    The Isle of Wight Council hereby give notice of the decision made on 21/07/2015 for planningpermission for the development described above and in accordance with the application, plans andany other associated information submitted.

    Conditions

    1 The mobile home hereby permitted shall be removed and the land restored to its formercondition within three years of the date of this decision in accordance with a scheme ofwork submitted to and approved in writing by the Local Planning Authority or within twomonths of Mr and Mrs Payne ceasing to occupy the mobile home, whichever is the sooner.

    Reason: The mobile home is not a structure considered suitable for permanent retention,to allow the Local Planning Authority to assess the functional need for a full time workerbased on future financial information and to comply with the advice contained within theNPPF and policies SP1 (Spatial Strategy), DM2 (Design Quality for New Development) andDM12 (Landscape, Seascape, Biodiversity and Geodiversity) of the Island Plan CoreStrategy.

    2 The development hereby permitted shall be carried out in complete accordance with thedetails shown on the submitted plans, numbered below, except where varied by any otherconditions of this permission.

    Reason: For the avoidance of doubt and to ensure the satisfactory implementation of thedevelopment in accordance with the aims of policy DM2 Design Quality for NewDevelopment of the Island Plan Core Strategy.

  • 3 The use of the mobile home hereby permitted and shown in the approximate position ondrawing number KC. 164/8 and the residential curtilage agreed in accordance withcondition 5 shall be limited to Mr and Mrs N. Payne and any dependents only. When Mr andMrs Payne cease to occupy the premises as a residence the mobile home shall bepermanently removed from the site and the agreed curtilage shall be returned to its formeruse.

    Reason: The site is located in an area where new dwellings are not normally permittedexcept where there is an overriding need in the interests of agriculture, forestry or otherrural businesses, because the application has been assessed on the basis of the uniquebusiness circumstances of the applicants business and to comply with the advicecontained within the NPPF and the requirements of policy SP1 (Spatial Strategy) of theIsland Plan Core Strategy.

    4 Within two months of the date of this decision, details of a landscaping scheme for thenorth and north eastern boundaries of the site shall be submitted to and agreed in writing bythe Local Planning Authority. The details shall include, a planting plan, schedules of plantsnoting species, plant sizes and proposed numbers/ densities together with an associatedmaintenance schedule for a minimum period of 5 years. The approved details shall becarried out in accordance with the agreed schemes within six months of the date of writtenconfirmation from the Local Planning Authority and shall be retained thereafter.

    Reason: To ensure a suitable level of screening is retained at the site, to protect andmaintain the rural character and appearance of the area and to comply with therequirements of policies DM2 (Design Quality for New Development) and DM12(Landscape, Seascape, Biodiversity and Geodiversity) of the Island Plan Core Strategy.

    5 Within two months of the date of this decision, details of the extent of residential curtilage tobe used in connection with the temporary residential use hereby approved shall besubmitted to and agreed in writing by the Local Planning Authority. Development shall becarried out in accordance with the agreed details and the use of the land as residentialcurtilage shall cease within three years of the date of this decision or two months of Mr andMrs Payne ceasing to occupy the mobile home, whichever is the sooner.

    Reason: To protect and maintain the rural character and appearance of the area and tocomply with the requirements of policies DM2 (Design Quality for New Development) andDM12 (Landscape, Seascape, Biodiversity and Geodiversity) of the Island Plan CoreStrategy.

    7 Notwithstanding the provisions of the Town and Country Planning (General PermittedDevelopment) Order 1995 (or any Order revoking and re-enacting that Order with or withoutmodification), no development within Classes A to E of Part 1 and Class A of Part 2 ofSchedule 2 to that Order shall be carried out.

    Reason: To protect the undeveloped character of the area and to comply with policies DM2(Design Quality for New Development), DM11 (Historic and Built Environment) and DM12(Landscape, Seascape, Biodiversity and Geodiversity) of the Island Plan Core Strategy.

    Statement of Proactive Working

    In accordance with paragraphs 186 and 187 of the NPPF, the Isle of Wight Council takes a positiveapproach to development proposals focused on solutions to secure sustainable developments thatimprove the economic, social and environmental conditions of the area in the following way:

    The IWC offers a pre-application advice service Updates applicants/agents of any issues that may arise in the processing of their application

    and suggest solutions where possible

    In this instance the applicant was asked to supply additional information relating to business accountsand the numbers of livestock owned by the business. The information was provided as requested andas a result, the Council held sufficient information to allow the application to be determined.

    Attention is drawn to the attached notes

    (a) This notice only relates to the decision of the Council under the Town & CountryPlanning Acts and does not relate to any application which may be required underthe Building Regulations or any other Act, Regulation, Byelaw or Order.

    (b) Attention is drawn to the provisions of Section 32 of the Isle of Wight Act 1980 whichrequires adequate provision for access for the fire brigade to premises which are thesubject of this approval and to adjoining property.

    (c) You are hereby advised of the need to make an application to Island Roads, St ChristopherHouse, 42 Daish Way, Newport, Isle of Wight, PO30 5XJ, on (01983) 828500 beforemaking any excavation in the footway or verge, in connection with any planning approval.

    (d) You are hereby advised of the need to make a formal application to Island Roads, StChristopher House, 42 Daish Way, Newport, Isle of Wight, PO30 5XJ, in accordance withthe Town Improvement Clause Act 1987 Sections 64 & 65 and the Public Health Act 1925Section 17 before addressing and erecting a property name / number or street name inconnection with any planning approval.

    (e) Please note that the development hereby permitted must be carried out strictly inaccordance with the plans attached, and any variation from the approved plans must beagreed with Local Planning Authority before the works are undertaken.
