local highway.

The accident records for the area indicates that the vehicular traffic associated with the proposed use is unlikely to have an adverse effect on highways safety.

The site is accessible by alternative modes of travel, other than the car, such as walking, cycling and public transport.

2. Introduction

The Brief

2.1. Waterman Energy, Environment & Design Limited (Waterman) was commissioned by Mr Robin Bristow (the Client) to prepare a Transport Assessment Report to inform the appeal made underground A of planning enforcement appeal APP/G1440/C/11/2166897.

2.2. The appeal is against the Enforcement Notice (EN) issued by East Sussex County Council on 10 November 2011. A copy of the EN is included in Appendix 1 of the appeal documentation.

2.3. This report was prepared in accordance with a scope of works agreed between Waterman and the client.

Limitations

2.4. Waterman has endeavoured to assess all information provided to them during this work, but makes no guarantees or warranties as to the accuracy or completeness of this information.

2.5. The scope of this work does not include an assessment for the presence of asbestos containing materials within or below buildings or in the ground at the site. Should there be a requirement under Regulation 4 of the Control of Asbestos Regulations 2006 for any part of the site to be deemed ‘non-domestic premises’ (including, inter alia, outbuildings, external pipe work, under-floor service ducts, bridges, fixed and mobile plant), the duty holder(s) should prepare an asbestos risk management plan and this may require technical survey works as described in the relevant HSE Guidance Note MDHS 100.

2.6. The conclusions resulting from this study are not necessarily indicative of future conditions or operating practices at or adjacent to the site.

2.7. Waterman Boreham Limited has been instructed by Mr Colin Charles Bristow to provide Highways and Transportation advice in support of the proposals to provide a change in land use for the importation, deposit, storage and processing of construction and demolition waste (including but not limited to concrete, rubble, soils, sub-soils, metal and plastics).

2.8. The existing lawful use of the land is as a general wood yard for the manufacture of fencing products, storage of timber, hard-core and tool store.

2.9. The report concludes that the proposals are unlikely to present an adverse impact in terms of highways safety or traffic capacity.

3. Existing Situation

3.1. The description of the site appertains to the Transport Statement, a more detailed description is provided in the Appeal Documentation.

3.2. The site is broadly square in shape, being approximately 70 m long (north to south) and 75 m wide (east to west), amounting to approximately 0.6 hectares.

3.3. The site is situated on land at Hole Farm with the access onto Westfield Lane as a simple priority junction layout.

3.4. Westfield Lane is subject to the National Speed Limit immediately north of the site access and 40mph to the south. It is considered that due to the almost ninety degree bend approximately 70m south of the access it is likely traffic speeds are in the order of around 30mph adjacent the site access as vehicles would tend to be slowing on entry to the bend and accelerating from a lower speed exiting the bend.

3.5. The existing visibility splays at the access are 4.5m x 215m to the north and 4.5m x 80m to the bend in the road south, therefore this accords with the desirable stopping site distances as specified in the DMRB (Design Manual for Roads and Bridges), although vehicles travelling northbound exiting the bend would be travelling at lower speeds, possibly at 30mph. A drawing showing the existing visibility splays is provided at Appendix A of this report.

3.6. Westfield Lane, which forms part of the A28, has a footway on the eastern side of the carriageway adjacent to the site which continues southwest to the A21.

3.7. The A28 joins the A21 approximately 1.2km southwest of the site. To the northeast the A28 continues through rural areas including villages such as Broad Oak and Horns Cross. A site location plan has been included at Appendix A of the Appeal Documentation.

Buses

3.8. The nearest bus stops in relation to the site are situated adjacent to Baldslow Down on Westfield Lane. These bus stops are a walking distance of approximately 700m from the site.

3.9. A summary of the bus routes is provided below.

3.10. Details of the bus routes and timetables are provided at Appendix B.

Accident Data

3.11. Traffic accident data has been obtained for the highway adjacent to the site (200m either side of the existing Hole Farm access on Westfield Lane) for a period covering the last 5 years.

3.12. The data records a total of 7 accidents during the period which were categorised as 1 fatal, 1 serious and 5 slight.

3.13. The fatal accident involved a car driver colliding with riderless horses on the carriageway during a late evening when it would have been dark.

3.14. The serious accident involved a car driver falling to negotiate the sharp bend heading southbound. The driver was suspected of driving too fast and under the influence of alcohol.

3.15. The 5 slight accidents all involved vehicles failing to negotiate the sharp left hand bend (travelling northwards). 2 accidents involved motorcycles and 3 involved cars.

3.16. Most of the accidents (5) occurred during the late evening i.e. after 20:30 hrs which is outside of the normal working day.

3.17. It is evident from the accident records that drivers/riders have difficulty in negotiating the sharp bend. However, given the central solid white road markings indicating mandatory ‘no overtaking’

and the ‘sharp deviation of route’ signs, already in place, it is considered that the reason for the

accidents is attributed to inappropriate speed and/or poor driving rather than deficiencies in highway layout.

3.18. It should be noted that no accidents involved HGVs or any vehicle turning movements associated with the existing access of Hole Farm were recorded.

3.19. Details of the accident data is provided at Appendix C of this report.

Permitted Use

3.20. The permitted site use has no restriction in terms of operational hours and can operate any day of the week (including bank holidays) between dusk and dawn.

3.21. It is estimated the use attributed to that permitted under the Established Use Certificate site generates in the order of 20 two-way vehicle movements per day (10 arrivals and 10 departures)

4. Transport Policy

4.1. In the context of Transportation, and when considering new development, it is appropriate to assess the development in relation to the relevant policy guidance.

PPG13 Transport

4.2. PPG13 (Updated 2011) indicates that by shaping the pattern of development and influencing the location of land uses, good planning can help to reduce the need to travel and reduce the length of journeys.

4.3. The three main objectives of the guidance are:

To promote more sustainable transport choices;

Promote accessibility to jobs, shopping, leisure facilities and services by public transport, walking and cycling; and

Reduce the need to travel, especially by car.

4.4. PPG13 does recognise (at paragraph 5) that the car will continue to have an important part to play. However, the guidance seeks to ensure that new development is well located and offers a realistic choice of access by public transport, walking and cycling.

Rother District Council Local Plan Adopted 2006 – 2011

4.5. The policies of the Local Plan have been 'saved' and they remain part of the Development Plan. In terms of context and vision the Local Plan’s vision statement is

“To provide a high quality of life based on vibrant and inclusive communities, access to a wide

range of jobs and respect for the built and natural environment.”

4.6. The aims of the Local Plan are

Aim 1 To ensure that the environment is conserved and enhanced and that new development

contributes to local character, cultural identity and amenities

Aim 2 To ensure that there is adequate infrastructure and services to support thriving

communities and facilitate new development

Aim 3 To meet housing needs in the most sustainable manner, with particular regard to

affordability and quality of housing

Aim 4 To secure a more prosperous and diverse economy

Aim 5 To promote a safe, efficient and sustainable transport system

5. Proposed Development

5.1. Proposals may be assessed as a change in land use to include for the importation, deposit, storage and processing of construction and demolition waste (including but not limited to concrete, rubble, soils, sub-soils, metal and plastics). Access arrangements are to remain as the existing.

5.2. An on-site vehicle wheel washing facility will be provided and a sweeping regime (either manual or mechanical) will be instituted to ensure mud and debris are not deposited on the public highway.

Proposed Traffic Generation

5.3. It is likely that the site will process a total of 10,000 tonnes of construction and demolition waste per annum. This is likely to generate an average of 20 vehicle movements a day (10 in and 10 out) including 8 wheel tipper, 6 wheel tipper and light goods vans (such as transit tippers). These movements will occur in addition to the use permitted under the Existing Use Certificate.

5.4. In addition to the above trips the existing wood yard generates in the order of 10 in and 10 out trips per day.

5.5. As a worst case it may be assumed there are a total of 2 staff on site who journey to work by car i.e. 4 two-way trips per day. This would lead to a total traffic generation of 44 two way vehicle trips per day for the site as a whole. In fact the circumstances are that Mr Bristow works at the site with his son. Since both live at Hole Farm, neither uses the Public Highway to access the appeal site. Nevertheless as a worst case, for the purposes of demonstration, it will be assumed access is taken using the Public Highway.

5.6. The proposed 44 two-way trips, over a 10 hour day, would present a total of 4 two-way trips per hour.

5.7. Due to the low hourly trip generation of the site the scheme is unlikely to present an adverse effect in terms of highways safety and traffic capacity.

6. Conclusions

6.1. The proposals have been assessed as a change in land use to include for the importation, deposit, storage and processing of construction and demolition waste as detailed.

6.2. The site has connections to public transport and the wider highway network.

6.3. It has been demonstrated that the proposed use is likely to generate very low traffic movements, in the order of 4 two-way movements an hour. The increase in vehicle movements attributable to the new use is unlikely to present an adverse impact on the local highway.

6.4. The accident data reveals that the proposals are unlikely to present an adverse impact on the local highway.

6.5. In terms of highways and transportation it is considered the scheme does not conflict with policies or plans for the area.
